1967-03-30 RGM (adj)The Adjourned Meeting of the Town Board of the Town of Wappinger, was
held on Thursday evening, March 30, 1967, at the Town Hall, Mill Street
Wappingers Falls, New York.

Meeting was called to order by Supervisor Fulton at 7:45 P.M.
Mr. Fulton noted the purpose of the meeting is for setting a date for
the referendum on the Sanitary Landfill. I would like to make a motion
that the date for the referendum be set for the 20th and a resolution
be drawn up by attorneys as soon as possible.
Mr. Francese recommended the polling places be in all of the normal
polling places in the district.
Mrs. Snowden cautioned the Board of the problem of the county vote on
the 17th, which requires the use of 14 of the Towns machines, and they
cannot be cleared for 30 days.

Mr. Bulger; Would it be possible to schedule these two on the same day?
Mr. Quinn said there would be a conflict as to the qualifications of the
voters.
Following some discussion it was recommended that New Hackensack Fire-
house could be used for the Polling Place for 4 districts (6&7, 9&10)
Evans School could be used for 3 districts (part of 344 and 11), Ketcham
High School, Hughsonville firehouse & Chelsea would keep their normal
districts. It was further suggested that the Town buy 2 voting machines,
and rent 2 with the option to buy.
Mr. Fulton said there was enough money in the budget to purchase two
machines and possibly rent four with option to buy, $150 of the rental
fee is applied against the purchase price. Machines cost $1646 - rental
is 10% of the cost ($164 a year) .

Mr. Bulger: I move that for the purpose of a referendum on the sanitary
landfill, this Board establish the date of April 20, 1967, and that the
following election districts vote at the following locations:
At the Evans School those portions of districts 3 and 4 which are out-
side the limits of the Village of Wappingers Falls and all of district 11.
At Ketcham School districts 5 and 8,
At the New Hackensack Firehouse districts 7,6,9, and 10.
At the Hughsonville Firehouse districts 12 and 13.
At the Chelsea Firehouse district 14.
The hours that the polling places will be open will be from 8 am to 8 pm.
Seconded by Mr. Diehl. Unanimously Carried.
Mr. Francese made the motion to empower the Town Clerk of the Town of
Wappinger to purchase 2 machines which have been budgeted for this year's
budget, to enter into a rental agreement with the supplier for rental of
at least an additional 2, with the option to purchase for the calendar
year 1968 or thereafter, and in addition, for the Town Clerk'to be
empowered to attempt borrowing an additional 3 machines from an adjoin-
ing municipality if possible and, if not possible, to exercise the
rental offer as offered by the voting machine vender. Seconded by
Mr. Clausen. Unanimously Carried.
Mr. Francese moved that the custodians of the election machines shall
be paid an additional $100 each for the additional election to be held
on April 20, 1967. Seconded by Mr. Bulger. Unanimously Carried.
Mr. Bulger suggested that the Town Clerk have these umachines delivered
directly to where we want to use them.
Counsel was directed to draw up the necessary resolutions for the
referendum.
Permission was requested the Board of Assessors to attend the New
York State Office of Local Government Regional Meeting, at the Holiday
Inn, Fishkill, on March 31, 1967.
Mr. Bulger made a motion that all the elected officials, and anyone
designated by Department head, bu authorized to attend the session
sponsored by the Office of Local Government tomorrow, the 31st of March,
1967. Seconded by Mr. Clausen. Unanimously Carried.

Let the record show the Board has no objections to the Town Clerk using
her discretion when requests come from municipalities for use of voting
machines.
An opinion letter from Joseph Quinn regarding ,inquiry as to airport
zoning and regulations was read. Received and ordered placed on file.
Letter from Mr. Quinn regarding bidding procedure for highway equipment
and supplies was received and ordered placed on file.
Mr. Diehl questioned if there was any way to get emergency materials,
and machinery through rental etc.
Knud Clausen explained that on some of the material bids, the bidders
had made errors, which weren't immediately perceived. He added also
that there would be statements to this effect from the 2 companies
who had erred: He then recommended to the Town Board that all bids
for gravel, sand & washed stone be rejected and rebid.
Mr. Fulton said a motion to rescind the previous resolutions on the
acceptance of these bids would be in order.
Mr•. Francese made a motion, on the Superintendent of Highways recom-
mendation, to reject all bids that have been received on crushed stone,
washed gravel, and washed sand, and re -advertise these materials for
bid. -Seconded by Mr. Bulger. Unanimously Carried.
Mr. Francese made a motion the the Superintendent of Highways recom-
mendation to reject all bids on bituminous concrete and re -advertise
for bid. Seconded by Mr. Bulger. Unanimously Carried.
Knud Clausen asked the Board to either accept or reject the bid onthe
trucks, he recommended, however, the Board accept the bid for the 2
Mack trucks .
Mr. Diehl called for a 5 minute recess.
Recess at 9:38, meeting called back to order at 9:51 A.M.
Mr. Diehl made a motion to reject the bid on the trucks on the basis
of one bid coming in. Seconded by Mr. Francese.

Knud Clausen asked about the bid for station wagon.
Mr. Bulger asked Mr'. Clausen if there was any reason why he could not
have submitted expense accounts for the expense of travelling with his

ori carsif he was having transportation problems? He continued by
mentioning that as the situation stands at present, with the sthtutory
limit on bond spending, awarding the bid for a station wagon might
hinder the purchase of the trucks needed. If the loader plus two
prosepctive trucks get up to the statutory limit, and the Board has
already approved the station wagon, which throws us over the limit,
then that presents another problem for the Highway Department.
No action taken on. Bid for Station Wagon.
A letter was read from Mr. Quinn to Mr. Fulton regarding the surplus land
available at the Castle Point Hospital_ Reservation.
Mr. Fulton notOd that the price put on this is $34,000, for approx-
imately 46 acres. _This would mean that the Town would have to pay
half of that, and the land would have various restrictions on it.
He felt it was far beyond the price the Board had in find.

Mr. Quinn mentioned that General Services Administration wanted the
Boards intent on whether or not the Town was interested in this land.
Refer to the Recreation Committee for immediate investigation and
reply. (Copy of the letter received by the Board be sent to them
and ask them if they_ think it is in the best interest of the Town.),
Mr. Bulger reported that he and Mr. Diehl had looked at this parcel
last summer and it didn't look like a very ideal property for re-
creational purposes.
Mr. Fulton asked the counsel to write a letter ro the effect that the
Town would like an extension of the deadline as the Board didn't have
enough time to give this consideration.
Aletter from Mr. Quinn to Mr. Clausen, was read regarding Tall Trees
Development Sect. II (proceedure for issuance of Bldg, Permits and
CO's) Effectively, the letter indicated that the developer has made
arrangements with a contractor to do the road work.
Mr. Fulton commented that, as Highway Superintendent, Mr. K. Clausen
has the right to see that these roads remain passable and in this
particular case, if those roads are not passable the Town has the right
to withhold CO's and Building permits.

Mr. K. Clausen said Mr.Angelo Williams' has been very cooperative,
but conditions were such that whatever was done only made the situation
worse.'
A letter 'from Clinton 'Bogert Associates addressed to Herbert Muller
was read, regarding a discussion Engineer Herbert Kaufman had had
with A. Scott Warthin, Jr, reviewing proceedures and -precautions
to be taken against water pollution at the proposed Sanitary Land-
fill Site. A lengthy:discussion followed pertinent to this and
other related matters. Rules were suspended to 'allow further
discussion on this subject with Mr. Hayton.
Motion was made t� resume the rules.
Mr. Fulton' said that proceedings on the Oakwood Knolls plant could
be conceivably closed out to the Towns satisfaction by about May 15,
providing the Board is in a position to act on this. He noted that
some time ago an order to`establish the Oakwood Water District had
been placed in front of the Board, adding that this would be doing
no more than allowing the water district over there to be formed.
Mr. Quinn"commented that alithe'work of formation of the water
district, including approval Of 'the controller's -office, 'was
accomplished in 1965. Previously approval of audit and control for
the revised form of contract has been received, concluding that this
is the last act before the formation of this thing.
Mr. Clausen- I would like to postpone action on this until we get
copies.
Action postponed until tomo,row night on the order establishing the
Oakwood Knolls Water and Sewer District.
Mr. Ludewig on the Town Junk Yard Ordinance sought a moratorium
from the Board on enforcing this Ordinance and recommended the licenses
be issued for 1 more year. He added that he had had discussions
with a gentleman from the State Department of Public Works and had
learned of legislation passed this week which would broaden the scope
of the State getting involved in fencing of junk yards, etc.
A five minute recess was called at 11:04. Meeting called back to
order at 11:06.

'Mr. Bulger- There being at the present time an ordinance in this Town
requiring the Zoning Administrator, in his capacity of administering
this order, to issue permits to automotive junk yards on an annual
basis, and there having recently been passed legislation in the
Legislature of this State concerning the involvement of State Depart-
ments in the improvement and restriction in the operation of auto-
mobile junk yards, and since now the Zoning Administrator is required
by the Ordinance to act and, at the same time, does not have
sufficient information concerning new legislation to knowingly act
in accordance with this newly passed legislation which may or may ,not
conflict with our present Ordinance, it is, therefore,. resolved that
the Town Board, for the year 1967, authorizes and issues permits to
the currently existing automotive junk yard operators and directs
the Zoning Administrator to deliver them to those operating est-
ablishments which so require. Seconded by Mr. Francese. Unanimous.
Mr. Bulger- Let the record show I shall not be in attendance tomerrow
night because of official duties.
Mr. Diehl made the motion to adjourn the meeting until tomorrow night
March 31, 1967, at 8 P.M., seconded by Mr. Ulausen.
Unanimous.
