1966-01-20 RGM (adj),4 ou2NED The Meeting of the Town Board, Town of Wappinger, was held on Thursday evening, January 20, 1966, at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Joseph H. Fulton - Supervisor William J. Bulger - Justice of the Peace Louis C. Clausen - Councilman Louis D. Diehl - Councilman Vincent S. Francese - Justice of the Peace Elaine H. Snowden - Town Clerk Absent: None Others Present: 18 Joseph D. Quinn - Attorney for the Town Harold H. Reilly - Attorney for the Town Vincent C. Kelley - Engineer for the Town Joseph E. Ludewig - Building Inspector Knud Clausen - Town Highway Superintendent Salute to the Flag by Girl Scout Troop 79 - Edith Fendell (Bearer), Becky Blanchard and Lois Stiles (Guards), Linda Smeriglio (Caller) The meeting was called to order by Mr. Fulton'at 8:15 P.M. Open discussion from the floor - Mr. Silver - asked disposition of questions raised in past meetings regarding Planning Board approval of Ye Olde Apple Orchard and a surcharge on developers for default. Mr. Reilly: A Public Hearing had been held and County Healith approval on water and sewer facilities received when Planning Board accepted the map. I could find nothing illegal. Mr. Quinn answered the question of surcharge saying it was not possible. Town Board sets amount of the bond. It is the builder's election to accept. There is no provision for penalizing anyone. Mr. Silver stated he would favor a Planning Board member attending all Town Board meetings. (Mr. Steinhaus was present.) Mr. Cortellino questioned using "penalize" in the discussion on surcharge. Mr. Quinn stated that Sections 276 and 277 of Town Law fix the procedure for determining the amount of bonds and it was not up to anyone to go beyond the statute. z Mr. Schmalz: What actions will be taken in regard to storm sewers in Edgehill Manor? Mr. Kelley: Money has-been placed in the budget. Next, draw up plans for the storm drainage system. Bids have been received at an earlier date. It's a matter now of awarding the bid. However, enough time may have elapsed allowing contractors to withdraw their bids and we may have to ask for rebids. Mr. Silver asked the amount of money involved and Mr. Kelley replied approxi- mately S38,000. Mrs. Schmalz thought the amount was S54,000. Mr. Kelley explained that the bids were broken down in three parts. 19 Mr. Bisom again complained about Myers Corners Road and asked the Clerk be allowed to read a newspaper article dated October 11, 1960, which indicated Mr. Bisom had at that time complained -on Myers Corners Road.to the Board of Supervisors. He asked the Supervisor to use his influence to get this road fixed and also to have road signs replaced. Mr. -Fulton noted that, due'to condemnation proceedings, progress was slow but he indicated probability of something being done in the Spring or early Summer. Mr. Bisom then asked that something be done to limit the speed on Myers Corners Road. Mr. Fulton assured him he would try. Mr. Brannen asked what the Board's thinking was on Cehtral Purchas- ing Department and reapportionment and suggested the Board express its sentiments so that Mr. Fulton could carry it to the Supervisors' Meeting. Mr. Fulton felt it would be premature to judge the situation now, but would possibly be in favor of Central Purchasing and would favor reappor- tionment. The Ooard took no action but Mr. Fulton said he would act independently if he could not win their support. Mr. Bulger excused himself as discussion on Rockingham Farms came up. Mr. Schmalz' question dealt with violations of Certificates of Occupancy - there is a number of families in occupancy and could an injunction be invoked to keep families from moving in. There was some discussion by Messrs. Fulton and Reilly. Mr. Quinn summed it up by saying that he felt the courts would deny a temporary injunction and that Mr. Reilly believed the criminal proceeding now pending to be most speedy. He closed discus- sion by saying he felt it improper to go more deeply into the matter. Mr. Bulger returned to the meeting. Mr. Cortellino raised the question of whether residents of Wildwood were paying for an over -adequate sewage plant and water since Atlas and L & A Filtration have preliminary approval to service a development off Widmer Road near Dorothy Heights. Mr. Kelley: Preliminary approval was not given, it was tabled. I do not know the capacity of service. It is possibly in excess of design capacity and I think the question should be directed to the Health Department. Mrs. Oberle: If the plant is not oversized and lines must be laid for that section, it it possible that the Town stipulate that those lines be turned over to the development for$1.00? Mr. Quinn: Basically, yes. Mr. Silver asked about payment to Mr. Hankin for his services in oper- ating Oakwood Sewage Plant and asked for a breakdown. Will Town pay Mr. Hankin and sue whomever ends up owning the Plant? 2 o Mr. Kelley: Mr. Hankin has not been paid. Mr. Quinn: It is questionable as to who will do this, but there is a pro- cedure under the Public Health Law to cover the abating of nuisances. Mr. Silver: Wasn't suit by L & A dropped? Mr. Quinn: No, both actions are still pending. Mr. Porter then asked to hold further discussion on Oakwood until they got to the matter on the agenda. Mr. Diehl: Would the Board direct Mr. Kelley to verify if the bids for work on Edgehill storm sewers are still legal so that we can act. Mr. Kelley: As far as I know, they are still good. Work wouldn't start until March. I will give a report at the next meeting. After a five-minute recess, the Board reconvened at 9:06 P.M. Mr. Fulton made the following announcements Skating rink at Reese property is in operation. Open with police supervision from 6 to 10 P.M. - open 7 days a week. Mr. Fulton stated he had received a letter from Farmers-Matteawan National Bank thanking the Board for their being named a depository. Bills were presented in following total amounts: General Fund - -03,479702- a 3, 3 / Highway 156.14 Mr. Bulger made the motion that bills be approved, subject to audit. Seconded by Mr. Clausen. Motion Carried Unanimously The Clerk read the following Monthly reports: Building Inspector's Report for the Month of December 1965 Building Permits issued for: 5 Apartment Buildings (78 Units) 10 Single Family Dwellings 1 Sewer Plant 1 Commerciat Garage 1 Residence Garage 1 Residence Addition 1 Other 20 Total Permits Issued for December Value of Construction $969,700.00 Fees Collected & Turned Over to the Town Clerk 597.35 Miles Traveled on Zoning & Building Inspection by Building Inspector 212 Miles Traveled on Building Inspection by Deputy Building Inspector 431 During the month of December, Certificates of Occupancy were issued for 28 Single Family Dwellings, 1 Doctor's Office Addition, and 1 Dentist's Office Addition. Ludewig Building and Zoning Inspector 21 Gentlemen: Following is a report of activities handled by me during the month of December, 1965 as Justice of the Peace: (1) 22 motor vehicle cases closed showing $340.00 collected in fines. (2) 10 civil cases handled showing $23.50 collected in fees and filing costs. (3) 8 criminal cases handled showing $10.00 collected in fines. A total of $373.50 has been forwarded to the State Oept. of Audit and Control. It is my opinion that the activity increase outlined above is caused by the population growth in our township and increased activity on the part of area police agencies. Bulger Justice of the Peace ANNUAL REPORT Gentlemen: Following is a report of activities handled by me during the year 1965 while presiding as Justice of the Peace: (1) 336 motor vehicle cases handled showing $5,510.00 collected in fines and forfeitures. (2) 78 civil cases handled showing $174.50 collected in fees and filing costs. (3) 20 criminal cases handled - $10.00 collected in fines; 9 defendants sentenced, 2 referred to Family Court and 1 treated as Youthful Offender. (4) 15 warrants were issued for arrest. (5) (a) A total of $1120.00 was handled by me in the taking of bail; (b) a total of $13.06 was handled in the disposition of a civil case. (6) In summary (a) a total of 449 cases were handled; (b) monies handled by me totaled $6827.56; (c) of which $5694.50 was forwarded to the State Dept.of Audit and Control; (d) 5988.06 which was disbursed to others in the handling of bail and civil dispositions. (e) showing a total of $145.00 left in my official bank account as of 12/31/65, for bail in 2 pending motor vehicle cases. Respectfully submitted, s/ Vincent S. Pike, Secretary Town of Wappinger Planning Board Building Inspector's Year End Report In 1965, this department issued a total of 480 Building Permits for an estimated value of construction of $10,616,995, as compared with 1964 when 412 permits were issued for an estimated value of construction of $6,675,140. Total income of fees collected and turned over to the Town Clerk in 1965 was $8,770.35, compared with 1964 when $6,366.75 was collected. At budget time, I recommended an increase in the fee schedule which should be put into effect as soon as possible. The appointment of Mr. Gutmann in February, 1965, as a part- time assistant building inspector has been very helpful. It has enabled us to do a more effective job in getting builders to comply with the regulations of the New York State Building Code, thereby raising the standard of construction for the protection of homeowners. We try to make several inspections on each job and when we find violations, check back to see that required corrections are made. Miss Susan Pike was employed in July as my office assistant and secretary tothe Planning Board. The Planning Board function and the Building and Zoning activities are closely allied. We have been able, by going back through the accumulated recorded material, to establish a new system and now have a fairly complete and orderly file. Having the files in our office is helpful to me since I act as representative of the Planning add Appeals Boards in dealing with the public. I have prepared two (2) tables which are attached to this report. One summarizes the year's activities. The other shows the present activity and what is ahead in the immediate future if the present rate of building continues. Respectfully submitted, s/ Joseph E. Ludewig Building & Zoning Inspectok Mrs. Fumarillo announced that "Friends of Grinnell Library" are starting a reading program for children, ages 4 to 6, one Saturday a month, from 10 A.M. to 12 P.M. Mr. Cortellino, representing Wildwood Civic Association, presented three problems - ditch, roads and drainage. (1) Final disposition of ditch, (2) drainage on roads (photos of ioe on roads were shown), and (3) how to solve problems in the future, also, discussion regarding large sign at entrance to Wildwood off New Hackensack - What are regulations of time and size? Mr. Landolf1 interjected that they will have an expenditure similar to Edgehill's in a few years if something isn't done to fix roads and drainage now. 24 Mr. Diehl asked Mr. Kelley if he had had any reports on their queries of regulating speeds in the development. Mr. Quinn interjected comment that something can be done, speed limit can be controlled. Mr. Fulton, answering on ditch: Apparently nothing has been done and we are not in a legal position to do anything. Knud Clausen stated he was in touch with Mr. Alexander who was cooperating in trying to correct the condition causing ice to form on the roads. Alexander is to dig a ditch to take care of excess run-off. It was decided that nothing more could be done other than what action Mr. Clausen has already taken. Knud Clausen, Superintendent of Highways, presented two similar con- tracts for a two-way communications system, consisting of nine mobile units, which had been studied by counsel. Mr. Clausen recommended General Electric be given the contract - cost $11,847 in a 5 -year period, for rental and service. Motorola also submitted a contract in the amount of $11,232.60. Mr. Hazard - N. Y. Communications - representative of General Electric said papers must be signed by the official of the Town and a resolution must be adopted. Mr. Bulger moved to adopt the following resolution: RESOLVED, that the Supervisor of the Town of Wappinger or Superintendent of Highways, whichever may be the appropriate officer, be authorized to enter into and execute on behalf of the Town Board and Highway Department, the contract recommended by the Town Superintendent of Highways. Seconded by Mr. Clausen. Upon Roll Call, the vote was as follows: Joseph Fulton Louis Diehl Louis Clausen Vincent Francese William Bulger Voting: aye Voting: aye Voting: aye Voting: aye Voting: aye Mr. Hazard explained the contract, saying this lease is all inclusive, adding it has been proven the most economical system. Mr. Porter spoke in behalf of Oakwood Knolls Civic Association regard- ing the sewage plant. He stated they had been presented with a proposal whereby Mr. Hankin would service Oakwood Knolls in connection with another proposed development on Spook Hill Road. Residents felt there had been negligence on the part of the Town on policing said developer, as contract had been entered into with the Town Board, and asked the Board give Mr. Hankin permission to proceed. Mr. Fulton countered: The County is now operating the plant. Service now is adequate and healthful. The Town Board is now engaged in searching out a solution to this problem on local, County and State levels. The reason the order for Mr. Hankin to proceed is not given is that we are consolidating 25 some facts, and we don't want to take action that will adversely effect the feasibility of a large sewer district. Mr. Fulton and Mr. Bulger both assured the people of Oakwood Knolls that no decision would be made without their being fully advised and without a vote from the people involved. A petition from Time -Life Broadcasting Company, Inc. was presented to the Board requesting the granting of the right to operate a cable TV service to the township. Mr. Quartararo was present for the petition passed out petitions to each Board member, asking that they set a date for a Public Hearing. He asked to be advised of date when Hearing is set. Action tabled. Mr. Armstrong presented for the Board's approval a map of the boundaries of Hackensack Fire District which was prepared by Mr. Kelley. Map requires Town Board approval before it can be filed with the County Clerk. The District was formed in 1948. Mr. Diehl made the motion that the map be accepted and approved as an official map of the Hackensack Fire District boundaries. Seconded by Mr. Clausen. Upon Roll Call, the vote was as follows: Joseph Fulton Louis Clausen Louis Diehl Vincent Francese William Bulger Voting: aye Voting: aye Voting: aye Voting: aye Voting: abstain Town Clerk read letters from Mr. Worona, representing L & A Filtra- tion,to Taconic Construction Company, and the Order of the State Comp- troller granting the application of the Town Board of the Town of Wappin- ger for permission to establish Oakwood Knolls Water District. Discussion followed. Mr. Quinn: The contract between Mr. Ritter and Oakwood Knolls sewer district implies not only the sale of the sewage disposal plant - but also the water system. These items are not separable. This contract is a matter of litigation at this time. The letter was read as ordered. Since this matter is in the courts now, the Board would be remiss to act. It is the Board's thought to table this matter until it is possible to act on it. A motion was made by Mr. Francese to table action on the Water District. Seconded by Mr. Bulger. Mr. Quinn read the letter addressed to Ye Olde Apple Orchard ordering them to cease further building or construc- tion and not to allow any families to move into any of the existing homes until written permission is given by the Department of Health. Mr. Dangler, Vice President of Ye Olde Apple Orchard, requested the Board to act on his application to form a sewer corporation. Mr. Quinn asked that the application be tabled since it is a matter pending before the Board of Health and it will also be discussed at a meeting on Monday, January 24. After further objection and another request to act on his application by Mr. Dangler, Mr. Quinn stated there is no compulsion on this Board to act on this tonight. A motion was made by Mr. Francese, seconded by Mr. Bulger, to table the application. Motion Carried Unanimously Clerk read letter from Mr. Effron, representing Todd Hill Realty Corp., requesting the Board to appoint an attorney and engineer to help prepare plans and papers for a proposed development. Mr. Effron was present„ and stated that simultaneous with this application, subdivision plans are being prepared, with the hope that Planning Board requirements and sewer and water plans will be completed in unison. Mr. Quinn suggested the Board entertain a motion the matter be referred to the Town Engineer and Counsel for a report to the Board and answer for Mr. Effron.as soon as possible. Mr. Francese made a motion to refer the matter to Counsel and Town Engineer and have them report back on February 3. Seconded by Mr. Diehl. Motion Carried Unanimously Application for permission to form a sewer district by Mid -Point Park Filtration Corp. was received. A motion was made by Mr. Bulger, seconded by Mr. Diehl to table the application. Motion Carried Unanimously A letter from Mr. Serino, representing Hubert Schaller, was read. Mr. Kelley stated that Mr. Bulger had talked with Mrs. Serino about their problem. Mr. Kelley had triedfrequently to reach Mr. Serino, has left calls which were unanswered. As soon as contact is made, Mr. Kelley will report to the Board. For the Board's information: A copy of Permit to Discharge for Royal View Apartments by State of New York Department of Health had been received by the Clerk. A letter of resignation from Mr. L'Archevesque from the Zoning Board of Appeals was received by the Town Clerk. A letter from Mr. Koffsky, Chairman of Zoning Board of Appeals, asking Board to consider their recommendation of Gordon Hirt for the position vacated by Mr. L'Archevesque was read. The following resolution was proposed by Mr. Clausen, seconded by Mr. Francese: RESOLVED, that Gordon Hirt be and he hereby is appointed to fill the vacancy -on the Board of Zoning Appeals of the Town of Wappinger which has occurred by reason of the resignation of Robert L'Archevesque, and it is further RESOLVED, that the said Gordon Hirt be and he hereby is appointed to fill such vacancy for the remainder of the term which shall expire on February 4, 1970. Mr. Diehl withheld his resolution. Upon motion made by Mr. Bulger, seconded by Mr. Clausen, a Public Hearing was directed to be held on the following proposed amendment to the Town of Wappinger Zoning Ordinance, such hearing to be held in the Town Hall, Town of Wappinger, Mill Street, at 8:00 P.M. on February 24, 1966. _ BE IT RESOLVED AND ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by Article 16 of the Town Law of the State of New York and also in pursuance of Article 9 of Town Law to the extent applicable as follows: Section 1. The Town of Wappinger Zoning Ordinance, adopted January 29th, 1963, is hereby amended by re -zoning the following tract of land from R-20, "Optional Dewlling Residential District", to G 8, "General Business District" Which said real property is generally bounded and described as follows, to wit: All that tract or parcel of land situate in the Town of Wappinger, County of Dutchess and State of New York, bounded and described as follows: Beginning at the intersection of the easterly line of lands of Beatrice Irving with the Southerly line of the New Hamburg Turnpike running from Hughsonville to the Albany Post Road (Route 9) and running thence with the Easterly line of -lands of Beatrice Irving South thirteen 28 (13) degrees thirty (30) minutes thirty (30) seconds East seven hundred twenty (720) feet; thence with line of lands formerly of Irving the following courses and distances North seventy three (73) degrees seven- teen (17) minutes West two hundred forty (240) feet; thence North thirteen (13) degrees thirty (30) minutes thirty (30) seconds West seven hundred twenty (720) feet to said turnpake; thence with the southerly line of New Hamburg Turnpike the following courses and distances South seventy two (72) degrees thirty three (33) minutes East ninety (90) feet; thence South seventy three (73) degrees forty three (43) minutes twenty (20) seconds East one hundred fifty (150) feet to the place of beginning. Letter from Mr. Vandewinckel recommending two people to fill vacancies on Planning Board. The following resolution was proposed by Mr. Francese, seconded by Mr. Bulger: RESOLVED, that Robert Heisler be and he hereby is appointed to fill the vacancy on the Town Planning Board of the Town of Wappinger which has occurred by reason of the expiration of the term of Frances Bisom, and it is further RESOLVED, that the said Robert Heisler is hereby appointed to the said Town Planning Board for a term which shall expire on the 4th day of January, 1973. Upon Roll Call, the vote was es follows: Joseph Fulton Louis Clausen Louis Diehl Vincent Francese William Bulger Voting: aye Voting: aye Voting: aye Voting: aye Voting: aye The following resolution was proposed by Mr. Bulger, seconded by Mr. Clausen: WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, did heretofore on the 9th day of September, 1965, adopt a reso- lution authorizing the ptoper officers of said Town to engage the services of Adler-Brenner and Associates, a consulting engineering firm maintain- ing offices in the City of New York, to study and report upon the feas- ibility of establishing a sewer district encompassing the L & A Filtra- tion Corporation service area and other adjacent and contiguous areas in the Town of Wappinger which might be economically serviced by the contemplated district, and WHEREAS, the aforesaid study has been undertaken and completed by said consulting engineering firm and a report of said study, dated October, 1965, has been submitted in writing by the said consulting engineering firm to this Town Board, and WHEREAS, the said report does contain an analysis of the needs and financial capabilities of the proposed improvement district, and does further contain a recommendation that this Town Board initiate a plan and program to design, finance, acquire and construct the facilities required to service the proposed district, and WHEREAS, under the terms of Public Law 560, 83rd Congress, as amended, the United States of America has authorized the making of advances through the Housing and Home Finance Agency to public bodies to aid in financing the cost of engineering, plans and specifications for public works projects of the type contemplated by the aforesaid report, and WHEREAS, it appears that this municipal corporation is eligible to make application to the said Housing and Home Finance Agency of the United States Government for aid in financing the cost of the aforesaid preliminary and preparatory work for the project contemplated, and WHEREAS, this Town Board, after thorough consideration of the various aspects of the problem and study of available data has determined that the proposed public works project contemplated is desirable and in the public interests and to that end it is necessary that action preliminary to the construction of said work be taken immediately, and WHEREAS, this Town Board has examined and duly considered the aforesaid act permitting the Housing and Home Finance Agency of the United States Government to make advances to aid in financing the cost of the afore- said preliminary and preparatory work for the project contemplated and considers it to be in the public interests and to its benefit to file an 30 application under said act and to authorize other action in connection therewith, NOW, THEREFORE IT IS RESOLVED, that the Town Board of the Town of Wappinger, Dutchess County, New York, does hereby accept and approve the Feasibility Report, dated October 1965, and prepared by Adler -Brenner and Associates relating to the establishment of the aforesaid proposed sewer district, and it is further RESOLVED, that the construction of said public works is - essential to and is in the best interests of the applicant, and to the end that such public works may be provided as promptly as is practicable, it is desirable that action preliminary to the construction thereof be undertaken immediately, and it is further RESOLVED, that the firm of Adler -Brenner and Associates of New York, New York, be and it hereby is retained and appointed to act as consultants and consulting engineers to this Town Board to undertake the planning of the aforesaid sewer district and to assist the authorized representative of this Town Board to make application to the Housing and Home Finance Agency of the Undted States Government for an advance for the required and related public works planning, and it is further RESOLVED, that this Town Board and its proper officers, officials and representatives be and they hereby are authorized and directed to enter into a contract with the aforesaid firm for the performance of the consult- ing services required, said contract to conform in all respects to the requirements of the Housing and Home Finance Agency relating and pertaining thereto, and it is further RESOLVED, that Mr. Joseph H. Fulton, the duly elected, qualified and acting Supervisor of the Town of Wappinger, Outchess County, New York, be and he hereby is authorized and directed to file on behalf of this Town Board an application (in form required by the United States and in conformity with said act) for an advance to be made by the United States to the applicant to aid in defraying the cost of plan preparation for the above described public works project, and it is further RESOLVED, that if such advance be made, the applicant shall provide or make necessary arrangements to provide such funds, in addition to the advance, as may be required to defray the cost of the plan preparation of such public works project, and it is further RESOLVED, that tfie_.saisd Joseph H. Fulton be and he hereby is authorized and directed to furnish such information and to take such action as may be necessary to enable this Town Board to qualify for the said advance, and it is further RESOLVED, that the said Joseph H. Fulton is hereby designated as the authorized representative of this Town Board for the purpose of furnishing to the United States such information, data, and documents pertaining to the application for such advance as may be required, and otherwise to act as the authorized representative of this Town Board in connection with such application, and it is further RESOLVED, that Mrs. Elaine Snowden, the duly elected, qualified and acting Town Clerk of the Town of Wappinger, Dutchess County, .New. York, be and she hereby is authorized and directed to prepare certified copies of this resolution and to furnish the same to the United Statesof America, the Housing and Home Finance Agency, and to such other agencies, bureaus, and governmental officials as may demand the same in connection with the subject application. The application then goes in for plans and specifications to complete this project. Federal Government indicates that the Town Board accept this study and no work can start until Federal Government approves this project. Approval by Housing and Home Finance Agency can be received within 2 months. The following resolution was proposed by Mr. Diehl,. seconded by Mr. Clausen: WHEREAS, the Town Board of the Town of Wappinger adopted a resolution on the 6th day of January, 1966 established the amount of the official undertaking to be furnished by the officers and employees of the Town of Wappinger, and WHEREAS, the said undertakings have been submitted to the Town Board of the Town of Wappinger for their approval as to form and sufficiency of surety, IT IS HEREBY RESOLVED, that the bonds submitted by the following persons holding offices and positions of employment in the Town of Wappinger be and they are hereby approved as to form and sufficiency of surety: 32 Town Clerk $ 4,000.00 Tax Collector 500,000.00 Supervisor 22,000.00 Justices of Peace 4,000.00 each Constables 1,000.00 each Town Superintendent of Highways 4,000.00 AND IT IS FURTHER RESOLVED, that the blanket undertaking in the amount of $5,000.00 as required by the resolution of the Town Board adopted on January 6, 1966, be and the same is hereby approved as to form and sufficiency of surety, AND IT IS FURTHER RESOLVED, that such undertakings shall be filed in the Office of the Clerk of the County of Dutchess pursuant to the provisions of the public officer's law and other related statutes of the State of New York. Seconded by Mr. Diehl. Motion carried unanimously There was a lengthy discussion on intersection lighting. Mr. Reilly stated Town Board must determine dangerous intersections on Town roads. It was also stated that Central Hudson has submitted two alternate pro- posals. Mr. Clausen asked that if the roads are moved, do the lights go with them. Yes. Mr. Reilly will prepare a resolution covering Maloney Road and Smith Crossing Road, River Road North and Old State Road, and Diddell and Smith Crossing Road. The matter was tabled until the next meeting and Mr. Reilly was directed to arrange for the necessary contract. There was a lengthy discussion on the legality of opening Dorothy Heights as a thru road. In summary, Mr. Fulton stated that it was the intent of the Board to close this road if it can legally be done, all Board members being in favor. Counsel was directed to pursue this course and report back to the Board. Mr. Fulton: Mr. L'Archevesque attended a meeting of the Land Fill Committed in my behalf. Report turned in was enthusiastic and they are working on a site. They have had test borings. They have an option which expires May 1. Mr. Fulton: I have a communication stating several families in the Fleetwood area have an 8 -party service in the AXminister exchange or they have to use the Fishkitl exchange. Telephone Company refuses to run in lines or increase service in any way. I called the Telephone Company and asked about this. I was asked to write a letter in behalf of the residents and will do so. Mr. Bulger suggested this matter be referred to the Public Service Commission. There was discussion on plowing roads in Oakwood Knolls since Mr. Ritter has not signed a waiver. Mr. Bulger felt that in order to pro- vide County with roads to service its sewage system, the Town should plow. Mr. Quinn stated that, if the resolution is properly drafted when the town accepts the bond on the road, there should be a resolution exempting the Town of liability. Mr. Kelley stated that specifications say that the Town can plow upon getting a release from the contractor. 34 Mr. Bulger made a motion to accept the State of New York's offer of $2,150.00 for the Town property on Myers Corners Road. Seconded by Mr. Clausen. - Motion Carried Unanimously Messrs. Bulger and Clausen were appointed as a Committee to set the policy on use of Town Hall. Mr. Diehl reported on police protection. He stated that he met with Mr. Litts, a Deputy Sheriff. Discussed a communication center at the Sheriff's office on Citizens' Ban. After hearing Mr. Hazard speak on Citizens' Ban, it doesn't sound very good. Mr. Reilly has been busy and we haven't gotten together. A motion to amend the lease to raise rent of Masons to compensate for light bill was made by Mr. Bulger, seconded by Mr. Clausen. Motion Carried Unanimously The Feasibility Report on Schoonmaker area was tabled. In a discussion on Dugan Lane, it was agreed, as a Board, it can't be plowed, on advice of counsel. There will be further discussion and policy at next meeting. Mr. Clausen said he would like Mr. Kelley to study unapproved roads. Mr. Fulton brought up the subject of agenda control, stating he felt he was in the best position to do so. Mr. Clausen felt it should not be Mr. Fulton's responsibility - that there should be a Board meeting to discuss agenda. Mr. Quinn: I'm afraid that you are going to have to leave a certain amount of this to the Supervisor. If you are going to get a lot of applica- tions, you will have to play them by ear for a while and then maybe restrict them to a certain time in the month. Mr. Fulton requested the Press to give particular emphasis in the newspapers to adherence to the agenda ten days prior to the monthly meeting. Mr. Fulton: I have intentions of forming a Supervisor's Committee and I am hoping to get the consent of the Board so that there won't be any pro- blem. I would like a group to report a T -;...:.;:.T Ten to the Town Board ,!t t7n L 4/3 on reviewing and recommendations of zoning and subdivision regulations. Mr. Quinn: Ordinances are minimal. I would .think what you are looking for are recommendations from Board members and Planning Board to be channeled into you. It is up to this Board to amend those regulations. There ought to be some insertions in the subdivisions with respect to multiple dwell- ings. You must have some way for someone to collect recommendations. Messrs. Diehl and Clausen felt that the Committee should report to the Town Board in Executive Sessions. - Mr. Bulger asked who would be on the Committee and Mr. Fulton replied, Knowledgeable people who attend Planning Board meetings, people who are generally interested and who have been exposed to this kind of situation. He had a list of people to recommend. Mr. Clausen asked that a committee not be formed until all members had a chance to recommend people for consideration. Public Utilities - Mr. Bulger: One of the problems is that we have two agencies that have the legal right to approve these utilities; the Planning Board and County and/or State Department of Health. Mr. Quinn: Any telephone or telegraph must come before the Board for a franchise. Any other private improvement setup (in the nature of furnishing services to the public) must come before the Board. As long as you leave this elastic, there is no harm. He listed TV people asking for a 25 -year franchise as falling into this category. Mr. Clausen: Ask Planning Board to make their recommendations upon approval by us. Mr. Quinn: As it applies to subdivisions, one - family subdivisions must come to you to offer a bond on their roads and no building permits may be offered until you accept the bond. You could prepare a questionnaire that must be submitted with the bond. Mr. Kelley: May I point out that the Town Board would be the reviewing agency for the formation of a district. Mr. Bulger: Why don't you work this out with Mr. Quinn since he seems to have some ideas. Mr. Fulton: I would ultimately direct the Buil-ding Inspector to see that this is filed with us before he issues any build- ing permits. Mr. Diehl made a motion allowing Mr. Bulger to engage a court reportee for the Rockingham case, if he deems it so necessary. Seconded by Mr. Clausen. Motion Carried Unanimously Mr. Fulton - It is my feeling and I am recommending to this Board that we hire district lawyers from time to time on different projects and I think our Town Lawyers should be in a position to be informed of all transactions by this Board. The following resolution was proposed by Mr. Bulger, seconded by Mr. Francese: RESOLVED, all special counsel who may at any time be retained by this Town Board or -who are now under retainer by this Town Board or any of its agencies or offices, are directed to promptly, within 5 days, submit copies of all correspondence, agreements, applications, and other papers relating to the matter to which they are assigned to the Attorneys for the Town of Wappinger.
