1968-03-20 SPMA Special Meeting of the Town Board of the Town of Wappinger was held Wednesday, March 20, 1968. Supervisor Diehl called the meeting to order at 8:16 P.M. Present: Supervisor Louis D. Diehl Councilman Louis Clausen Councilman G.Donald Finnan Councilman Leonce Heady Councilman James Mills, Jr. Town Clerk Elaine H. Snowden Others Present: Rudolph E. Lapar, Engineer to the Town Allan E. Rappleyea, Attorney to the Town Mr. Lapar presented to the Board a map, plan and report on the formation of a Town Garbage and Refuse Disposal District. The purpose of the report was to set forth the boundaries of this district, outline the proposed method of disposal and estimated cost( capitol expenditure and operation and maintenance costs). The Board put several questions to Mr. Lapar in various areas of his report, and then Mr. Heady asked him to give a brief resume of the report for the benefit of the residents present, and Mr. Lapar accordingly accomodated his request. Among other things, Mr. Lapar pointed out that the figures, he felt, were fairly firm, as they were based on the engineering figures given him by Mr. Maurer, City of Poughkeepsie comptroller. Rules were suspended to permit questions from the floor. Mr. Cortellino asked what was the price per assessed valuation of the City and Town of Poughkeepsie, and, what about commercial refuse -would there be a comm- ercial charge. Mr. Eck asked Mr. Lapar if he had made any investigation of the figures he was given to work with, and Mr. Lapar responded that he had taken the figures at face value. Mr. Clausen assured Mr. Eck that if the Town went further, the figures would continue to be scrutinized. Mr. Eck then asked if anyone had spoken to the haulers, would they charge more for the haul to Salt Point? Mr. Diehl assured him he had spoken to one of the haulers, and they would not raise their price, as they would just be happy to have a place to dump. Mr. Frank Benn asked what it would cat per ton Mr. Cortellino asked if use of the Beacon incinerator had been investigated, and if figures on composting were checked. Mr. Benn delved into the cost and instiutuion of composting. Mr. Eck commenting on a letter he gave to Mr. Diehl (3/18/68), regarding the use of landfill, rather than incinerator, and also asked why not go into the incinerator with the City and Town of Poughkeepsie on a rental basis- the Board said it was financially ridiculous - the rate would be about $14.00 a ton. He then went on about the landfill operation, advocating the utilization of the north-west corner of the County Airport (West side of New Hackensack Rd) He felt this would be even more economical and feasable than the Airport pro- perty on the East side of New Hackensack Rd. Rules resumed. The following ORDER was adopted by the Town Board: In the Matter of the Establishment of the own of Wappinger Garbage and Refuse Disposal Ijistrict in the Town of Wappinger, Dutchess Bounty, New York, pursuant to Article 12-A of the Town Law WHEREAS a map, plan and report have been prepared in such manner and in such detail as determined by the Town Board by Rudolph Lapar, a duly licensed engineer in the Stae:of New York, which map, plan and report have been filed in the office of the Town Clerk of the Town of Wappinger and are available for public inspection in said office during regular business hours; and WHEREAS, such map, plan and report proposed the creation of a garbage and refuse disposal ¢district in the Town of Wappinger, Dutchess County, New York, the boundaries of which shall include all land area of the Town of Wappinger outside the corporate limits of the Village of Wappingers Falls, and WHEREAS, after the creation of such district, this Town Board; the City of Poughkeepsie, and the Town of Poughkeepsie Refuse and Garbage District propose to enter into a contract wherein and whereby certain lands will be purchased in the City of Poughkeepsie for the construction thereon of an in- cinerator with each municipality contributing thereto in proportion to its population, and thereafter said municipalities plan to operate said incinerator and any necessary land fill areas for the disposal of garbage and refuse on a tonnage basis, all as more fully set forth in the plan and report above referred to; and WHEREAS, the maximum amount proposed to be expended for said improvement is $472,000.00; and WHEREAS, the cost of acquisition and construction of the said improvement including the annual debt service on any bonds issued to finance the same and and cost of operation and ma intenance shall be payable in the first instance from assessments levied on benefited:ral property in said proposed District, and WHEREAS, the proposed method of financing the costs of the improvements consists of the issuance of serial bonds to mature in annual installments over 49 a period not exceeding 30 years, payable in the first instance from assess- ments levied on benefited real property in said proposed District and WHEREAS, it is now desired to call a public hearing in connection with the establishment of said District pursuant to Section 209-b of the Town Law; now, Therefore, It is Hereby ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. A meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, shall be held at the Town Hall, Mill Street, Wappingers Falls, New York, in Dutchess County, New York, on the llth day of April, 1968, at 8:00 o'clock P.M. Eastern Standard Time, to consider the establishment of said proposed Garbage and Refuse Disposal District, and the map, plan and report filed in relation thereto, and to hear all persons interested in the subject thereof concerning the same, and for such other action on the part of the Town Board in relation thereto ad may be required by law or proper in the premises. Section 2. The Town Clerk is hereby authorized and directed to cause a notice of this Order to be published in Wappingers and Southern Dutchess News, and posted in accordance with the provisions of Section 209-b of the Town Law. Section 3. This ORDER shall take effect immediately. The question of adoption of the foregoing ORDER was duly put to a vote on roll call which resulted as follows: Louis D. CLAUSEN offered the following resolution, and moved its adoption: WHEREAS, the Town Engineer has prepared standarasand specifications for future public highways of the TOWN OF WAPPINGER, Dutchess County, New York, and WHEREAS, said standards and specifications provide for the construction of roads, drainage facilities, curbs, gutters and sidewalks, where required by the Town Planning Board, NOW THEREFORE, be it resolved that the Street Specifications dated March 20, 1968, prepared by Rudolph E. Lapar, licensed engineer, are hereby adopted by the Town Board of the Town of Wappinger as the minimum standards for the acceptance of streets and drainage facilities for all streets and drainage facilities and, be it further RESOLVED, that said specifications must be complied with before the acceptance by Town Board of any street with the exception of any street or drainage facility which is shown on a plat which has had finat Planning Board approval, as of the date of the passage of this resolution, and be it ftrther RESOLVED, that the Town Clerk is hereby authorized and directed to_ forward a copy of these specifications to the Town Planning Board and the Town Highway Superintendent. CLAUSEN moved to appoint Mr. Joseph Gutmann as an assistant to Mr. Richard Hodge, Oakwood Knolls Water Plant Operator, effective as of April 1, 1968. Seconded by MR.
