An Adjourned Public Hearing was held by the Town Board of the Town of Wappinger at the Town Hall, Mill Street, Wappingers Falls, New York, on Thursday, December 8, 1966, at 6:30 P.M. Mr. Fulton opened the meeting at 6:40 P.M. for the purpose of hear- ing any interested persons on the Petition of D.C.R. Realty Corp. for rezoning a tract of land on Route 9 and Cooper Road. The Clerk submitted that notice of publication and posting along with their respective affidavits had been ofered for the record. The application had been read, and the Board had received the decision from the Dutchess County Planning Board. Mr. Fulton asked if there was anyone present to speak in favor of this petition. Edward Rosen, representing the owners of the property, wished to make 4 points in favor of the application. First, for the benefit of the Representatives from Fishkill, he reiterated the purpose i.e, request for a planned industrial zoning classification, under which, anything that is constructed on the property would have to be approved by the Town of Wappinger Planning Board. Second, Mr. Hansen's intent to move Roe Movers to this particular location - office and warehouse for furniture storage; third, the geographic suitability of the land (almost a bowl -like swamp, with surround- ing land steep, rocky hill) for Industry rather than single family dwellings; and further what is sought to be put on this acreage is something that would increase, and add to, the broad Tax Base of the Town in every respect, and wouldn't burden the schools by additional homes. Mr. Rosen concluded by noting that at the request of the Town and Counsel to the Town, the Corporation had agreed in writing acknowledged, so that it could be recorded by any town- ship, that this land would not be used for any lesser purpose - i.e., one family or multiple houses or anything of that nature. George Pagones, representing the Megtam Corp., purchasers of this property, noted that this property was strictly rem ainder land, any good land having already been sold off, and that development of this area for residential use would be too costly. 3 55; ja Mr. Fulton asked if there was anyone present to speak in opposition to the Application. Edward Cunningham, attorney for the Town of Fishkill, was present to speak in opposition in the behalf of the Town of Fishkill. Mr. Ronald Brown, Chairman of the Town of Fishkill Planning Board, Mr. Fietsam, Planning Board Member, and Mr. Everett Johnson, Councilman accompanied Mr. Cunningham. Mr. Cunningham made particular reference to the resolution of the Dutchess County Planning Board (October 13, 1966). He pointed out that they would be opposed to this change in zoning in that: 1. Land in the vicinity of the tract be reclassified has been developed along the lines prescribed by both towns. 2. The parcel proposed for re -zoning extends for approximately 600 feet and; if approved, would create a potential for industrial development penetrating the heart of a growing residential area. Mr. Cunningham placed the Town of Fishkill's objections on the facts that the parcel adjoins Fishkill R-40 areas back to back; there is no great commercial development in the area and no industry to speak of; and there didn't seem to be the need for such a vast tract for what had come before the Wappinger Board for rezoning. Fishkill's opinion was that Wappinger should respect the develop- ment plan agreed upon by Fishkill, Beacon and Wappinger in 1961- 62 for uniform development. It was suggested that if the Town felt the need for industry, industrial areas be set up that cen be reasonably suited for the needs of the community and the property owner. The feeling expressed was that it was important that the people in the area have confidence in zoning. Another possibility offered was Buffer Zoning - preventing spot zoning - provision of some pattern and plan - graduating from Industrial areas to greater restrictions. In conclusion it was requested that Wappinger evaluate rezoning carefully, and keep in mind the spirit of cooperation that has existed between the adjoining towns, and_ deny the rezoning request. Mrs. Keeler expressed her feeling that this rezoning violates the Town study plan and she is against it. Edward Rosen, in defense of the petition, pointed out what had been done in Poughkeepsie, citing the DeLaval plant, and that the Planning Board could make certain that lands adjoining this property were protected in the same manner. Mr. Spevak brought out the fact that this parcel is unsuitable for a residential area, and in order to make the land usable, the amount of money that would have to be spent would prohibit development, except for commercial and industrial usage. He also felt that Fishkill has a built-in buffer zone, the hill rising up from the swamp and the acreage in the Town itself. Ronald Brown, Fishkill Planning Board wanted the point clear that one of Fishkill's objections was that this rezoning was not in keeping with the Town of Wappinger and Fishkill's Developement plan. Mr. Diehl requested more information on this Development Plan and questioned if in the past the two Towns consulted each other before acting. Mr. Brown answered giving a brief resume of formation and content. Mr. Keeler remarked that the Town does have an Industrially Zoned area on Route 376, and asked why there was the need for more when what is already zoned has not been utilized. Mr. Eck expressed his feeling that if anything would help with the Taxes, even a dollar a thousand, the Town should go 100 % for it.
