1966-04-26 SPM106 WAIVER OF NOTICE OF SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK The undersigned, being all of the members of the Town Board of the Town of Wappinger, Dutchess County, New York, do hereby waive notice of the time and place of the holding of a special meeting of said. Town Board, and do hereby agree and consent that the same be held on the 26th day of April, 1966, at 8:66 o'clock, Eastern Daylight saving time in the afternoon of that day at the Town Hall of the Town of Wappinger, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, for the transaction of all business wich may properly come before the meeting or any adjournment thereof. Present: Joseph H. Fulton - Supervisor Louis C. Clausen - Councilman William J. Bulger - Justice of the Peace Louis D. Diehl - Councilman Vincent S. Francese - Justice of the Peace Elaine H. Snowden - Town Clerk Absent: None Others Present: Joseph D. Quinn - Attorney Harold H. Reilly - AttorneyJoseph E. Ludewig Bldg. Inspector Vincent C. Kelley - Engineer The adjourned hearing on the proposed Rockingham Sewer District was opened by Mr. Fulton at 8:40 P.M. Clerk read the Order for supplemental petitions of Edgehill III* Opala Realty and Angel Brook Acres which would enlarge the original district pro- posed by Rockingham Farms. A motion was made by Mr. Francese, seconded by Mr. Clausen, to waive the reading of the metes and bounds. Motion Carried Unanimously Mr. Quinn formally presented the following to the Town Board: 1. Affidavit of publication of Order made by Wappingers and Southern Outchmss News, published April 14, 1968° 2. Affidavit of posting by Town Clerk on April 14^ 1966. Mr. Quinn then took the following testimony from Mr. Kelley: Quinn: You are an engineer, licensed by the State of New York and have a license for professional engineering? Kelley: Correct Quinn: You serve in the capacity of Engineer to the Town of Wappinger? Kelley: Correct Quinn: Are you familiar with the fact that Schoonmaker Bros. filed with this Board requesting the formation of a public sewer district? And have you seen the plans? Kelley: Yes, and I have seen the plans. Quinn: Are you also familiar with the fact that on March 10 this Board adopted an Order calling for a hearing on April 4th? Kelley: Yes. Quinn: Are you further familiar with the fact that on April 4th a petition was submitted by Edgehill III* Angel Brook Acres, and Opalo Realty generally to the effect that the owners of these properties requested to join the Rock- ingham Farms Sewer District and that their properties be included? Kelley: Yes 108 108 the formation of Rockingham Sewer District and the supplemental request for enlargement of the district, particularly the latter one, and the feasibility of what is requested? Kelley: The supplemental petition requests the inclusion of subdivisions peri- pheral to Schoonmaker Bros. This is advantageous in the formation of this enlarged district in that we will have one plant instead of possibly four with ,a greater increase in operational costs. Quinn: This would have the eventual effect of lowering costs to the eventual owner of the lot? Kelley: Yes, in addition, it forms a nucleus for extension of the district. Quinn: It is my understanding that ifdthe prayer of the supplemental petition is granted, and if there is favorable action by the Town Board, there will be one large district which will be inter -connected and inter -dependent. Do you have that same understanding? Kelley: Yes Quinn: Based upon your experience in the engineering field and the field of sewage disposal and treatment plant construction, can you state whether or not you feel that granting of both of these petitions and combining of these various properties would be in the public interest? Kelley: Yes, in my opinion, it would be in the public interest. Quinn: Do you know of any reason, from an engineering point of view, why this Town Board should not act favorably? Kelley: No. Quinn: Do you have any other comment with respect to this matter? Kelley: No. Quinn: Let me ask a negative question. Were these petitions for the formation of one large district to be denied, based on your engineering experience and knowledge of sewage disposal, what would probably result? f Kelley: We could conceivably end up with what I stated before - an individual plant for each subdivision. Quinn: What is your opinion of that? Kelley: Very inefficient from an engineering and economic Standpoint. Mr. Quinn then called on Mr. Jack Hill to answer a few questions. Quinn: You are a professional engineer licensed by the State of New York? Hill: No. Quinn: A licensed surveyor? Hill: No. I am qualified as a Civil Service employee of the Dutchess County Health Department. Quinn: jWhat are your duties? Hill: I supervise the subdivision program for the County Health Department relative to approval of plans, sewage disposal systems, water systems, etc, 109 I supervise supply systems for various commercial buildings, comprehensive programs on water studies, all sewage treatment plants for all projects, plus miscellaneous emergency problems that come before our department. Quinn: In other words, your experience covers the formation of sewage disposal districts? Hill: Yes. Quinn: Are you familiar with the fact that in February 1966, the Schoonmaker Bros. Corp. filed with this board a petition and accompanying plans, maps, etc. requesting the formation of a public sewer district in the Rockingham Farms area? Hill: Yes Quinn: And, on April 4, 1966, you testified at length with respect to the Schoonmaker Bros. petition? Hill: Yes. Quinn: Are you also familiar with the fact that, at thathearing on April 4th, there wasna written petition submitted tothis Board with accompanying maps and plans made by Edgehill Manor Corp., Opalo Realty and Angel Brook Acres Realty Corp., requesting that the properties be joined and=:ricluded in the Rockingham Farms district? Hill: Yes Quinn: And are you familiar with the construction, installations and improve- ments in those areas? Hill: Yes Quinn: Based upon'.your experience in the field of sewage disposal, can you make any comment on the feasibility, particularly of the supplemental petition whereby the petitioners have -asked to join in the original proposed district? Hill: It is our job to advocate the formation of municipal sewer districts. We advocate adjoined areas beformedinto one large district wherever possible to eliminate a great number of plants being operated. It is our opinion that it is feasible to form one large. district. Quinn: Can you make any commentboth from an administrative and economic point of view if these properties are added? I am talking about the areas of cost and efficiency of operation. Hill: It is our opinion that it would be better to have one instead of con- ceivably four -individual plants (one for each subdivision). Operation of plant is better and you have only one plant to watch over instead of four. Quinn: If the various plans submitted here are followed faithfully,,and proper installation and construction is carried on, do you know of any reason why this enlarged district should not be created? Hill: No, sir. Quinn: Do you have any other comment with respect to this proposed extended district? Hill: Just to repeat what I have already stated, that our department advocates 110 the, formation of municipal districts wherever feasible so that we have as few sewage treatment plants in operation as possible. Quinn: Do you know whether this policy of the Dutchess County Health -.Depart- ment coincides with that of the New York State Health Department?. Hill: Yes, it does. Quinn: .Do you know of any -reasons why it would not be in the public interest to join these four subdivisions in the sewer district? Hill: No. Quinn: At this point, I do not have any further witnesses tcx call but I would like to state, for the record, that both Harold Reilly and I have had ,occasion to carefully examine the supplemental petition presented to this Board on April 4th by the three corporations previously mentioned and we find that, firstly, this petition ,has been properly signed and properly acknowledged in compliance with the related sections of Article 12 of Town Law, and, secondly, from an examination of the assessment rolls as of the date of the last completed roll, August 1, 1965, that the petitioners in both petitions comply with Section 191 of Town Law with respect to sufficiency as to ownership of property, and speci- fically, we found that Schoonmaker Bros. Corp. is the owner of Rockingham Farms development and the full value on the lots is $8,870. With respect to the sub- division owned by Edgehill Manor Corporation, Section III, Edgehill Manor, Inc. is owner of all lots in the subdivision and full valuation for that property on August 1, 1965, is the sum of $20,345. Ye Olde Apple Orchard, Opalo Realty is the owner of record of this property and each and every part of that property and total valuation is the sum of $37,115. Angel Brook Acres Corporation is the owner of Angel Brook Acres. and they own each and every part of that pro- perty and the property is carried on the rolls at the sum of $54,650. These four petitioners are the only owners of all properties described therein and they far exceed the requirement of Section 191 of Town Law. Mr. Fulton then asked if there was anyone who wished to speak in favor of this proposition. Mr. Don Margolis asked if it was the policy of the Board to limit discussion to those speaking for or against the proposition or if questions would be permitted and Mr. Fulton replied, that questions would be answered. Mr. Lahey expressed his concern over the affluent from the treatment plant being directed to. empty into Sprout Creek since the creek runs through his pro- perty and it is used for swimming during the summer. months. He wanted a guar- antee that the water would not be polluted, Mr. Lahey was assured by Messrs. Fulton and Hill that permission to discharge Affluent from any sewage treatment plant into any surface water comes from the State of New York Health Depart- 111• ment and that the discharge is harmless because it is processed and put through a sand filter. Mr. Fulton again asked if there was anyone to speak in favor of the proposition. Mr. Schmalz: I would like to speak in favor of the original proposal for Schoonmaker Bros. Notice I say nothing about the subsequent petition. Mr. Corteblino: I am in favor of the municipalities participating in sewer districts per se. Mr. Vandewinckel: As a representative of the Planning Board, we have deliberated this and we are on record as recommending the formation of public sewer districts and we are in favor of these being as large as possible so that there will be a minimum number of these plants in the Town. Mr. Puzio: As a taxpayer, businessman, and President of the Wappingers Falls Chamber of Commerce,and I think I speak for the Chamber, I think it is about time thatthis was done so that these men can get under way with their developments. Mr. Worona: On behalf of Angel Brook Acres Corporation, I would like to add that we are not only -in favor but I would like to state that the objective, intent and purpose is to implement, as well as amplify, the Federal and State government in the elimination of as much pollution as possible in the State and Country. Mr. Fulton then asked if there was anyone who wished to speak against the proposal. Mr. Schmalz: I was for the first proposal. I am against the subsequent proposal-untilI get some questions answered. Mr. Schmalz then directed some questions to Mr. Kelley regarding costs and was told that these questions were not pertinent. Mr. Quinn: I would like the record to show that the Schoonmaker petitions which are before this Board currently disclose that the cost of improvements in this proposed sewer district will be borne by the developers and that there will be no expense to the Town of Wappinger. Mr. Schmalz then asked how the costs would be distributed among the other developers. Mr. Fulton replied that the cost will be equally shared among the other developers. Mechanics will be worked out by the Board. We are just forming a district tonight. Mr. Schmalz: I would like to withdraw my objection if the cost is equally distributed among the developers. Mr. Fulton: The other developers are all here and I have heard no objec- tion from them. 112 Mr. Cortelljno: Eventually there are to be 1200 taps. I haven't heard any testimony as to whether the plant can handle this number of taps._ Mr. Fulton: This is not pertinent to this discussion. Mr. Margolis: Assuming the formation of this district, will there be 'an additional public hearing at that time? Mr. Quinn: This is a proceeding for the establishment of a district right now. Mr. Fulton: Any time you combine one or more districts, public hearings are involved. I would expect there would be public hearings involved. Mr. Margqlis: If this district is approved, will it then automatically be- come a part of the Town sewage system? Mr. Fulton: It will be controlled and administered by the Town Board; it will belong to the people within the metes and bounds. Mr. Herb Meltzer then asked if the plant would be privately owned and Mr. Quinn replied: Sewer districts are public entities which exist subservient to the Town Board. They are maintained and administered for the sake ofJhose property owners whq obtain the service provided for the district and the benefits resulting. When Mr. Fulton said it will be created for the benefit of people living in the boundaries, he is talking aboqt laws of the State of New York in which, if there was no need for the operation of the district or improvements of the facilities, etc., they must be sold and can be sold and, if they are sold, the proceeds must be used to retire any operating costs or indebtedness and if any owners of the property have contributed by assessment or other means, the proceeds would eventually go back to them or, if not, to the General Fund of the Town. Rents will go toward the cost of administration of the sewer district itself. There will be no private profits. Mr. Margolis: Is this subject to referendum? Mr. Quinn: No. There is no bond issue - no indebtedness by the munici- pality. Mr. Cortell.inp then raised the question as to the possibility of the Town's exercising an option to accept the plant a year from now, when they know how to use it with maximum utilization for the Town. In reply Mr. Quinn said: It is not possible legally for this Town to approve a sewer district as of tonight with the thought that some day in the future the improvements in the facilities will be contributed by these petitioners. It is not possible to approve a sewer district with a possibility of picking up an option to acquire the facilities some time in the future because we would be exposing ourselves to a vast amount of indebtedness and couldn't get approval of Audit and Control. Mr. -Julius Gerzoff then spoke, saying that the four developers involved had gotten together in the interest of getting the subdivisions going and, while they liked it less than anyone else in the Town of Wappinger, they agreed to go along with "this gift to the Town". Mr. -Meltzer: Is this proceeding only to approve the formation of a district? Mr. Quinn: With all due respect to the Townspeople, these four corpora- tions are -the sole owners of those properties and, frankly, they are really the only persons who have a genuine legal interest in this proceeding. Mr. Worona: As a point of information, the language of the petition might be a clarification. He then quoted from the petition, saying that this would be accomplished with no expense to the Town of Wappingers FIVE-MINUTE RECESS AT 9:55 P.M. HEARING RECONVENED AT 10:05 P.M. Mr. Fulton: Is there anyone else to speak against this proposition. There was no one who wished to speak against the proposition. The Town Clerk then read the following resolution forthe estabtishment of a sewer 6istrfot* proposed by Mr. Bulger, seconded by Mrs Diehl: WHEREAS, a petition in writing dated the 24th day of February, 1966, made by Schoonmaker Bros., Inc. together with the necessary -maps and plans attached thereto, has been presented to and filed with the Town Board of the Town of Wappinger, Dutchess County, New York, for the formation of a sewer district in said Town to be known and designated as the Rockingham Farms Sewer District, and WHEREAS, an order was duly adopted by this Town Board at a special meet- ing thereof held on March 10x 1966, reciting the filing of said petition, the improvements proposed, the boundaries of the proposed dfstrfct* and thmfact that the improvements proposed would result in no cost or expense to the/Town of Wappinger, and specifying April 4, 1966, at 8:00 o'clock E.S.T. in the after- noon of that day, as the time, and the Town Hall of the Town of Wappinger, as the place, where the -said board would meet to consider the petition and to hear -w� { all persons interested in the subject thereof, concerning the same, and WHEREAS, such order was duly published and posted as required by law and as shown by the affidavits of posting and publication filed therein, and WHEREAS, a supplemental petition in writing dated April 1, 1966, made by Edgehill Manor, Inc., Opalo Realty Corp. and Angel Brook Acres Corp., together with the necessary maps and plans attached thereto, in due form, has iii been presented to and filed with the Town Board of the Town of Wappinger, Dut- chess County, New York, on the 4th day of April, 1966, requesting that a deter- mination be made by this board establishing the said Rockingham Farms Sewer District as prayed for in the Schoonmaker petition, with the exception that the boundaries thereof as described in said Schoonmaker petition be changedf modified, enlarged and extended so as to include the properties described in said supplemental petition, and the said supplemental petition having included a prayer that this board call a further hearing upon said petitions sursuant to the provisions of Section 194 of Article 12 of Town Law of theState of New York, and WHEREAS, a hearing in the matter of the Schoonmaker petition was duly held by this Town Board on the 4th day of April, 1966, commencing at 8:00 o'clock P.M. E.S.T. at the Town Hall in this Town, and this board having heard all persons desiring to be heard either in support of said petition or in opposition thereto, and this board having considered the prayer for relief contained in said supplemental petition wherein and whereby it was requested that the boundaries of the proposed Rockingham_Farms Sewer District be changed, modified, enlarged and extended so as to include the properties described in said supplemental petition, and WHEREAS, upon the evidence presented at the said hearing held on April 4, 1966, and after due deliberation, the Town Board of the Town of Wappinger duly adopted an order on April 4, 1966, finding and determining the following facts with respect to the aforesaid petitions: 1. That the petition of Schoonmaker Bros., Inc. is signed and acknowledged as required by law and complies with the require- ments of Section 191. of Article 12 of the Town Law of the State of New York as to sufficiency of signers with respect to the boundaries of the proposed district described therein and is otherwise sufficient. 2. That it is in the public interest to grant the relief sought in the petition submitted by Schoonmaker Bros., Inc., with the exception of the fact that the boundaries of the proposed sewer district as described in said petition should be changed, modi- fied, enlarged and extended as as to include therein the properties and property owners described and designated in the supplemental petition dated April 1, 1966 and made by Edgehill Manor, Inc., Opalo Realty Corp., and Angel Brook Acres Corp., so that such additional properties and property owners may be benefited thereby. 3. That the creation of said proposed district, as enlarged and extended, may be accomplished without cost or expense to the said Town Board and/or to the said proposed district. AND WHEREAS, by and under the terms and provisions of the order adopted on April 4, 1966, this Town Board did specify thenecessary changes of the bound- aries of the proposed district to be made in order that the property and property owners described and designated inthe said supplemental petition be included within the proposed Rockingham Farms Sewer District, and 115 WHEREAS, by and under the terms and provisions of the said order adopted on April 4, 1966, this Town Board did direct and specify that a further hearing be held before it at the Town Hall, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, on April 26, 1966, at 8:00 o'clock E.D.S.T., in the afternoon of that day, to consider the aforesaid peti- tions heretofore filed herein, and to consider the proposition of changing, modifying, enlarging and extending the boundaries of said proposed sewer dis- trict to include the properties described in the said supplemental petition, and to hear all persons and parties interested in the subject of the aforesaid petitions, and to take such other action with respect to the said petitions as might be required by law or proper in the premises, and WHEREAS, such order made and adopted on April 4, 1966, was duly posted and published as required by law and as shown by the affidavits of posting and publication filed herein, and WHEREAS, a hearing in the matter was duly held by this Town Board on this 26th day of April, 1966, commencing at 8:00 o'clock P.M., E.D.S.T., at the Town Hall, in this Town, and this board having heard all persons desiring to be heard either in support of said petitions or in opposition thereto, and having considered the evidence presented at this meeting and hearing, and having duly deliberated thereon, NOW, THEREFORE, it is RESOLVED AND DETERMINED as- follows: 1. That the petition of Schoonmaker Bros., Inc., is signed and acknowledged as required by law and complies with the require- ments of Section 191 of Article 12 of the Town Law of the State of New York as to sufficiericy of signers with respect to the boundaries of the proposed district described therein and is otherwise sufficient. 2. That the supplemental petition of Edgehill Manor, Inc., Opalo Realty Corp. and Angel Brook Acres Corp., is signed and acknowledged as required by law and complies with the require- ments of Section 191 of Article 12 of the Town Law of the State of New York as to sufficiency of signers with respect to the boundaries of the proposed enlarged and extended district des- cribed therein and is otherwise sufficient. 3. That all of the property and property owners within the pro- posed district described in both of said petitions are benefited thereby. 4. That all of the property and property owners benefited are included within the limits of the proposed district described in both of said petitions. 5. That it is in the public interest to grant the relief sought in the said petition submitted by Schoonmaker Bros., Inc., as well as that sought in the said petition of Edgehill Manor, Inc. Opalo Realty Corp. and Angel Brook Acres Corp. to the end that the sewer district approved hereby shall include within.its boundaries the properties described in both of said petitions, and it is further RESOLVED AND DETERMINED, that the establishment of a sewer district as 116 proposed in the said petition and supplemental petition be and the same hereby is approved; that the improvements mentioned in both of said petitions be con- structed and the service therein mentioned be provided for at no cost or expense to the Town Board of the Town of Wappinger and/or to the said sewer district; that such district shall be known and designated as the Rockingham Famms Sewer District of the Town of Wappinger, Dutchess County, New York, and shall be bounded and described as follows: COPIES OF METES AND BOUNDS FOLLOW SEPARATELY AND IT IS FURTHER RESOLVED, that the Town Clerk of this Town shall, within ten (10) days after the adoption of this resolution, file and record a certified copy of the same in the office of the Clerk of the County of Dutchess pursuant to the provisions of Section 195 of Article 12 of the Town Law of the State of New York. Diehl - Councilman Aye Mr. Clausen made a motion, seconded by Mr. Francese, to waive the reading of the description of the metes and bounds attached to the above resolution. Motion Carried Unanimously Clerk then read the following Order for Establishing Sewer District: IN THE MATTER of THE ESTABLISHMENT OF THE ROCKINGHAM FARMS SEWER DISTRICT IN THE TOWN OF WAPPINGER, COUNTY OF DUTCHESS, AND STATE OF NEW YORK. A petition in writing dated the 24th day of February, 1966, together with the necessary maps and plans attached thereto, made by Schoonmaker Bros., Inc., having been presented to and filed with this Town Board praying for the formation and establishment of a sewer district inthe Town of Wappinger to be known and designated as the Rockingham Farms Sewer District, and an order having been duly adopted by this Town Board at a Special Meeting thereof held on March 10, 1966, reciting the filing of said petition, the improvements proposed, the boundaries of the proposed district, and the fact that the improvements proposed would result in no cost or expense to the Town of Wappinger, and specifying April 4, 1966, at 8:00 o'clock E.S.T. in the afternoon of that day, as the time, and the Town Hall of the Town of Wappinger, as the place, where the said board would meet to consider the petition and to hear all persons interested in the subject thereof, and a 117 supplemental petition in writing dated April 1, 1966, together with the necess- ary maps and plans attached thereto, made by Edgehill Manor, Inc., Opalo Realty Corp. and Angel Brook Acres Corp., having been presented to and filed with this Town Board on the 4th day of April, 1966, praying that a determination be made by this Town Board establiih;isng..theFsaidrR9ckin£ham Farms Sewer District as prayed for in the Schoonmaker petition, with the exception that the boundaries thereof as described in said Schoonmaker petition be changed, modified, enlarged, and extended so as to include the properties described in said supplemental petition, and the said supplemental petition having included a prayer that this Town Board call a further hearing upon said petitions pursuant to the .provi- sions of Section 194 of Article 12 of the Town Law of the State of New York, and the matter having come on for a hearing before this Town Board at such time and place, and it having been determined by this Town Board after such hearing that the petition of Schoonmaker Bros., Inc. was signed and acknowledged as required by law and was otherwise sufficient and it was•in the public interest to grant the relief sought therein but that the boundaries of the proposed sewer district asdescribed in said Schoonmaker petition -should be changed, modified, enlarged and extended so as to include therein the properties -and property owners described and designated in the said supplemental petition, and an order having been duly adopted by this Town Board on the 4th day of April, 1966, directing and specifying that a further hearing be held before it at the Town Hall, in this Town, on April 26, 1966, at 8:00 o'clock E.D.S.T., in the afternoon of that day, to consider the aforesaid petitions heretofore filed herein, and particularly the aforesaid supplemental petition, and to consider the proposition of changing, modifying, enlarging and extending the boundaries of the originally proposed sewer district to include the properties described in the said supplemental petition, and to hear all persons and parties inter- ested in the subject of the aforesaid petitions, and the matter having come on for a further hearing before this Town Board at such time and place, and it having been resolved and determined by this Town Board after such further hear- ing that both the petition of Schoonmaker Bros., Inc. and the supplemental petition of Edgehill Manor, Inc., Opalo Realty Corp., and Angel Brook Acres Corp. were signed and acknowledged as required by law and were otherwise suffi- cient, and that all of the property and property owners within the proposed district described in both of said petitions were benefited thereby, and that all property and property owners benefited were included within the limits of the proposed district described in both the said petitions, and that it was in the public interest to grant the relief sought in the said petition submitted by Schooniiaker Bros., Inc., as well as the relief sought in the supplemental 117,4 ALL that certain .piece or parcel of land situate, lying and being in the Town of Wappinger, County of Dutchess and State -of New York, bounded and described as follows: BEGINNING at a point in the westerly line of All Angel's_ Hill Road, said point being the ,northeasterly corner of lands now or formerly of White; thence along the northerly line of lands now or formerly of White the following courses and distances: South 79 degrees 30 minutes 20 seconds West 148.31 feet; South 80 degrees 53 minutes/20 seconds West 198.31 feet, South 81 degrees 21 minutesi 00 seconds West 200.00 feet, South 80 degrees 34 minute 00 seconds West ; The following resolution was proposed by Mr. Diehl, seconded by Mr. Francese: WHEREAS, this Town Board did, on the 26th day of April, 1966, adopt a resolution approving the petition of Schoonmaker Bros., Inc. and the supplemental petition of Edgehill Manor, Inc., Opalo Realty Corp. and Angel Brook Acres Corp. for the formulation of a sewer district in the Town of Wappinger embracing the �N � U� ~ � � �� areas described in said petitions, and did by said resolution approve the establish- ment of said sewer district to be known and designated as the Rockingham Farms Sewer District, and WHEREAS, an order was duly adopted by this Town Board at a special meet- ing thereof held on April 26, 1986, establishing the said Rockingham Farms Sewer District as a public improvement district in the Town of Wappinger, and WHEREAS, it has been established in the proceedings taken for the forma- tion of said sewer district that the improvements contemplated by said petitions, resolution and order shall be installed at the expense of the respective owners of the several tracts of real property involved and to be benefited thereby and without expense to this Town, and WHEREAS, the area of said sewer district does include a subdivision of approximately 380 lots owned by Schoonmaker Bros°v Inc. and approximately 80 lots owned by one Henry Vorndran, and WHEREAS, the Schoonmaker firm has heretofore expended and/or incurred the obligation to expend large sums of money for installation of sewerage facilities to serve such lots and the aforesaid sewer district and has obligated itself to transfer such facilities to the Town and the sewer district without cost, and WHEREAS, the Schoonmaker firm has expressed apprehension that the cost of possible future enlargement of the sewer system and particularly the treat- ment and disposal plant facilities would result in a benefit assessment against the aforesaid lots, and WHEREAS, the Schoonmaker firm has requested that this Board take formal action to reassure it that no assessment for expansion of sewer facilities in the Rockingham Farms Sewer District will be made against any residential building lot within the area of the boundary of lands now owned by Schoonmaker Bros., Inc. and described in its petition dated February 24, 1966, nor against any of the aforesaid 80 lots of Vorndran, unless the owners of said lots derive special benefit additional to the benefit contemplated -for the aforesaid Schoonmaker and Vorndran lots by establishment of said sewer district by the order of this Town Board adopted April 26, 1966, NOW, THEREFORE, it is hereby RESOLVED, that in the event that in the future the Town Board of the Town of Wappinger shall determine that the need for increased sewer service in said district and/or in any extensions thereof requires expansion and enlarge- ment of the sewage disposal and treatment plant and auxiliary facilities hereto- fore approved by the New York State Health Department for the said Schoonmaker Bros., Inc., no assessment for the cost thereof shall be made against the afore- said lots now owned by Vorndran and Schoonmaker » unless the then owners of such 120 lots derive special benefit from such improvements, and it is further RESOLVED, that, if this municipality incurs expense by reason of the making of such improvements in the future, the cost thereof shall be assessed and levied against the district properties which derive special benefit there- from and such cost shall be collected on a benefit basis of such properties, and it is further RESOLVED, that the other petitioners from the then owners hereinbefore mentioned who shall have shared the expense of construction of the sewer system currently planned for the Rockingham Sewer District shall be entitled to enjoy equal protection from assess- ment for future improvements pursuant to the provisions of and in keeping with the letter and spirit of this resolution.
