1965-12-27 SPM328 A Special Meeting of the Town Board, Town of Wappingers, was held on Monday evening, December 27, 1965, in the Town Hall, Mill Street, Wappingers Falls, for the purpose of discussion the Oakwood Knolls Sewage Treatment Plant, and other allied problems. Present: R. H. Ling., Supervisor V. C. Kelley, Engineer to the Town W. J. Bulger, Justice of the Peace H. H. Reilly, Attorney for the Town George Robinson, Councilman E. H. Snowden, Town Clerk L. D. Diehl, Councilman Absent: V. S. Francese, Justice of the Peace Others Present: R. E. Aldrich J. D. Quinn J. Worona The meeting was opened by Mr. Linge at 8:12 P.M. A motion was made by Mr. Bulger and seconded by Mr. Diehl that the following resolution be adopted: WHEREAS, the resolution adopted by this Board on December 2, 1965 found that a public health menace was threatening the residents of the Town of Wappinger, and that the Commissioner of Health of the County of Dutchess, after a meeting of the Board of Health of said County held on December 23, 1965, has made a determination that such a health nuisance exists in said township and, specifically, in the Oakwood Knolls Sewage Treatment Plant, this Board RESOLVES that the Clerk of the Town of Wappinger be directed to immediately inform the Commissioner of Health of the Dutchess County that it anticipates the abatement of the nuisance as provided for by law under the direction of the Dutchess County Department of Health and/or the State Department of Health, and be it further RESOLVED that the Board rescind the resolution of December 2, 1965 because the same was based upon a mistake in fact and was further based upon an order of the Dutchess County Board of Health, made by its Commissioner, which same is now on the advice of Counsel to the Board of questionable validity, and further because the Town Board, in its legislative determination and best judgment, feels that, in the interest of the Town and of the residents of the Oakwood Knolls Sewer District, the order should no longer be obeyed because the same might result in a waste of public funds to the detriment of the taxpayers of the Town of Wappinger, and be it further RESOLVED,that the Engineer to the Town be directed to terminate the services of any personnel previously authorized to maintain the Sewage Treatment Plant 3* at Oakwood Knolls. Upon roll call, the Supervisor Councilman Justice of Councilman vote was as follows: Linge Robinson the Peace Bulger Diehl Voting: Aye Voting: Aye Voting: Aye Voting: Aye A motion was made by Mr. Bulger and seconded by Mr. Diehl that Mr. Russell Aldrich be given permission to continue the defense for the Town of Wappinger in the litigation brought against the Town by L & A Filtra- tion Corporation,and to take other steps as deemed necessary..
