Adjournment The Regular Meeting of the Town Board of the Town of Wappinger was held on March 11, 1968, at the Town Hall, Mill Street, Wappingers Falls, New York. The Supervisor called the meeting to order at 8:05 P.M. Present: Louis D. Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Jr. Councilman Elaine H. Snowden, Town Clerk Others Present: Rudolph Leper, Engineer to the Town Allan Rappleyea, Attorney to the Town William Horton, Highway Supt. Mr. Heady moved the minutes of Special Meeting, Jan. 29, 1968, Regular Meeting, Feb. 13, 1968, Special Meeting, Feb. 19, 1968, Special Meeting, Feb. 29, 1968, as submitted by the Town Clerk be and they are hereby approved, seconded by Mr. Mille. Motion Unahimously Carried Mr. Heady moved the monthly reports of the Building Inspector, Justices, and Supervisor be accepted and placed on'file. Seconded by Mr. Mills. Motion Unenimously Carried The following bills were presented: General Fund: $12,216.12 Highway: $12,512.41 R.F.S.D.: 996.18 0.K.W.&S: , 727.20 Mr. Clausen moved the bills be paid, subject to au Mr. Finnan. A Rezoning Petition was . Seconded by Motion Un nimously Carried received from the K.B.&M. associates ( Robert Ka a , Ralph Bernstein and Edward J. Minskoff) to rezone a parcel if land on McFarlane Rd. (originally Oak Ridge-own0 by Snape) from R-40 to RD -20; MR. CLAUSEN moved that this petition for rezoning be referred to the Planning Board for their review and recommendation, seconded by MR. MILLS. Motion Unanimously Carried A letter was received from Mrs. Thomas Cosgrove, (representing also Mr. & Mrs. L. Jaycox, B. Shultz, T. Cosgrove, R. Bickford, J. Hever, C. Mellow and F. Dursee). The letter was in regard to a drainage problem on Myers Corners Road in the vicinity of Montfort and Gold Roads. MR. MILLS moved the complaint be referred to the Engineer to the Town for him to discuss with Mr. Petrovits, County Supt. of Highways, seconded by MR. CLAUSEN. Motion Unanimously Carried Letters on Dog Complaints were received from Mrs. Jack Johnston, Mrs. Edward Stokowski, Mrs. Edward Hawksley, Mrs. Frank Devine, Mrs. Albert Weir, Mrs. Louis Ruseskas, Mrs. Barbara Bhalla, R. DeVries, and a petition, submitted by Mr. Joseph J. Zagursky, from Town residents, all of which bpsically requested that the Town adopt a dog ordinance. The Supervisorl referred these letters to the Ordinance Committee (Messrs. Millsi& Heady) with respect to introducing a proposal for a Dog Ordinance, at the next meeting, if possible. Mr. Diehl asked if there were any persons in the audience who wished to address the Board regarding the dog problem in the Town. Mr. William Sneyd, Mr. John Pease, Mrs. Shirley Davis spoke all favor- ing the adoption of an Ordinance. Mr. John Hamilton (representing the Edgehill Civic Association)submitted a draft of a Dog Ordinance. Mr. Heady suggested that a few of these interested people be appointed as a committee to work with the two Board members in drafting a pro- posal for a dog ordinance. Mr. John Pease, Mr. John Hamilton and Mrs. Shirley Davis were selected. Letters were received from Mrs. Gerald J. McDougall and Mrs. Joseph Almena, both with regard to Fleetwood Water and Sewage plant, rates being charged, and operations of them. MR. MILLS moved this matter be turned over to the Attorney for further study, seconded by MR. CLAUSEN. Motion Unanimously Carried Addendum #4 to the proposed Highway Specs was submitted by Mr. Lapar Engineer to the Town. Mr. Diehl ordered addendum tabled. Mr. Armand Fuimarello requested permission to continue discussion with the Board on an interpretation of the CATV agreement with regard to installation rates. It was his understanding that installation would be free for the first 6 months - after that $20, which would be uniform throughout the Town of Wappinger. Mr. Diehl stated that it appears to him that installation meant to the nearest telephone pole to a residence and 150' in. Mr. Rappleyea enlarged by remarking that the point was ambiguous in the agreement, and it appears that Highway Displays says that installation, in their opinion, is so many feet from where the Telephone Co. makes its drop, to the house and its their attitude that where a house is more than 150' from the pole line they will not carry it beyond that point without charging. The contract does provide a clause that if there are any disputes they are to be referred to the CATV Committee, and that, based on the CATV Committees recommendation the Board can act. Mr. Fuimarello felt that the contract didn't provide for people like himself who lived further back off the roads that normal. Mr. Diehl recommended this matter be turned over to the CATV Committee for their investigation and recommendation. A request was received from Mrs. Dorothy Alsdorf, Town Historian, for permission to attend a conference on "Historical Preservation in Dutchess County" at Marist College, March 16th. A $4 fee is being charged. Mr. Mills moved that permission be granted Mrs. Alsdorf and her expense be a Town charge, seconded by Mr. Heady. Motion Unanimously Carried A report on estimated cost of drainage problems in the Town was received from Mr. Lapar, and referred to the Health and Safety XININR.Se2 CLOrrec_LICI Committee (Mr. Mills and Mr. --Bwmdy) with Mr. Horton, Highway Supt. eq to work with them. Several residents of Wildwood Forest spoke vehemently against includ- ing the Wildwood ditch in with general drainage problems of the Town, and spoke just as strongly in favor of the Town covering the ditch immediately, if not sooner. Mr. Clausen asked what these residents reactions would be if the solution were to form a special district to finance the cost of covering the ditch. This was not received .4U well at all. It was pointed out by one of the residents that the sides of the ditch were crumbling, endangering the surfaces of the roads on either side. Mr. Diehl asked Mr. Horton, Highway Supt. to look into this. Several residents asked if they could work on the committee with Messrs. Mills & Heady to solve the Wildwood ditch problem. Mr. Leonard Kewalik and Mr. Robaitalli from Wildwood, were named to assist. (Mrs. Raymond Richie left pictures with the committee of her child that had gotten stuck in the mud in the ditch). The residents of Wildwood were assured, after some confusion over the total drainage problem report, that the ditch would be considered as a separate problem, but expense would have to be considered in with the total town drainage costs with relation to finance. Mr. Diehl stated that now the Town was lst Class speed limits for Town roads could be considered. He referred this to the Ordinance Committee (Messrs. Mills & Heady) for Study and Recommendation. MR. DIEHL moved that the Board notify the Dutchess County Civil Service Board to set up a Civil Service list in regard to appoint- ing Special Police for the Town of Wappinger, that would replace the second class Town use of constables. Motion failed for lack of a second. In discussing this motion, Mr. Heady made the Board cognizant of services obtainable from a unit of the Civil Defense Auxiliary Police in the Town, headed by an Inspector from the Town, trained by the Sheriffs office and Mr. Heilman in penal law. These men would, gratis, perform the same duties as would Special Police. His belief was that instituting Special Police would eventually lead into a paid Police force - which would be a cost to the taxpayers, and these Civil De- fense Police would be more than happy to serve at the Town's request for any function. This is a volunteer organization and cannot be paid, and there is alrady a budgeted item for donations toward their equipment. Mr. Mills felt that, if the Town had these auxiliary police available without expense, for the time being they would appear to be very adequate. Mr. Finnan commented that the Inspector would be available to discuss with the Board how any needs of the Town could be handled. A Mr. Clausen also expressed his interest in this and recommended having further information forwarded to the Board regarding services of these auxiliary police. A policy regarding the procedures. of vouchers for payment of services rendered to the Town, having been previously discussed informally, was brought up for acceptance. MR. HEADY moved that the following policy be adopted as requirements for voucher payment for the Town: Effective immediately the Town Board will not approve vouchers for payment if any of the conditions listed below are not met: 1. Vouchers for materials of any nature should bear an invoice signed and dated by the official employee who accepted the goods certifying receipt of the item. 2. Vouchers for labor or services should have invoices attached, signed_and dated by an employee or official of the Town who has direct knowledge that the effort was performed for the number of hours shown and on the date or dates indicated. We call to your attention that when you approve an invoice, you are certifying that Town government has received the number or amount of the items for which you signed on the date that you show they were received. Good business practice demands that you have personal knowledge that the items for which you signed were actually received. If you are acknowledging an invoice for work performed by two men for eight hours, be personally convinced that the Town received that effort before you sign. To do otherwise is poor business and exposes you, to say the least, to criticism. Town officials and department heads are directed to provide all their employees whom they authorize to acknowledge receipt of labor or materials, with a copy of this letter. Seconded by MR. MILLS. Motion Unanimously Carried A vacancy on the CATV Committee, due to the resignation of Robert L'Archevesque, tabled from the Feb. 13th meeting, was again brought before the Board for appointment. MR. MILLS moved that Mr. Walter Evans, VanVoorhis Terrace, be appointed subject to the committees' approval. Seconded by MR. FINNAN. Motion Unanimously Carried A vacancy was created by the death of Dwight Robbins for an.Enforce- ment Officer, MR. DIEHL moved that Joseph Costa be appointed as an Enforcement Officer, seconded by MR. CLAUSEN. Mr. Diehl -- Aye, Mr. Clausen -- Aye, Mr. Finnan -- Nay, Mr. Heady -- Nay, Mr. Mills -- Nay. Motion Failed MR. MILLS moved Mr. Arthur Waddle be appointed as an Enforcement Officer, seconded by MR. FINNAN. Mr. Diehl -- Nay, Mr. Clausen -- Nay, Mr. Finnan -- Aye, Mr. Heady -- Aye, Mr. Mills -- Aye. Motion Carried A request was made by representatives of Mid -Hudson Auto Wreckers seeking a salvage yard license. Having been denied a renewal of this license by the Town Clerk, Mr. Charles A. Pincus, on behalf of Mid -Hudson Auto Wreckers, Inc. was present to put it before the Board (pursuant to Section 137 of Town Law). Mr. Pincus indicated that he was not sure on what the denial was based. Mr. Rappleyea, in defense of the Clerks action, informed Mr. Pincus that the Clerk denied the application based upon the provisions of the law as to the qualifications of the applicant or a member of the corporation, and by letter, dated Jan. 16, 1968, the application was denied. Town Law provides that the applicant may appeal this decision to the Town Board and the Town Board may make a decision, based upon such an appeal. He suggested to Mr. Pincus that he get a copy of the letter of Jan. 16, 1968, which would provide him with the exact reason for denial, and if he (Mr. Pincus) feels he meets the quali- fications he has a right to appeal to the Town Board. Mr. Rappleyea said it should be a formal application by Mid -Hudson Auto Wreckers, Inc. to the Town Board and he would assume fill out the same applica- tion as would be filed for the Town Clerk. Mr. Pincus pointed out that the only problem is one of time, as the application that was made -for operation for the first of the year, and, as he observed, they are operating a business, and as the Board only meets once a month, asked if there was any way of meeting the situation so that it could come up at an earlier date. Mr. Diehl said that it would be possible for the Board to hold -a Special Meeting, and requested that Mr. Pincus get together with Mr. Rappleyea and submit another application, so the Board could take it under advisement and consider the request. A draft of Rules and By -Laws of the Town Board was ordered tabled by the Supervisor. Bids for a four wheel drive pick-up truck for the Highway Dept. were received March 6, 1968 and opened publicly. Two bids received - Mid -Hudson Chevrolet - $2,797.92 Whl Brothers - 2,916.71 The Highway Supt. recommended the bid for the four-wheel drivepick-up truck be awarded to Mid -Hudson, as low bidder. MR. MILLS moved the Board_accept the recommendation of the Highway Supt. and award the bid for a four wheel drive pick-up truck be awarded to Mid -Hudson Chevrolet at $2,797.92, seconded by MR. HEADY. Motion Unanimously Carried Bids for calcium chloride for the Highway Dept. were received on March 6, 1968 and opened publicly. Three bids were received - Duso Chemical„Corp, Capitol Highway Materials and H.G. Page. The Highway Supt. recommended all bids be rejected and calcium chloride be: advertised for re -bid. Bids.for corrugated metal culvert pipe for the Highway Dept. were received on March 6, 1968 and opened publicly., Five bids were received - Capitol Highway Materials, Chenung, H.G. Page and Edgerton (see attached tally sheet). The Highway Supt. recommended the bid for corrugated metal culvert pipe be awarded to Edgerton Sales Corp. MR. MILLS moved the Board accept the recommendation of the Highway Supt. and award the bid for corrugated metal culvert pipe to Edgerton Sales Corp. Seconded by MR. HEADY. Motion Unanimously Carried. Mr. Horton reported on a problem of dumping in Chelsea. He said that the Highway Dept. cleaned up the dump and put up a barrier. Also "No Dumping Allowed" signs were installed. Mr. Diehl elaborated by saying that as this had been quite a problem the Sheriffs' office had been very cooperative in helping with investigation and the apprehension of one violator. 44 1J11131 110,11111 0, I Mr. Russell G. Jones made a complaint about a swimming pool, an open well and refrigerators with doors on them on property formerly owned by Angelo Williams (Wheeler Hill area - where house with apartments .-; had burned - now in process of changing owners). Mr. Ludewig reported he had had complaints, had investigated, and notified the new owners of these hazards. MR. HEADY moved that the County Commissioner of Public Works be contacted and requested to conduct a traffic survey at the intersec- tion of All Angels and Myers Corners Rd. (2 county roads) to ascertain if there is a need for stricter traffic control at this intersection. Seconded by MR. MILLS. Motion Unanimously Carried. The Clerk was also -directed to include in the communication to Mr. Petrovits, a request that the guard rail at this intersection be replaced•with expediency. Mr. Richard Price, Chelsea, thanked the Board and Mr. Horton for the fine job they did down in Chelsea regarding the dump situation. Mr. Russell Jones asked what the condition was regarding fire hydrants in Wheeler Hill (Tall Trees) development with no water in -them. Mr. Diehl asked Mr.-Lapar to check into this complaint. MR. CLAUSEN moved that the Town notify the Public Service Commission that there has been a complaint in Amherst Lane regarding water- conditons, seconded by MR. MILLS. Motion Unanimously Carried. Mr. Cortellino pointed out that the hydrants were essentially "blow • out" and where the real problems lay in Tall Trees was the fact that there was no water in the storage tanks the time of the fire. This is where he felt the Town, utilizing and enforcing the Water Law, could possibly step in. Mr. Gregory Sarno asked if the public could be present when the Board was working out the Town Budget. He asked to go on record as requesting a requisition of $70,000.00 be placed in the Budget for _ . t , Wildwood Forest improvements.
