1968-02-19 SPMWAIVER OF NOTICE OF SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK The undersigned, being all of the members of the Town Board of the Town of Wappinger, Dutchess County, New York, do hereby waive notice of the time and place of the holding of a Special Meeting of said Town Board, and do hereby agree and consent that the same be held on the 19th day of February, 1968, 7:00 o'Clock in the afternoon of that day at the Town Hall of the Town of Wappinger, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, for the transaction of all business which may properly come before the meeting or any adjournment th eof. Town Clerk Town of Wappingef• Supervisor Diehl called the Special Meeting to order at17:30 P.M. The following Resolution was proposed by Mr. Mills, who Moved its adoption: WHEREAS there has been forwarded to the Town Hoard a proposed amendment to the Zoning Ordinance of the Town of Wappinger, whereby certain definitions contained in the zoning code have been amended and certain districts have been added to the zoning code, NOW, THEREFORE, be it resolved that a public hearing on'the said proposed zoning ordinance be held at the Town Hall of the Town of Wappinger, at 8:00 p.m. on the 25th day of March, 1968, and be it further resolved that the Town Clerk is hereby authorized and directed to forward a copy of the zoning Ordinance amendment to the Town Clerk of the Town of Poughkeepsie, the Town of Fishkill, the Village Clexk of the Village of Wappingers Falls, and the Dutchess County Planning Board, and to the Clerk of the Board of County Representatives of the County of Dutchess, AND BE IT FURTHER RESOLVED That the Town Clerk is hereby authorized and directed to publish a public notice of said public hearing in the W & S D NEWS, at least ten days prior to said public hearing. Seconded by Mr. Heady Supervisor Diehl, -- Aye Councilman Finnan -- Aye Councilman Heady ,-- Aye Councilman Mills -- Aye Resolution duly adopted The followinig Resolution -was proposed by Mr. Finnan, who moved its adoption: WHEREAS thei has been forwarded to the Town Board of the Town of Wappinger a proposed amendment to the zoning map adopted January 29, 1963, which is to be amended, NOW, THEREFOtE, be it resolved that a public hearing on the said proposed zoning odinance be held at the Town Hall of the Town of Wappinger at 8:00 P.M. on the 25th day of March, 1968, and be it further resolved that the Town Clerk is hereby authorized and directed to forward a copy of the zoning ordnance amendment to the Town Clerk of the Town of Poughkeepsie, the Town of Fishkill, the Village Clerk of the Village of Wappingers Falls, and the Dutchess (County Planning Board, and to the Clerk of the Board of County Representatives of the County of Dutchess, AND BE IT FU THER RESOLVED, that the Town Clerk is hereby authorized and directed to pblish a public notice of said public hearing in the W & S D NEWS, at least ten days prior to said public hearing. Seconded by Mr. Mills Supervisor Diehl -- Aye Councilman Finnan -- Aye Councilman Heady -- Aye Councilman Mills -- Aye Resolution duly adopted Mr. Diehl made the following statement: "Since our last meeting I have had discussions with the Attorney for the Rabilt firm, the Town Building Inspector and Mr. Rappleyea the Town Attorney. It appears that the resolution of thematter of the acceptance of the roads in the Tall Tree development is some time off, as the action on the bond is very complicated. Because a building permit has been issued and on that basis several houses have been built, I believe we can no longer delay the occupancy of these buildings. All the parties agree that a permit can be issued which specifically sets forth that the Town has not yet accepted the roads as an official Town road and that the owner will accept the certificate 8f occupancy on this condition." Mr. Diehl moved that the Town Board notify the Town Building Inspector to issue certificates of occupancy tothose owners who have constructed homes on Amherst Lane on the the conditions that Certificates of Occupancy can be issued, which specifically sets forth that the Town has not yet accepted the roads as an official Town road, and that the owner will accept the C.O. on this condition, and also, that no further building permits be issued until such time as the matter of the acceptance of these roads has been resolved. Supervisor Diehl -- Aye Councilman Finnan -- Aye Councilman Heady -- Aye Councilman Mills -- Aye Seconded by Mr. Heady Motion Carried Mr. Mills moved the meeting be adjourned, seconded by Mr. Heady, and unanimously carried.
