1966-06-16 RGM (adj)150 The Adjourned Meeting of the Town Board, Town of Wappinger, was held on Thursday evening, June 16, 1966, at the Town :Hall, Mill Street, Wappingers Falls, New York. Present: Joseph H. Fulton, Supervisor Louis C. Clausen, Councilman William J. Bulger, Justice of the Peace Louis D. Diehl, Councilman Vincent S. Francese, Justice of the Peace Elaine H. Snowden, Town Clerk Absent: None Others Present: Joseph D. Quinn, Attorney for the Town Vincent C. Kelley, Engineer for the Town Knud Clausen, Town Highway Superintendent The Meeting was called to order at 8:34 P.M. by Mr. Fulton. Mr. Fulton asked if the Board wished to hear the Public. Mr. Clausen moved the meeting be suspended to hear discussion from the floor, but since it is an adjourned meeting, limit discussion to 10 minutes. Seconded by Mr. Francese. Motion Unanimously Carried Open disciussion from the floor — Motion was made by Mr. Clausen, seconded by Mr. Francese, to bring the meeting back to order; 9:04 P.M. Motion Unanimously Carried A Petition was presented to the Town Board from residents of Dorothy Heights: We, the undersigned, being residents- of Dorothy Heights, To'Vn of Wappinger, feel that the blockade erected by the Town Highway Department during the a.m. of June 13, 1966, upon complaint of residents of the northerly end of the street, is creating inconveniences and annoyances to the residents at the most southerly end of the street. We feel that the construction workers have been considerate, and have created no conditions which have been un— desirable for residents in the immediate area. We have observed no heavy equipment being transported through Dorothy Heights into the project so far during this building season. The only traffic which has been using the construction road has consisted of private automobiles driven by the workmen. The blockade has caused a hazardous situation for school buses using the area to turn around and has created a parking problem for the workmen which, in turn, has caused inconvenience to residents of the area. The matter of the school buses has caused a great number of annoyances to those who h.0 children who are being transported on them. We, therefore, respectfully request that the Town Board take action to have the blockade removed as soon as possible. Thank you. Mr. Bulger: May i suggest that we have a poll of both sides of Dorothy Heights as to whether they want it open or closed. Mr. Fulton: I understand that there has been talk that they intend to close the road off. Suppose we clarify that with Mr. Rosen. Mrs. Pike was asked if Rosen and Rosen planned to close that road off. Mrs. Pike: We thought maybe there might be some legal matter which would say whdher it stays open or closed. We would like to have it legally decided, so that it doesn't come up next year or in the fall again. Mr. Francese: I have already contacted Mr. Rosen, and I spoke to the Super- intendent. They had planned on using Dorothy Heights as a permanent access road. Mr. Diehl: I move we refer this to our attorney so that we may come up with a final and complete answer as to whether this road can be legally a dead end or legally open. Miss Swan: You are missing the point. The pile of dirt is laying on our Property. Mr. Quinn: The road is 50 ft. in width. A lot of people think that they own to the edge of the traveled road, but the land may still belong tb,fhe Town. Mr. Francese: A turn around was never made on this road. Mr. Knud Clausen: It would be a solution that a Surveyor go down and survey the land. Maybe the road was.mislocated. Mr. Diehl: 1 would like to amend my motion to refer this to Counsil and re- quest a survey be done of the property in question. Seconded by Mr. Francese. Motion carried Unanimously Mr. Fulton: The Board just passed a motion to refer Dorothy Heights to Counsil and have a survey done. Mr. Diehl asked the Pikes and the Swans if it would meet with their approval to have this all leveled off in preparation for a turn -around. (Both Parties would accept this) Then we'll so advise the Highway Superintendent. A Petition was received from Carl Swenson for a permit to excavate gravel.; Application is hereby made by the undersigned for a permit to extract gravel in accord with Section 439, et. seq. of the Zoning Ordinance of the Town of Wappinger, and in Support of such application, the undersigned hereby submits the following information: I. The name and address of the applicant is Carl Swenson, New Hackensack Road, Wappingers Falls, New York. 2. The general area of the proposed excavation is real property owned by the applicant and situated in the Town of Wappinger, and is more particularly described on the map submitted herewith, made a part hereof, and marked Exhibit 3. In accord with the requirements of Section 439.01, et. seq. of the Zoning Ordinance of the Town of Wappinger, the excavation of gravel shall be conducted as follows: (a) No excavation shall be closer than 50 feet to any street line or other property line. Any excavation below the grade of a street line or property line shall be more than 200 feet from said lines, all as shown on the annexed Exhibit "A". fl A II 152 (b) The final slope of any excavated material shall not exceed the normal limiting angle of repose of such material. (c) Fences and/or barricades shall be erected to protect pedestrians and vehicles. All open pits shall be enclosed by fencing until they are refilled or graded. The uphill side of side hill excavations shall be permanently fenced. (d) Materials and waste materials shall be stored, piled or located relative to property lines in accord with the standards set forth in paragraph "(a)" above. After the excavation operation is complete, waste materials shall be used to fill all open pits, and any excess waste materials will be graded and leveled. (e) Excavation shall occur only between the hours of 6:00 A.M. to 8:00 P.M., Monday through Saturday. (f) Processing of the gravel excavated shall be limited to washing, separating or grading. 4. The undersigned respectfully requests that a permit be issued to him to excavate gravel in the area described on the annexed map, such permit to be for a period of not less than two years, and such excavation to be subject to and limited by the Zoning Ordinance of the Town of Wappinger. Dated: June 6, 1966 Signed: Carl Swenson Mr. Fulton entertained a motion to recommend to the Board that this request be made part of the record, and tabled for further study. Motion so moved by Mr. Clausen, Seconded by Mr. Bulger. Motion Unanimously Carried Mr. Bulger: What does the Planning Board have to say about this type of proposal? Mr. Quinn: This is a Town Board function. Motion to suspend the rules made by Mr. Clausen, Seconded by Mr. Diehl. Motion Unanimously Carried Mr. Swenson: How long will you study it? There are only 2 months before it starts getting frost again. Mr. Quinn: If Mr. Swenson has some additional engineering information, he should supply it to the Town Board. You need slope and topographical information. Mr. Swenson: If you are going to fool around with this thing, why can't you give us a temporary permit or something. Mr. Rifkin asked what zoning Mr. Swenson was in. Mr. Quinn: Looking at the maps I would say Al and GB. Motion to readopt the rules was made by Mr. Clausen, seconded by Mr. Bulger. Motion Unanimously Carried Mr. Fulton: Referring to CATV, I recommend that we table this. Motion so made by Mr. Bulger and seconded by Mr. Clausen. Motion Unanimously Carried A Contract from Commando Window Cleaning Company was presented to the Board. (Letter as follows) Gentlemen: We would appreciate your consideration of the following bid of $75 (seventy five) a month for the cleaning of the Court House located on Mill St., Wappingers Falls, New York. This includes the wabhing and waxing of all floors and the complete cleaning of the windows on the first floor and the second floor. The above will be done on a monthly basis. Third floor windows are to be cleaned every month on the inside and every three months on the outside. Respectfully, Chris Davies Robert Ruit Mr. Diehl stated it sounded like a fair price, and questioned insurance. Mr. Quinn: They would have to show proof of coverage, both workmen's Comp. and liability. Motion was made by Mr. Bulger to refer this to the Town Hall Committee, seconded by Mr. Diehl. Motion Carried - Francese Abstain Mr. Fulton: I would like to put a proposal before the Board asking authori- zation for the supervisor to authorize a standing committee under the Jur- isdiction of the Supervisor - Municipal Services - if I get recognition from the Board, I can have them report to the Board. I would want this committee to recognize possible complaints and possibly take care of them before we get them. Mr. Diehl: I do gquestion if we are stepping into areas where we do not belong, and making trouble. I do not feel I could vote on it tonight, I would like more time to make some observations. Proposal failed for lack of a motion. Mr. Fulton- Engineering service at Rockingham Sewer District - We spoke about this and show a need for an engineer to complete the district. Mr. Quinn: Professional services are not biddable. You may select on recommendation. Mr. Fulton proposed that the Chazen Firm be appointed engineers to the Sewer Disctrict. Mr. Clausen: 1 would like time to study this and look into the matter myself. I would like to see more names brought in. Motion made by Mr. Clausen to table the appointment for a week, seconded by Mr. Diehl. Mr. Quinn: This matter is imminent, as the Sewer District may not operate without a licensed engineer or engineering firm being appointed; Neither the State of New York nor the County Health Department will allow us to operate. Mr. Bulger called for a 5 minute recess. 9:40 P.M. Meeting reconvened 10:01 P.M. Motion to table the proposal of appointing an Engineer to the Rockingham Farm Sewer District for a week was made by Mr. Clausen, seconded by Mr. Diehl. Motion Unanimously Carried Letter was received from Ronnie Lafko, Licensed Sewer Plant Operator, asking to have his name placed in consideration for the position of Operator of the Rockingham Sewer Plant. Mr. Fulton suggested there would be a period we would have to have a licensed operator. If we need a licensed operator he would take it and accept payment based on the lowest bid. If you urgently need an operator he will accept it. Mr. Quinn: This fails in the same category. You may not operate the plant 154 without a licensed operator being appointed. This gentleman has said that he will work at your pleasure, and will not make a charge until you receive public bids. He will then back charge you at the lowest bid submitted. Mr. Diehl made the motion that we advertise for a licensed operator, subject to the specifications and requirements by Counsel and Engineer, seconded by Mr. Bulger. Motion Unanimously Carried The Clerk submitted a list of names for Election inspectors that had been recommended by Mr. Jay P. Rolison, Jr., Dutchess County Republican Committee Chairman, and Mr. George E. Whalen, Dutchess County Democratic Committee Chairman. Motion was made by Mr. Bulger, seconded by Mr. Clausen to appdnt names as read as Election Inspectors. (List follows on page 156) Motion Unanimously Carried Bills were submitted from the Highway Department in the total amount of $5,249.67. Motion was made by Mr. Bulger, seconded by Mr. Clausen, that bills be paid, subject to Audit. Motion Unanimously Carried Knud Clausen: In the past, I have been making a mistake. I have been paying bills that do not come under my fund; Telephone, Light, etc., I would like to have this patd back to my fund. Mr. Quinn: I would suggest that at your next meeting, the Supervisor will submit a resolution for your approval, making the necessary transfers, if Mr. Clausen will get the necessary amounts, and submit them to the Supervisors Bookkeeper. Knud Clausen: Regarding additional help — i am going to have my radio put in. My Secretary will be home—base operator at the same time. I would like her put on the payroll as a Secretary. Money is provided for in the Highway Budget. Mr. Bulger: This is the prerogative of the Highway Superintendent. Mr. Francese: I know there was a question last week on air conditioning for upstairs. There is a fund for Town Hall Improvements that hasn't been tapped yet. Installation of an air conditioning unit would come under that heading. The question was what fund it would be taken out of. Mr. Clausen: At the lastmeeting I brought up inviting Mr. Heissenbuttel. There was an open date on this. I would like to made a motion that he be invited for the 14th of July. Seconded by Mr. Bulger. Motion Unanimously Carried Mr. Francese: It was mentioned last week we would study the proposal for Wildwood streets and drainage. Has any of the members of the Board had enough time to really go over it? Mr. Bulger: I see one problem — no cost estimate accompanying it. 0.5 Mr. Clausen made a motion to have an executive meeting with the Highway Superintendent and Engineer, and go over it with Fred Lafko and Dave Alexander and Town Attorneys. Mr. Fulton made a motion to hold an Adjourned meeting on June 23rd — 7:15 P.M. before the Executive meeting with Oakwood Knolls Civic Association. Seconded by Mr. Francese. Motion Unanimously Carried Mr. Bulger: I read recently in the paper that the Governor has Just signed ligislation enabling local municipalities to reduce taxes for certain people of fixed incomes and advanced age. I suggest that the Board refer to Councel a request for a study of this particular piece of legislation andits possible repercussions. Report requested for the first of September. Mr. Quinn: I would doubt it it's in effect before the year of 1967. It is going to be a situation where people will have to apply for an exemption. Mr. Bulger: I have had some complaints about the speeding on the flat at Route 376 from the New Hackensack Road intersection to the turn at the airport. I move we direct a letter to the State Troopers in Fishkill requesting sur— veillance of this area. Seconded by Mr. Diehl. Motion Unanimously Carried Mr. Bulger stated that he and Mr. Diehl will report on their trip to Chelsea at the next meeting. Mr. Fulton brought up the; County Supervisors committee on Mosquito Control. He would like to see the Board go on record supporting Schoentag in his forming of a committee to look into the spraying by the County. Mr. Clausen: Will that be for this year? We could register as one of the Towns in need of this. Motion was made by Mr. Clausen, seconded by Mr. Bulger, that a letter be written to the Chairman of the Board of Supervisors, indicating a need for mosquito Control. Motion Unanimously Carried Motion made by Mr. Clausen, seconded by Mr. Bulger, to suspend the rules — carried — Mr. Swenson asked that no spray harmful to cows be used, and that this be included in the letter to Mr. Schoentag. Motion to readopt the rules made by Mr. Bulger, seconded by Mr. Clausen, and Motion Unanimously Carried Mr. Clausen made a motion to amend his motion to include in the letter to Mr. Schoentag that no harmful sprays to dairy cattle be used. Seconded amendment by Mr. Bulger. Motion Unanimously Carried Motion made by Mr. Diehl that the meeting be adjourned until June 23, 1966, at 7:15 P.M. Seconded by Mr. Clausen.
