1966-11-29 SPMWAIVER OF NOTICE OF SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF WAPP[NGER DUTCHESS COUNTY, NEW YORK The undersigned, being all of the members of the Town Board of the Town of Wappinger, Dutchess County, New York, do hereby waive notice of the time and place of the holding of a Special Meeting of said Town Board, and do hereby agree and consent that the same be held on the 29th day of November, 1966, at 10:45 o'clock in the afternoon of that day at the Town Hall of the Town of Wappinger, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, for the transaction of all business which may properly come before the meeting or any adjournment thereof. / \ / � /�/ '/� c� � �"per.|sor 6 4 us ice ohe Peace Due and timely notice of the above mentioned meeting is hereby admitted. Town Clerk ago A Special Meeting of the Town Board of the Town of Wappinger was held at the Town Hall, Mill St. Wappingers Falls, N.Y. on Nov. 29, 1966. Present: Joseph H. Fulton, Supervisor Louis Diehl, Councilman William J. Bulger, Justice of the Peace Louis Clausen, Councilman Vincent Francese, Justice of the Peace Elaine H. Snowden, Town Clerk Others Present: Harold Reilly, Attorney to the Town Supervisor Fulton called the meeting to order at 10:45 P.M. Mr. Francese proposed the following resolution: WHEREAS, on the 1st day of November, 1966, a public hearing was held in the Town of Wappinger, Dutchess County, New York, by the Water Resources Commission, pursuant to Section 451 of the Conserva- tion Law, and WHEREAS, the Town of Wappinger appeared at said hearing and opposed the application of Schoonmaker Bros. Inc. and, WHEREAS, at the request of the Town of Wappinger the said hear- ing was adjourned to the 16th day of November, 1966, for the taking of further evidence in support of its position, and WHEREAS, with the consent of the applicant, the said hearing was further adjourned until the 19th day of December, 1966, and WHEREAS, this Board is desirous of ending the Said hearing and having the Water Resources Commission make its finding without the submission of further evidence, NOW, THEREFORE, it is hereby RESOLVED, that this Board does hereby withdraw its request for the opportunity to submit further evidence at an adjourned public hearing, amd it is further RESOLVED, that this Board has no objection to the closing of the hearings and it is further RESOLVED, that this Board requests that the Water Resources Commission make its findings on the objections submitted by the Town of Wappinger at the hearing of November. 1, 1966, and other evidence heretofore submitted. Seconded by Mr. Clausen. Roll Call Vote: Mr. Fulton Aye Mr.: FranceseAye Mr. Bulger Nay Mr. Clausen Aye Mr. Diehl Aye Resolution duly adopted A Resolution was read relating to installation and operation of 851 4 public and private water supply and distribution systems in the Town of Wappinger. Mr. Diehl: The reason I came back was because of our worthy Judge Bulger and Judge Francese - to act on the first resolution and that was all. Motion to adjourn made by Mr. Diehl and seconded by Mr., Clausen.. Roll Call Vote: Mr. Fulton -----Nay Mr. Clausen Aye Mr. Francese---Nay Mr. Diehl Aye Mr. Bulger Nay Motion Failed Upon conclusion of the vote, Mr. Diehl and Mr. Clausen left the meeting. Mr: Fulton advised them, before their departure, that the meeting was not adjourned. Mr.,Fulton proposed the following resolution: RESOLUTION, TOWN BOARD RELATING TO INSTALLATION AND OPERATION OF PUBLIC AND PRIVATE ' WATER SUPPLY AND DISTRIBUTION SYSTEMS IN THE TOWN OF WAPPINGER WHEREAS, it has come to the attention of the Town Board that the Town of. Wappinger .lacks; regulations sufficient to protect and safeguard the residents of the Town with respect. to the installation and operation of public and private water supply and distribution systems, and, WHEREAS, it appears that no applicable State statutes and regulations exist to affo:r,d such protection to the public as is necessary and appropriate, and, WHEREAS, the adoption of a local law to afford such protection is indicated, NOW, THEREFORE,it is hereby RESOLVED, that no private or public water supply and distribu- tion system other than ones installed and operated prior to the date of this resolution shall hereafter be constructed, installed, extended and/or operated in the Town of Wappinger for the purpobe of supply- ing domestic water to twd or more dwelling houses until an appropri- ate local law relating to the same shall have been presented to this Town Board and either adopted or defeated, and it is further RESOLVED, that this resolltion shall take effect immediately. Resolution failed for lack of a second. Mr. Francese: I cannot condone the causing of a good business climate for one developer, to the detriment of another - by present- ing this type of a resolution would cause this kind of a situation. 3 b4r.
