ADJOURNMENT 47 0 The Regular Meeting of the Town of Wappinger Town Board was held on Thursday, March 9, 1967, at the Town Hall, Mill Street, Wappingers Falls, New York. The meeting was opened at 7:10 P.M. The Girl Scouts placed the Flag and were thanked by Mr. Fulton. Public Discussion was held. Recess at 7:43 P.M. The meeting was called to order at 7:53 P.M. Mr. Fulton mentioned the fact that the meeting was being taped. Members Present: (answering roll call) Joseph H. Fulton, Supervisor William J. Bulger, Justice of the Peace Vincent S. Snowden, Town Clerk Others Present: Joseph Quinn, Attorney to the Town Harold Reilly, Attorney to the Town Rudolph Lapar, Engineer to the Town Knud Clausen, Superintendent of Highways Joseph Ludewig, Building Inspector Mr. Bulger moved that the minutes of the meetings of this Board held on Dec. 29, Jan. 23, Jan. 30, and Feb. 9, 1967, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Francese. Unanimously Carried. Communications - Letter received from Oakwood Knolls Civic Association requesting street light at Myers Corners Road and Roberts Lane. Referred to Lighting Committee (Mr. Bulger & Mr. Diehl.) Commando Window Cleaning Co. proposed supplement to their contract - Bi -Monthly cleaning of the Town Clerks office for an additional $10 a month. Mr. Francese made a motion to authorize the additional expenditure of $10 a month for the additional cleaning of the Town Clerks office by Commando Window Cleaning Co. Seconded by Mr. Bulger. Unanimously Carried. Communication between Mr. Worona and Mr. Quinn with reference to 471 problems of issuing Building Permits & C.O's due to poor road condi- tions in Tall Trees Section II. Communication to Mr. Elliott Weiner from Mr. Quinn regarding agreement for acquisition of Oakwood Knolls Sewer and Water systems. Mr. Diehl had a question on the Oakwood correspondence. He asked if any other developments had come up other than these two letters and had Mr. Ritter in any way shown intent of not doing business with the Town? Mr. Quinn replied that he had talked to Mr. Fulton this afternoon and they were both very encouraged, noting also that the State Comptrollers' office has given approval to this purchase contemplated by the contract between Mr. Ritter & his associates and the Town of Wappinger and at this time feels that we're getting very close to closing this thing out. Mr. Diehl commented on a rumor that Mr. Ritter is pulling out of this and going back to holding to the original contract. Mr. Quinn commented that, to the contrary, his counsel has been very cooperative with us and doesn't think there will be any difficulty. Mr. Fulton added that he had spoken to Mr. Ritter twice this month and he has every reason to believe he will close on the contract the Town has with him, indeed, seems anxious to close. More discussion was requested on Item 4C on the Agenda - Tall Trees Section II. Mr. Quinn explained there had been problems concerning the road condi- tions in Tall Trees Section II which prohibited issuance of Building Permits & C.O's, and in an effort to alleviate the difficulty, he, Mr. Worona, the Building Inspector and the Highway Superintendent had agreed on an avenue of relief for the Developer, i.e, withholding $100 per title closing for the purpose of reimbursing a qualified road contractor to shape up the roads. Subsequently, a statement by Malcolm Cornell, agreeing to maintain these roads, was sent to the Town Highway Dept. with an implication that the Town would reim- burse him for his services. This implication prompted the reply of Counsel advising the Building Inspector and Highway Superintendent that until appropriate compliance with the proposed agreement was 4 72 effected, no further permits or C.O's should be issued, and, until some road contracting firm indicates a proposal, it is assumed there won't be any. Its the developers problem now. Motion was made by Mr. Clausen, seconded by Mr. Diehl to suspend the rules to give Mr. Worona an opportunity to also clarify something on the Tall Trees subject. He wished to make it clear he had been un- aware of the Cornell Statement until conversation with Mr. Quinn regarding it, and upheld Mr. Quinn's impressions. He assured the Board a correction would be forthcoming and added that Mr. Cornell will consent to the original understanding that he and Mr. Quinn had, which they thought would be satisfactory to the Town. Motion made by Mr. Francese, seconded by Mr. Clausen to resume rules. Mr. Fanuelle, President of the Wildwood Forest Civic Association, requested to be placed on the agenda since road and drainage situation in Wildwood Forest Section I had not been resolved. Mr. Fanuelle:was called -by the -Board to_speak.. He asked if any action had been taken to resolve road and drainage problem. He then gave the Superintendent of Highways a petition, signed by residents of Wildwood Forest, Section I, requesting that the Performance Bond be called. He added that the residents hope some action can be taken instead of actions being set aside for another month or more.. Mr. Knud Clausen said that before he made any recommendation to the Board, he thought Mr. Lapar's report on this subject should be intro- duced. The following report was submitted: Town Board Town of Wappinger Town Hall Wappingers :Falls, -New York Feb. 27, 1967 Re: -,Wildwood Forest, Section I Streets and Drainage 473 Gentlemen: After reading the various reports and studies made by Mr. Richard G. Barger, P.I., and Mr. Vincent C. Kelley, P.E., former Town Engineer, I am submitting this report as a supplement to Mr. Kelley's report. My investigation has not only verified Mr. Kelleys' report, but shows an increased number of problems that are now in evidence. They are as follows: 1. Additional areas of Wildwood Drive and Dennis Road which may be considered deteriorated road. 2. The necessity of cleaning all catch basins and paving around catch basins so that road gravel and oil will not clog them. 3. The question of the open ditch has been spoken of by Mr. Kelley, however, I question the load bearing capacity of the existing pipe and suggest the instal- lation of a gate to prevent entrace of individuals until such time as the ditch is completely piped. In lieu of complete piping, it should be required that the open ditch be cleaned and the riprap properly replaced. In addition, the mall should be leveled and seeded. 4. The various drainage easements which are shown on the final plan should be installed as shown, or good reason for any deviation be explained in writing to the Board. As mentioned.in Mr. Kelley's report, Mr. Shaller on Wildwood Drive is one such situation. 5. It is also noted that any construction should be supervised by a licensed Professional Engineer and/or the Town Superintendent of Highways. 6. Construction details must be submitted to the :crown Engineer for approval. Respectfully submitted, 1 s/ Rudolph E.Lapar Engineer for the Town of Wappinger Mr. Lapar confirmed Mr. Fanuelle's statement that the situation is getting worse, and he felt sure it wouldn't get any better. Mr. Knud Clausen added a word of warning to Wildwood residents that even if he recommended calling the bond, and the Board accepted his recommendation, that the Town would not make the repairs immediately. He then recommended to the Board to take it under consideration to pull the bond in Wildwood. Mr. Quinn: On that recommendation of the Superintendent of Highways, I would suggest that if it is the pleasure of this Board that you instruct the Town Clerk to send to our office the petition from the residents of the development, the bonds, related Planning Board 474 material, Town resolution, and so forth and we'll commence action against the principal in surety. I think there is no other way to. resolvethis. If there are going to be meetings or discussions, I think they should follow our notice to the surety company. If there is any action on the bond, the bond company will negotiate with private contractors to complete this work. Mr. Francese made a motion to call the bond on Wildwood Forest Development, Section I. Seconded by Mr. Diehl. Motion Unanimously Carried, A Rezoning request was presented to the Board from John P. Holler - Property located on Pye Lane and All Angels,Road. Referred to Planning Board for recommendation, and Counsel for adequacy. The following recommendation was received from the Planning Board: March 8, 1967 Town Board Town of Wappinger Wappingers Falls, New York Re: Rezoning Petition of Arthur Masch, Jr. and Belzora Masch Gentlemen: The Town of Wappinger Planning Board, at its March 6, 1967 meeting, took the following action on the above matter: A motion was made by Dr. Harvey Miller, seconded by Einar Chrystie, to recommend against the rezoning of the property of Arthur Masch,,Jr. and Belzora Masch, situated on the north side of Hopewell Junction Road in the Town of Wappinger, from R-20 (Residential) to GB (General Business). Motion Unanimously Carried The Planning Board noted that there exists on the parcel in question a legally non -conforming use. The matter of the possible permitting of non -conforming uses to expand is presently under study. The Planning Board, therefore, feels that this application - should more appropriately be considered as being a part of that study and bases their recommendation on this fact. Respectfully yours, s/ Susan J. Pike, Secretary Town of Wappinger Planning Board Mr. Fulton noted there had been prior discussions on these non- conforming properties in the Town. He recommended scheduling an executive meeting with our planners and discuss it. If it can be arranged, probably Thursday. 475 1.,Buiger.suggested the Planning Board -ought to be there, too. Letter from Mr. VandeWinckel to Mr. Fulton with enclosure of an excerpt from the Zoning Ordinance of Fishkill pertaining to expansion of non- conforming uses, seeking direction Town Board favored. Mr. Diehl: We can discuss it at the same meeting with the Planning Board. Mr. Bisom requested to be on the agenda in reference to non -conforming uses. He had made a rough map of Myers Corners Road showing all the businesses and other non-residential structures both non -conforming and conforming. He feels, all small businesses should be permitted to enlarge. He emphasized that we need small busniesses in the Town of Wappinger. He believed Planning Board has made some recommendations. Mr. Francese pointed out to Mr. Bisom that the Town Board was having a meeting the following Thursday night with the Planning Board and Planning Consultants and this is one of the major topics of discussion. Mr. Bisom, continuing, contended that prior to adoption of zoning an amendment.to samil businesses was supposed to be added, but wasn't. He asked why small businesses be condemned and stifled while big businesses comes in and gobbles up the small ones. Mr. Fulton: The Town Board has sympathized with the situation by recognizing condition. ,Any change in non -conforming is going to be a major change and it will have to go to a public hearing.. Mr. Bisom asked when this would be. Mr. Clausen: After discussions with our planners, if there is a need for Public Hearing, we will hold it. Mr. Fulton: Board is already on record as favoring liberation for small business peiple. We're going to discuss this with our planner. Mr. Bulger:, This is a complex question. We con't merely say that all non -conforming uses become conforming. To make a blanket change in the law would not accomplish it. Mr. Bisom: Each small business should be on its own merits. Mr. Bulger: I'm saying to you we are sympathetic to the problem of yours and other establishments in the Town, at the same time we have 476 not come up with a solution which would enable us to be fair to everyone. Mr. Bisom still contended that small businesses should be able to enlarge 50% just like Fishkill has. Mr. Quinn commented that there is an extremely complex legal problem in this. Mr. Fulton informed Mr. Bisom that this was all the answer the Board could give him tonight. Letter was received from Mayor Furnari requesting exemption of Town Taxes on the Wappinger Lake. Mr. Fulton: I'm Chairman of the -County Tax Committee and -we faced the same problem. We were advised not to take any positive action until ownership of the land was in the hands of the Village. The Village does not need this exemption as a requirement to the purchase of the lake. If the Board would like to make a motion of intent on this, it might be appropriate. Mr. Diehl: I would like to make the motion of intent that this Board go on record of exempting the Town taxes of the lake. Seconded by Mr. Clausen. Mr. Francese: I would like to amend Mr. Diehl's motion - our motion of intent should state that we will exempt the Village from their share of Town taxes on that property once the Village gains actual ownership of the property, depending on the taxable status date. Mr. Diehl accepted Mr. Francese's amendment. Mr. Fulton said the useage of recreation was pretty well clarified in the purchase agreement. Mr. Quinn noted that the Town cannot exempt the Village on any other useage except recreation. There is a retainer of private ownership and certain water rights here. There will have to be a segregation. Mr. Francese: There should be some clarification on the private ownership of certain water rights, Mr. Fulton: I think the point Mr. Diehl is trying to get across is that we don't have any serious objections and don't forsee any problems that might arise. 477 Mr. Diehl: Upon completion, and when all legal terms are satisfied - there's only an intent there. Rules were suspended to permit Mr. Arndt to ask if there would be any reciprocol action that would provide free access to Town residents for recreational purposes. Rules were resumed. Mr. Bulger: The motion should be so qualified that it indicates only that portion of the lake that will be used by the Village for recrea- tion, because if we just refer to the lake we may be also covering that portion which is taxable because, as_Mr. Quinn indicated,;. there was some proprietary rights involved. Mr. Francese: That proprietary right extends from dam in Red Oaks Mill to dam in Wappingers Falls. Mr. Diehl came to the conclusion that the best thing would be to withdraw his motion and simply inform the_Village Board that it is the intent of the Board to cooperate 100/ with them upon completion of all•legai.terms.. On that basis he withdrew his motion and Mr. Clausen withdrew his second. The Clerk was instructed to write a letter to the Village,Board shgw- ing the Town Board's intent to work with them. A letter from Mr. Worona was received with regard to the possibility of the Town using zoning as a tool to block the Airport runway exten- sion. Board referred it to Counsel. Mr. Quinn gave an informal answer from the floor pointing out that the Section (356 General Municipal Law) Mr. Worona referred to had to be read together with the preceding Section 355. They have to do with the power of municipalities to join cooperatively in zoning in the area of the airport and really, that part of the General Municipal law is intended to enhance airport improvement rather than to accomplish what may be intended by the taxpayers' action here. It is not to the benefit of the taxpayers' action but rather to the detrement of it. The Board suspended rules for 3 minutes, to permit Mr. Worona to 478 discourse on the foregoing. In defense of his letter, Mr. Worna employed the argument that the. Board had adopted a resolution opposing the presently planned runway extension and that the General Municipal law states that in the interest of the particular nuisance this Town Board has power to adopt what is necessary to protect residents. He pleaded'that the Board consider this other alternative. Rules resumed on a motion by Mr. Bulger, seconded by Mr. Diehl. A directive was received from the State of New York, Dept. of Law informing the Town -that upon -completion of audit, a check would be forthcoming on payment for Town property on Myers Corners Road. Reports of Officers - Motion by Mr. Clausen, seconded by Mr. Bulger, to suspend reading of reports. Unanimously Carried. Supervisor ordered reports received and placed on file. Bills -:were presented in the: following. total amounts; General Fund- Highway $14,558.00 15,774.10 Mr. Francese made a motion that the bills be paid, subject to audit, seconded by Mr. Diehl. Unanimously Carried. CATV Report - Robert L'Archevesque (see attached -pages). r - Mr. L'Archevesque concluded his report adding"CATV is good for the Town of Wappinger, is workable in the Town of Wappinger, therefore I recommend that the Board authorize Supervisor and Attorney to nego- tiate contract." Mr. Francese: Would this local outfit propose any local programming? Mr. L'Archevesque: They agreed to construct a local studio and agreed to assist. Mr. Diehl asked if this company would have any excuse not to put their lines through the Wheeler Hill and Cedar Hill area because they don't have enough customers? Mr. L'Archevesque replied that it could be a point made, while negotia- ting, that these two areas be serviced first but noted that they might 479 be a little reluctant from a business point of view. Mr. .Francese requested it be required of -them to absolutely state that they would service these two particular areas. Mr. L'Archevesque felt, in negotiations, it could be attempted, as it was a point that should be agreed to, and assured Mr. Francese it would be a part of negotiations. Mr. Diehl commended Mr. L'Archevesque on his report and made.a motion recommending that the Supervisor be empowered to follow through with negotiations with ,Highway Displays Inc., with the stipulation of checking these two areas, seconded by Mr. Francese. Mr. Francese recommended that the Board issue a letter of thanks to Mr. Lipman acknowledging the work he has done and the help he had given Mr. L'Archevesque. Mr. Bulger:' Mr Diehl-and.I have discussedthis request for astreet light at Myers Corners Road and Roberts Lane. We are in conformity with it. We would like to ask the Board's permission to contact Central Hudson and authorize Supervisor to sign necessary papers. Seconded by Mr. Clausen. Unanimously Carried. Mr. Diehl brought up the fact that there were to be lights installed over a month ago at the New Hamburg Bridge, which, to the present time, have not been_installed. He requested this matter be checked into to see if there is any problem. Mr. Diehl mentioned he had received a report from the Assessors' Office tonight, on assessments of privately owned water works in the Town but hadn't had a chance to examine it. "Again on reports, in regard to test borings on Robinson Lane, any report, Mr. Fulton?" Mr. Fulton: We haven't any reports but a test has been made. Mr. Lapar & I were there on Tuesday, the 28th. It appeared to me that they didn't find anything they didn't expect to find. However, I feel we should wait until these reports come in. Mr. Diehl: Will these reports be coming? Mr. Fulton replied in the affirmative. Mr. Diehl: Have we heard anything from the Dutchess County Conserva- March 8, 11967 To: Town Board, Town of Wappinger Subject: Results of CATV Applicant Interviews and My Recommendations During the last three months I met with representatives of Northeast Cablevision, Hightower of Poughkeepsie, Inc., WEOK Cablevision Inc. , and Highway Displays, Inc. I was assisted in the interviews by Mr. Sid Lipman. Table I summarizes the response of these companies to the points I presented to the Board in my letter entitled, "Proposed CATV Requirements and Points for Negotiation Between a CATV Applicant and the Town of Wappinger". A. RATING JUSTIFICATION 1. Highway Displays Incorporated Although this applicant has had no prior experience with a CATV system, his plan to use New York Telephone rental equipment in his head end plus having N. Y. Telephone head end and distribution line maintenance minimizes the experience factor. This applicant would provide a tower, head end facility and studio at his cost. Additional advantages are: a. A bond has been posted with New York Telephone thus assuring cable distribution system priority. b. The head end site will be in the Town of Wappinger and, more specifically, in the All Angels Hill area. This is the only applicant with a site in our Town and it is an extremely important factor. c. Construction of the system can begin almost immediately with a three (3) month target for installation of initial service. (In my opinion, no other applicant can get going this quickly). d. This applicant is a local business and, therefore, his reaction to problems should be better. It is one of two applicants from whom we have received a formal proposal. Town Board 2. WEOK Cablevision Page No. 2 March 8, 1967 • This applicant is well known for the system in the City of Poughkeepsie. The system operation in Poughkeepsie has been good. This applicant's rate is $. 25 better than anyone else and has proposed a 1/3 reduction in the monthly service charge for senior citizens who are on social security. These advantages are outweighed by the following: a. The head end site is in LaGrange, thus mandating a distribution run of from 11 to 13 miles which will lead to a deterioration in the signal to noise ratio of the signal due to too many stages of amplification thus giving a poorer quality picture at the set. b. This company has more work than it can handle in the City of Poughkeepsie. It is estimated that 5 to 6 months will be required to complete the work in the city thus resulting in a September or November start date here. c. Their was no commitment by this applicant to provide a studio for local organization which is also important to our system. 3. Northeast Cablevision, Inc. This company has also had much experience with CATV systems in Upstate New York. However, it offers nothing more than WEOK plus it is not a local company. This company will provide studio space also. 4. Hightower of Poughkeepsie, Inc. This company is, again, very experienced, in the CATV area. It has lines strung in the Town of Poughkeepsie but no head end to which the lines may be connected. It has been trying for many months to get approval for a microwave link from an antenna which will be located on Mt. Beacon. To date, the antenna on Mt. Beacon is not up nor has any approval been granted by F. C. C. for a microwave link. The lack of the above mentioned facilities in the main reason for rating this company fourth best. B. ADDITIONAL INFORMATION 1. State aid is available to municipalities on a matching grant basis for purchase of video equipment. Town Board Page No. 3 March 8, 1967 2. There are approximately $2. 5 million worth of video tapes and I6MM film available in Albany for use at no charge by municipalities. 3. The installation fees, rental charges and termination charges of the New York Telephone Company are regulated by Tariff F. C. C. #34 of which I have a copy. 4. In our area all of the CATV signal distribution lines are installed by New York Telephone and rented to the CATV companies at rates specified in the tariff under an arrangement called a " lease back". New York Telephone is also supposed to rent pole space to the CATV. companies for their own lines, but this "pole attachment" system is rarely used. 5. The problem of radiation is best controlled by prompt action by the CATV Company in conjunction with the New York Telephone Company. A contract between the CATV Company and the customer allowing for periodic checks inside the house would also help this situation. In part "C", I am proposing the establishment of a committee of people know- ledgeable in the field of communications .who would be charged with the • responsibility to investigate radiation problems in conjunction with the New York Telephone Company, and the CATV operator and whose recommendation would be binding on a problem, attributable to the CATV operator. C. SUMMARY Two areas of the Town most need CATV service. They are Cedar Hill and the Wheeler Hill Road area plus certain other smaller areas. I am convinced that CATV can be of immense value to the Town not only for those areas requiring improved reception, but for our school system, local civic organizations and for the Town government itself. The availability of a local studio and channel coupled with the huge video tape library run by the State could result in a presentation of issues and topics not normally seen. A whole series of new viewing fare would come into being through local government participation. Debates, forums, panels and discus- sions on a local channel would bring local government closer to the citizenry Appeals for charitable organizations could be presented. Area school children would have a new outlet for their debates and dramatic presentations. Local athletic contests could be video taped and shown over the network. Town Board. Town Council be authorized. to negotiate a contract with Highway Displays, Inc. , using their proposal of February 7, 1966, as a basis for negotiation and. that this non-exclusive contract include a rate competitive with the lowest rate offered. and embracing the points outlined in Table 1. I also recommend. the establishment of a standing committee under the direction of the Town Board or Supervisor which would be responsible for investigation of and recommended solution to radiation problems and who would. co-ordinate use of the local channel with the CATV operator ) Robert L. Mr. Diehl asked if there was any kind of a report from the Attorneys on financing the 11 year road program. Mr. Quinn: Nothing is going to be done this session of the legislature, apparently. Situation is still the same that if you want to exceed the sum of $15,000 there will have to be local referendum on it each year. At the pleasure of the Board and the Superintendent we can prepare -the necessary bond resolution and material for mandatory referendum on the first year voting with relatively good speed. The thought would be to have a revolving situation - I'm hopeful there will be some changes in the finance law. Mr. Bulger asked if it must be approved by the citizens each year? Mr. Quinn: Yes, it would have to, under the statute right now. Knud Clausen: If this bond was adopted, we were supposed to have $85,000 in the budget this year to start out with. As we stand today we could not start any kind of rebuilding road before '69 and that is providing if the Town Board will provide money for surveying and taking of land. Mr. Francese: Surveying and taking would be considered in the expen- diture of the bond, wouldn't they? Mr. Quinn: From what I understand. Mr. Francese: Should the Board take action this year there could'pos- sibly be -surveying work done this year and actual physical work begin next spring. Mr. K. Clausen: Next spring is a little too early. Mr. Diehl: If we don't start it now, next year it will be '70 before we can get started. Get down to the workings of it and waht we're going -to do. Mr. Clausen: Mr. Diehl, would you like to make a motion that Counsel and Highway Supt. get together and build a resolution as to what's needed? Mr. Diehl: It doesn't need a motion. Direct the attorney to have a 483 resolution drawn for meeting of April 6th. He then stated that he had just had a note handed to him from a taxpayer in the audience. They were in contact with Soil Conservation last Friday and at that date, Conservation had no communication from the Town of Wappinger in regard to landfill on Robinson Lane. Mr. -Fulton: I got in touch with Mr. Scoralick and asked him to present it to that Board. Mr. Diehl: Ask them to recheck on it. At the last meeting also I asked in regard to a resolution made on March 4, 1965 in regard to a change in the specification of roads. At that meeting Mr. Bulger asked for an opinion report to be given from our attorney. Mr. Quinn: I didn't think this needed a formal opinion. I can tell you this, gentlemen, that this Board has no right to adopt a resolu- tion correcting a resolution adopted by a prior Board. If it wishes to do anything about it, it may rescind the resolution or substitute one in its place. It may not correct one that was adopted by a prior Board and that is evidenced by a record in the minutes approved by all members of the then Board. If you want to change the highway specifications you can change them any day of the week. Discussion between Mr. Diehl, Mr. Clausen and Mr. Fulton, concerning a letter from Public Service Commission (addressed and sent to Mr. Quinn) being received by the Supervisor. Mr. Diehl felt strongly that mail relating to Town affairs, though addressed directly to the Super- visor should be made available to the rest of the Board. Mr. Fulton opposed this position expressing his opinion that it was his peroga- tive to decide what was proper to bring before the Board - anything he feels important he brings before the members. Mr. Diehl: Another letter in regard to the Town Board of the Town of Wappinger voting in_favor of acting as a frienid of the, court. After this meeting we adjourned to the back room and discussed just how to go about sending facts and how to word it. Mr. Clausen was there, yourself, and myself, I'm not sure about Mr. Francese and Mr. Bulger. We did agree that Mr. Worona draw up a Statement of facts,to 484 to be sent to Albany. The statement of facts that Mr. Worona drew up were handed to you and I did speak to you on one occasion and you said yes, it was sent to Albany. Later I found it was not sent to Albany, but a revised letter was sent which did not contain the same information and the same force the original letter had. Mr. Fulton: We sent the brief Mr. Worona made. We sent the actual case up tiere, Mr. Worona's interpretation of this is not pertinent of the situation. We sent him an exact copy of what Mr. Worona gave to us. We couldn't have submitted any better facts to them than the complete court case. Mr. Diehl: Did you agree that this would be sent? Mr..Fulton: I agreed that Mr. Worona would send down the_facts as they were. Mr. Quinn: I think that what were sent up were the pleadings in the lawsuit and the decision. I sent your summons, your complaint, your answer of County of Dutchess judgment. Mr. Diehl: You took all the force, all the meat out of the whole thing. I feel that you did change it. We had your trust. A ten minute recess was held at 10:20, meeting reconvened at 10:35. Resolution #22 was presented to the Board. I would just like a little time to get a better understanding of the matter. - Mr. Francese: I recommend we review it. Mr. Bulger commented that he wouldn't feel so badly about it if more than one Mack dealer submitted a bid just to even have a figure to compare. Mr. Diehl: I think it is the general feeling they're trying to put across the point of only one company coming with a bid. No question 486 we need the trucks. Mr. Diehl asked the question as to what test borings 1. - results were on Robinson Lane. I checked with the Town Engineer tonight and he says, although reports weren't in and official, -the difference is about a foot. I understand an engineer from the State was down there today looking at'- Robinson Lane, accompanied by Mr. Ruf of the County Health Dept. There are some residents from Robinson Lane here tonight and I beg the indulgence of the Board to listen to any" -questions they might•have: Rules suspended. Mr. Hayton said he had come down to the Town Clerks office Tuesday seeking the petitions for a referendum. He asked if they had 30 days from the -time they -received -the forms. - Mr. Quinn informed him that petitions will be available tomorrow and that they have 30 days from the date of publication. Mr. Hayton then requested a meeting with the Town Board and with the 488 Town Engineer when the report is in, so that we may have a chance to examine the facts. Mr. Fulton said he thought this could be arranged. -It was his under- standing that the reports would go first to Mr. Muller_and_after that a meeting could be set up. Mr. Quinn cautioned the Board that there was a strong possibility of- litigation to enjoin any further progress of this project; and recommended discussion with the interested parties. Mr. Ben Breslo: Mr. Ruben said he would try to avoid the possibility of a lawsuit if there is any possibility of reaching an agreement or compromise between the Town Board and any of,the petitioners, or reach an understanding in regards to what the petitioners are protesting. If there is any possibility that the site location is an improper choice and the site might be detrimental to the people in the communi- ty, we would certainly want to know this -and avoid a lawsuit and determine what the proper site -is.- To forestall the purchase of a site that might be unnecessary, is up to be considered by the Town Board. Possibly a good understanding could be reached and a lawsuit, which would be unnecessary, could be avoided. Motion made and seconded to resume rules. Unanimously Carried.
