1965-11-04 RGMThe regular monthly meeting of the Town Board, Town of Wappinger was held on Thursday evening, November 4, 1965, at the Town.Hall, Mill Street, Wappingers Falls, New York. Present: Supervisor - Richard H. Linge Councilman - George Robinson Councilman - Louis Diehl Justice of the Peace - William J. Bulger Justice of the Peace - Vincent Francese Attorney for the Town - Harold Reilly Engineer for the Town - Vincent Kelley Building Inspector - Joseph E. Ludewig Highway Superintendent - Robert Lawson Town Clerk - Elaine H. Snowden Absent: None The meeting was opened by Supervisor Richard Linge at 8 P.M. Supervisor Linge tupreusad sympathy in noting the deathof Helen Travis, Town Clerk° since the last Town Board meeting, and proposed that sympathy of the Board be sent to the family. A motion was made by Justice of the Peace Bulger that there be a minute of silence in expression of sympathy to the family of Helen Travis^ seconded by Councilman Robinson. Motion Carried All Stood for a moment of respect. The following Resolution was proposed by Justice of the Peace William J. Bulger: WHEREAS, Helen L. Travis was duly elected the Town Clerk of the Town of Wappinger for a term which was to expire December 1965, and WHEREAS, the said Helen L. Travis passed away before the expiration of her term of office, and WHEREAS, the Town Board finds that in order to properly conduct the affairs of the Town of Wappingar, it is necessary to have someone appointed tothe office of Town Clerk of the Town of Wappinger to fill the unexpired term of the said Helen L. Travis, and WHEREAS, Elaine Snowden has assisted the Town Clerk on many occasions and is qualified to assume the position of Town Clerk, and WHEREAS, the said Elaine Snowden has expressed a desire to assume the duties of the Town Clerk, NOW, THEREFORE, IT IS HEREBY RESOLVED, that Elaine Snowden is hereby Appointed to the position of Town Clerk to fill the unexpired term of the said Helen L. Travis, and to be paid a monthly salary at the rate of $5^200°0O per annum. Seconded by; Councilman Louis Diehl. The following vote was taken: Supervisor Linge - Aye. Justice of the Peace Francese - Ave. Justice of the Peace Bulger -Aye. Councilman Robinson - Aye. Counoilman Diehl - Aye. - ^� Motion Carried. Supervisor Linge advised the Board that they had received copies of the minutes of the Regular meeting October 7, 1965, and copies of the Special meetings, October 7th, 4th, llth, and 14th, 1965° What was the Boards pleasure on same. A motion was made by Justice of the Peace Bulger that the minutes be accepted as read, seconded by Councilman Robinson. Motion Carried The following bills were presented: Highway Fund 2^436,10 General Fund $8^791°77 A motion was made by Councilman Robinson and seconded by Justice of the Peace Francese that the bills be paid, subject to audit. Motion Carried The following reports were presented: Building Inspectors report for the month of October, 1985 Building Permits issued for: 31 Single Family Dwellings 6 Residence Additions 3 2 -Car Garages 2 Tool Sheds 4 Others 46 Total Permits Issued for October Total Value of Construction $622,700^00 Total Amount of Fees Collected and turned over to Town Clerk $ 680"00 Miles traveled on Zoning & Building Inspection by the Building Inspector 213 During the month of October, Certificates of Occupancy were issued for 18 Single Family Dwellings and 1 Residence Addition. Ludewig The following is a report of activities handled by me during the month of October, 1965 as Justice of the Peace: (l) 43 motor vehicle cases showing $605.00 collected in fines. (2) 1 motor vehicle warrant issued. (3) 2 civil cases handled showing $4°00 collected in fees and filing costs. A total of $609°00 has been forwarded to the State Dept. of Audit and Control. $235°00 is being held in my official bank account on pending motor vehicle and criminal cases. Francese The Following is a report of activities handled by me during the month of October, 1865: Type Number Fines & Fees Collected Motor Vehicle 85 $1040°00 Civil 3 7.50 Criminal 3 A total of $1047.50 has been forwarded to the State Department of Audit and Control. I am holding a total of $1O.00 in a pending motor vehicle case. 1 Warrant was issued during the month. Respectfully submitted, William J. Bulger Justice of the Peace Bulger noted that no action had been taken on the Ditch in Wildwood Forest I. A motion was made by Justice of the Peace Bulger that the Board direct a letter to Malcolm Cornell indicating the fact that nothing has been done in regard to the stipulated conditions of the Ditch, and that the Board is directing the Attorney for the Town, Harold Reilly, to prepare to call the Bond, and, advise Mr. Cornell Building Permits on Wildwood II would then be withdrawn. Seconded by Councilman Diehl. Motion Carried A Letter was received from the Wildwood Forest Civic Association, asking to be included on the Agenda. Mr. Cortellino was present and read the following letter: We have waited in the past for many promises to come true. We admit that in time most of them did come true; however, why were they always late? A case in point is the roads in Wildwood Forest. We were told they would be finished by October ]lt; today is November 4th, and they are still not completed. We do not object too violently to this fact, as over the past year, the residents have become inured to the many wrongs. We do object, however, to the continual exploiting of Town of Wappinger residents by devel- opers and wish this exploitation to cease. With this view, we propose for your considerations, the following: 1. The bonds posted by developers who have required extensions and/or did not meet deadlines in the past have a 50% surcharge on the normally calculated bond. This 50% surcharge would be used for overtime work to complete the work as fast as possible. Any corporation which has an individual who has at least 10% financial interst in the corporation and who was at any time an officer and/or has had at least 10% financial interest in a different corporation which had defaulted, will have this surcharge. 2. a) When a map is to be shown to the Planning Board, a duplicate be posted in the meeting hall so that interested parties can follow the discussion. These maps are to be kept on file at the Town Clerk's Office for the public to view. b) That the public be granted the right to be heard, rather than privileged at all Planning Board meetings. c) That the Planning Board Chairman or his delegate attend the Town Board meetings. Thank -you, C. A. Cortellino Wildwood Forest Civic Assocn. Mr. Cnrtallino then thanked public officials and private citizens who have who had contributed to work done in the past few days. A letter was received from Mr. Tomazin in reference to Dorothy Heights Rd. usage. Justice of the Peace Francese said the matter had been answered at the Public Hearing and with the Ordinance adopted then. The Board at this time was informed that the Village Board meeting was to be Nov" 10, 1965, and that confirmation had been received that the Town Board had been put on the agenda for said meeting. A letter of appreciation was received from the Travis family. A letter was received from the Oakwood Knolls Civic Association extending their sympathy on the death of Mrs. Travis. A Letter was read from Concetta Silvestri, notifying the Board that she will no longer be doing the bookkeeping for the Town of Wappinger, and that she had also notified the Supervisor -elect, Joseph Fultorl to this effect. A letter was received from the Recreation Commission with a recommendation for the appointment of Mr. George Schlathaus to fill the vacancy on the Comm- ission left by the resignation of Murray Edelstein. A motion was made by Justice of the Peace Bulger that George Schlathaus be appointed to the Recreation Commission, as Mr. Schlathaus has been very active in Little League Baseball and football, and has spent much time and effort on recreation and the Town would benefit greatly by his experianca° teconded by Councilman Robinson Motion Carried Mr° James Porter addressed the Board. He requested information as to the outcome of a meeting between the Developers of Oakwood Knolls, the Engineer for the Town, and the Planning Board. Engineer Kelley replied there was no such meeting. Justice of the Peace Bulger felt Mr. Porter had been misin- formed. There had been an informal meeting between the Town Board members, nothing the Developer ^ and 2 gentlemen interested in purchasing the proparty4in re- gards to obtaining a bond. There was no particular outcome from this meeting. Mr. Porter asked who would be responsible for plowing streets in Oakwood this Winter. Attorney Reilly said that Ritter could plow and maintain the Roads. Justice of the Peace Bulger asked if the Town plowed, could the Town bill Ritter back. Attorney Reilly repied //No//° Supervisor Linge asked if we could get a release from him and do it. Attorney Reilly said he would check on it. Schoonmakers request for permission to form a Sewer Corporation, having been Tabled at the previous meeting, was again brought up. Attorney Reilly stated �� .~ � � _. �� / that no one had signed the consent, and he needs the signatures of the individuals. He said he would call and have them forward it to him. 313 Supervisor Lingebrought before the Board, a list of outstanding checks that his bookkeeper informed him were outstanding for more than 90 days. The records had been checked and the payees contacted. All of the people contacted indicated there was no money owed them. Supervisor Linge requested the con- sent of the Board to return the balances of these checks to their respective funds. A Motion was made by Justice of the Peace Bulger that the money be put back into the funds, seconded by Councilman Robinson. Motion Carried Supervisor Linge advised the Board that a Public Hearing on the Budget for the Town of Wappinger, for the fiscal year of 1966, had been held on Monday Evening, November 1, 1965. The following Resolution was madeby Councilman Robinson, and seconded by Justice of the Peace Bulger. WHEREAS, the Town Board has met at the time and place specified in the notice of Public Hearing on the preliminary budget and heard all persons desiring to be heard thereon, NOW, THEREFORE, BE IT, RESOLVED, that the Town Board does hereby adopt such preliminary Budget as the Annual Budget of the Town of Wappinger, for the fiscal year beginning the lst day of January, 1966, and that such budget as so adopted, be entered in detail in the minutes of the proceedings of this Town Board, and be it FURTHER RESOLVED, that the Town Clerk of the Town of Wappinger shall prepare and certify in duplicate, copies of said annual budget as adopted by the Town Board together with the estimates, if any, adopted pursuant to Section 202a, Subd. 2m of the Town Law, and deliver one copy thereof to the Supervisor of the Town to be presented by him to the Board of Supervisors of the County. The following vote was taken: Supervisor Richard H. Linge Aye Councilman George Robinson Aye Councilman Louis Diehl Aye Justice of the Peace William J. Bulger Aye Justice of the Peace Vincent S. Francese Aye The Resolution was thereupon declared duly adopted. Supervisor Linge took this opportunity to introduce the Candidates -elect for Superintendent of Highways and Councilman, Knud Claussen, and Louis Claussen. Superintendent of Highways Robert Lawson suggested to Mr. Knud Claussen that he felt it would be a good idea for the two of them to get together, and that he would help Mr. Claussen all he could on his new job. They decided to meet after the meeting for further discussion. Supervisor Linge added at this time that he would try to work with Mr. Fulton for a smooth transfer of responsibility of the Town. The following resolution was made by Councilman Diehl and seconded by Justice of the Peace Bulger, and unanimously carried. WHEREAS, an application has been received by this board from Opalo Realty Corp., requesting that the proposed streets and partially constructed proposed streets known as Cider Mill Loop and Winesap Lane, located in a residential real estate subdivision, in the Town of Wappinger, Dutchess County, New York, known as "Ye Olde Apple Orchard" be accepted as and for public streets in the Town of Wappinger, and WHEREAS, Opalo Realty Corp. has tendered to this Board a deed conveying and dedicating the said proposed streets to the Town ofWappinger as and for public streets, it is hereby RESOLVED, that this Board does hereby accept the proposed street known as Cider Mill Loop and Winesap Lane and the deed dedicating the same, and it is further RESOLVED, that the said streets shall hereafter be public streets in the Town of Wappinger known as Cider Mill Loop and Winesap Lane, subject to the following conditions: FIRST: That Opalo Realty Corp. furnish to the Town Board of the Town of Wappinger a performance bond in the amount of $53,000=O0 approved by the said Town Board, and by the Town Attorney and by the Superintendent of High- ways of the Town of Wappinger as to amount, fom^ sufficiency of surety and manner of execution, insuring satisfactory completion of the aforesaid streets in said subdivision in accordance with the current minimum standard require- ments for establishing roads in the said Town of Wappinger and in accordance with current specifications provided by the Superintendent of Highways of the Town, of Wappinger and further insuring installation and completion of the storm water drainage system for said subdivision, the plan for which has been heretofore approved by the Town Superintendent of Highways and the Town Engineer, said work and improvements being subject to the final approval of the Town Superintendent of Highways and the Town Engineer of the Town of Wappinger, and further insuring compliance with the conditions set forth in the resolution of the Planning Board of the Town of Wappinger giving final approval to the said subdivision plat. SECOND: That the Town oflda99fnger assumes no responsibility for maintenance and repair, including the removal of snow, of and from said streets until the performance of the conditions mentioned in the aferementioned bond has been completed. THIRD: ° That a full covenant and warranty deed of dedication and the grant of storm sewer drainage easements be delivered to the Town of Wappinger and to the approval by the Town Attorney as to the adequacy, substance and form of such instruments and that such instruments are accepted subject to an examination of title to the premises or rights conveyed thereby by the Town Attorney. FOURTH: That an attorney's certificate of title insuring title in said road shall be delivered andaccepted by the Town Board. FIFTH: That a Release of all Mortgages and liens on the premises be presented to the Town Board. Supervisor Linge asked the Beacon reporter, Mr. Everts, what had happened to him since he was last at a Town Board meeting. Mr. Everts reported that a baby daughter had been born to them on October lOth° Justice of the Peace Bulger made reference to a letter received at the lett Town Board meeting, concerning the Town taking over Curran Terrace on Cedar Hill" He asked if there was any report. Engineer Kelley said he would have the material in order for the next Board meeting. Mr. Silver addressed the Board, asking if there were any other reports of the L & A suit, other than in the paper. Justice of the Peace Bulger replied that the paper gave the complete dotaila» and as there were arguements, no decision was reached. Supervisor Linge declared the meeting be adjourned.
