1967-08-08 SPMA Special Meeting of the Town Board of the Town of Wappinger was held at the
Town Hall, Mill Street, Wappingers Falls, New York, on Tuesday, August 8, 1967.
The meeting was called to order at 3:06 P.M..

Mr. Fulton wanted verification from the clerk that notices were sent out to all
members for this meeting. She replied that they were sent out August 4, Friday,
in the afternoon mail.
The first item of business was a telegram which read:

As you know, your town is eligible to sell State Lottery Tickets. New
proceeds go to education with 36-2/3 cents of every dollar ticket sold returned
to localities for educational purposes. It is important that every community in
the state support this revenue program and that every ticket outlet available under
the law .be utiliz-ed. I urge you to apply for a license to sell lottery tickets by
night letter to Ernest T. Bird, Director, Division of the Lottery, Building No. 9,
State Campus, Albany, New York or by Phoning him Collect at area code 518—GIL-7-2497.
Licensed outlet agents receive 5 cents for each ticket sold.

Mr. Fulton: I didn't act on this as I wanted the Board's -opinion. Is it the
Board's pleasure that we get a license and sell lottery tickets? What other agencys
sell them in this area, does the post office?
Mr. Bulger: The bank next door' does.
Mr. Fulton: As I understand from reading some literature tha general feeling is

the whole program hasn't been given a fair shake. Many pla4es haven't taken their
licenses out.
Mr. Bulger: The program is established and is designed for one of the sources for
the Budget this year and since this Town can receive an income by being an agent for
these tickets since the lottery has been approved by the people in a referendum, I
would therefore move that this Town take advantage of the ()filer from Mr. Murphy and
avail itself the opportunity of becoming an agent for the sale of State Lottery
Tickets.

RESOLUTION NO. 36, 1967
RESOLUTION, TOWN BOARD, TOWN
OF WAPPINGER, DUTCHESS COUNTY,
NEW YORK, DETERMINING THAT THE OFFICE
OF RECEIVER OF TAXES AND ASSESSMENTS
IN THE TOWN OF WAPPINGER,'DUTCHESS
COUNTY, NEW YORK, SHALL BE AN
APPOINTIVE OFFICE.
The following resolution was offered by Mr. Fulton who moved its adoption:
- WHEREAS, this Town Board heretofore passed a resoltuion adopting a propos-
ition changing the classification of the Town of Wappinger, Dutchess County,
New York, from that of a Town of the second class to that of a Town of the First
Class, and
'WHEREAS, such proposition was submitted to the qualified electors of the
Town of Wappinger for approval at a special election held on the 8th day of
November, 1966, and
WHEREAS, such proposition was adopted by a majority of the qualified
electors of theiTown of Wappinger voting thereon at said election, and
WHEREAS, any Town, which shall have determined to become a.Town of the
first class, is empowered to determine that the office of receiver Of taxes
and assessments shall be an appointive rather than an elective office in such
Town, provided that such Town shall adopt a resolution, subject to a permiss-
ive referendum pursuant to section 12 (4) (f) of the Town Law, and
WHEREAS, It appears that the. inteRests of ?the Town of Wappinger will be
best served by the appointment of a receiver of taxes and assessments,
NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wapp-
inger as follows:
1. That the office of receiver of taxes and assessments in the Town
of Wappinger shall be an appointive office.
2. That on or after the first day of January, 1968, the effective date
of the change of classification of the Town of Wappinger from that of a
town of the second class to that of a town of the first class, this
board shall appoint a receiver of taxes and assessments who shall take
and hold office for a term of four years.
3. That the Town Clerk of the Town of Wappinger be and she hereby is
authorized, empowered and directed to post and publish a notice of the
adoption of this resolution within ten (10) days after the date. of
adoption of the same In the manner and in the form required by section
90 of the Town Law.

AUT IORIZING THE BORROWING OF

$64,950.00 IN ANTICIPATION OF THE
COLLECTION AND RECEIPT OF REVENUE
FROM THE STATE OF NEW YORK IN THE
FORM OF STATE AID, MORTGAGE TAX
DURING THE CURRENT FISCAL YEAR,
AND THE ISSUANCE OF A REVENUE ANTIC-
IPATION NOTE IN THAT AMOUNT.
The following resolution was offered by Mr. Fulton who moved its adoption:
WHEREAS, in preparing the annual budget for the fiscal year 1967, the Town
Board of the Town of Wappinger did reasonably estimate that it would collect and
receive from the State of New York revenue in the form of state aid, mortgage tax,
in the amount of $75,000.00, and
WHEREAS, the amount of such revenue received to date by the Town of Wappinger
amounts to the sum of $11,050.00, and the amount of $64,950.00 remains unpaid and
uncollected, and
WHEREAS, it is necessary for the Town Board of the Town of Wappinger to borrow
at this time the sum of $64,950.00 in anticipation of the collection and receipt of
state aid, mortgage tax, to pay the ourrent expenses of the Town for thb current
fiscal year,
IT IS HEREBY RESOLVED, by the Town Board of the Town of Wappinger, as follows:
Section 1. That the Town Board of the Town of Wappinger borrow upon the
the faith and credit of the Town of Wappinger the sum of. $64,950.00 in ant—
icipation of monies to be paid to said Town by the State of New York for State
aid, mortgage tax, for the fiscal year beginning January 1, 1967 and ending
December 31, 1967, in accordance with the provisions of Section 25.00 of the
Local Finance Law of the State of New York.
Section 2. That such borrwing be financed by the issuance of a revenue
anticipation note in the principal sum of $64,950.00, which note in such
amount is hereby authorized,f pursuant to the provisions of the Local Finance
Law. That such note shall' be payable from amounts which shall be levied annually
on all of the taxable real property in said Town. That such note shall be of
such terms, form and content as the Supervisor of the Town of Wappinger shall
prescribe. That such note shall have a maturity date of not more than one (1)
year to be measured from the date ofissuance thereof.
Section 3. The full faith and credit of said Town are hereby pledged to the
payment of the principal of said note and the interest thereon when due.
Section 4'. The Supervisor of the Town of Wappinger is hereby empowered and
directed to authorize the issuance of and to issue said revenue anticipation
note and renewals of such note at such times and under such circumstances as he
deems proper and advisable, and to prescribe the terms,.form and content thereof,
and to execute the same in the name of and on behalf of this Town and to sell
the same at° public or at private sale and to deliver the same; and the full
faith and credit of this Town are .hereby pledged to.the payment of the principal
of and interest on all notes issued pursuant to this resolution by said Super—
visor; all in pursuance of and consistent with the provisions of the Local
Finance Law of the State of New York.
Section 5. The validity of the notes hereby authorized may be contested
on I y i f '(1) 'such obligations are au thor i zed-ifor . an object or purpose for which
said Town is not authorized to expend money, or (2) the provisions of law which
should be complied with at the date of publication of this resolution are not
substantially compli'ed°wit°h, :and }an ect°ion,'suit or proceeding contesting such
validity is commenced wi thin 'twenty (20)' days after the date of such publication,
(3) such obligations are authorized in violation of the provisions of the Con—
stitution. .
Section 6. This resolution shall be published in full in ..the..W. & S. D.
News, a newspaper regularly published in- the -Town of Wappinger, Dutchess County,
New York,together with a notice° by the Clerk of this Townin substantially the
form required by and provided in Section 81.00 of the Local Finance Law of the
State of New York.
Section 1, This resolution shall take effect immediately.

YEAR, AND THE ISSUANCE OF A TAX AN—
TICIPATION NOTE IN THAT AMOUNT.
The following resolution was offered by Mr. Fulton who moved its adoption:
WHEREAS, of the total amount of taxes levied by the Town of Wappinger for
the current fiscal year, the sum of 41 1,300.00 thereof remains unpaid and un—
collected, and,
WHEREAS, it is necessary at this time for the Town Board of the Town of
Wappinger to borrow the sum of $11,300.00 in anticipation of the collection and
receipt of the aforesaid unpaid taxes in order to pay current expenses of the
Town for the present fiscal year, it is hereby
RESOLVED, by the Town Board of the Town of Wappinger as follows:
Section 1. That the Town Board of the Town of Wappinger borrow upon
the faith and credit of the Town of Wappinger the sum of ,$11,300.00 in
anticipation of monies to be collected by and paid to said Town'for un—
paid taxes for the fiscal year beginning January 1, 1967 and ending Dec—
ember 31, 1967, in accordance with the provisions of Section 24.00 of the
Local Finance Law of the State of New York.
Section 2. That such borrowing be financed by the issuance of a tax
anticipation note in the principal sum of $11,300.00, which note in such
amount is hereby authorized, pursuant to the provisions of the Local Fin—
ance Law. That such note shall be payable from amounts which shall be
levied annually on all of the taxable real property in said Town. That

Town of Wappinger shall prescribe. That such note shall have a maturity
