Supervisor Diehl called the meeting to order at 8:10 P.M. Present: eLcuis Diehl, Supervisor "DLouis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman i.:LJames Mills, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Highway Superintendent Rudolph Lapar, Engineer to the Town Joseph Ludewig, Building Inspector Mr. Quinn asked the Board if they would have any objection to consider- ing an earlier date for the Public Hearing previously'scheduled for January 25, 1968 on the Town of Wappinger Sewage Disposal District. Mr. Clausen moved to rescind the order fixing time and place for Public Hearing on establishment of sewage disposal district acted on at the December 21, 1967 Special Meeting in the matter of the establish- ment of a sewage disposal district in the Town of Wappinger, Dutchess County, New York to be known and designated as Town of Wappinger Sewage Disposal District, pursuant to Article 12-C of the Town Law set for January 25, 1968, seconded by Mr. Mills. ( Roll Call Vote: Mr. Clausen, Aye, Mr. Finnan, Aye, Mr. Heady, Aye, Mr. Mills, Aye, Mr. Diehl, Aye. The Order setting the date of January 23, 1968 for a Public Hearing on the Town of Wappinger Sewage Disposal District is annexed hereto and made a part hereof of the record. Mr. Diehl announced he had appointed June Scalzo as his Bookkeeper and Mr. William Egan as his Confidential Secretary. Mr. Snowden made known that she had appointed Eleanor B. Morton as Deputy Town Clerk. Mr. Diehl moved that Mr. Louis Clausen be appointed Deputy Supervisor. Motion failed for lack of a second. Mr. Mills moved that Mr. Leonce Heady be appointed Deputy Supervisor, seconded by Mr. Finnan. Roll Call Vote: Mr. Clausen, abstain, Mr. Finnan, Aye, Mr. Heady, Aye, Mr. Mills, Aye, Mr. Diehl, Nay. Motion Carried. The following resolution was offered by Mr. Mills who moved its adoption. RESOLVED, that the persons holding the following offices and positions of employment in the Town of Wappinger be 'and they hereby are required to furnish official undertakings, conditioned for the faithful performance of their duties in the sums set forth after the respective offices and positions set forth below: Town Clerk $ 15,000.00 Receiver of Taxes 500,000.00 Deputy Town Clerk 10,000.00 Supervisor 22,000.00 Town Justice 5,000.00 Supervisor's bookkeeper , 10,000.00 Superintendent of Highways 5,000.00 AND IT IS FURTHER RESOLVED, that the form and sufficiency of of surety of such undertakings shall meet with the approval of the Town Board of this Town and shall comply with the provisions of the Town Law of the State of New York in general and with Section 25 _ thereof in particular, and it is further RESOLVED, that such undertakings shall be filed in the office of the Clerk of the County of Dutchess pursuant to the provisions of the Public Officers Law and other related statutes of the State of New York, and it is further RESOLVED,'that a blanket undertaking in amount of $10,900.00 be procured from a corporate surety licensed to do business in the State of New York indemnifying the Town of Wappinger against losses arising from the failure of all other Town employees to perform their duties or to account properly for all monies for property received by virtue of their positions or employment. RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity throughout the year 1968 unless their services shall be sooner terminated at the pleasure of the supervisor: NAME OFFICE June Scalzo William Egan Joseph Ludewig Joseph Ludewig Kenneth Croshier Supervisor's Bookkeeper Supervisor's Confidential Secretary Building Inspector Zoning Administrator Deputy Town Superintendent of Highways Harry Straley Elaine Snowden John Biassoti Joseph Gutmann Dog Warden Registrar of Vital Statistics Director of Recreation Deputy Building Inspector AND IT IS FURTHER RESOLVED, that the salaries otherwise fixed for the above desginated offices and positions shall be -paid to the holders of such offices and position, with the exception that no compensation shall be paid to the holder of the office of Deputy Town Superintendent of Highways, payable every other friday through- out the year 1968, with 26 pay periods during such year, with first payday to be January 12, 1968, and with the further exception that no salary or compensationshall be paid to the Dog Warden and the Registrar of Vital Statistics who shall, however, be entitled to receive for the performance of the duties of their respective offices the fees fixed by applicable statute. Seconded by: Mr. Mills Roll Call Vote: 5 Ayes The following resolution was offered by Mr. Mills who moved its ,adoption,. -RESOLVED, that the pay scale -for" the following categories of employees hired by the Town of Wappinger Highway Department be and the same hereby is fixed and established at the following haximum hourly rates: Chauffeur Operator Laborer Foreman $ 2.78 per hour 2.92 per hour 2.67 per hour 3.35 per hour AND IT IS FURTHER RESOLVED, that all of such Highway Department employees engaged on an hourly basis shall be paid every other Friday throughout the year 1968, with the first payday to be on Friday January 12, 1968. RESOLVED, that the annual salaries for the following classi- fied Civil Service positions in the Town be and the same hereby are fixed and established .at the followingannual rate: Secretary to the Assessors $ 4,500.00. Secretary to the Building Insp. 4,600.00' AND IT IS FURTHER_ RESOLVED, that the salaries of persons holding such positions shall be paid every other Friday throughout the year 1968, with 26 pay periods during such year, with the first payday to be January 12, 1968. Seconded by: Mr. Heady Roll Call Vote: 5 Ayes The following resolution was offered by Mr. Heady who moved its adoption.., RESOLVED, that the pay scale for all extra part time clerical employees engaged to perform services for the Town Board of this Town and/or its officers, officials, and agencies be and the same hereby is fixed and established at a maximum hourly rate of $2.00 per hour, and itis further RESOLVED, that the pay scale for all extra part time secre- tarial employees engaged to perform services for the Town Board of this Town and/or its officers, officials and agencies be and the same hereby is fixed and established at a maximum hourly rate of $2.50 per hour, and it is further RESOLVED, that all of such extra part time clerical and secretarial employees engaged on an hourly basis shall be paid every other Friday throughout the year 1968, with the first pay- day to be on_Friday January 12, 1968. RESOLVED, that monthly meetings of the Town Board of the Town of Wappinger shall be held at 8:00 P.M. o'clock in the evening of the 2nd Monday of each month, at the Town Hall, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutche ss County, New York, or at such other place or places within the Town of Wappinger as the Town Board shall, from time to time, ,designate. News, a newspaper regularly published in the Town of Wappinger, Dutchess County, New York, and having a general circulation in this Town, and being a newspaper entered as second class mail matter, be and the same hereby is designated as the official paper of this town, and it is further RESOLVED, that the Poughkeepsie Journal and The Evening News, newspapers published in the County of Dutchess and having general circulation therein, be and they hereby are designated as additional newspapers for the publication of Town notices, subject to the limita- tions of Section 64, Subdivision 11 of the Town Law of the State of New York, and it is further RESOLVED, that the Town Clerk be and she hereby is authorized and directed to give notice of such designation to the publishers of such newspapers. RESOLVED, that the Marine Midland National Bank of South. eastern New York, t.he Dutchess Bank and Trust Company, each being a banking institution maintaining banking rooms and offices in the Town of Wappinger Dutchess County, New York, be and they each hereby are severally designated as depositaries of the monies of this town, and it is further _RESOLVED, that. the Town Clerk be and she hereby is directed to give notice of such designation to each of said banking insti- tutions, Seconded by: Mr. Mills Roll Call Vote: , 5 Ayes The following resolution was offered by Mr. Mills who moved s adoption. RESOLVED, that the Beasley Agency, Inc., a general insurance agency doing business in the Town of Wappinger, Dutchess County, New York, be and it hereby is designated as the insurance agent forvthis town. Licensed Public Accountant of the Town of Wappinger be and he hereby is retained to audit the accounts and reports of the Town Supervisor and the Town Clerk for the year 1967, and it is further RESOLVED, that the said accountant receive reasonable compensa- tion for the productive services which he shall render to the Town in this connection. Seconded by: Mr. Finnan Roll Call Vote: 5 Ayes The following resolution was offered by Mr. Diehl who moved its adoption RESOLVED, that Rudolph E. Dapar be and he hereby is employed and retained for the purpose of furnishing to the Town Board, its officers and angencies, such engineering advice and services as may be required and he shall receive compensation therefor in accordance with a proposal submitted to this board. Seconded by: Mr. Clausen Roll Call Vote: 5 Ayes A resolution for Receiver of Taxes was presented. Mr. Mills forwarded the name of Amelia Crosby and Mr. Diehl forwarded the name of Sylvia Johnson. Mr. Finnan seconded Mr. Mills motion. Mr. Clausen seconded Mr.. Diehls motion. On the preliminary vote Mr. Clausen and Mr... Diehl voted Nay], Messrs. Finnan, Heady & Mills votes Aye. Mr. Heady recommended a salary of $2,750 be set. The following resolution was offered by Mr. Heady who moved its adoption. , RESOLVED, that Amelia Crosby be .and she hereby is appointed to the office of receiver of taxes and assessments in the Town of Wappin- ger to serve in such capacity for a term ending on the 31st day of December, 1969, and it is further RESOLVED, that the receiver of taxes and assessments be paid an annual salary of $2,750.00 payable every other Friday throughout the year 1968, with 26 pay periods during such year, with the •first pay day to be January 12, 1968, and it is further RESOLVED, that the receiver of taxes and assessments be and she hereby is authorized to,employ such clerical employees as may be necessary for the performance of her duties and to compensate such clerical employees at the maximum hourly rate of $1.75 per hour. RESOLVED, that a petty cash fund not to exceed the sum of $200.00 and the same hereby is established for the Receiver of Taxes, and it is further RESOLVED, that the Supervisor of this Town advance an amount not to exceed $200.00 to the Receiver of Taxes to fund such petty cash account, and it is further RESOLVED, that payments from said petty cash account be made and that the Supervisor of this Town be reimbursed for advances made to such account in accordance with_the provisions of Section 64, Subdivision la of the Town Law of the State of New York. Seconded by: Mr. Finnan Roll Call Vote: 5 Ayes The following resolution was offered by Mr. Mills, who moved its adoption. WHEREAS, it has come to the attention of this Town Board of the Town of Wappinger that there are now or may be in the future funds and monies, except proceeds of loans: and monies the investment of which is otherwise provided for by law, belonging, to the Town which are or which may be in excess of the amount re- quired for immediate expenditure to pay current expenses and obli- gations, and WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts in, or certificates of deposit issued by, banks or trtst companies located and authorized to do business in this State, short term obligations of the United States of America - and/or the State ,of New York, and WHEREAS, it appears that the temporary deposit,and/or invest- ment of such excess and surplus funds may be beneficial and profit- able to ,the Town of Wappinger, NOW, THEREFORE, it is hereby RESOLVED, that the duly elected, qualified and acting Super- visor of the Town of Wappinger be and he hereby is authorized, empowered and directed to deposit;.and/ox invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section 11 of the General Municipal Law of the State of New York, and it is further RESOLVED, that such temporary deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section 11 of the General Municipal law of the State of New York, And it is further RESOLVED, that the aforesaid Supervisor of this Town be and he hereby is authorized, empowered and directed to take all steps necessary from time to time to carry out and implement this resolu- tion. Seconded by: Mr. Heady Roll Call Vote: 5 Ayes A resolution setting the salaries for the Assessors and setting an additional amount for the Chairman; appointing 2 Assessors for a= two year term each; and appointing a Chairman was offered for the Board's consideration. The Board saw fit to take preliminary votes on each part.. Mr. Finnan moved the salaries be set at $1,000 each with an addi- tional $5,4.00.00 for the Chairman. Seconded by Mr. Heady. - Motion Unanimously Carried. Mr. Clausen forwarded the name of Kenneth Van Voorhis to be appointed as one of the Assessors. Mr. Mills forwarded the name of Martin LeskoW. RESOLVED, that the annual salaries for the assessors of the Town of Wappinger be and the same hereby are fixed and established at the rate of $.1,000 per year, with the exception that the Chairman of the, Assessors shall receive additional compensation of $5,400. per year, and it is further RESOLVED, that the salaries fixed for the above designated offices and positions shall be paid to the holder of such offices and posi- tions every other Friday throughout the year 1968, with 26 pay periods during such year, with the first pay day to be January 12, 1968, and it is further RESOLVED, that Howard J. Walker and Martin Leskow be and they hereby are appointed to the office of assessor of the Town of Wappin- ger to serve 'in such capacity for a, term _ending on .the 31st day of December, 1969, and it is further RESOLVED, that Martin Leskow be and he hereby is, appointed to the position of Chairman of the Assessors to serve in such capacity throughout the year. 1968 unless his services as Chairman be sooner terminated at the pleasure of the Town Board. _ Seconded by: Mr. Finnan Roll Call Vote: 5 Ayes The following,resc4ution was offered by Mr. Heady who moved its adoption. RESOLVED, that voucher -order checks of the Town of Wappinger may be signed with a facsimile signature of the Supervisor of the Town of Wappinger as reproduced by a mechanical check -signing device or machine provided that the safeguards specified by the manufacturer and inherent in the operations of such device are properly observed, and it is further, RESOLVED, that a certified copy of this resolution be filed with all banking institutions which are depositaries of the monies and funds of the Town of Wappingex., for the purpose of indicating authority for the use of such facsimile signature, and it is further, RESOLVED, that the Supervisor of the Town of Wappinger be and he :is hereby authorized and empowered to takeall steps which may be necessary and proper to acquire a mechanical check -signing device' for:use inconformity with this resolution. RESOLVED, that the following persons be and they hereby are appointed to serve as enforcement officers in and for the Town of Wappinger, Dutchess County, New York, at the pleasure of the Town Board: (1) Donald Synnett (2) Al Berberich (3) Richard Price (4) Dwight Robbins AND IT IS FURTHER RESOLVED, that the aforesaid persons so designated as enforcement officers shall be paid no salary by the Town Board but shall be entitled to collect the statutory fees allowed by law, and it is further, RESOLVED, that the persons so designated as enforcement officers shall be' required to furnish official undertakings, conditioned for the faithful performance of their duties in the amount of $1,000.00 each. RESOLVED, that Eleanor Croshier be and she hereby is appointed to serve as secretary to the Town Justices of the Town of :Wappinger, Dutchess County, New York, at the pleasure of the Town Board, and it is further RESOLVED, that the said secretary to the Town Justices of the Town of Wappinger shall be required to furnish an official undertaking, conditioned for the faithful performance of her duties in the amount of $1,000.00-. RESOLVED, that Joseph Gutmann be and he hereby is appointed to serve as sewer plant operator in and for the Town of Wappinger, Dutchess County, New York, at the pleasure of the Town Board, and it is further RESOLVED, that the annual salary for the sewer plant operator for the Town of Wappinger be and the same hereby is fixed and estab- lished at the rate of $2,600.00 per year, to be paid every other Friday throughout the year 1968, with 26 pay periods during each year:, with the first pay day to be January 12, 1968. Seconded by: Mr. Clausen Roll C411 Vote: 5 Ayes Mr. Mills moved that Mr. Joseph Gutmann be paid $50 a week retro- actively from the time he started the job of sewer plant operator, seconded by Mr. Heady. Motion Unanimously Carried. Mr. Mills moved that a position for an assistant to the sewer plant operator be operated at an annual salary of $2,100 to -be paid every other Friday throughtout 1968 with 26 pay periods during Stich year with -the first payday to be January 12, 1968. Seconded by Mr. Finnan. Motion Unanimously Carried. Mr. Diehl moved that 10 a mile be allowed as town mileage, seconded by Mr. Heady. Motion Unanimously Carried. L Mr. Diehl moved that George Brannen be appointed to fill the vacancy on the Planning Board for a seven year term, seconded by Mr. Clausen. Roll Call Vote: Mr. Clausen, Aye, Mr. Finnan, Nay, Mr. Heady, Nay, Mr. Mills, Nay Mr. Diehl Aye. Motion Defeated. Mr. Heady moved that Charles R. Smith be appointed to fill the vacancy on the Planning Board for a seven year term, seconded by Mr. Finnan. Roll Cali Vote: Mr. Clausen, Nay Mr. Finnan, Aye, Mr, Mills, Aye Mr, Diehl, Nay. Motion Carried. Mr. Heady, Aye, Mr. Mills moved that Dr. Robert Y. Heisler be appointed as Chairman of the Town of Wappinger Planning Board. Seconded by Mr. Finnan. Motion Unanimously Carried. -Mr. Clausen moved Mr. Donald Grossman be appointed to fill the unexpired term of Mr. Mills on the Town of Wappinger Zoning Board of Appeals, seconded by Mr. Diehl. Roll Call Vote: Mr. Clausen, Aye Mr. Finnan, Nay 1i, Mr. Heady, abstain Mr; Mills, Nay Mr. Diehl, Aye. Motion Failed. Mr. Heady moved that Jason Morse be appointed to the Town of Wappinger Zoning Board of Appeals to fill the unexpired term of Mr. Mills, seconded by Mr. Finnan. Roll Call Vote: Mr. Clausen, Nay Mr. Finnan, Aye, Mr. Heady, Aye Mr. Mills, Aye Mr. Diehl, Nay. Motion Carried. Mr. Malls moved that Dorothy Alsdorf be appointed Town Historian, seconded by Mr. Heady. Motion Unanimously Carried. This concluded the reorganization meeting. The Board immediately commenced the Regular business meeting. Mr. Diehl began with setting up committees, comprised of Board members, to function as investigative and Liasson agents. He pointed out that it was already established thatthe' Agenda closed 7 days prior to the meeting., but there would be strict adherance to this, also they would enforce part of the policy,that specifies all persons who request to speak must write the Board stating the problem they wished to be discussed, in detail. There had been some discussion at budget time regarding,a policy to allow a meal allowance for, overtime work for the Highway Dept. Mr. Horton stated he had no policy to forward at this. time, as,.after consideration, he rejected the presented suggestion. Mr. Mills moved the minutes of December 7, 1967 meeting be accepted as submitted by -the Town Clerk and hereby approved, seconded by Mr. Heady. Permisdion was requested by the Chairman of the Board of Assessors that Gladys Timbo, Clerk to the Board of Assessors be given permission to attend the annual conference on Assessment Administration in Syracuse, Jan. 14 thru Jan. 17, 1968. Mr. Clausen moved that Mrs. Timbo be granted permission to attend and her reasonable expenses be a legitimate Town charge. Seconded by Mr. Finnan. Motion Unanimously Carried. [ Communications from tbe Associations of Towns had been received regarding the annual meeting in February. Mr. Diehl moved that Mr. Clausen be appointed representative to the Association of Towns Annual Meeting, seconded by Mr. Mills. Roll Call Vote: Mr. Clausen, abstain, Messrs. Finnan, Heady, Mills Diehl voting Aye. Motion Carried. Mr. Heady moved that Mr. Mills be appointed as Alternate, and that permission be granted all Town officials and appointed employees who wished to attend the Association of Towns meeting February 5, 6, 7, 1968 in New York City and their expenses be a town charge. Seconded by Mr. Finnan. Mr. Mills abstained, Messrs. Clausen, Finnan, Heady, Diehl voting Aye. Motion Carried. Bids had beef received Nov. 30, 1967 and Dec. 7, 1967 for two Material Spreaders and two Snow Plows for the Highway. The prior Board had accepted these bids on condition that they be accepted by the new Board and new Superintendent of Highways. Inc. $ 5,998.00 Dec. 6, 1967 Snow Plow equipment for two trucks Hudson River Sales Corp. 8,915.00 (Letters had been received from both low bidders that they accepted the action of the Board and that their bids would remain, as submitted, until Jan. 30th, 1968). Mr. Horton, Superintendent of Highways recommended that both low bids be accepted. Mr. Mills moved that Ralph C. Herman Co. Inc. bid for 2 Material Spreaders @ $5,998.00 and the bid of Hudson River Sales Corp. for 2 Snow plows @ $8,915.00 be accepted, as recommended by the H.gbway Superintendent, seconded by Mr. Finnan. Motion Unanimously Carried. Mr. Diehl asked if any of the Board members had any other business they wished discussed. Mr. Mills said he had been contacted by Mr. Nils Andersson about the problem of a lack of a name for that section of Myers Corners Rd. which was by-passed by the reconstruction of this road. This was referred to the Highway Committee to submit a name for this road, and also referred to Mr. Horton to ascertain whether the County had officially turned this road over to the Town.
