The Regular Meeting of the Town Board of the Town of Wappinger was held
on Thursday, May 4, 1967, at the Town Hall, Mill Street, Wappingers Falls,
New York.
The meeting was called to order at 7:57 P.M.
Members Present:
Joseph Fulton, Supervisor William Bulger, Justice of Peace
Vincent Francese, Justice of Peace Louis Clausen, Councilman

Motion made by Mr. Francese, seconded by Mr. Bulger to accept minutes of
March 9, 1967, Regular, April 9, Reg. March 30, Special, March 31, Adj.
A request was received from Jack Leibowitz and Kenneth Bray for a
Special Permit to excavate for a Lake (Map accompanied request.) The
location of the proposed lake is on the Parkhurst property, Robinson Lane.
Mr. Francese recommended it be referred to the Planning Board.
Mr. Quinn pointed out that this was a matter within the province of the
Town Board.
Request for special permit referred to Planning Board, ;Counsel and
Engineer to the Town.
A request was received from Spoor-Lasher for the return of their $1,000
bid check.
Knud Clausen recommended the Bid Bond Check be returned. Mr. Bulger
made a motion to return the $1,000 Bid Bond to Spoor-Lasher Co. Inc.
Seconded by Mr. Francese, Unanimously Carried.
Mr. Arthur Bisom had requested to be on the agenda to discuss the
problem of non -conforming businesses. He reiterated his position as an
owner of a business in a residential area. He would be satisfied
continuing as a hon -conforming business if the Board would just see fit
to grant him relief by allowing him to expand. Mr. Fulton pointed out
that this was something that had to be done carefully, and much effort
had already been put into it. Mr. Bisom said he had recommended to the
Chairman of the Planning Board that the amendments Fishkill had made be
looked into, and he also mentioned the list of non -conforming businesses
(on file in the Building Inspectors Office) which Mr. Fulton had showed

him which he agreed with 100%.
At this point Mr. Diehl requested that the following letter be read:

SUBJECT: Non -conforming uses
The purpose of this memorandum is to insure no misunderstanding
between the Planning Board and the Town Board on the issue of non-
conforming uses.
For some time, the Town Board has indicated an interest in a
change in the prjesent Zoning Ordinance as it pertains to non -conforming
uses. The Planning Board has attempted to draft changes to reflect the
intent of your Board. Thus far, their attempts have not been satisfac-
tory.
In an atterr{pt to better understand your Board's objectives, we
agreed to a joint executive meeting of the two boards. This meeting
was held on Mardh 20, but unfortunately only a small percentage of the
Town Board was present for most of the meeting. The subject was dis-
cussed for several hours, including comments from Mr. Ornstein, our
Planning Consultant, and Mr. Reilly, the Town's Attorney.
Although many items, concerns, and alternatives were discussed, no
clear direction came from this meeting. It remains the task of your
Board to determine what course of action, if any, will be pursued.
The Planning Board knows of no further assistance it can provide at
this time.
The Planning Board stands ready to assist you when a clear direc-
tion has been established.

Town of Wappinger Planning Board
Mr. Diehl said as he remembered the meeting, referred to in the
preceding letter, there were 4 Board members present and it was a clear
cut decision that the Town Board wanted to grant relief. There was
no question in his mind as to what direction the Board wanted to take.
Mr. Fulton interjected that when he left that meeting he was under the
impression the Planning Consultants were going to come up with some
answers.
Mr. Diehl said the Town Board took an informal vote and were in
favor of granting some kind of relief, and that the Planning Board

would work with the consultants to formulate some recommendations 7
for the Town Board consideration.
Mr. Bulger expressed surprise at an apparent Clack of communication
(referring again to the preceding letter) as he was under the impres-
sion the Planning Board & consultant were going to attempt to work
up a proposal. It was Mr. Reilly's recollection also that the
Consultant said he would draw up a proposed amendment to be presented
to both Boards.
Mr. Clausen disagreed that there was cognizance on the part of 2
of the 4 attending Board members as to all that was discussed at
that meeting. He agreed a vote was taken and it was the direction
of the Board to more or less see what the consultant could come up
with, but that there was no clear understanding what the Town Board
wanted and what the Planning Board was going to do.
Mr. Ludewignpointed out that some time ago the Town Board had asked
the Planning Board for recommendations for seeking relief. These
recommendations were never acted on.
Mr. Diehl moved that the Supervisor direct a letter to the Planning
Board, and call another meeting, to be held in the near future, to
follow through on what was done the last time, and direct the Planning
Board to seek relief for non -conforming uses. Also, inquire as to
whether the Consultants are working on a recommendation for non-
conforming uses. Seconded by Mr. Francese. Unanimously Carried.
Mr. Clausen wanted to go on record as supporting and agreeing with
the Planning Boards original recommendation and the Consultants on
the proposal they had on allowing them to rezone commercial properties
and not allow non -conforming uses, as such, to expand. He agreed
with their recommendation.
A letter was received from Nathaniel Rubin, attorney for Rufus Rawls
(owner of Roberts Mobile Park) citing certain flooding conditions to
Mr. Razl's property and requesting the Town take action to alleviate
this condition. Mr. Rawls was informed by Mr. Fulton that the matter
had already been placed in the hands of the Attorney, Engineer and
Highway Superintendent, and action taken on their dparts.
Mr. Lapar said that it was a situation where a small amount of work

may conceivably alleviate the situation.
Mr. Diehl asked if anything had come up on the water problems
referred to in letters received from Harold Ingalls (Wheeler Hill) and
John A. Wolf, Attorney representing Leonard Robbins (Kretch Circle).
Mr. Lapar reported that last fall the Highway Superintendent, former
Town Engineer, Developer, and builder got together and agreed on
certain things to do. Mr. Gallo would extend the piping, Mr.
Clausen would put in catch basin, and Mr. Raker would build a swale.
He said letters had gone out today to Mr. Gallo (to put in pipe as
soon as possible,) K. Clausen (to put in catch basin) and Mr. Raker
(who is on record, as of April 13, as wanting to put in a swale.)
Mr. Diehl objected to the wording "as soon as possible", he felt
the direction should be firm - the ideawas that the Town wanted the
job done:
A letter was received from E.C.C. informing the Board of a problem
being encountered by the Rockingham Farm Sewer Plant i.e. water
infiltration in the collection system. They feel this matter should
be investigated, and corrective measures taken this summer to
eliminate the problem.
Mr. Quinn stated he had attended a meeting with engineers from the
Dutchess County Health Dept. N.Y. State Health Dept. and the RRecking-
ham Farm District, on general matters relating to Rockingham, and he
noted that steps have been taken, and are in progress, to correct
infiltration, and felt it was under supervision and control.
Mr. Clausen asked about the land in back of the sewer plant = the
land dedicated to the Town as recreational area - which appeared to
be under water - was this a normal or abnormal situation. Mr. Lapar
answered that that area would be in a flood plain and that situa-
tion could exist, but the plant was designed to keep it mut of
flood levels. Mr. Clausen then commented that it looked like the
developer had stripped the topsoil from what would be the Recreation
Area, and asked if there was anything the Town could do to assure
the developer would regrade the playground so that it wouldnit have
to be done by the Town. Mr. Lapar said he didn't think that the

Planning Board had been that specific.
The redevelopment of the Recreation Area by the developer was referred
to the Engineer to the District and the Clerk was instructed to write
ECC telling them that the Board has been advised that the Engineer to
the District is working on the problem.
A request was received from Joseph Keegan, Supt. of the Wappinger Central
School District, to borrow 6 voting machines for June 21st.
Motion was -made by Mr. Diehl to grant permission to Mr. Keegan -for the
use of 6 voting machines, seconded by Mr. Bulger. Unanimously -Carried.
A request was received by the Village of Wappingers Falls for the use
of the Town Hall for a Jury Trial May 10th. Mr. Diehl made a motion
to grant permission to the Village for use of the Town Hall May 10th,
Seconded by Mr. Bulger. Unanimously Carried.
The following letter was received from the Planning Board:

Gentlemen:
The Town of Wappinger Planning Board, at its April 17, 1967
meeting, reviewed the petitiohn of N&S Supply Corpl, Iva D. Nussbickel,
Paul Nussbickel, Paul Nussbickel, John Nussbickel, Norman Nussbickel,
Wilbur Nussbickel, and Herbert Nussbickel, for the rezoning of the
portion of their property which is presently zoned residential and
which fronts on realigned Route 9, from "R-20, One Family Residential
District, and/or R-40, One Family Residential District, to GB, General
Business Districtd" (NOTE: The zone referred to in the petititon as
"R-20" is actually an RD -20 zone.) Said petition was referred to them
by your Board on April 6, 1967. •
The Planning Board recommends that this application be reject-
ed without prejudice.
Due to the realignment of Route 9, the Planning Board is present-
ly reviewing the entire Route 9 zoning, with the Planning Consultants,
for possible changes. The property in question in the above petition
is inclluded in this review and is presently under consideration for
possible recommended zoning change.
Therefore, the planning Board feels that it is inappropriate
to consider this, or any other petitions for rezoning of individual
Route 9 properties, since the anticipated recommendation will in-
clude the zoning of the entire Route 9 within the Town of Wappinger.

Mr. Bulger made a motion that the bills be paid, subject to audit,

Reports from the Building Inspector, Supervisor and Justices of the
Peace were received and ordered placed on file.
Mr. Francese - report on the roof of the Town Building. He said
Mr. Lapar had received several bids for repairs.

SUBJECT: Repair of Town Hall Roof
Gentlemen:
At your request, I have obtained informal bids for the repair
of the Town Hall roof.
The results of the bids are as follows:

I, therefore, recommend that the contract be given to the low
bidder, H. (MOnk) Mannain.
Breakdowns of the work to be done and rhe cost of each item are
available upon request.

Engineer to the Town of Wappinger
Mr. Diehl asked that the Masonic Sign be removed from the roof at the
same time repairs are being made, as the Village Zoning Administrator
has indicated it is in violation of a Village Ordinance.
Mr. Lapar said it was not included in the bid but that it could be
included under removal of debris.
Mr. Francese asked if the figures received were fbr the entire project,
and Mr. Lapar confirmed that the bids included both materials and
labor, and also the job carries a 15 yr. guarantee bond.
Mr. Francese moved that the Town contract with H. (Monk) Mannain, the
low bid for $1,480.00 for the repair of the Town Hall roof. Seconded
by Mr. Clausen. Unanimously Carried.
Mr. Francese asked for an executive meeting with the Board at some
near future date. He stated that he would like to talk to the
other members of the Board about certain ideas that he and Mr. Bulger
had on the c ►rk to be done on the inside of the building after the
roof is completed and see what -path the Board would like to take.
Mr. Fulton said he would arrange a meeting sometime when it was
convenient for all the members.
Report from Mr. Diehl and Mr. Clausen on thier attendance at the
Village of Wappingers Falls Public Hearing - April 14th - on the
Zoning Ordinances affecting the lake. -Mr. Diehl said the purpose
of the hearing was to end the zoning that previously affected the Lake.
Various topics came up regarding the Lake, and one point he and Mr.
Clausen stressed was that an equal recreation area be allowed in the
Town - that is to say not to restrict the Town from being able to
do the same things the Village couldedo. He felt confident that
there would be an acceptable agreement reached. Mr. Clausen asked Mr.
Quinn if the Town wants to improve a recreation area alongside the
lake, and, say, the recreation commission wants to float a raft,
would the Village have jurisdiction over this.
Mr. Quinn -said he wasn*t too familiar with their title but the Town
may be able to solve whatever problem that might exist, as, the
Village has requested a tax exepption on some portions of this land,
and as the real property tax law permits this municipality to enter
into an agreement to grant such an exemption, any future agreement
might secure type of rights being referred to here, and others.
Mr. Bulger reported on the request of Tall Trees residents for street 1
lights, that had been referred to the Light Committee. He said he had
met with Mr. Ganci, of Central Hudson, toured the area, and picked
several likely locations and discussed them with Mr. Diehl. Mr.
Ganci is in the process of preparing the necessary documents, and
will be presented to the Board in the near future.
Mr. Fulton asked the light committee if there was anything on his
request to look into -a request from a woman on Curry Rd. fdr a
street light. Mr. Bulger said he and Mr. Diehl had been down in
that area several -times but were not clear as to the exact location.
He asked Mr. Fulton for a copy of the letter to aid them in their
investigation.
Montclair Apts. requested a street light at the intersection of
their entrance and. Route 9D. Request referred to the Light Committee.
A discussion was held between Mr. Clausen ,and Mr. Fulton as to the
future of the Sanitary Landfill Committee. Mr. Fulton said there
would be a meeting on the 15th of May, after which time a more defini
ite report would be made. He also_asked if the Board wished to
make any recommendations to be forwarded on to the Landfill
Committee, at this point. The members felt they would wait for
a more comprehensive report, and what the intent of the other
towns are.
Mr. Clausen asked if Mr. Fulton would furnish the Board with a
financial report - from the inception to present - on what the Town
has spent on the Sanitary Landfill.
Further discussion continued between Mr. Clausen and Mr. Fulton re-
garding the Towns' position with relation to the garbage pickup,
what would constitute an emergency, w.ould74the State. arnal County
Boards of Health ascertain an emergency, and what courses of action
could be taken to prevent this situation from arising.
Mr. Diehl mentioned he had read where some official from Fishkill
had two possible sites for garbage disposal, and recommended that
this should certainly be kept in mind.
Local Law #2 -
Members had received copies several weeks prior to this meeting -
another Public Hearing would be required, as there had been mator
alterations on it after the first presentation to the Board.
Mr. Diehl stated he hed received a copy of the proposed Local Law, and
although he_felt the Board was heading in the right direction, he
would like to recommend a committee be set up to take this Law and rip
it apart, reconstruct it, make it better, find out what's wrong, what's
good with it, and bring it before the Public, to let them know
exactly what it is. This committee, he feels, should act as a Public
Relations Committee, an advisory committee to bring these things forth.
His opinion was that it should come to a Public Hearing at this time,
as he doesn't believe that the Public has been informed.
A slight controversy arose between Mr. Diehl and Mr. Fulton dealing
with the subject of appointing committees, Mr. Fulton pointing out
that he had suggested last year appointing citizens committees, whereas
Mr. Diehl contended there was a difference, the recommendation here was
that the committees be responsible to the Board, not to the Supervisor.
On further pursuit of the subject, Mr. Clausen feat a committee
did have merit and recommended the same course of appointing as had
been done with the first class Town Committee, i.e. each member sub-
mit one name. Mr. Francese felt that on the whole the Law had been
presented very well, but did think Mr. Diehl's suggestion might be a
good one. Mr. Bulger had no objection, but he felt it should be
pointed out to the people serving on the committee that the Board
would like a report in a certain period of time - as this law in in
the nature of one of the statutes that is really needed - he doesn't
think a considerable amount of time should go by before the Board
is in a position to propose such a Law.
Mr. Diehl made a motion that each Board member recommend -a represent-
ative to serve on a Citizens Committee to study the Local Law on
Water Systems. Mr. Diehl made a motion to establish a citizens
committee to study the proposed Local Law #2, and that each Board
member will submit their nominations by next Thursday (May lrth), and
that a sixty day time limit be set for this committee to report to
the Town Board. Seconded by Mt. Clausen. Unanimously Carried.

The following resolution was proposed for adoption by Mr. Diehl:
RESOLUTION NO. 30, 1967
RESOLUTION, TOWN BOARD, TOWN
OF WAPPINGER, DUTCHESS COUNTY,
NEW YORK, FIXING THE TIME AND
PLACE FOR PUBLIC HEARING TO
CONSIDER THE APPLICATION OF
HIGHWAY DISPLAYS, INC. FOR A
PERMIT TO USE THE STREETS,
HIGHWAYS AND PUBLIC PLACES OF
THE TOWN OF WAPPINGER FOR IN-
.STALLATION AND OPERATION OF A
COMMUNITY ANTENNA TELEVISION
SYSTEM, AND FURTHER TO CONSIDER
A PROPOSED AGREEMENT RELATING
THERETO.
WHEREAS, Highway Displays, Inc. has heretofore made'application
to the Town Board of the Town of Wappinger seeking to obtain a per-
mit to use the streets, highways and public places of the Town, ex-
clusive of the area of the Town situate within the corporate limits
of the Village of'Wappingers Falls, for the purpose of installing,
operating and maintaining a community antenna television system to
furnish television service to the residents of the Town by means of
a master antenna cable system, and
WHEREAS, this Town Board has heretofore authorized the Super-
visor, with the assistance of counsel, to negotiate an agreement
with said applicant relating to the terms and conditions upon which
the subject permit might be granted, and
WWEREAS, a draft of proposed agreement has been prepared -as a
result of negotiations conducted by the Supervisor pursuant to the
aforesaid autorization and such agreement has been submitted to this
Town Board for consideration, and
WHEREAS, the provisions of Town Law section 64 (7) require that
no permit or consent for use of the streets, highways and public
places of the Town or any part thereof shall be granted by the
legislative body of the Town until a public hearing thereon Teas
been held before such body,
NOW, THEREFORE, be it resolved as follows:
1. That a public hearing to consider the aforesaid application
of Highway Displays, Inc. and the agreement prepared in'connection
therewith shall be held by the Town Board of the Town of Wappinger
on the 25th day of 'May, 1967, at 8:00 o'clock P.M., EDST on such
day, at the Town Hall, Mill Street, in the Village of Wappingers
Fails, Town of Wappinger; Dutchess County, New York.
2, That at least ten (10) days notice of such hearing shall
be given by the Town ' 'Clerk ' of the Town of Wappinger by the due
posting thereof upon the bulletin board maintained by said Town
Clerk in the Town Hall and publishing such notice at least once in the
official newspaper of the Town of Wappinger.
Seconded by: Justice of the Peace Bulger. Unanimously Carried.
Mr. Bulger referred back to the previous motion on the establishment
of a citizens committee - suggesting that July 6th be the deadline
for the committee to report to the Board. The Board was in full
agreement as to accepting this for the due date of the report.
The following resolution was proposed by Mr. Diehl for adoption:
WHEREAS, the proposed eleven year Road Program for the Town
of Wappingers will provide a means of correcting existing road
problems, and
WHEREAS, correction of such road conditions will serve the
public interest by increasing public safety, and
WHEREAS, this program has 'been available for consideration and
study for many months it is hereby,
RESOLVED,
1. That the engineering and technical recommendations of this
plan be adopted, effective 'immediately;
2. That the recommended financing and implementation schedules
be updated and revised to reflect changes that have occured in the
bond market or other areas since the plan was first proposed. Such
updating and revision shall maintain the original flexibility of the
plan, as regards financing and implementation, to effect the great-
est possible economies in bond issuance and construction schedules;
3. That, in acdoedance with program prerequisites itemized on
pages 4 and 5 of the subject plan, the town attorney, the town

engineer and the toqn superintendent of highways are hereby requested
to expedite and complete, at the earliest possible date, the engineer-
ing surveys and acquisition of reghts df way required to implement
the plan. A definite schedule to complete said surveys and acquisitions
shall be prepared by the town attorney, the town engineer and the
town superintendent of highways and submitted to the members of the
Town Board not later than the next regular monthly meeting of the
Town Board. Such schedule shall identify any problem areas in such survey
and acquisitions and shall recommend necessary corrective action.
4. That, the Planning Board be immediately advised of the
adoption of this plan with a request to aid in implementation of this
plan as prescribed on page 5 and elsewhere. To enable the Planning
Board to meet its responsibilities in this instances, copies of
this plan along with a copy of this resolution shall be immediately
forwarded to each member of the Planning Board.
Seconded by: Councilman Clausen Unanimously Carried
Ten minute recess called 10:07 P.M. Meeting called back to order 10:35
P.M.
Mr. Fulton - referring to the Ardmore Hills development roads. A
report from Mr. Lapar had been requested by the Supervisor on the
condition of these roads.
The following report was presented to the Board:
REPORT TO: Town Board, Town of Wappinger
FROM: Rudolph E. Lapar, Engineer of the Town
DATE: April 13,1967
SUBJECT:. Estimated Cost of Rebuilding Eck Development Roads (which
includes the following roads: Eck Road, Marlyn Drive,
Michael Drive, Lydia Drive, Peter Drive and Ada Drive)
On Saturday, April 8, 1967, Mr. Joe Fulton, Supervisor, Mr.
Knud Clausen, Superintendent of Highways, Mr. Ken Croshier, Foreman,
Rudy Lapar, Engineer of the Town, and a committee of several residents
met and examined the condition of the road s in the Eck Development.
At that time, it was decided that I should work up an estimated
cost to rebuild the roads. The estimate is as follows:
Subgrade $7,400
Foundation Course 18,500
Double S . T 18,500
Drainage 30.400
Total Construction Cost...$74,800
If Town forces are used, it is estimated that between 20% and
30% of the above cost can be saved. However, it should be pointed
out that this entire project would easily take the full time of the
Town Highway Department, and all other projects, and possibly even
ordinary operations of the department would be impaired.
It is therefore, my recommendation that if the monies are not
available at this time for the entire project, that at least the
drainage should be installed, and the reconstruction of the road at
a later time.
I also recommend that any work done should be done by a private
contractor.
Discussion followed on the best way to attempt permanent repairs of
these roads. Mr. K. Clausen recommended that $15,000.00 be provided
by the Board for Eck development, to fix Eck, Michael and Ada Drives.
Mr. Fulton made a motion to accept Mr. K. Clausen's recommendation
and that we proceed to work out a plan for the expenditure of money
there for the drainage and ask attorney to the Town to draw up
the necessary resolutions to bring forth this tax anticipation note.
Seconded by Mr. Diehl.
Mr. Fulton withdrew the prior motion of accepting the Highway Supt's
recommendation and Mr. Diehl withdrew his second to - that motion.
Mr. Fulton made a motion to authorize the Engineer to the Town and
the Attorney to the "Town to draw up and publish specifications for
improvements for a portion of roads within the Ardmore Hills develop
ment, not to exceed $15,000.00 and for the Attorney to the Town to
draw up a resolution for compliance to the Bidding Statute.
Seconded by Mr. Bulger. Unanimously Carried.
Mr. Diehl made a motion to have a citizens committee appointed to
study the 11 year road program. Working on the same basis as the
Local Law committee, each Board member again would appoint one man,
and this committee would act as a public relations committee, an
advisory committee to the public, formulating,indormation received from
the Engineer deo the Town and Highway Supt. to inform the Public
again as to exactly what is going on and this information to be
formulated before tiny Public Hearing would be held. Seconded by Mr.
Fulton. Unanimously Carried.

On April 18, 1967, I met with Mr. Knud Clausen, Superintendent
of Highways, and Mr. Ken Croshier, his assistant. It was proposed
at that time that the bond issue be floated to include the following
projects:

Drainage
3" Asphalt Concrete Pavement
River Road North
Drainage
3" Asphalt Concrete Pavement
Kent Road & Cedar Hill Road

These monies will be used during a period of approxmimately
two (2) years.

Engineer to the Town of Wappinger
After hearing Mr. Lapars report, the thought crossed Mr. Fulton's
mind that along with -the -updating of -the -roads specified in the 11
year -road program that -a similar plan -could -be devised to update
the development roads.
Mr. Fulton made a motion that Mr. Lapar also devise a general plan,
in cooperation with Mr. K. Clausen, that would schedule the updating
of- all those roads other than those encompassed by the 11 year road
program. Seconded by Mr. Diehl. Unanimously Carried.
Mr. Clausen asked that the Board act on Mr. Lapar's report so that
counsel could get the necessary mechanics going for a referendum.
Discussion ensued over the fact that a committee had just been author-
ized to be established to study the 11 year road program. Mr. Fulton
felt that this report was the type of thing that would ordinarily
be turned over to such a committee not being precluded by a Board
vote. At this point it was reiterated that the two committees were
simply established basicly as publicly functions, that they would
have no administrative function and Mr. Clausen pointed out that
as such they wouldn't be looking for new proposals. He felt the
Board was delaying action. It was determined that if action was
delayed until July there would still be ample time to prepare for
referendum.
Mr. Lapar's report was accepted and placed on file.
Highway Bids -
Readvertised Bids, opened April 14th were discussed. The Board had
not received copies, so by mutual agreement the bids were held for
Thursday, May llth, at 8 P.M. (1967)
Mr. Francese directed the Attorney to the Town to draw up a proposed
ordinance for the regulation of hours at any recreation site within
the Town and include any control of vehicles regulating hours, and
suggest a "safety valve" that the -Recreation site may be used after
dark for camping and Boy Scout activities, etc. by special permission.
Bids for Recreation Building that were received and opened April 17th
were presented,as follows:

Ninnie Construction Corp. 14,185.00
Ferrari & Sons 15,100.00
The Recreation Commission recommends the Board accept the low bid
from Ifill Enterprises, Inc..
Recess called 11:55 P.M., called back to order 12:06 A.M..
Mr. Francese made a motion to accept the low bid for $12,547.00
submitted_by Ifill Enterprises,, Inc. and authorize the Attorney
to the Town to prepare a Bond Resolution, and it understood _
that any award of contract on this will be subject to no litigation
after the estoppal notice. Seconded by Mr. Bulger, Unanimously
Carried.
Mr. Clausen said he would like to see the road specs upgraded (those
adopted March 4, 1965) and would like to make a resolution accomp-
lishing this, - it had been in the discussion stage too long.
Mr. Clausen made a motion that the Town Board empower the Attorney
to the Town to draw up a resolution stating that in the future all
developers should install roads up to the last specification -
which is the final Blacktop - before any Building Permits are issued.
Mr. Clausen clarified his motion indicating that he didn't want to
get into the legal resolution, he just wanted the Board to empower
counsel to draw up a resolution whereby it would state the intent
of future developers having to put in the road specs as of March 4,
1965 with the exception of the final specification, that of the
Blacktop - before Building Permits are issued. He would like it
to become effective tonight and the Planning Board so notified
if, it is passed, they would incorporate this in their mandatory
regulations.
The ensuing discussion brought out that it couldn't become effective
tonight, as notice would have to be given, public hearing held, rev-
ision of specifications, etc..

Mr. Clausen reworded the motion, and moved that the Town Board adopt
this resolution and refer it to Engineer to the Town and Highway Supt.
for recommendation, whereby the developers would have to install all
of the road specifications under the March 4, 1965 specs. with the
exception of final surface before any Building Permits are issued,
subject to the Engineer to the Town and Highway Supt. inspectiiin and
acceptance.
Seconded by Mr. Diehl. Unanimously Carried.
Continuing the conversation on the roads, the discussion revolved ar-
ound the pros and cons of what position the developer would be put
in; where the present specs are lacking; how the present required
bonding would be affected, i.e. what requirements of time would be
recommended; and position of the Town in taking over the roads.
Mr. Bulger brought up the fact that the flag in the Town Hall needed
to be cleaned. Referred to Building Committee.

Dear Mr. Fulton:
The Board of Fire Commissioners of New Hackensack Fire District under-
stands that the Town of Wappinger Town Board has received two petitions
asking that the Imperial Plaza area and the Liss Road Area which were
annexed to the Village of Wappingers Falls be excluded from the territ-
orial limits of New Hackensack Fire District. It is our understanding
that the Board of Fire Commissioners has no legal power to influence
in any way the action of the Town Board upon the petitions.
However, the Board of Fire Commissioners would very much like to see
the Town Board adopt the necessary resolutions to exclude this territory
from the Fire District and for several years has actively promoted action'
to so exclude them.
Where the property within these areas is liable for the general Village
tax and in addition is liable for Fire District taxes seems to the
Commissioners to be basically unfair and the present Fire District
liability for fire protection in these areas would also involve some
problems.
We look forward to prompt and favorable action of the Town Board upon
the petitions.

Mx. Reilly pointed out that, as the resolutions now are drafted, there
is a problem that affects the Village and the Fire District, that is
the Fire District is obligated, as is the Village, for the bonded
indebtedness, and that they both will both have to show the oblig-
ation on their debt statements. It doesn't affect the Town, but
there doesn't seem to be a solution for the Fire District and the
Village without legislation.
Resolutions again referred to counsel, with action to be taken at
the May llth meeting.
Mr. Fulton brought forth that the Attorney for the Hughsonville Fire
Co. has drawn up a recommendation for a 3 yr. lease and the Recreation
will handle it.
There is a little piece of land on Fowlerhouse Rd. - about an acre,
triangular shaped - the people down there had contacted Mr. Fulton
asking if the Town would take it over for a little park area. The
understanding is that Mr. Card would give it to the Town. The Super-
visor asked the Board if they would go on record as recommending
referring this to the Recreation Commission for taking it over.
Mr. Bulger moved that this parcel of land be referred to the Rec-
reation Commission and Attorneys to the Town.
A letter was received from Harry Straley, Dog Warden, with regard
to his problems with dogs.
Mr. Fulton stated that he had also been getting calls on dogs. He
asked what the dog warden's duties were with regard to dog problems
in the Village.
Mx. Francese emphatically stated that he could only pick up the dogs -
the Village was responsible for enforcing its own Ordinance.
Mr. Bulger recommended that this be referred to Counsel for reply
to that portion of Mr. Straley's letter dealing with, the duties
of Dog Warden and the enforcement of the Ordinance, in the Village.
Mr. Fulton mentioned the possibility of contracting with the SPCA,
and that he would investigate this possibility further.
