1965-12-02 SPMA Special Meeting of the Town Board, Town of Wappinger was held Thursday
evening, December 2, 1965, at the Town Hall, Mill Street, Wappingers Falls,
New York.

A letter had been received from the Dutchess County Department of Health
Re: Oakwood Knolls Sewer District
Gentlemen:
This is to advise you that I have been informed by the New York State Depart-
ment of Health that as of this date a Permit to Discharge has been issued to
the Oakwood Knolls Sewer District for the discharge of seage from Section I
of Oakwood Knolls through the Oakwood Knolls Sewage Treatment Plant.
Since the proper maintenance and operation of this plant is essential to
the public health, you are, therefore, directed to assume the responsibilities
for the maintenance and operation of the Oakwood Knolls Sewage Treatment
Plant, at once.

The following Resolution.was proposed by.Councilman Louis Diehl, seconded by
Justice of the Peace Vincent S. Francese, and unanimously carried.
WHEREAS, the Town Board of the Town of Wappinger is of this date, in receipt
of a letter from Matthew A. Vassallo, M.O., Health Commissioner of the
Dutchess County Department of Health, informing this Board that a permit to
discharge has been issued to the Oakwood Knolls Sewer District for the dis-
charge of seage from Section I of Oakwood Knolls through the Oakwood Knolls
Sewage Treatment Plant, and
WHEREAS, the said letter directs the Town Board to assume the responsibilities
for the maintenance and operation of the Oakwood Knolls Sewage Treatment
Plant, at once, and
WHEREAS, it is the opinion of the Town Board that the Dutchess County Depart-
ment of Health is derelict in its duties and that, if the operation of this
plant is essential to the Public health, it is the duty and obligation of
the Department of Health to assume the operation and maintenance of the said
sewer plant, and
WHEREAS, the Town Board does question the Authority of the Dutchess County
31,9-;,,Hea1th Commissioner to issue such a directive,
NOW THEREFORE, IT IS HEREBY
RESOLVED, that due to the apparent Public Health Menace threatening the
residents of the Town of Wappinger, the Town Board shall obey the directive
of the Dutchess County Health Commissioner under Protest, and it is further
RESOLVED, that the said operation shall be in No Way Construed so as to limit
the rights of the Town of Wappinger to recover compensation for the operation
and Maintenance of the said plant, and it is further
RESOLVED, that the Town Engineer to the Town of Wappinger is hereby authorized
and directed to take the necessary steps to employ qualified personnel for
the operation and mainenance of the said plant.
