1966-09-08 RGMThe Regular Meeting of the Town Board, Town of Wappinger, was held on Thursday evening, Sept. 8, 1966, at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Joseph H. Fulton, Supervisor Louis C. Clausen, Councilman William J. Bulger, Justice of the Peace Louis D. Diehl, Councilman Elaine H. Snowden, Town Clerk Absent: Vincent S. Francese, Justice of the Peace Others Present: Joseph D. Quinn, Jr., Attorney for the Town Vincent C. Kelley, Engineer for the Town Knud Clausen, Highway Superintendent The meeting was called to order by Supervisor Fulton at 8:15 P.M. Open discussion -was held from the floor. Meeting resumed 9:10 P.M. Motion made by Mr. Bulger to accept minutes of Aug. 4, 1966, seconded by Mr. Clausen. Motion Unanimously Carried. Motion made by Mr. Fulton, seconded by Mr. Bulger that petition be denied upon advice of Counsel. Motion Unanimously Carried. Clerk directed to send notice to the petitioner of denial of petition. 2!9 5. Letters from Mr. Chanjn and Mr. Carlisto, two of the engineers interviewed for position of Engineer to the Town. Mr. Chanjn acknowledged his interview with members of the Town Board and expressed a desire for a favorable reply. Mr. Carlisto went into detail about hourly rates and monthly rates for specific services relating to forming a consulting engineering service including a staff of technicians, construction inspector, draftsmen etc. Mr. Fulton noted 4 engineers had been interviewed and the Board would make a determination in the near future. 6. Letter from Mrs. Robert Hanna in reference to "policy of accepting money in lieu of land" from Developers for recreational purposes. Mr. Fulton commented that it was not the policy of the Board to accept money in lieu of land, and requested attorneys for Town contact Mid— Point Park, Inc. and inform them it wasn't the Town Boards policy to accept money in lieu of land and empower attorneys to negotiate for dedication of land to the Town for recreational purposes. Motjonr Unanimously Carried. Mr. Quinn agreed with the thought Mrs. Hanna expressed. He seriously questioned the right of the Town.to accept a payment of cash in lieu of dedication of land. He noted that the only instance under the statute that money may be accepted is when it is impractical or impossible to dedicate land. It was requested that the Planning Board be requested to amend their policy of accepting cash in lieu of land for Recreational purposes. ,Also, that the Recreation commission be notified of this action taken. Mr. Clausen: Might not the Building Inspector be involved here in relation to the amount of building already in progress and the amount of land needed. Mr. Quinn suggested that the matter should be pursued immediately. 7. Letter read from Friends of Grinnell Library requesting contribution to Program Book for Harvest Ball. Legal obstacle (unbudgeted and Town already supports Library). 6. Contract for Raymond and May Planning Consultants, tabled from last meeting. Mr, Quinn informed the Board he had spoken with Mr. Raymond about the revised contract, and more recently with Mr. May, both indicating they approved of revisions and would send it out. As the contract has not yet been forthcoming the matter was tabled until the next meeting. ���� ~- � � 7. Request was received from the Planning Board for 3 members be granted permission to attend. Motion was made by Mr. Clausen, seconded by Mr. Bulger that permission be granted 3 members of the Planning Board and Mr. Ludewig, Building Inspector to attend the conference and that payment of their expenses be authorized. Motion Unanimously Carried. 8. Mr. Bulger requested permission to attend the New York State Magistrates meeting at Lido Beach N.Y. Sept. 18-21. Motion was made by Mr. Diehl, seconded by Mr. Clausen to grant permission to Mr. Bulger to attend the meeting and authorize payment of his expenses. Motion Carrt|ed. Mr. Bulger Abstained. 9. Mr. Diehl: l would like to bring up such things as temporary approvals on Sewage Treatment plants. l would like to suggest a discussion between Mr. Ludewig and the new engineer to the Town with regard to not issuing C.O.'s until complete approval is given. l would like this to go into the form of an investigation and go through it with Mr. Ludewig and our new engineer, and do away with temporary approvals of all kinds. Mr. Ludewig: There Is a valid reason for issuing temporary C.O.'s, for instance, if a man was putting up 15 apt. buildings and had 3 completed, the builder should be given a temporary C.O.If the grounds and landscaping are not complete, this could hold back a C.O. There are 2 sides to the thing. l think, however, it is a very good thing to explore. Mr. Quinn: (referring to issuing permits on Sewer Plants) the Town has no authority if the State or Dutchess County authorize operation of a Sewer Plant. The Town relinquished its control quite some time og)to the County Health Dept. This is not within the province of this Town to regulate unless there are some undisclosed facts that would prevent them from getting C.O.'s. Mr. Fulton: When the County Health Dept. issues a temporary permit and we Issue a temporary permit we're the ones who get in a box. Mr. Quinn: It has been 2 yrs. since temporary permits have been issued by the County. l know of nothing where temporary permits has,been issued since Oakwood Knolls. The Town must give permission for people to occupy, if they refuse to do so the court will compel it. Mr. Fulton: Can the .Town enact an Ordinance more restrictive than the QJunty Health Dept.? Mr. Quinn: Nb Sir. Mr. Clausen: Weren't temporary C.O.'s issued in Montclair Apts.? Mr. Quinn: No 9.2i�: Mr. Diehl: I thought it was temporary. Mr. Quinn replied it was not. Mr. Fulton: Although they issue the permits, can we pass an Ordinance that states that occupancy cannot be had until installation is complete? Mr. Quinn: No, you may not. Mr. Bulger: What you are saying is that we have duties but no rights. Mr. Quinn: I have said we have no Jurisdiction over the matter. Mr. Bulger: You miss my point. My point was we have the right to issue or not to issue a C.O. You are saying that if the action of the County is not in the best interest of the Town we should go ahead and issue it anyway. Mr. Quinn: If you have definite facts — if the officials of the Town think, in good faith, that the County is overlooking something, the Building Inspector may refuse to issue the C.O. but, unless there are facts that Justify the action the courts will compel this. Mr. Diehl: I think, if it is possible, that we can put ourselves in a better poyition, possibly that minimum specs can be boosted up — something to look into. Mr. Fulton: I learned this afternoon from Mr. Thompson, Hydraulic Engineer of Water Resources Commission that Oakwood Knolls did not receive final approval from water resources. Mr. Ritter shouldn't have operated it before.the system was completed and petitioned for final approval. He said there was corrective action that could be taken on this. I plan to follow this up tomorrow. Mr. Clausen: (to Mr. Fulton) you have indicated an Oakwood Knolls investigation of sewer plant and water system, that it was being studied and a report to be forthcoming. Have you got it? Mr. Fulton: No, they reported in the Poughkeepsie paper that they expected reports from the County by Aug. 31. The attorney for the State Board of Health is working with the County Attorney. Mr. Clausen: I think It is our intent to have an open hearing. Mr. Fulton: This point has been brought up. I feel it should be held locally. Mr. Clausen: As far as the Town is concerned, an open hearing in Wappingers has not been scheduled, we should go as far as the Governor. I think we should set a deadline for an investigation. We should send a telegram to the Governor asking for the Public Hearing in Wappinger. Ellie Menshu said she had spoken with Mr. Richards and Mr. Jackson 22" asking w� m*w* asklnQ why it has been taking so long. She was informed that since Aug. 1st the Dept. has conducted 130 separate hearings throughout the State on similar prob\emS. They are aware of it. Mr. Clausen: { mould like to go on record to push it. Rules suspendedon motion of Mr. Bulger, seconded by Mr. Clausen and carried.' Mr. James Porter asked if the Town had received recognition from anyone in the State on a petition concerning the status of Oakwood Knolls sewer. It was sent 3 or 4 months ago and the residents never heard anything about it. Copies were sent to Mr. Ingraham, Dr. Vassallo and the Supervisor. Residents of Oakwood Knolls have brought up the issue at the State and County levels. Mr. Fulton: Nothing has been heard. Rules resumed on motion of Mr. Clausen, seconded by Mr. Bulger and carried. Mr. Clausen: l make a motion that this Town Board make the Governor aware of our request, see if we can get action. l think the State should come and investigate this on their own, we should make request for an investigation solely by the State, seconded by Mr. Diehl. Motion Unanimously Carried. Mr. Bulger: Now we are left with the mechanics. Mr. Clausen: . We can get'together informally tonight after the meeting and draft a letter. Mr. Diehl: In reference to the Fleetwood area regarding the water supply, it hos never been approved by the'Woter Resources Board and has been operating Illegally. On the basis of this I nm informed that they have no right to charge for water. l move that this Board notify Water Resources Board of the problems that exist - poor supply, poor pressure, fragments - and direct our attorney to investi8ole° Seconded by Mr. Clausen. Motion Unanimously Carried. Mr. Quinn: Final approval of the Water Resources Commission is a step . that takes months or years after preliminary approval is given. Mr° Fulton: In their application, the CommTsSion has stated that final approval must be given before'the system is operated; Mr. Quinn: What happens is this - after resources commission holds bearing and approval of plans and installation is made under the supervision of. a licensed engineer water may be and'990 of the' time: is, provided. I think you are reading into the preliminary order, of the resources commission something that isn't there. It is unthinkable that people residing in a development could be furnished with water on a portable basis and not be obliged to pay for it. Water Resources Commission and in some cases, Public Service Commission, keeping touch with supplier. -I don't think this does away with any indebtedness between the supplier and the consumer. When the value is more than $30,000, rates are set by Public Service Commission, under this amount there is no regulation. Any penalties would go to the Attorney Generals Office, it would be up to them whether any punitive action was taken. Mr. Diehl: I would like to have the Water Resources Board notified and establish whether they are operating illegally. Water Resources Board of New York State should be notified of the condition that exists here, that they are operating without approval and at the same time, should they be charging for water when it has never been approved? Mr. Bulger: First, find facts, second, recommend appropriate action by appropriate authorities be taken if these are not in accordance with legal authorities. Mr. Diehl: Fleetwood and Tall Trees roads, I was not satisfied with the discussion Tuesday night. He had heard summonses had not been served and had previously questioned Mr. Quinn about reissuing them. Mr. Fulton: It was made public that we were issuing them and maybe the principals ducked them.: Mr. Quinn: Explained that one of the Principals lived in Westchester County, but the subpoena had to be served in the Town of Wappinger. A capable Village police officer had made several attempts to serve them and he is not obligated to keep trying. He said Mr. Worona had contacted him and advised him that Mr. Williams was available at any time the Board wished to have a conference with him. - Mr. Fulton: Do you still want to re—issue the subpoenas? Mr. Diehl: No, under the conditions discussed tonight, I hope some groundwork has been laid, we'll see what transpires. Mr. Clausen: Mr. Quinn's explanation has cleared up a lot of misunder— standing. Mr. Korol, a resident from Cedar Hill Rd. spoke at length about the problems that exist there with the roads. Because of the new shopping center on Rt. 52, the new IBM plant and the fact that Route 9 is being torn up, he claims that Cedar Hill Rd. has now become a secondary road and is in need of attention. He suggested that one bad curve be 2'24! eliminated before any homes are erected on that particular parcel which would make it more costly. Since the road is about 40% in Fjshkill an engineering survey could be conducted Jointly with this town, he said. He asked that consideration be given this road on next years budget. Mr. Clausen: The surface of this road is good, there are many others that require attention more. If provision is made in the budget for surveying, this road will be surveyed. When Mr. Korol asked for caution signs and that the brush be cut back, Mr. Clausen told him that he would put signs up and the brush could be cut back as far as the Town owns. Mr. Bulger: I believe that the Commissioner of Motor Vehicles is charged with providing assistance to local governments in areas of traffic safety and problems. It might behoove us to ask for advice and counsel. Should we approve this back road to the point where it is completely improved or improved by 50%, we will attract possible 100% more traffic. I think we should call on the Commissioner of Motor Vehicles for assistance, to analyze the problem before we end up with a plan that brings about more problems. Mr. Fulton: We have an extensive road program outlined already, we Just haven't gotten it off the ground due to finances and the fact that we have been involved in so many other things. Mr. Diehl: Has there been any further report on Mr. Kelley's 11 year Road Program? Mr. Clausen: Has this Town Board ever adopted that recommendation as a policy? It would seem to me that we should adopt it before Budget time. Mr. Bulger: There's one problem — we have a program that sets forth Bonding. Mr. Clausen: We should make a decision on how funds are going to be raised prior to budget time. Mr. Bulger made a motion to direct communications to the Commissioner of Motor Vehicles asking for his opinion on the traffic problem on Cedar Hill Road and ask his advice from a point of view of safety. Seconded by Mr. Diehl. Motion Unanimously Carried. Mr. Cortel1ino: 1. On what date will the roads in Wildwood be accepted or the road bonds be called? Road bond ran out in March of 1966. Mr. Clausen: Mr. Cortel1ino should present all questions to the Board, and we, as a Board, will give him answers. Mr. Cortelljno: 2. Beth Place has not been graded, has not been paved. I predict that there will be a road through lot #3 before Beth Place is ever built. Zoned residential — single family. 3. Street signs — we have 225 two signs at the entrance advertising Wildwood Manor. No Street signs. Mr. Bulger, is it true we had a fire on Dana Place and some individuals did not know where it is? Mr. Bulger: Yes. Mr. Clausen: It is up to Mr. Lafko to put in signs on every road. Mr. Diehl: Is it not true that there are supposed to be temporary signs? In that case, he is'supposed to put up signs. Suspend rules, motion made by Mr. Clausen, seconded by Mr. Bulger. Mr. Sevenson queried who had torn down his monuments, and torn down his stone wall. Motion to resume rules made by Mr. Bulger, seconded by Mr. Clausen. Mr. Clausen: Mr. Cortellino may present all of his questions - but we, as a Board are not prepared to answer them all at this time. Mr. Kelley was asked to be prepared to answer at the next Regular meeting on the Road Bond. Mr. Sucich: Referring to Montclair Apts. on 9D - since they have started construction I notice that the sewage treatment plant has been moved to several hundred feet from the spot originally shown on plan to the Board Right of way has been raised 5 or 6 feet above level. They put a sewer line into drainage ditch which was kept up by me and Mr. Harsborg. There was another ditch through my property which was draining possibly 6 parcels and of land/they Just buried that. They just tore up the culvert pipe. My leaching field has not been working sufficiently after that. 10yy t'iouse will be surrounded by water, even though they raised the right of way. I went to the Board of Health and asked if they approved new location of sewer lines. A new plan came up approved by the Town Board to move the sewage disposal plants and lines. We were not notified. My tenants want to move out. Mr. Ludewig: Mr. Sucich came in to us and we wrote a letter to the owners of the apartment protect. We asked them to write us and assure us it is in accordance with the plan. We have not heard from them as yet. Mr. Diehl: Has the principal a legal right to move a sewer plant without public hearing, etc.. Mr. Quinn: Mr. Sucich stated that he found that the Town Board approved the relocation. I think he is referring to the Planning Board. What zone? Mr. Ludewig: R-20 Mr. Quinn: Public hearing required? Mr. Ludewig: Yes Mr. Kelley: There was the original sewer plant shown located on the site which was approved. That sewer plant was abandoned and plans were redrawn. The second approval showed the plant to be on the same site as the original. Effectively, the second approval did not show a relocated sewer plant — certainly nothing like what Mr. Sucich is talking about. I asked their engineer if he had moved sewer plant and he said no, although it Mad been staked out by another surveyor. Tenant: Open man—holes. My son plays near there and raw sewerage runs through there. Mr. Bulger: Ask Mr. Ludewig to check on these open ditches and man—holes and attempt to have them covered as soon as possible. Mr. Sucich: On my deed Mr. Shook deeded me a 50 ft. right of way. Then these people dug through that right—of—way without my permission, — is that legal? Mr. Bulger: It is not legal, but it is not within the jurisdiction of this Board to help you. We would suggest you retain an attorney. Problems on open manholes, sewer plant and open ditch were referred to Mr. Ludewig and Mr. Kelley for report. Letter from Arthur Bisom requesting considering amending Section 416.032 of the Zoning Ordinance. Mr. Bisom came before the Board and explained that the Building stands on about a half acre of land. I am stymied for additional business because I don't have adequate facilities. I would suggest that you give my application consideration for enlargement. Mr. Fulton: We have a contract under negotiations with Raymond & May Planning Consultants and I am sure there will be many changes. Mr. Bisom: How long do you think it will take to get an answer? I have been waiting for at least 2 or 3 years. Mr. Fulton: We're trying to move very fast. We have rezoning on Route 9 to consider. I don't think it is the intention of the Board to do the whole town at once. I think there will be areas that will be done quickly. Mr. Bisom: The Board of Health gave me violation notice. I have to have two bathrooms. If I don't break out I have to close up. Rockingham Sewer District Operator — The two bids received were from Fred Lafko and Environmental Control Corporation. Mr. Fulton: We have considered tabling this tonight, several points are left to be discussed on it. We will take action in the future on it. Motion was made by Mr. Clausen, seconded by Mr. Bulger to suspend rules. 227 Ben Strosky, referring to Oakwood Knolls: I operated it for awhile and had no problems, but take Summit Gardens, there is a terrible stench up there. Mr. Diehl: Ken Euell: Summit Gardens & Oakwood Knolls? I don't get the point. We operate Summit Gardens plant at this time, let the record show that Hall & Co. is renovating and has abandoned the plant twice. We are calling them every day. Nothing is being done. The plant is in half existence at this time. As far as effluent entering stream, there is no affect. Mr. Fulton: Are you a licensed operator? Mr. Euell: Yes. Mr. Diehl: On the basis of what I have heard, I dont know whether it is the fault of the operator or the plant. Set up meeting with the two operators and come to a decision soon. Mr. Clausen: Do you feel it operated to the best of conditions? Did you get full cooperation? Ben Strosky: When I took over there was a stench there and I cleared it up within a month. Mr. Euell: Check with the Dutchess County Health Department if these are in question. I am sure our record shows in the Health Dept. what we have done. Presently operating 6 plants and fi ave 11 under contract. We have 2 licensed operators, another attending school. We are very efficient operators. Mr. Worona: Letter received from the New York State Dept. of Health concerning expansion of the plant. Letter has to be sent by the engineer before we can get our plans back. I understand the engineer has to submit a letter concerning the expansion of the plant. Mr. Quinn: Letter came in on Wednesday. Immediately took it to Mr. Kelley of the IChazen firm. Mr. Kelley has conferred with Mr. Harrison today. As a result of this conference, they want a timetable. They want a schedule. We will prepare a resolution for the next meeting. That will relieve any bottleneck that may exist. Motion made by Mr. Bulger, seconded by Mr. Clausen to resume rules. Motion made by Mr. Diehl, that the County Health Department be asked to check into conditions at Summit Gardens and notify both bidders and give specific date to come in for interview for questions that are in our minds, seconded by Mr. Clausen. Motion Unanimously Carried. Mr. Fulton: Special meeting on Tuesday or Wednesday, this will be on that matter. 229 Letter from Supervisor in reference to budget and funds. Adjustment of accounts. Motion made by Mr. Clausen, seconded by Mr. Diehl to adopt the following resolution: RESOLUTION, TOWN BOARD TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING INCREASE OF ACCOUNTS AND THE EFECTING OF THE NECESSARY TRANSFER TO ACCOMPLISH SUCH PURPOSE RESOLVED, that the sum of $10,000.00 be and the same hereby is appropriated to account "Town Hall & Offices, Repairs, Light, Heat & Phone" and that the said sum is hereby transferred thereto from account "Town Hall & Offices, Purchase of Furniture & Equipment". RESOLVED, that the sum of $1,000.00 be and the same hereby is appropriated to account "Town Hall & Offices, Repairs, Light, Heat & Phone" and that the said sum is hereby transferred thereto from General Fund. RESOLVED, that the sum of $1,200.00 be and the same hereby is appropriated to account "Town Hall & Offices, Other Expenses" and that the said sum is hereby transferred thereto from General Fund. RESOLVED, that the sum of $500.00 be and the same hereby is appropriated to account "Buildi•ng Inspector, Office & Other Expenses" and that the said sum is hereby transferred thereto from General Fund, Part—Town, and it is further RESOLVED, that the Supervisor of the Town of Wappinger be and he is hereby authorized, empowered and directed to make such transfers in accordance with the provisions of this resolution and it is further RESOLVED, that the Town Board does hereby authorize, empower and direct the Supervisor to expend s' d sum for the above mentioned purpose and for not other purpose. Resolution submitted on amending the 1966 Budget on Appropriations for the Chelsea Fire District. ��&� ���49 RESOLUTION, TOWN BOARD, TOWN OF WABzlNGER, DUTCHESS COUNTY, NEW YORK, CURRECTlNG APPROPRIATION PLACED IN THE 1965 TOWN OF WAPPINGER BUDGET FOR 1966 EXPENDITURES OF THE CHELSEA FIRE DISTRICT WHEREAS, the commissioners of the Chelsea Fire District did during the year 1965, submit to the Town Board of the Town of Wappinger an estimated appropriation in amount of $8,300.07 to meet the estimated expenditures of said special district for the year 1966, and WHEREAS, the said commissioners of the Chelsea fire district overlooked' the fact that a portion of said appropriation should have been raised by tax upon real property of the special district situate in the Town of F|shhi||, Dutchess County, New York, and WHEREAS, the entire amount of such appropriation was included by inadvertence in the budget adopted during the year 1965 by the Town Board of the Town of Wappinger for the year 1906, and WHEREAS, it has been determined that the correct amount of said appropriation to be raised by tax upon real property situate within that portion of the special district which is located in the Town of Wappinger is the sum of $5,505.37. NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Town budget of the Town of Wappinger adopted in the year 1965 for the year 1960 be and the same hereby is amended and corrected to the extent that the total appropriation for the Che|seq fire district be and the same hereby is fixed in the sum �f $5,5O9.5O, and to the further extent that the total revenue to be raised for the Chelsea fire district be and the same hereby is fixed in the sum of $5,505.37^ and it is further RESOLVED, that a copy of this resolution be attached to and made a part of the aforesaid budget adopted in the year 1965 for the purpose of givingevidence that the said budget has been amended and corredted nunc pro tunc. Mr. Quinn: When Chelsea submitted their appropriation last fall, they put in a figure and forgot to specify that part of the tax should be taken out of Fiahki||. Motion made by Mr. Diehl, seconded by Mr. Bulger to adopt resolution. Mr. Quinn: A claim has been served on us on the basis that we unconstitutionally turned the water back on in Oakwood Knolls. Motion made by Mr. Bulger, seconded by Mr. Clausen to refer this to counsel. Cable TV — Mr. Fulton: We have all been reluctant to act and have heard a lot of rumors concerning the possibility of interference with non subscribers of Cable TV. Mr. L'Archevesquo: The intent was to turn these proposed specifications over to our attorney and have him draft a form to send to the applicants who have applied for permission to establish CATV in the Town of Wappinger. Discussion brought out the fact that it was intended that the specification be sent to the applicants who desired to establish cable TV in Wappinger so that they might review these specs and indlcatedwhether or not they were willing and able to comply with them. Mr. L/krcheuesque indicated he had obtained the specs from IEEESpectrom. 2.3,0 Mr. Bulger: What affect would these specifications have on the telephone company, as supplier of the lines? Mr. Quinn: On the application of one or more of these people we will and must hold a public hearing and if the Board so determines, award them a. non—exclusive franchise, by resolution of the Board. Mot -ion made by Mr. Diehl to empower Supervisor to forward suggested specifications to the various companies interested and send same specifications •to WEOK in Poughkeepsie. They are now doing city of Poughkeepsie with no charge for installation, seconded by Mr. Bulger. Motion Unanimously Carried. Rockingham Farms — Motion made by Mr. Bulger•, seconded by Mr. Diehl to adopt the following resolution authorizing the initiation of Ipplications for governmental aid to the Rockingham Farms Sewer District. Motion Unanimously Carried. RESOLUTION, TOWN BOARD, TOWN OF WAPPINGER, DUTCHESS COUNTY, NEWYORK, AUTHORIZING THE INITIATION OF APPLICATIONS FOR GOVERNMENTAL AID TO THE ROCKINGHAM FARMS SEWER DISTRICT WHEREAS, the Town Board of the Town of Wappinger has been advised by counsel and by its consulting engineers that the town is eligible to receive financial aid from various governmental agencies of the United States of America and the State of New York for the purpose of defraying the cost of proposed expansion of facilities in the Rockingham Farms Sewer District and for the further purpose of defraying the cost of operating such district, and WHEREAS, this Town Board has been further advised that formal application for such financial aid must be made by the chief fiscal officer of this town with the assistance of counsel and the consulting engineers, NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Supervisor of the Town of Wappinger be and he hereby is authorized and directed to take all steps necessary to make application to the appropriate agencies of the United States of Amer-ica and the State of New York for financial aid and a$sjstance for construction of sand filters at the Rockingham Farms Sewer District in the Town of Wappjnger, Dutchess County, New York, and it is further RESOLVED, that the Supervisor of the Town of Wappjnger be and he hereby is authorized and directed to take all steps necessary to make application to the Department of Housing and Urban Development of the United States of America for a loan to defray the cost of preparation of engineering plans and studies relating to the expansion of facilities in the Rockingham Farms Sewer District, in the Town of Wappinger, Dutchess County, New York, and it is further RESOLVED, that the Supervisor of the Town of Wappinger be and he hereby is authorized and directed to take all steps necessary to make application to the appropriate agencies of the State of New York to obtain financial aid and assistance to defray the cost of operating facilities and providing service in the Rockingham Farms Sewer District, in the Town of Wappinger, and it ;is further RESOLVED, that counsel to the Town of Wappjnger and the engineering consultants to the Rockingham Farms Sewer District be and they hereby are authorized and directed to assist the Supervisor of the Town of Wappinger in the making and filing of the aforesaid applications. Mr. Bulger to Mr. Diehl: Have you had any success with the doctor attraction? Mr. Diehl: I spoke to Mr. Fulton before the meeting and 'I have a letter here from Herman Osten. Thursday, Sept. 15, Mesier Homestead will be a meeting of the committee for locating Doctors. Mr. Bulger made motion that Mr. Diehl be empowered to contract for the Town to pay a portion of the share of expenses for the purpose of bringing up a Doctor from N.Y. to interview, seconded by Mr. Clausen. Motion Unanimously Carried. Mr. Quinn: A couple of meetings ago you empowered Supervisor 'to enter into negotiations with L. & A. Motion made by Mr. Clausen to authorize and direct the attorney to the Town to proceed with Negotiations for a submittal of a contract for the purchase of the L&A Sewerage Disposal plant, seconded by Mr. Bulger.
