1966-02-24 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on Thurs- day evening, February 24,_1966, at the Town Hall, Mill Street, Wappingers Falls, New York for the purpose of conducting Town Business. Present: Joseph H. Fulton - Supervisor William J. Bulger - Justice of the Peace Vincent S. Francese - Justice of the Peace Absent: None Others Present: Joseph D. Quinn - Attorney for the Town Harold H. Reilly - Attorney for the Town Joseph E. Ludewig - Building Inspector Louis C. Clausen Councilman Louis 0. Diehl - Councilman Elaine H. Snowden - Town Clerk The meeting was called to order by Mr. Fulton at 10:15 P.M. Clerk read a letter from John Williamson to Mr. Bloomer, Editor of the Evening News, expressing appreciation for signs erected on Route 9D North, indicating Chelsea area. Clerk read letter from John Mitchell, Superintendent of Schools, asking that the February 28th meeting with the Town and Planning. Boards be rescheduled because of conflict with School Board meetings. Mr. Bulger made a motion that the Clerk contact Mr. Mitchell and set a new date for the meeting,notifying the Planning Board of the change. Seconded by Mr. Clausen. Motion Carried Unanimously Clerk read a letter from John Nigro, Soil Conservationist, indicating that work on, the requested Wappinger maps will begin soon. Clerk read letter from Indzonka re: Public Hearing by Water Resources Commission - Schoonmaker Brothers. Mr. Quinn: I will appear as Counsel for the Town at the Hearing but I need some other background information. A petition from D.C.R. Realty for rezoning property or Route 9 and Cooper Road from R-40 to RD -20 was presented. Mr. Francese: I recommend turning this petition over to the Planning Board. Mr. Bulger: We need to know what the alignment of this property will be in relation to Route 9. I would like to recommend we write a letter to the Planning Board. About a year ago we wrote about the zoning problem. We need a progress report and, at the same time, request their recommendations in regard to the zoning along Route 9 as it stands and what the new Route 9 Boning will be when Route 9 is moved. We should also get an opinion from Counsel as to this zoning problem. The ordinance describes zoning from the edge of Route 9 back 200 to 300 feet. It will no longer be Route 9 in some cases. Therefore, you will not have a standard from which to measure. We need to adopt a policy or change the ordinance. 0.4 Discussion returned to the petition from D.C.R.Realty. Mr. Quinn: This request appears defective and it is doubtful a public hearing can be set because it doesn't have any deed references or show metes and bounds. Mr. Bulger: I move we refer the D.C.R. Realty petition to Counsel for clarification. Seconded by Mr. Francese. Motion Carried Unanimously Mr. Bulger made a motion that the letter be sent to the Planning Board ask- ing for a progress report and recommendations regarding zoning along the present Route 9 and along its new realignment. Seconded by Mr. Clausen. Motion Carried Unanimously Regarding a petition for consent to form sewerage disposal corporation for Spookhill Estates - Hankin, Mr. Bulger moved it be referred to Counsel and the Town Engineer for investigation. Seconded by Mr. Clausen. Motion Carried Unanimously It was requested that Counsel get a copy of the letter of technical accept- ability on Ye Olde Apple Orchard. Mr. Fulton: Regarding Spookhill, I think we are going to have to advise them at that time that there is a Town policy' Mr. Quinn: They had a previous application. We gave it back to them because it was premature. Since that time, I have talked with their counsel and with the developer and also with the developer's engineer and informed them of the general policy of the Town with respect to public districts. In light of my conversations, I am amazed that this is in here. They indicated that they were going to make an application for a public sewer district. Mr. Clausen: Do we have to give it to them? Mr. Quinn: No. Mr. Ludewig: In May, this Board passed a resolution saying any developer would be required to request formation of a district. This approval probably does antedate. Clerk stated she had a letter from Indzonka, re: Rockingham Farms, request- ing the Board to act on applicatibn of the Rockingham Farms Filtration Corp. Mr, Quinn: In the light of the fact that you now possibly have a petition coming to you for a public district, this would become academic. Mr. Bulger made the motion it be ordered this letter placed on file with the minutes of this meeting. Seconded by Mr. Francese. Motion Carried Unanimously After some discussion on 0 letter dated February 21, 1966 from Mr. Robert L'Archevesque regarding the Recreation Commission, Mr. Bulger made a motion that the letter be referred to Counsel for an opinion letter. Seconded by Mr. Clausen. Motion Carried Unanimously Mr. Diehl made the motion that the minutes of the meeting of this Board held on the 3rd of February, 1966, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Clausen. Motion Carried Unanimously 58, Discussion was held on the Sanitary Land -Fill Corporation. Mr. Bulger made the motion that the payment of $2,669.60 be paid from General Fund. This is the amount of the Town's assessment for the preliminary site approval. Clerk was requested to inform the Village Board that the Town will pay the necessary assessments since the Town must, by statute, collect the taxes for this purpose from all residents of the Township; and suggest that the Village take appropriate action to adjust the taxes of the Village residents in the Town of Wappinger to avoid double taxation. Seconded by Mr. Clausen. Motion Carried Unanimously The following bills were read by the Clerk: General Fund - $3,738.41 Mr. Bulger made the motion that the bills be paid, subject to audit. Seconded by Mr. Clausen, Upon Roll Call, the vote was as follows: Joseph Fulton - Voting: abstain Louis Clausen - Voting: aye Louis Diehl - Voting: aye William Bulger Voting: aye Vincent Francese Voting: aye Mr. Clausen asked if there was any report on the County Airport. Mr. Fulton replied that it is in the engineering proposal state. Engineers are being selected to make a new engineering study. Mr. Clausen: Is there any feeling that the airport should be relocated? Mr. Fulton: Personally, I would be sympathetic to using it for what it is. I haven't heard any discussion in that regard. Mr. Clausen: Perhaps the Town Board could appear before these meetings and learn their feelings. Mr. Fulton: I will present that thought to the Board of Supervisors. Mr. Bulger: On the use of the Town Hall, we feel that the only agency or individuals who should be permitted the use of this building are govern- mental agencies of the Town because any others interfere with the proper functioning of the government. Mr. Bulger moved 90 days adoption of this policy. Seconded by Mr. Diehl. Motion Carried Unanimously Mr. Bulger proposed a resolution to change the date of the regular meet- ing of the Town Board from March 3rd to March 10th. Seconded by Mr. Clausen.
