A Special Meeting of the Town Board, Town of Wappinger was held on Tuesday
evening, August 17th, 1965, in the Town Hall, Mill Street, Wappingers Falls,
N. Y.

The meeting was opened at 8 P. M. by Supervisor -Richard H. Linge.
Supervisor Linge read the following report from Engineer forvthe Town Vincent
Kelly
An inspection of the Fleetwood Developemnt as at this date was made.
The items of work to be done as detailed in our letters to the developer
dated July 21 and August 2 have been accomplished except for a few items.
In gneral the work done meets the specification under which the road
was approved and bonded. Additional work has been done in excess of the
specifications and requirements.
My opinion is that the specifications have been met and exceeded pending
completion of item of work remaining as noted above.

Test sampling of the bee* construction have been made and the base is
satisfactory to depth and material. The pavement was inspected as it was
constructed.
The following resolution was made by Councilman Robinson and
seconded by Councilm Deihl and unanimously carried.
WHEREAS:, an application has been recieved by the Board requesting final
approval and acceptance of the improvements to that portion of the pro-
posed streets and roads known as Kretch Circle and Franton Drive, as
has been previously accepted by the Town Board on October 4, 1962 in this
residential real estate subdivision in the Town of Wappinger, Dutchess
County, known as "Osborn Hills, Inc., " and
WHEREAS, a further application has been made to this Board requesting
that that portion of the said streets be finally accepted as and for
a public street and road in the Town of Wappinger, and
WHEREAS , THE Town Superintendent of Highways and the Town Engineer of the
Town of Wappinger has reported that the improvement to the aforementioned
streets and roads have been satisfactorily completed in accordance with
the applicable maximum standard requirements for establishing Roads in
the Town of Wappinger and in accordancfewith the applicable specific-
ations set forth by the Superintendent of Highways of the Town of
Wappinger, and
WHEREAS, it appears that all conditions pertaining to the construction
of said roads and streets as set forth and contained in the Resolution
duly passed and adopted by this Board with reference therto on the
4th day of October 1962 have been completed with and fulfilled
NOW, THEREFORE, IT IS HEREBY,
RESOLVED, that this Board does approved and accept the construction
and improvement to the said roads, and it is further
RESOLVED , that the said roads shall hereafter be a public street
and road in the Town of Wappinger known as Kretch Circle and
Franton Drive, and it is further
RESOLVED , that Osborne Hills, Inc., as principal and Continental Casualty
Company, as surety in a certain performance bond heretofore posted with
the Town of Wappinger, dated October 2, 1962 guaranteeing completion
of improvements to the aforesaid street and road, be and they hereby
are realeased from any agd all liability on said bond, and it is further
RESOLVED, that the Board does hereby consent that the road performance
bond be caneelled and exonerated forthwith.
The following resolution was made by Councilman Deihl and seconded by Councilman
Robinson and unanimously carried.
WHEREAS, an application has been received by this Board
from GALLO BROTHERS HOLDING CORP., requesting that that portion
of the proposed streets and partially completed proposed streets
known as Midge Drive and Kretch Circle, as more fuly described
on a rider attached hereto, and located in a residential real
estate subdivismon in the Town of Wappinger, Dutchess County,
New York, known as "Fleetwood Manor" be accepted as and for
public streets in the Town of Wappinger, and
WHEREAS, the said GALLO BROTHERS HOLDING CORP., has
tendered to this Board a deed conveying and dedicating that
portion of the proposed streets, as is more fully described on
a rider attached hereto, to the Town of Wappinger as and for
public streets, it is hereby
RESOLVED, that this Board does hereby accept that
portion of the proposed streets, known as Midge Drive and
Kretch Circle, as is more fulitiy described on a rider attached
hereto, subject to the following conditions:
FIRST That Gallo Brothers Holding Corp.
furnish to the Town Board of the Town of Wappinger a performance
bond in the amount of $28,000.00 approved by the said Town
Board, and by the Town Attorney and by Superintendent of

Highways of the Town of Wappinger as to amount, form, sufficiency
of surety and maner of execution, insuring satisfactory comple-
tion of the aforesaid streets in said subdivision in accordance
with the present current minimum standard requirements for esbablishing
road in the said Town of Wappinger and in accordance with present current
specifications provided by the Superintendent of Highways of the
Town of Wappinger and further insuring installation and comple-
tion of the storm water drainange system for said subdivision,
the plan for which has been heretofore approved by the Town
Superintendent of Highways and the Town Engineer, said work and
improvements being subject to the final approval of the Tovn
Superintendent of Hgjhways and the Town Engineer of the Town of
Wappinger, and further insuring compliance with the conditions
set forth in the resolution of the Planning Board of the Town of
Wappinger approving the said map.
SECOND That the Town of Wappinger assumes no
responsibility for maintenance and repair, including the removal
of snow, of and from said streets until performance of the condi-
tions mentioned in the afor ementioned bond has been completed.
THIRD That a fullcovenant and warranty deed
of dedication and the grant of storm sewer drainage easements
be delivered to the Town of Wappinger and to the approval by the
Town Attorney as to the adequacy, substance and form of such
instruments and that such instruments are accepted suject to
an examination of title to the premises or rights conveyed
thereby by the Town Attoarney.
FOURTH ; That an attorney's certificate of tit&e
insuring title in said road shall be delivered and accepted by
the Town Board. -
FIFTH : That pending completion of the said roads and final
acceptance by this Board, the developer shall at his own cost and expense
maintain the said roads in a suitable condition for use by the public
