The Regular Meeting of the Town Board of the Town of Wappinger was
held February 13, 1968 at the Town Hall, Mill Street, Wappingers Falls,
New York.
Supervisor Diehl called the meeting to order at 8:08 P.M.
Present:

Motion was made by Mr. Mills to accept the minutes of Dec. 21, Special
Dec. Public Hearing, Dec. 29, Auditing, Jan. 4, Reorganizational,
Jan. 18 Special and Jan. 23 Special as submitted by the Town Clerk be
and they are hereby approved. Seconded by Mr. Finnan. Motion
Unanimously Carried.
The Annual Reports were received from Grinnell Library, Building
Inspector and Town Justice William Bulger. Mr. Heady moved they be
received and placed on file. Seconded by Mr. Finnap. Motion Unani-
mously Carried.
The Building Inspectors, Town Justices reports for 4ecember and January
and the Supervisors' report for December were prese.tted. Mr. Milts
moved they be received and ordered placed on file. Seconded by Mr.
Finnan. Motion' Unanimously Carried.

A letter was received from Mr. Robert N. Neulen regarding CATV servic-
ing Cedar Hills Area. Mr. Mills moved the letter be referred to the
CATV Committee. Seconded by Mr. Finnan. Motion Unanimously Carried.
A Petition was received from Revere Ridge Homes Corp. (formerly Mid -
Point Park Rt. 376) reguesting the release of a Bond placed with the
Town by Mid -Point Filtration Corp. Inc. on the sewer plant. Mr. Lapar
reported that h* felt the construction bond could be released, as the
Plant is now in, operation. Mr. Heady moved that on the basis of the
Engineers report, the bond be released, seconded by Mr. Mills.
Motion Unanimously Carried.
A letter was received by Mr. Arthur Swan, Dorothy Heights, reporting
damage to his fence allegedly caused by a Town Highway truck. A
report was received from Mr. Q. Groenwegen of the Beasley Agency, Inc.
stating he had investigated. Mr. Diehl moved to accept Mr. Swans
letter, and instruct the Attorney to the Town and Town Clerk to notify
the claimant the complaint has been received, and if they care to
pursue this matter further, they can file a formal complaint as
prescribed by Law. Seconded by Mr. Mills. Motion Unanimously Carried.
A letter was xeceived from Joseph Incaronato regarding the Fleetwood
Sewage Disposal Corp.
Mr. Rappleyea having done some research in the Towns Minutes on
Fleetwood, his finding was that when the Corp. was set up in 1960,
it was set up as a Transportation Corp.. and there was no special
agreement between the Town and the Corp. whereby there were no price
or terms set up. It appears that, it being a privatd corp. and deal-
ing in Public Health, the Town can only look to the other agencies
having jurisdiction of this type of operation. He also mentioned that
he had had correspondence from the Attorneys General's Office. and State
Dept. of Health and has been advised by them that there is to be
immediate action by them to enforce their recent order regarding the
improving, and bringing up to standard, the operation of the Fleet-
wood Sewer Plant.
Mr. Lapar added that, by action of the previous Town Board he was
in the process of revising the original analysis of Barger & Adler
for the Fleetwood Civic Association.

DISTRICT IN THE TOWN OF WAPPINGER,
DUTCHESS COUNTY, NEW YORK, TO BE KNOWN
AND DESIGNATED AS TOWN OF WAPPINGER
SEWAGE DISPOSAL DISTRICT, PURSUANT TO
ARTICLE 12-C OF THE TOWN LAW.
ORDER FIXING

ESTABLISHMENT
OF SEWAGE
DISPOSAL DISTRICT.
WHEREAS, a map, plan and report have been prepared in such
a manner and in such detail as have been determined heretofore by the Town
Board of the Town of Wappinger relating to the establishment and formation
of a sewage disposal district for the purpose of conveying, treating and
disposing of sewage from sewer districts within its area, and
WHEREAS, said map, plan and report have been prepared by
Adler -Brenner & Associates and Rudolph E. Lapar, competent professional
engineers duly licensed by the State of New York, showing the boundaries
of theproposed sewage disposal district, the identity and boundaries of the
sewer districts which the Town Board in its judgment considers will be

benefited by the establishment of a sewage disposal district, a general plan
of the proposed sewage disposal system, and a report of the proposed
method of operation thereof, and
WHEREAS, said map, plan and report show all outlets and the
terminus and course of each proposed main sewer or drain, together with
the location and a general description of all sewage disposal plants, pumping
stations and other public works required, and
WHEREAS, the boundaries of the proposed sewage disposal
district are described in Schedule A which is annexed hereto and made a
part hereof and incorporated herein by reference to the same extent as if
the same were more fully set forth herein, and
WHEREAS, t he proposed improvements as set forth in such map,
plan and report consist of the acquisition and construction of main sewers,
trunk sewers and intercepting sewers, sewage treatment and disposal
plants, pumping stations, and the acquisition of rights of way, easements,
real property and interests in real property, and
WHEREAS, the maximum amount proposed to be expended for
the aforesaid improvements and for the acquisition of the aforesaid
necessary acquisitions of interests in real property is the sum of One
Million Five Hundred Eighteen Thousand Dollars ($1, 518, 000. 00), and
WHEREAS, the proposed method of financing the cost of such
improvements and acquisitions consists of the issuance of serial bonds of
said Town of Wappinger to mature in annual installments over a period
not exceeding forty (40) years, payable in the first instance by the assessment
and levy upon and the collection from the several lots and parcels of real
property within the benefited area in just proportion to the amount of benefit
which the sewer improvements shall confer upon such parcels, and

WHEREAS, the aforesaid map, plan and report have been duly
filed in the office of the Town Clerk of the Town of Wappinger,
Now, on motion of Mr. Clausen, seconded by Mr. Heady, it is
hereby
ORDERED, that the Town Board of the Town of Wappinger shall
meet and hold a public hearing at the Town Hall, Mill Street, in the Village
of Wappingers Falls, in said Town, on the 23rd day of January, 1968, at
8:00 o'clock in the afternoon of said day to consider the aforesaid map, plan
and report, and to hear all persons and parties interested in the subject
thereof concerning the same, and to take such action thereon as is required
or authorized by law, pursuant to Article 12-C of the Town Law.
The question of adoption of the foregoing order was duly put to a
vote on roll call which resulted as follows:

by Messrs. Rappleyea and Lapar the Board should address a letter to
both New York State Health Dept. and Dutchess County Dept. of Health,
again reminding them of the urgency and high priority of the situation
in Fleetwood and with this the Board should wait for Mr. Rappleyea to
receive information from both the Dept. who have pledged immediate
action. Seconded by Mr. Mills. Motion Unanimously Carried.
Mr. Incoronato mentioned an immediate problem with a broken main in
Fleetwood that was occuring this evening, and voiced his appreciation
the cooperation that the Board has indicated a letter was received
from the Dutchess County Health Dept. regarding the ditch in Wildwood
Manor.
Mr. Finnan pointed out that it was his understanding that the Engineer
to the Town was compiling a report on this and the several other trouble
spots in the Town, the matter should be tabled pending a full report.
Mr. Lapar commented that he hoped to present a joint report (his and
the Highway Supt.) in the near future on the Wildwood ditch and the
other trouble spots.
Mr. Diehl directed this be referred to the Highway Committee so that
in conjunction with the Engineer and Highway Superintendent they can
continue the investigation, and report at a future date.
A letter was received from Mr. Joseph Quinn regarding the suit of
City of New York v. Verner Christensen, and asking authorization to
appeal Mr. Justice Hawkins decision on this case.
Mr. Clausen moved that the firm of Quinn & Reilly be instructed to
file notice of appeal, but hold up on the processing of it until the
Board can be further informed of the details and what the approximate
costs of such an appeal would be. Seconded by Mr. Finnan.

A letter was received from Mr. John Wolf, representing Bell -Air
Construction Company Inc. requesting the roads in the Spook -Hollow
Development be accepted as Town roads.
Mr. William Horton, Highway Supt. recommended that these roads be
accepted as Town roads, and that the Town retain 20% of the Perfor-
mance Bond for a one year period.

BELL -AIR LANE AND ORANGE COURT
The following resolution was offered by Mr. Finnan who moved its
adoption:
WHEREAS, BELL -AIR CONSTRUCTION COMPANY INC. has offered to the
Town of Wappinger the two streets known as Bell -Air. Lane and Orange
Court, together with certain drainage easements and
WHEREAS, the Planning Board of the Town of Wappinger has previous-
ly accepted the plat covering said streets, and
WHEREAS,‘the Town of Wappinger Highway Superintendent has advised
the Town Board that the roads have been completed according to the Town
specifications, now, therefore,
BE IT RESOLVED that Bell -Air Lane and Orange Court are hereby
accepted as town roads in the Town of Wappinger and that they are
described and set forth in a map made by Richard G. Barger, dated
July 1964, and revised October 10, 1964, and filed in the office of
the Clerk of Dutchess County as Map #3326, and also described in a
deed dated June 25, 1965, and be it further
RESOLVED that the Town of Wappinger also accept the drainage
easement on the aforesaid map #3326 as described in a deed to the
Town of Wappinger dated October 26, 1967, and be it further
RESOLVED that 20% of the original performance bond be retained
for one year by the Town.

A request was received from Mr. Merritt Effron, on_ behalf of Rabilt,
Inc., regarding the matter of Certificates of Occupancy in Section 11
of Tall Trees. -
Mr. Diehl asked that Mr. Effron address the Board more fully.
Mr. Effron reiterated the circumstances leading up to the Town Boards'
decision torequest the Building Inspector to withhold C.O's on 4 of
Mr. Rakers' houses in Section 11, Tall Trees. He requested the Board
review this situation and recommend to the Building Inspector that he
issue these C.O's. He pointed out that previously a petition had been
submitted to the Board by residents of this Section indicating no
objections to favorable action of the Board to having these C.O's issued.
Mr. Reilly was asked what the status of the litigation of the Bond on
Tall Trees Section 11 was.
Mr. Reilly responded that he was not personally familiar with the case,
but did mention that a settlement was imminent on Brook Hollow Estates.
Mr. Kessler came forward to support Mr. Effrons' plea, and asked that
the Board act favorably on the request for the issuance of this applica-
tion.
Mr. Clausen, although being able to appreciate the builders postion,
that having received the Building Permits in good faith,_and that_he is
the builder, not the developer, felt, however, the position of the Board
at the time was that the developer hadn't lived up to the road specs,
and that the Board, in allowing C.O's to be issued, wouldn't be doing
anyone a favor. He felt the Board should stand firm on their decision
and further that the Board would only have to go by whether the road
specs had been met, and in this case they obviously hadn't.
Mr. Clausen moved that the Certificates of Occupancy be denied until
either a successful conclusion to the case with the Bonding Company or
until the roads have met specifications by the developer_. Seconded by
Mr. Heady.
Motion Unanimously Carried
Mr. Heady agreed with Mr. Clausen and further felt that if the Board
made an exception and granted these Certificates that basically they
would be condoning a mis-action on the part of the developer.
Mr. Clausen commented briefly on the fact that he has continually asked
for the,upgrading of the r;ad specs, so that situations such as Amherst
Lane would be prevented.
Mr. Diehl called for a moment of silence in memory of Dwight Robbins.
He expressed the sorrow felt by all of the Town Officials at the passing
of this man, who had worked for the Town and given of himself so freely
toward the good of the_community. A moment of silence was observed.

A letter was received from the Planning Board regarding expansion of
non- ®nforming uses.
Mr. Clausen felt that the Board should discuss this matter further, and,
in proposing the revisions to the Zoning Ordinance that are being worked
on now, this matter should be incorporated, if the Board favors accepting
the recommendations of the Planning Board.

Mr. Clausen moved that the Board accept the report from the Planning
Board and hold off comment until the next meeting. Seconded by Mr.
Finnan.

A letter regarding a 22 lot Subdivision was received.
Mr., Diehl moved this be referred to the Attorney to the Town. Seconded
by Mr. Clausen.'

Mr. Heisler was asked if this would have any effect on actions of the
Planning Board. He pointed out there was a 45 day period in which the
Board had before it necessitated action.
Mr. Mills moved that the Board proceed with plans for making the old
kitchen on the second floor of the Town Hall into a Board room.
Seconded by Mr. Heady.

Mr. Robert L'Archevesque submitted his resignation as a member of the
CATV Committee.
Mr. Clausen, on behalf of the Board accepted Mr. L'Archevesque's
resignation with thanks and appreciation for the job he has done since
the inception of the Committee. And, since Mr. L'Archevesques's resig-
nation also created a vacancy in the chairmanship. Mr. Clausen submitted
the name of Ed Valentine for consideration as chairman. Seconded by
Mr. Finnan.

district to commence work immediately on a collecting sewer to service
the Orchard Park Homes area of the Town of Wappinger, it being under-
stood that such work shall be commenced by said engineers at the same
time as work on otherfacilities for said improvement district.

tions of the seller of the Oakwood Knolls sewer plant, and
WHEREAS, an interest charge of $10.70 has been received for the
interest due on the tax bill, now therefore,
BE IT RESOLVED that the sum of $10.70 is hereby transferred from
the,Assurety Account to the Tax Collector of the Town of Wappinger, in
payment of the interest on said tax bill.

The Highway Superintendent recommended that the following bids be

chloride, corrugated metal pipe, and pipe arch, be rejected.
Mr. Heady moved the Highway Superintendent recommendations for highway
materials, and #2 fuel oil be accepted and the bids be awarded to:
Spoor-Lasher for bituminous road materials„ bituminous concrete;
Morton Salt Co. for rock salt; Mid -Hudson for gasoline; Dutchess Quarry
for concrete pipe; B.F. Goodrich for tires and tubes; Spoor Lasher for
crushed stone; Camelot for sand, Circle Sand & Gravel for washed gravel
and R.O.B; and Vinces Oil Co. for #2 fuel oil. Seconded by Mr. Mills

The term of Mr. Richard Jacobson, on the Zoning Board of Appeals expires
as of Feb. 4, 1968.
Mr. Mills moved that Mr. Richard Jacobson be reappointed to a 5 year
term on the Zoning Board of Appeals. Seconded by Mr. Clausen.

Mr. Diehl made a few brief comments on the executive meeting held last
night (Feb. 12th) regarding the airport. He noted that Mr. Schoentag,
and the 4 County Representatives from the Wappinger-Fishkill district
had been present, and he felt that they and the Airport Committee, would
pick up and carry on what the Town had started.
Mr. Diehl asked if anyone from the floor wished to comment.
Mr. Eck voiced his feelings regarding the situation and Mr. Clifford
Harding spoke for the residents and offered transcripts of their suit
to the aid of the Town if the Board felt it would help.
Mr. Clausen moved that the Town Board forward a letter to the Regional
Office of the F.A.A. asking for funds to be available in the very near
future for the erection of a control tower at the Dutchess County Airport.
It is understood that the programing for the Tower is designated for 1969,
providing the funds are available. The Board would ask the F.A.A. to
give the funds so that the Tower can be activated in a very short time.
Seconded by Mr. Mills. Copies were directed to be sent to the County
Board of Representatives and the Airport Commission.
Mr. Bisom commented that letters be sent to our Assemblyman and State
Senator congratulating them on their stand against the Governor on the
New York City garbage problem.
Mr. Cortellino asked that in the course of the investigation (airport)
that perhaps the Board should get some of the local fire chiefs or fire
commissioners to give their comments on what their problems are.
Mr. Heady cited that the recommendations of the fire district in question
is a matter of record, on tape, as a result of a County Supervisors
Hearing several years ago.
Mr. Clausen moved the meeting be adjourned, seconded by Mr. Finnan and
unanimously carried."
