The Regular Meeting of the Town of Wappinger Town Board was held on
Thursday, February 9, 1967, at the Town Hall, Mill Street, Wappingers
Falls, New York.
The Meeting was opened at 7:13 P.M.
Mr. Fulton called for a half-hour of free discussion from the audience.
Public discussion closed at 7:34 P.M.
The meeting was called to order by Supervisor Fulton at 7:37 P.M.

Mr. Bulger moved that the minutes of the meetings of this Board held
on Oct. 13, Nov. 3, 10, 14, 22, 28, 29, Dec. 8, 22, 1966 and Jan. 5,
1967, as -submitted by the Town Clerk be and they are hereby approved.
Mr. Francese: I have one slight correction. There is a resolution
#2, Year 1967, at the end of the resolution should read "Seconded, by
Justice of the Peace, William Bulger," which is not there.
Motion for acceptance of the minutes seconded by Mr.! Francese.
Motion Unanimously Carried.
An application by Arthur & B.elzora Masch for a chane; in zoning of
their property on Hopewell Rd. was placed before thei Board. Request
was for a change of zoning from R-20 Residential to "GB -General Business.
Petition was referred to Counsel, and request to Planning Board for
their recommendation.
An application by Henry Vorndran far a change in zoning of his
property on All Angels Hill Road & Brown Rd. was placed before the
Board. Request was for a change of zoning from R-40 Residential to
LB -Local Business. Petition was referred to Counsel and request to
Dutchess County Planning Board and Town of Wappinger Planning Board
for their recommendation.

road opening.bohd for repair of trenches for water & sewer services
across Pye Lane.
Knud Clausen recommended that it be, returned, as it has been finished'
and the road is in good order.
Mr. Francese: On the Superintendent,of Highways' recommendation,
move the returniof Mr. Thomann's bond, seconded by Mr. Bulger.
Unanimously carried.
Application was made by Allen J. Weisman, Attorney for. Adama
Development Corp. for the approval of a performance bond for the
revised Section III Summit Gardens.
Mr. Lapar stated that there.was a problem in Summit Gardens as, far
as the approved plan and what was put in. He added that as of this
moment, nothing has been submitted, so certainly this application is
not in order.
Referred to Engineer & Counsel to the Town.

Application for extension of the performance bond on Beechwood
Circle was requested by Angelo Williams.
Knud'Clausen: I• would not recommend tonight to have any extension.
I would like to have a meeting with Mr. Williams before we can extend
it.
Mr. Bulger proposed it be referred to the Superintendent of Highways
and table it tonight.
Motion made by Mr. Francese, seconded by .Mr. Clausen to suspend rules
to- hear gentlemen from Beechwood Circle.
Bill Heydman asked "why don't we have.a road"? It was his understand-
ing that the road was to be put in last May. He questioned further
extension being tabled.
Knud Clausen was asked to clarify the point in .question. He had
stopped Mr. Williams in December, as it was too late to complete the
surfacing - the road must be drained before surfacing would be
permitted, and as there had been heavy rain in the late fall Mr.
Williams had been delayed, but Mr. Clausen_hoped that the road would
be fixed by Spring. He remarked it would not be fair to make anyone

put in a road that will fall down a month after it was put in.
Mr. Heydman reiterated his question, "when are we going to have a
road"?
Mr. Clausen said as soon as the weather permits but he wouldn't go
out on a limb to state a date.
Mr. Heydman said he had contacted several different road contractors,
asking when the best time was to put down oil & chip and was told
April & May. He asked the Board to give Mr. Williams a good exten-
sion to finish the roads.
Mr. Williams: I never asked the Board for an extension of a bond
before. Lots of you' know that I tried to put the road in in Novem-
ber. We had more rain in November than we had all year.
Mr. Fulton asked Mr. K. Clausen if what he was suggesting was the
Board not extend the bond to a date. To put a date on it, I think,
would be very hard to do. As soon as the weather is right, the
Highway Superintendent will order the road be put in. He noted the
Superintendent has a responsibility here, once he orders that road
to be put in. He is responsible for the roads.
Mr. Fulton asked Mr. Reilly if the Board can stipulate that the road
be put in on the recommendation of the Highway Superintendent?
Mr. Reilly said that i iclausen carte': direct- the developer to do so,
and pull the bond if he refuses. He added that the Board doesn't
have to act on it at all if this is the case.
Mr. Fulton: I think the record will show that you have Mr. Clausen's
word on this - as soon as the weather is good, this road will be put
in. Extension of this bond will be dependent on the order of the
Highway Superintendent.
Mr. Heydman said he didn't want to be too critical, but how would they
know they are going to have a road in 1967?
Knud Clausen: I guarantee this to you.
Rules resumed on motion of Mr. Clausen, seconded by Mr. Bulger.
Mr. Fulton: Knud Clausen has said here tonight that as soon as the
weather permits he will order that road be put in. As soon as he has
ordered it, if the roads are not put in he will come to this Board.
Permission was requested by Mr. Ludewig and members of the Planning
and Zoning Boards to attend a meeting conducted by the New York
State Federation of Official Planning Organization in Poughkeepsie
March 9, 1967, and permission was requested by Vernen Christensen
for the assessors to attend a 5 session course on the Principals of
Assessment Administration to be held in Poughkeepsie.
Motion made by Mr. Bulger, seconded by Mr. Francese to grant per-
mission to attend these meetings and expenses by paid. Unanimously
Carried.
Board of Assessors requested permission to purchase a calculator per
policy of the Town Board. Request approved.

Mr. Bulger made a motion that the bills be paid, subject to audit,
seconded by Mr. Diehl. Motion unanimously carried.
The Board suspended the reading of all reports, both monthly and
annual and the Supervisor ordered their copies to be Rent to the
Board members.
Mr. Francese: asked if these reports could be filed with the Board
members before the meetings in the future so that the reading could
be suspended.
Reports on Committees -
Mr. Diehl: I have a report on obtaining an attorney to represent
the Town of Wappinger in the Airport action - Perry Satz, Attorney
at Law, Poughkeepsie, New York. The Board appointed Mr. Clausen and
myself to check into an attorney who would be capable of representing
the Town of Wappinger in action on the airport.
Mr. Fulton recommended that the Board sit with this attorney and
discuss the problem further before appointing him.
Mr. Diehl said he and Mr. Clausen felt he was capable.
Mr. Fulton suggested a meeting with this attorney and discuss this
problem further. He mentioned he had called a special meeting for

for Monday the 13th also as he wanted to get together with the Board
on the sanitary landfill and discuss it, and also Ian MacDonald, Attorney
for the Village wanted to come in and talk to the Board about the , la ke.
Mr. Clausen suggested Wednesday, February 15th, at 7:30 P.M. for a
meeting with Perry Satz with alternate dates of the 17th and 18th.
Mr. Worona requested to be present.
Mr. Diehl recommended wholeheartedly that Mr. Worona be in on the
meeting and asked that he be notified.
Mr. Diehl reported on Doctors' Committee. He said that on Sunday the
Doctors' Committee met with a Doctor from Middletown, who has been
operating in a partnership. This Doctor wishes to break up her partner-
ship and is looking for another place to establish a practice.
Mr. Francese: This is in the form of committee per se report. On
Tuesday we had one of the worst snow storms we have seen in the past
6 or 7 years. I would personally like to commend the efforts and work
done by Mrs. Tenna Jensen and Bob Croshier, he was in a peculiar
situation where the Superintendent was out of Town and the Deputy
Superintendent was in the hospital for emergency operation. He took
over the reins and did an especially good job under the conditions.
Winds were causing brake lines to freeze up on the trucks, and they
had to return from time to time to thaw them out. They did an
exceptionally good job. There just aren't enough words to say about
those two people, and the highway crew.
Knud Clausen: Mr. Francese went up there when he knew we weren't in
Town. I think it was a very nice thing to do. I personally want to
thank him.
Mr. Fulton: I personally want to thank you, Mr. Francese for assuming
the responsibilities as Assistant Supervisor.

of Wappinger is currently in the process of reconstructing the
public street and highway located in the Town of Wappinger,
Dutchess County, New York, known as Spook Hill Road, and
WHEREAS, the widening and reconstruction of the said road
requires the acquisition of a parcel of land, containing 0.143
acres, being situate on the easterly side of said road and
being presently owned by John P. Welter and Marie I. Welter,
and
WHEREAS, the Town Superintendent of Highways has reported
to this Board that the acquisition of this parcel is necessary
for the reconstruction of this road, and
WHEREAS, John P. Welter and Marie I. Welter, have tendered
to this Board a deed conveying and dedicating this parcel of
land to the Town of Wappinger for the nominal consideration of
$1.00 , for the widening and reconstruction of Spook Hill Road,
- NOW, THEREFORE, IT IS HEREBY
- RESOLVED, that the Supervisor of the Town of Wappinger beand
he hereby is authorized and directed to acquire the aforesaid
premises now owned by John P. Welter and Marie I. Welter for the
purpose of the widening and reconstruction of Spook Hill Road
for the nominal consideration of $1.00, and it is further
RESOLVED, that this Board does hereby accept the dedication
and conveyance of the aforesaid parcel of land acquired for the
widening and reconstruction of Spook Hill Road upon the following
conditions:

acknowledge and deliver to the Town of Wappinger a
full covenant and warranty deed in proper form for
recording conveying to the Town of Wappinger the title
to the aforesaid premises in fee simple absolute. The
form, content and manner of execution of such deed of
conveyance shall meet with the approval of counsel to
the Town of Wappinger.
2. That counsel to the Town of Wappinger furnish to
this Board an opinion certifying that the present
owner of the subject premises has conveyed a good and
marketable title thereto, free and clear of all
encumbrances, except public utility easements.

requires the acquisition of a parcel of land, containing 0.074 acres,
being situate on the northerly side of said road and being presently
owned by Russ B. Winters and Edna C. Winters, and
WHEREAS, the Town Superintendent of Highways has reported to
this Board that the acquisition of this parcel is necessary for the
reconstruction of this road, and
WHEREAS, Russ B. Winters and Edna C. Winters, have tendered
to this Board a deed conveying and dedicating this parcel of land
to the Town of Wappinger for the nominal consideration of $1.00, for
the widening and reconstruction of -Kent Road,
NOW, THEREFORE, IT IS HEREBY
RESOLVED, that the Supervisor of the Town of Wappinger be
and he hereby is authorized and directed to acquire the aforesaid
premises now owned by Russ B. Winters and Edna C. Winters for the
purpose of the widening and reconstruction of Kent Road for the
nominal consideration of $1.00, and it is further
RESOLVED, that this Board does hereby accept the dedication
and conveyance of the aforesaid parcel of land acquired for the
widening and reconstruction of Kent Road upon the following
conditions:
1. That Russ B. Winters and Edna C. Winters execute,
acknowledge and deliver to the Town of Wappinger a full
covenant and warranty deed in proper form' for recording
conveying to the Town of Wappinger the title to the
aforesaid premises in fee simple absolute. The form,
content and manner of execution of such deed of
conveyance shall meet with the approval of counsel
to the Town of Wappinger.
2. That counsel to the Town of Wappinger furnish to
this Board an opinion certifying that the present
owner of the subject premises has conveyed a good and.

Motion made by Mr. Francese, seconded by Mr. Clausen to adopt all
Resolutions. Unanimously Carried.
Mr. Knud Clausen asked if it would be a good idea if the Town Clerk
were advised to send those people letters of thanks, on behalf of
the Town Board and the Superintendent of Highways. Then he asked
if anything had been done about property of Louis Eck on Spook Hill
Road.
Mr. Reilly said it seemed a question of inability. to sell as far as
he could determine. He remarked that from what -Mr. Clausen had told
him it is owned in a corporation and apparently can't get the .consent
to sell.

Knud Clausen said Louis Eck told him he was willing to sell but had a
partner to consider.
Mr. Reilly pointed out it seemed a question not of money, but inability
to sell.
The following resolution was presented to the Board,
RESOLUTION NO. 21 YEAR 1967
TOWN BOARD, TOWN OF WAPPINGER,
DUTCHESS COUNTY, NEW YORK,
AUTHORIZING THE SUBMISSION OF
THE SUPERVISORS ANNUAL
FINANCIAL REPORT TO _THE STATE
COMPTROLLER
WHEREAS, Subdivision 10 of Section 29 of the Town Law requires
that the supervisor of each town prepare and file with the Town
Clerk within 30 days after the expiration of each fiscal year, an
annual financial report accounting for all moneys received and
disbursed by him, together with the certificate or certificates
of the bankor trust company, where Town moneys are deposited,
showing the amount of such moneys on deposit with said bank or
trust company, and cause a certified copy of such report to be
published in the official newspaper,
WHEREAS, in lieu of preparing the report required by
Subdivision 10 of Section 29 of the Town Law, the Town Board
may determine, by resolution, that the supervisor shall submit
to the Town Clerk within 60 days after the close of the fiscal
year, a copy of the report to the State Comptroller required by
Section 30 of the General Municipal Law and the Town Clerk shall
cause a summary of such report to be published within 10 days
after receipt thereof in a form approved by the State Comptroller
in the official newspaper.
NOW, THEREFORE, IT IS HEREBY
RESOLVED, that in lieu of preparing the report required by
Subdivision 10 of Section 29 of the Town Law, the supervisor shall
submit to the Town Clerk within 60 days after the close of the
fiscal year, a copy of the report to the State Comptroller required
by Section 30 of the General Municipal Law and that the Town Clerk
shall cause a summary of such report to be published within 10
days after receipt thereof in a form approved by the State
Comptroller in the official newspaper.
Motion made by Mr. Bulger, seconded by Mr. Francese to adopt
Resolution. Unanimously Carried.
Mr. Reilly, referring to recreation areas in Quiet Acres anticipated
having deeds for the two parcels but found deficiencies in the deeds.
They had contacted_ Mr. Lapar and hope to have them. resolved. (Item
on Agenda withdrawn.)
Mr. Diehl said he had one motion and two resolutions to bring before

the Board while still on resolutions. The following motion was
proposed by Mr. Diehl:
A Motion to correct the Minutes of the March 4, 1965 Regular Monthly
Meeting of the Town Board, Town of Wappinger.
WHEREAS, the subject minutes are at variance with the wording
and intent of the original resolution on new road specifications and,
WHEREAS, there is no record of a formal, legal action, duly
executed and approved by the Town Board to change the wording of the
original resolution and,
WHEREAS, the change in wording of the original resolution that
appears in the subject minutes is in conflict with preceding
paragraphs of the minutes which define the intent, scope, purpose
and effective date of the resolution, and,
WHEREAS, the correction of said minutes to agree with the
original resolution will protect the best interests of the citizens
of the Town of Wappingers, it is hereby
RESOLVED, that the paragraph of page 212 which reads as follows:
"RESOLVED, that these requirements shall become effective
immediately and that all new roads, except those in subdivisions
whose developers have made formal application to the Planning
Board for plat approval, must comply with these specifications."
shall be and is hereby corrected to agree with the wording of the
original resolution which reads as follows:
RESOLVED, that these requirements shall become effective
immediately and that all new roads, except those in subdivisions

Board for preliminary approval, must comply with these specifications.
Seconded by Councilman Clausen
Mr. Diehl: It is my contention that the cross -off and the change
in those minutes was never authorized by the Board and should go
back to the original minutes.
Mr. Fulton: Refer this to attorney for advice - I would not be in
favor of going back and changing minutes of meeting I did not attend.
I am not so sure we can go back and change it.
Mr. Clausen to Mr. Diehl: I understand it was your motion, the
resolution originally that was presented to the Board, and it was
your understanding that the resolution was adopted as such, and when
there appeared a change in the wording, you are saying that you were
not aware of it.
Mrs. Snowden read the following:
I, Louis Diehl, currently Councilman of the Town of Wappingers,
proposed a resolution on March 4, 1965 relating to the upgrading in
the road specifications of the Town of Wappingers. This resolution
carried unanimously and was duly adopted at this meeting. I am
positive that this typed resolution presented for passage at this
meeting contained no modifications, no alterations of words, no
crossed out words or "written over" words, and in short, no changes
of any kind.
No discussion was held at this meeting on making any modifica-
tions or changes, etc.
The intent of my resolution was certainly not to give release
from the new updated road specifications predicated upon an applica-
tion for. "preliminary layout."
At a subsequent meeting of the Town Board, when the minutes
were approved, no changes, modifications etc., were considered and
the approval of the minutes of the March 4, 1965 meeting was
predicated upon the resolution passed on March 4, 1965 which was
typed in the original form.

Mr. Reilly said once a resolution has been passed, adopted by the
Board, and the minutes have been approved, it is presumptive evidence
to go back and amend it, the Board would have to have a pretty strong
indication that it was erroneous - it is legislation in that the
Board is amending previous legislation.
Mr. Diehl: I would like to have the record show that I have a
resolution on the floor.
Mr. Clausen: I wasn't a member of the Board at the time, but after
hearing Mr. Diehl's statement, I hereby second his motion.
Mr. Fulton: This should be referred to the attorney, so I recommend
voting down this motion.
Mr. Bulger: I move to amend the motion for future consideration
after we have had a formal opinion by the Attorney to the Town. .

WHEREAS, this is presently a five way criss-cross, with a
traffic island which presents confusion to drivers at this inter-
section.
WHEREAS, traffic is particularly heavy during early morning
and late afternoon industrial traffic rush, many minor traffic
accidents have occurred here.
WHEREAS, the Town would ask the State to improve this situation
with a traffic signal or a new pattern of traffic flow.

Presented by Mr. Diehl.
WHEREAS, since the completion of the Newburgh -Beacon Bridge,
traffic in both directions has steadily increased.'
WHEREAS, housing developments, both east and west of 9D have
increased the traffic flow on the New Hamburg -Hopewell and 9D Road,
which has led to dangerous conditions at this intersection.
WHEREAS, traffic egressing from Hughsonville Road in a westerly
direction has an added impediment due to the fact that a residence
blocks off a driver's view of south bound vehicles on Route 9D.
NOW, THEREFORE IT IS HEREBY
RESOLVED, that the Town Clerk is authorized and directed to send
a letter to the State Traffic Commission requesting a survey on this
resolution.

Zoning Board of Appeals -

Mr. Francese:, The Board has recommended appointment of Mrs. Martha
Oberle, She has requested that she not be considered for the job.
I understand that the second name considered by the Zoning Board
would be Mr. Jim Mills and I wish to place his name on the table
for appointment to the vacancy caused by the resignation of Mr.
Koffsky.
Mr. Bulger: I second the recommendation of Mr. Mills. Unanimous.
Mrs. Snowden informed the Board that Mr. Graham's term expired the
first of February, adding that the Zoning Board has recommended
that he be reappointed.
Motion made by Mr. Francese, seconded by Mr. Bulger to reappoint Mr.
Graham to the Zoning Board. Unanimous.
Mr. Fulton recommended that Mr. Graham be appointed as Chairman of
the Zoning Board of Appeals, seconded by Mr. Bulger. Unanimous.
Mrs. Snowden reminded the Board that the position was open for
Town Historian.
Mr. Fulton said he had spoken to Mrs. Oberle and would like to
recommend her appointment as Town Historian. He mentioned that she
has a background in history, and has a very good knowledge of the
subject and how to approach it. Motion made by Mr. Fulton to appoint
Mrs, Martha Oberle as Town Historian, seconded by Mr. Bulger. Unanimous.
Mr. Francese said he would like to suggest to Mrs. Oberle that she
find out who owns the cemetery.
Knud Clausen pointed out that there was a sign in that cemetery,
advertising display, and he didn't believe they ever got permission
to put it up. He indicated that the sign must be moved in order to
clean up the cemetery. He then suggested that Counsel 1e directed
to look into the matter and get it moved as the property ison the

assessment rolls as belonging to the Town of Wappinger. Referred
to the attorneys.
Mr. Bulger suggested it may also need the assistance of the Engineer
to the Town.
Knud Clausen pointed out that under the law the Town Highway Supt is
responsible for caring for any abandoned cemetery.
Letter from Mr. Quinn regarding L&A -
Mr. Fulton stated that each Board member had received a copy of the
latest contract.

Gentlemen:
Certain statements contained in a letter of Joseph D. Quinn, Jr.
dated Feb. 7, 1967 concerning the above draft of contract require
answer and clarification.
It is true that I met with Mr. Quinn on Jan. 16, 1967 at his °Mae
and at his request, to discuss his proposed revision of the draft
of the above contract. At that time I made it perfectly clear
that my client desired a contract of purchase subject only to the
approval -of a bond issue by the Department of Audit and Control.
I further stated that no additional option contract was required,
since one had been entered into in 1964; that we would not consent
to the discontinuance of present legal proceedings unless there
was a definite contract of purchase with no options or strings
attached except as above indicated; and that further we certainly
would not waive all our rights unless the Town likewise consented'
to a return to the status quo, in the event of the rejection of
the bond issue by Audit and Control.
At the recent conference at which my draft of the contract was
reviewed with members of the Board, the substance of the above
was in fact agreed upon. Mr. Quinn apparently has other notions
concerning the same. Apparently, from the preseht letter, it
would appear that he did not review the results of our conference
before he re -drafted the agreement in its present proposed state.
It is again respectfully requested that a conference be arranged
at which all members of the Town Board and the principals of L&A
shall b e present to finalize this entire matter in the interest
of expediency and equity.

Mr. Clausen asked the Clerk to read an excerpt from the Minutes of
Dec. 8, 1966 meeting, paragraph from the resolution authorizing the
assignment of option to purdhase certain lands situate in the Towns
of Wappinger and East-Fishkill, bottom Page 4, unapproved minutes -
"WHEREAS, the cooperatinglmunicipalities said instruments_of
assignment."
Mr. Clausen: I think it was our interpretation at the time that the
Town Board not assign its option for the Travis property to the
sanitary landfill corporation until the Town has officially acted in
becoming a part of the sanitary landfill corporation as such. If the
Town of Wappinger does not see fit to go in as a partner and we have
signed the option over to them, we are in a bad position.
Mr. Fultpn: We are a member of the landfill corporation now - as far
as signing rights over to them until the Town of Wappinger is clear,
we would not.
Mr. Clausen made a motion that our option would not be signed over to
the joint landfill corporation until the position of the Town of
Wappinger is clear as to going ahead with it. Seconded by Mr. Diehl.
Unanimously Carried.
Mr. Clausen: As there is a public hearing coming up on the 14th - I
understand that the test borings taken out on the Travis property were
taken during the summer, following several years of drought. For our
information it would be well if we could authorize the Highway Supt.
to take test borings at this time to find out what the water table
is. The reason I'm asking this is the report we got back was that
water level is something like 7 ft below the surface. I have visited
the site several times in the past few weeks and it looked like the
water level was 11 to 2 ft below the surface. I think it would-be
well if the Town could obtain test borings this time of the year.
We should be just as concerned about the high as we are about the low.
Mr. Clausen made a motion that the Highway Superintendent be authorized
to go out with the Town Engineer and take test borings, seconded by
Mr. Diehl.
Mr. Lapar: As far as I'm concerned the corporation has hired a
reputable engineer and I would think that he would first have to be
questioned on how he got his information. We're trying to prove
something that they havenot been able to prove. The firm that was
employed has the responsibility to do this. The Health Dept. has
approved this site, it is up to them to approve it.
Mr. Fulton said Mr. Kelley had made a report on this site and asked if
anyone knew what time of the year it had been done.
Mr. Clausen: To my belief it was somewhere around May. I would like
to ask if you know over how many months duration these tests were made.
I'm wondering if it wouldn't be good practice to take borings at this
time of the year. I don't think it is an extra flood stage. The Town
may want to defend its position, or the engineering firm. Go to
sanitary landfill and ask them to have test borings taken at this time
of the year. I realize we may not have the results by the public hear-
ing.
Mr. Fulton said he had planned to ask for a vote on the night of the
public hearing.,
Mr. Clausen: You are prejudging the situation. We might have facts
come up that may require consideration.
Mr. Diehl: I heard someone say that we might hurt someone's feelings.
We should disregard statements like this. We have too much at stake
to worry about hurting anyone's feelings. If there is anything
serious coming us, something that requires discussion, it would be
putting us on a spot.
Mr. Clausen: I would like to make it clear that I'm not against the
landfill operation, not doing anything to prevent its actual occurence.
Mr. Bulger: Where does your resolution stand right now?
Mr. Clausen: To direct the Supervisor or Town Clerk to direct a letter
to the sanitary corporation to make test borings as soon as possible,
weather permitting.
Mr. Fulton: I will phone them tomorrow directly, will follow it up
with a formal letter.
The motion made by Mr. Clausen, seconded by Mr. Diehl regarding the
test borings was unanimously carried.
Mr. Diehl: I wonder if we have any report from Mr. Christensen in
regard to private water companies - assessing on it. It was brought
before the Board at the December meeting, thoroughly discussed. Mr.
Christensen said he would have a report at the January meeting. He
did send a letter in to January meeting stating that there is no
report for some reasons. I assumed tonight there -would be a report.
Could the Town Board contact him and ask him for further information

that he did volunteer to give this Board.
Mr. Bulger: I suggest that this be communicated to him early so that
he has as much time as possible before our next meeting.
Mr. Fulton: I was notified today of a stoppage in the line at
Oakwood Knolls,Sewer Line. The party that complained had a
plumber come and run a snake down the line around 80 ft. out. It
measures out to come around the front of the property from the house
to line in the street. The line is still stopped. I would like to
have something done about this. He thinks it's right out in the main.
James Tennant: My only reason for concern is it is stopped up. The
plumber ran snake out past my property line into the street. I
contacted Mr. Fulton to see what the status is. It's not a total
blockage but it's about a 90% blockage. The plumber thinks the
lateral has dropped as he hit something solid.
Mr. Fulton: Mr. Euell (E.C:=C.) contacted me, and he didn't feel it
was anything in the plant. It's somewhere between the main and the
house line.
Mr. Lapar: The legal question is where the responsibility of the-
owner ends and where the sewer district takes over. It varies in all
different townships.
Mr. Reilly: Question number one is where the stoppage is.
Mr. Lapar: Or does the sewer district take over at the property line.
If there is any digging to be done on his house connection, that's his
cost. The question is, is that whole lateral or house connection; is
that fully the responsibility of the house owner, or, is there someplace
along that lateral where the district takes over.
Mr. Reilly: First thing is to determine where the blockage is.
Mr. Fulton: Should the Town Board permit Mr. Tennant to dig it up
and find out where the blockage is?
Mr. Lapar: If the Town digs this up and pays this, they're going to
have to dig up everyone's.
Mr. Arndt: There are two houses involved in this.

Mr. Fulton directed Counsel to look into the legality as to who will
bear the responsibility, and have the Town Engineer present when it is
dug up. Mr. Fulton mentioned that the other house involved was Chester
Miller, Robert Lane & Patti Place intersection, about three houses up
from Mr. Tennant. It was his understanding that he had to dig it up.
Mr. Tennant: I just wanted to say that it wasn't my intent to come in
and stick the district with this - I was in doubt. Anything the Town
can do I certainly will appreciate - any expense that is my obligation
I will certainly meet.
Letter from Vincent Kelley - pertaining to testing and inspection.
sanitary sewers Rockingham Farm recommending provisional acceptance
of trunk sewer lines connecting Ye Olde Apple Orchard Section I to
the Rockingham Farms sewer plant was received by the Board.
Mr. Bulger: Refer it to Counsel for resolution.
Letter from Mr. MacDonald, and answer from Quinn & Reilly regarding
assessment of the Village Lake.
Mr. Bulger: I think this should be discussed by the Board in executive
session.
Letter from Mr. Christensen referring to an erroneous light district
assessment and subsequent request of Mr. Samuel Noto to assessors for
a refund.
Mr. Reilly: We will have an opinion.letter going out on this tomorrow.
Copy of letter from Mr. Quinn to Mr. K. Clausen regarding bond issue
for purchase of equipment was read by the Clerk.
Mr. Diehl: Do we have to act first or Dutchess County?
Mr. Bulger: First, Superintendent of Highways must act - then we will
act and then Dutchess County.
Mr. Reilly: Advertise for bids is the first thing.
Letter from Alien Rappleyea and letter from Telephone Co. (Mr. Brown)
to Mr. Schwartz and Resolution, pertaining to application for CATV
were received by the Board. Referred to Counsel.

,Mr.[ Reilly: The record should show the letter and resolution and
application have been received and referred to Counsel. Any consent
for franchise would require a public hearing.
Mr. Fulton: Mr. L'Archevesque has been interviewing these companies
and the last one he reviewed was this company here. He is going to
be prepared to make a recommendation on this soon.
Mr. Bulger: Would it be possible to see what they want to install
or where they want to install it?
Mr. Clausen: Your intent is to notify all the people who have written
us?
Mr. Fulton: Mr. L'Archevesque has specifications which we asked him
to review with them. This is the last one he reviewed. He wants to
make a report to the Board in executive session and I would suggest
the Town Board take it from there.
Refer to Attorneys for review of the resolution.
Let record show that Mr. Ludewig indicates he has no record of an
application on file for building permits.
Two letters from E.C.C. regarding Oakwood Knolls were received.
Referred to Town Engineer.
Mr. Clausen: What is the situation there now as far as the County,
Mr. Ritter or the Town? If these things are to be repaired, let's say
immediately, whose expense is it? Do we have a contract?
Mr. Fulton: We have a contract.
Mr. Clausen: Mr. Euell was in a quandry as to who really was responsi-
ble if something should happen over there.
Mr. Bulger: The contract said we have the right.
Mr. Clausen: Mr. Euell didn't know that the Town would allow him to
do this and charge it back. He was wondering who was actually
responsible. I think if we could, we should clarify it.
Letter from Planning Board in reference to Spook Hill Properties
(Hankin).
Knud Clausen: How long can the Board give him extension when he hasn't
even cut down a tree out there? In my opinion the Board should deny
the extension until he comes in under new specification.
