The meeting was called to order by Mr., Fulton at 8:12 P.M.
The Adjourned Public Hearing on Wheeler Hill Rezoning opened. Clerk
read letter and resolution from Dutchess County Planning Board. Mr. Diehl
proposed the following resolution, seconded by Mr. Clausen:
WHEREAS, an application has been made to this Board by the owners of lands
situate in the area hereinafter described, in the Town of Wappinger, Dutchess
County, New York and
WHEREAS, the said application requests a rezoning of said lands from RD -40,
"one family residential district, 40,0001 square feet per dWelling unit",
and R-20, "one family residential district, 20,000 square feet per dwelling
unit" to R-40, "one family residential district, 40,000 sorare feet per
dwelling unit", and
WHEREAS, the Town Board, on the 8th day of October, 1965, did refer this
application to the Planning Board of the Town of Wappinger for its considera-
tion and recommendation, and
WHEREAS, the Planning Boardpf the Town of Wappinger did file its report and
recommendations with the Town Board.on the 16th day of No'ember, 1965, and
WHEREAS, after notice duly given, a public hearing was held by the Town Board
of the Town of Wappinger at the Town Hall, Mill Street, Wappingers Falls,
New York at 8:00 P.M. on the 13th day of January, 1966, at which all persons
desiring to be heard in favor of said rezoning and also all those desiring to
be heard in oppositiontIereto were given an opportunity to be heard, and
thereafter the public haring was adjourped to the 3rd day of February, 1966,
and

WHEREAS, the Dutchess County Planning Board was, on the 14th day of January,
1966, given ndtice of the proposed rezoning as required by Section 264 of the
Town Law, and
WHEREAS, the Town Board of the Town of Wappinger received the report and
recommendation of the Dutchess County Planning Board on the 2nd day of
February, 1966, and
WHEREAS, the adjourned public hearing was held by the Town Board at Mill
Street on the 3rd day of February, 1966 and thereafter the public hearing
was closed and decision reserved.
NOW, THEREFORE, IT IS HEREBY
RESOLVED, that the following property located on the Wheeler Hill Road
and Old Troy Read, in the Town of Wappinger, Dutchess County, New York
and designated as follows be and the same hereby is rezoned from RD -40,
"one family retidential district, 40,000 square feet per dwelling unit",
and R-:20, "onei family residential district, 20,000 square feet per dwell-
ing unit" to R4-40, "one family residential district, 40,000 square feet
per dwelling uhit",
All that certain premises, lots, lands, and real property
situate in the Town of Wappinger, Dutchess County, New York,"
which same is generally bounded and described as follows:
Beginning at the most northerly point of the southerly abut-
ment of the New York Central railroad bridge, over the
Wappingers Creek at New Hamburg and running from thence
easterly and southerly along the shore line of said abut-
ment and thence northeasterly along southeasterly shore line
of the Wappingers Creek to the point which is at right
angles to Creek Road in range of the junction of the south-
westerly side of Marlorville Road and the easterly side of
Creek Road, running from thence to the said junction of
road lines, thence southeasterly along the southwesterly
side of Marlorville Road approximately 1302 feet, thence
northeasterly still along said Marlorville Road approxi-
mately 110 feet, thence southeasterly still along said
southwesterly side of Marlorville Road 680 feet more or
less to the northeasterly corner of lands of the Willis
Reese Estate, thence southwesterly along the southeasterly
boundary line of the lands of the said Willis Reese Estate
approximately 1400 feet to its Junction with the north-
easterly side of New Hamburg Road, thence in a straight
line crossing said New Hamburg Road to the northeasterly
corner of other lands of said Willis Reese, thence south-
westerly along the southeast boundary line of lands of
said Reese and lands of New York City Congregational
Church Association approximately 2200 feet to lands now
or formerly of Lilyan Berger, thence northwesterly along
boundary of said lands of New York City Congregational
Church Association approximately 2000 feet to its junction
with the northwesterly side of Wheeler Hill Road, thence
southwesterly along said Wheeler Hill Road for apprexi-
mately 1100 feet to junction with northwesterly boundary
of lands of Edward Kompass, thence southeasterly in a
straight line along boundary of said lands of Kompass,
land of Lawrence Kanter for a distance of approximately
2150 feet to the southeasterly boundary line of lands of
said Kanter, thence southwesterly along the said Kanter
lands approximately 675 feet to the lands_of Edward
Kellenberg, thence southeasterly along said land of Kellen -
berg approximately 1150 feet thence 675 feet southwesterly
along the southeasterly boundary of lands of said Kellenberg to
northwesterly boundary of lands of Gerard Scheuer thence south-
easterly along northwesterly boundary of -lands of said Scheuer
for approximately 475 feet, thence southwesterly along the south-
easterly line of Gerard Scheuer; thence northwesterly along the
northeasterly side of Wheeler Hill Road approximately 2600 feet
to the northwest corner of land of Begg; thence crossing Wheeler
Hill Road and along the westerly boundary of the lands of Wendell
354.36 feet; thence further along the lands of Wendell to the
right of way of the New York Central Railroad; thence northerly
along said right of way of the New York Central Railroad to the
point or place of beginning.
EXCEPTING AND RESERVING, from the above-described parcel or
parcels of land, the subject of this application for rezoning,
lands which are not intended to be rezoned, to wit, premises,
parcels, lots or tracts of land situate on the southeasterly
side of Old Troy Road, (Wheeler Hill Road) containing approxi-
mately 55.368 acres of land, having a frontage on said Old
Troy Road (Wheeler Hill Road), of approximately 1136 feet, a
rear line of approximately 1213 feet, and northeasterly and
southwesterly boundary lines of approximately 2095 feet and
2147 feet respectively, said parcel being lands now or formerly
of Lilyan Berger, Brookhollow Builders, Inc., or their suc-
cessors or assigns.
RESOLVED, that the necessary changes be made upon the zoning map of the -
Town of Wappinger so as to indicate the subject premises as being located
in an R-40, "one family residential district, 40,000 square feet per
dwelling unit,"and it is further -
RESOLVED, that said amendment and change shall take effect immediately,
and it is further
RESOLVED, that said amendment be entered in the minutes of the meeting
of the Town Board of the Town of Wappinger, held on the 3rd day of
February, 1966, and that a certified copy thereof be published once in
the official newspaper of the Town of Wappinger, and that a certified
copy thereof shall be posted on the signbpard maintained by the Town Clerk
pursuant to Section 30 (6) of the Town Law, and that affidavits of publi-
cation and posting be filed with the Town Clerk.

Public discussion period opened.
Mr. Cortellino read letter from Wildwood Forest Civic Association
dated February 3, 1966, questioning the effectiveness of the Planning Board.
(Letter on file with agenda). He also asked if the cemetery on South Road
is abandoned, as the Association would like to consider it as a beautifica-
tion project, and, whether the Town will plow the roads in Wildwood.
Mr. Fulton: Waiver to plow has been arranged and will come before the Board
later in the meeting.

Mr. Cortellino pointed out that conservation maps show soil in Wildwood to
have very poor drainage. Mr. Diehl: It is interesting to note that my
colleague will also bring this matter up later in the meeting.
Mr. Brannen: What is the status on Rockingham? How many more adjournments
will there be? Mr. Quinn: That is in the province of the court.
Mr. Silver: I suggest it's about time the Town Board lay down a set of
guide lines for the Planning Board directing them to cooperate with schools,
fire districts, police, etc. on all these items that will hit us in taxes.
Mr. Clausen: I pian to make a motion to write the Planning Board and also
invite the School Board to a meeting. Mr. Quinn: Let's not have a false
impression that the Planning Board can approve or disapprove a subdivision
because of the effecj a,subdivision will have on police protection, etc.
Mr. Schmalz: Doesn't this fall into the category of Public Welfare? Mr.
Quinn: Cases are numerous that Boards may not approve or disapprove sub-
divisions merely on the impact they may or.may not have on population growth,
etc. Mr. Fulton: This will be taken under consideration.
Mr, Keeler: I would like to see a limit placed on a minimum -sized lot for
building in the Town of Wappinger. I think a half acre: should be suitable
with water and sewage. Mr. Fulton: We are requesting a joint meeting with
the Planning Board to go over revisions in the future. Mr. Clausen: I
think we feel that high density in certain areas is a problem. We are look-
ing into possibly deleting R-15.
Mr. Schmalz: It was reported by the newspapers that I was squelched in ask-
ing a question on Rockingham. Counsel said a hearing would be held on
January 28th. I came here to find that the hearing had been adjourned. It
would seem appropriate that when a hearing is announced, it should be a
matter of record that it is adjourned. Mr. Bulger: I received a copy of the
letter. Mr. Quinn: Letter was merely confirmation of a phone call and that's
all the law requires.
Mr. Cortellino: If a developer is granted an extension of preliminary
approval, are we required to give him a second extension? I think, to pre-
vent any circumventing of the Town's intentions, after first extension he
should adhere to any new specifications as though he had applied fresh.
Question from floor: At first meeting Mr. Diehl attended, he made a proposal
suggesting the Town raise its standards on Town roads, In view of the fact
that almost every developer has forfeited a bond, is it possible that the bond-

ing is so low that it is profitable for the developer to forfeit? Mr.
Fulton: Road standards were raised March 5, 1965. Mr. Quinn: There have
been no bond forfeitures. No -cases where surety company has tendered the
amount of the bond to the municipality.
Discussion period closed and there was a five-minute recess.
Meeting reconvened at 8:40 P.M.
Mr. Clausen proposed that the Clerk be directed to send a letter to the New
York State Conservation Department availing ourselves of their services,
requesting a large map indicating soil structures, etc., this giving the
Town another yardstick. Seconded by Mr. Diehl.

Mr. Clausen made a motion that the Clerk direct a letter to the Planning
Board and School Board asking if they would be interested in a joint meet-
ing to discuss common problems of the Town. Seconded by Mr. Diehl.

Mr. Fulton, referring to an Executive Meeting with builders of the area:
We proposed to them part of our policy in regard to sewage in the Town, We
said we planned that the laterals involved in future subdivisions would be
turned over to the Town, cost free. This means ail lines in internal sec-
tions of the subdivision. Developers' reactions were favorable.

9th of December, 1965, as submitted by the Town Clerk be and they are

Mr. Fulton called for discussion on Time -Life TV Broadcasting Petition.
Mr. Schmalz cited that there were other corporations that might make
better offers to the Town. He made reference to an article he had read,
indicating larger percentages had been obtained elsewhere. He questioned
the possibility of putting out bids to other capable companies. Mr,
Bulger: I think it is required by law that we hold a Public Hearing.
Mr. Diehl: There are a number of questions to be answered on this.
Perhaps contacting the Time -Life TV Broadcasting people and asking them
to be present at the next meeting to answer a dozen or so questions the
Board has would clarify this matter.

.5, The following resolution establishing policy of the Town Board with
respect to sanitary sewage disposal facilities was proposed by Mr.
Francese, seconded by Mr. Clausen:
RESOLVED, that the following policy be and the same hereby is established
with respect to sanitary sewage facilities in the Town of Wappinger:
1. The Town Board of the Town of Wappinger has formulated a policy
relating to treatment and disposal of sanitary sewage in residential
housing subdivisions located within its territorial limits. Sewage treat-
ment and disposal plants and systems shall be owned and operated by the
municipality, wherever and whenever economically feasible. This policy
contemplates the formation of sewer districts and sewage treatment dis-
tricts to serve areas of the Town as the need for service arises. Action
in this respect shall be dictated by good engineering practice, sound
financial planning and the public interest as determined by the Town
Board after careful investigation. Existing local regulations shall be
amended to implement this policy.
2. Developers shall be required to construct and install lateral
sewers within the subdivisions. Construction of such lateral systems
shall not be commenced by developers without written authorization from
the Town Board, the Town Engineer, the Dutchess County Health Department,
and/or the New York State Health Department.
Plans and specifications for lateral sewer systems shall meet
standards maintained by the Town Engineer, the Dutchess County Health
Department and the New York State Health Department.
Developers shall be required to enter into written agreements with
the Town Board and/or appropriate improvement districts with respect to
construction of lateral sewer systems. Such agreements shall be executed
prior to commencement of construction of sewer systems, and agreements
shall cover, among other things, the following subjects:
a. Posting of performance bonds by the developer to insure
satisfactory completion of lateral sewer systems.
b. Acquisition by the developer of necessary easements to
permit construction, installation operation, maintenance and
repair of lateral sewer systems.
c. Tapping and hook-up fees and charges.
d. Dedication of completed systems and underlying easements
by the developer to the Town and/or improvement districts with-
out charge or cost to the municipality. All costs involved
shall be borne solely by the developer.

3. Developers may be required to dedicate land within subdivisions for
use by the municipality for future construction and installation of sanitary
sewer facilities.
4. Private installation, ownership and operation of sewage facilities
in residential subdivisions will not be generally permitted. However, such
private facilities may be allowed, in the discretion of the Town Board, in
outlying areas where the municipality determines that it cannot feasibly
function.
5. Sanitary sewage treatment and disposal systems serving industrial,
commercial and similar uses will be considered by the municipality upon
individual applications.

Mr. Cadwallader addressed the Board, asking if any action had been taken
regarding the Cedar Hill Development's request that theTown accept Forest
View Road. Request had been presented before the Board at an earlier date,
discussion and action had been tabled. Mr. Cadwallader mentioned a quit
claim for this road had been obtained, and he felt it was just a matter of
the Town Board's acceptance now. None of the residents have Certificates
of Occupancy because of the roads' status. Mr. Francese recommended the
Board refer this to Mr. Knud Clausen so he can familiarize himself with
the situation, discuss it with Mr. Kelley, and then report.back to the
Board. Mr. Fulton: We should have a positive report by next meeting.
Mr. Clausen: FOR INFORMATION PURPOSES: I have a letter from a Mrs. Wagner,
who resides in the Fleetwood area, to Mayor Furnari, regarding a leash law
because of dog nuisances. She wishes to know how an ordinance can be adopted
to prevent dogs running loose in their area. Mr. Bulger: This must be a
Town ordinance. We have had a petition presented and it was voted down at
a previous hearing.

David Koffsky's. term of office on the Zoning Board of Appeals expires on
February 4, 1966. Mr. Bulger proposed the following resolution, seconded
by Mr. Francese:
RESOLVED, that David Koffsky be and he hereby is appointed to .fill the
vacancy on the Zoning Board of Appeals of the Town of Wappinger which
has occurred by reason of the expiration of the term of David Koffsky,
and it is further
RESOLVED, that the said David Koffsky be and he hereby is appointed to
fill such vacancy for a term which shall expire on the 4th day of
February 1971. Motion Carried Unanimously
Mr. Francese made the motion to have proper persons advertise for bids
on fuel oil for Town Garage and Town Hall. Seconded by Mr. Diehl.
Motion Carried Unanimously
Mr. Porter read a letter from Oakwood Civic Association addressed to
Mr. Fulton, stressing the Association's concern regarding the status of
the water and sewage facilities. Mr. Fulton: We have been advised
legally that this is part of an agreement between- the Town and Mr.
Ritter. The agreement describes this as a package condition and we don't
want one part to get ahead of another. We are still in a form of nego-
tiation on this. The Town has not dropped this litigation. It is, at
this point, being reviewed. (I would like, however, to meet with you
and explain our position.)
Mr. Diehl: Regarding the shortage of doctors in this area, and having
read where other municipal governments have tried to find more doctors
for their areas, I make a motion that the Board go on record in support
of trying to find more doctors for this area and that letters be directed
to Stephen Puzio, President of the Wappingers Falls Chamber of Commerce,
and Gordon Brannan, President of the Dutchess County Medical Association,
informing them of this Board's support in their efforts in this direction.
Seconded by Mr. Bulger. Motion Carried Unanimously
Mr. Diehl, referring to a letter received from William S. Dresher,
District Manager, Social Security Administration, in Dutchess County,
made a motion that the Town Board support a public meeting for the
purpose of explaining Medicare to the public. Seconded by Mr. Clausen.
Motion Carried Unanimously
A representative from the Dutchess County Social Security Office will be
the speaker. Meeting scheduled for February 14 at the Town Hall. Mr.
Bulger: I move Mr. Diehl be named Chairman of this committee. Seconded

Mr. Francese reported that he has had discussions with Mr. Kelley in
regard to work to be done on the Town Clerk's office.
Mr. Diehl proposed the following resolution; seconded by Mr. Clausen:
RESOLVED, effective immediately, the policy of the Town Board, on all new
appointments made by the Town Board, should be that appointees' names and
qualifications be made known 10 days in advance to all Board members so
that all prospects can be screened and the best accepted.

Mr. Bulger: I would like to advise the Board that Wappinger-Casper Creek
Sewer Survey Committee has had several meetings. Clinton -Bogart Associates
of New York have been designated as the engineering consultant firm for the
sewer survey. We have had an agreement, very strongly worded, that they
make the best use of engineering talent available in the Dutchess County
during the preparation of this work. It will probably be about April before
a contract can be signed. This is for the Wappinger drainage basin. Thus,
with the fishkill survey, this means the entire Town will be surveyed and
we will have an over-all plan when the survey is completed. Bogart is also
the engineering firm for the Fishkill drainage area and we have been given
to understand that the two contracts will be negotiated by the State and
signed at the same time.
With reference to the Land -Fill Committee: Mr. Fulton expects to have a
special meeting this month. There seems to be a problem with double tax-
ation in the Village and therefore, the consensus is that there should .be
Village representation.
Mr. Kelley: In reference to Edgehill Storm Sewer, I think a motion would
be in order to accept the low bid of C & E of $38,000 and authorize the
Supervisor to sign a contract. There was some discussion as to whether
the whole project should be undertaken this year. .Mr. Clausen made a
motion that the Engineer for the Town be authorized to proceed with the
first stage of the Edgehill Storm Sewer project, subject to review by the
Engineer and Counsel. Seconded by Mr. Bulger.

WAIVER OF NOTICE OF SPECIAL
MEETING OF THE TOWN BOARD OF
THE TOWN OF WAPPINGER,
DUTCHESS COUNTY, NEW YORK
The undersigned, being all of the members of the Town Board of
the Town of Wappinger, Dutchess County, New York, do hereby waive
notice of the time and place of the holding of a special meeting of
said Town Board, and do hereby agree and consent that the same be held
