1966-09-20 RGM (adj)2 44 The Adjourned Meeting of the Town Board, Town of Wappinger, was held on Tuesday evening, September 20, 1966, at the Town Ho||, Mill Street, Wappingers Falls, New York Present: Joseph. H. Fulton, Supervisor Vincent S. Francese, Justice of the Peace 0_ou\s D. Diehl, Councilman Louis C. Clausen, Councilman Elaine H. Snowden, Town Clerk Absent: William J. Bulger, Justice of the Peace Others Present: Joseph D. Quinn, Attorney for the Town The Meeting was called to order at 8:55 P.M. by the Supervisor for the purpose of straightening out Mr. Su||o's Bond for Hickory Hill Section of Fleetwood Manor Subdivision. Mr. Fulton: Our Attorney advises me he soes not have a written resolution, but advises us that we can make an oral resolution. Mr. Quinn informed the Board that the corrected bond had been brought in to his office this morn- ing. He reiterated the fact that there had been a bond posted September 9, 1965, geared to the March 1965 Road Specifications. After conferences late this summer and a determlnk-inotinn made, the Developer was requested to furnish the To!oin with an amended Bond reflecting the fact that the Bond which had Been posted was to insure establishment of Roads under previous specifications, and also include an expirotionidate. The amended Bond before the Board, in the amount of $20/000, including all terms exactlythe same as in Septimber 1965 Bond, is signed, sealed acknowledged properly by the principals and surety company. The expiration date is 2 years from date (September 9, 1065) of origional issuance. Mr. Francese made a motion that the amended bond presently offered by Gallo Bros. Holding Corp. and Anthony T. Gallo and Frank Gallo as principals and Continento('Casuaity as surety be accepted by the Town of Wappinger to assure completion of roads and improvements in the Hickory Hill Section of Fleetwood Manor Subdivion in accordance with the specifications immediately preceding March 1965 specifications. Seconded by Mr. Clausen. Roll Call Vote -Motion unanimosly carried. Mallon was made by Mr. Francese that the meeting be adjourned at 9:40 P.M., seconded by Mr. Clausen. Motion unanimously carried. Meeting adjourned 9:40 P.M. c�`�, ��OL-US) .x.0 ���AA '^�� -~' RESOLUTION, TOWN BOARD, TOWN OF WAPPINGER, DUTCHESS COUNTY, ESTABLISHING SCHEDULE FOR EXPANSION OF EXISTING FACILITIES OF THE ROCKINGHAM FARMS SEWER DISTRICT FOR THE CONVEYANCE, TREATMENT AND DISCHARGE OF DOMESTIC SEWAGE Proposed by: Cuvrc,. XNNA,r ‘¢XA WHEREAS, a special district known as Rockingham Farms Sewer District and situate in the Town of Wappinger, Dutchess County, New York, was established by the Town Board of the Town of Wappinger by order duly adopted on April 26, 1966, and WHEREAS, the Department of Health of the State of New York did, on May 11, 1966, issue a permit to the Rockingham Farms Sewer District allowing the conveyance, treatment and discharge of domestic sewage at the rate of 200, 000 gallons per day based upon presently existing facilities and/or previously approved planned facilities, and WHEREAS, since the date of issuance of the aforesaid permit, applications have been made to the Department of Health of the State of New York and permits issued for two sewer extensions contemplating additional cormreyance, treatment and discharge of domestic sewage at the rate of 67, 600 gallons per day, and WHEREAS, there is presently pending before the Department of Health of the State of New York an application contemplating additional conveyance, treatment and discharge of domestic sewage at the rate of 48, 000 gallons per day, and WHEREAS, the Town Board of the Town of Wappinger has been advised by the engineers to the said special district that the existing facilities thereof must be expanded to accomodate anticipated extensions of service, and WHEREAS, the Town Board of the Town of Wappinger has been -1- advised by the Department of Health of the State of New York that currently pending and future applications for extension of service in the said special district will not be considered for approval until that department is furnished with evidence of formal action taken by the Town Board of the Town of Wappinger to insure the planning, construction and completion of expanded facilities in the Rockingham Farms Sewer District, and WHEREAS, the Town Board of the Town of Wappinger has previously taken action to authorize the engineers to the said special district to prepare plans for construction of expanded facilities in said district, and WHEREAS, this Town Board has heretofore taken action to authorize its supervisor, its counsel and the engineers to said special district to apply to appropriate agencies of the United States of America and the State of New York for financial aid to defray the cost of preparation of engineering plans and studies relating to the expansion of facilities in said special district and to defray the cost of constructing such expanded facilities, NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: 1. That the Supervisor of the Town of Wappinger, with the cooperation and assistance of counsel and the engineers to the Rockingham Farms Sewer District shall file an application with the Department of Housing and Urban Development of the United States of America, not later than October 15, 1966, for a loan providing financial aid to defray the cost of preparation of engineering plans and studies relating to the expansion of facilities in the Rockingham Farms Sewer District. 2. That the Supervisor of the Town of Wappinger, with the cooperation of counsel and engineers shall file an application with the appropriate agencies of the United States of America and the State of New York, not later than October 15, 1966, for financial aid for construction of -2- sand filters of a capacity of 200, 000 gallons per day at the Rockingham Farms Sewer District. 3. That the aforesaid sand filters shall be constructed and installed not later than May 15, 1967. 4. That at the point in time when the measured flow through the Rockingham Farms sewage treatment and disposal plant has reached 100, 000 gallons per day, the engineers to the district shall prepare and furnish to the Town a report on expansion of treatment facilities, said report to be made in accordance with "Bulletin 1" and "The Waste Water Facilities Report" (BWRS, March 16, 1966. ) 5. That at the point in time when the measured flow through such plant has reached 200, 000 gallons per day, the expansion of treatment facilities, based upon approved plans and a properly issued permit, shall be completed and in operational condition. 6. That this resolution shall serve as a declaration of intent and policy by the Town Board of the Town of Wappinger with respect to the subject matter hereof.
