1965-08-05 RGM265 The regular monthly meeting of the Town Board, flown of Wappinger was held on Thursday evening, August 5, 1965 in the Town Hall, Mill Street, Wappingers Falls, N. Y. Present -Supervisor -Richard H. Linge, Justice of the Peace -William J. Bulger, Justice of the Peace -Vincent S. Francese, Attorney for the Town -Harold H. Reilly, En}mneer for the Town -Vincent Kelly, Building Inspector -Joseph E. Ludewig, Town Clerk -Helen L. Travis. The meeting was opened at 8 P. M. by Richard H. Linge, Supervisor. Supervisor Linge advised the Board that they had received copies of the July 8, 1965 and June 3, 1965 minutes. What was their pleasure on same. The .) Board layed these minutes over until next meeting, due to the fact that -there was not enough botkd members present. The following bills were presented for the month of July Highway $7,549.19 General Fund $5,905.00 Motion was made by Justice of the Peace Bulger and seconded by Justice of the Peace Francesethat theabove bills be paid -subject to audit. Motion carried Attorney Russel Aldrich presented to tbet!iown Board an order establishing the Creation of a Sewer District in the Town of Wappinger. He stated that acceptance of the State of New York had forwarded a copy of/application of the Town Board of the Town of Wappinger, for permission of the State Comptroller to Establish Oakwood Knolls Sewer District in said Town as follows: - WHEREAS, application has been duly made to the undersignedbythe town board of the Town of Wappinger, Dutchess County, New York, by its Supervisor, pursuant to section 194 of the Town Law, for the permission of the State Comptroller to establish Oakwood Knolls Sewer District in said Town, in ac- cordance with such application and a resolution of said board adopted on Feburary 11, 1965, and WHEREAS, notice of such applicationtothe State Comptroller has been duly giventothe Clerk of the Board of Supervisors of Dutchess County, New York, by the State Comptroller in the manner prescribed by section 194 of the Town Law, and WHEREAS, the undersigned has duly examined such application, NOW,THEREFORE, purs uant to such examination and upon such application of the town board of the Town of Wappinger, the undersigned does hereby find and determine, after due deliberation: (1) That.the public interest will be served by the establishment of Oakwood Knolls Sewer District in the Town of Wappinger in accordance with such application. Attorney Aldrich then presented an order establishing the District for the Town Board Acceptance and signature: Motion was made by Justice of the Peace Bulger and seconded by Justice of Peace Francese that the Town Board accept and sign the following Order establishing the Oakwodd Sewer District: STATE OF NEW YORK COUNTY OF DUTCHESS : TOWN OF WAPPINGER IN THE MATTER OF THE CREATION OF A SEWER DISTRICT IN THE TOWN OF WAPPINGER, COUNTY OF DUTCHESS, STATE OF NEW YORK. ORDER ESTABLISHING DISTRICT The petition in this matter for the creation of a sewer district having been duly presented to the Town Board of the Town of Wappinger, together with the necessary map and plan attached thereto, and the map and plan,having been found satisfactory by the Dutchess County Department of Health, with whom a copy of the same is on file, and an Order having been duly adopted by the Town Board of the Town of Wappinger on the 25th day of June, 1964, dir- ecting a public hearing upon the said petition, which said petition was ver- ified the 28th day of April, 1964, and filed with the Town Board of the Town of Wappinger on said date, whcih said public hearing was directed to be held on the 16th day of July, 1964, at 7:30 o'clock in the evening of that day to further consider said petition, at the Town Hall, Mill Street, in the Village of Wappingers Falls, Dutchess County, New York, and a hearing having been held by said Board at such time and place, and evidence and proof having been in- troduced with reference to the proposal, and said hearing having been adjourned, from time to time, and lit having been duly resolved and determined following the said hearing that the petition herein was signed, acknowledged and approved, as required by law, and otherwise sufficient, and that all of the property pi-eperty owners within the proposed district were benefitted thereby, that all property and property owners benefited were included within the territory of the proposed district, and that it was in the public interest to grant and allow the relief sought, and it having been then and there duly resOolved that the establishment of said district, as proposed, be approved and app - plication having been thereafter and on the 3rd day of March, 1965, duly made. in duplicate, to the Department of Audit and Control, at Albany, New York, for permission to create such district as more fully provided for by the Town Law, Section 194, and the State Comptroller having duly made an Order, in duplicate, dated the 28th day of July, 1965, granting permission for the creation of the district, in all respects as petitioned for, and approved by the Town Board of the Town of Wappinger, as aforesaid, and one copy of such Order having been duly filed in the office of the State Deparment of Audit and Control, at Albany, New York, and the other in the Office of the Town Clerk, of the Town of Wappinger,Dutchess County, New York, and the Town Clerk having duly pre- sented such Order to this Board at this meeting, the same being the first meeting held after the said Order was filed with her; Motion carried Motion was made by Justice of the Peace Bulger and seconded by Justice of the Peace Francese that a public Hearing be held on the Establishment of the Oak- wood Knolls water District on Thursday, September 9, 1965 at 7:30 P. M., in the Town Hall, Mill Street, Wappingers Falls, N. Y. Motion carried The following resolution was made by Justice of the Peace Francese a WHEREAS, in May 1956, a deed wasstendered to this Board from Louis Eck, which deed conveyed and dedicated certain streets known as Lydia Drive, Ada Drive, Peter Drive, Marlyn Drive, Michael Drive and a portion of Eck Road, as shown and delineated on the subdivision maps known as, "Ardmore Hills, Section A", filed in the Dutchess Clunty Clerk's office as Map No. 2604, "Ardmore Hills, Sections B. and C", filed in the Dutihess County Clerk's office as Map No. 2614 and "Ardmore Hills, Section D", filed in the Dutch- ess County Clerk's office as Map No. 2722, and WHEREAS, the said deed of dedication was never recorded and the same has subsecintly been misplaced, and WHEREAS, the portion of Eck Road excepted in the said deed has now been completed in accordance with the applicable Town highway specifications, and WHEREAS, an application has been received by this Board from Louis Eck requesting that the excluded portion of Eck Road be accepted as and for a public street in the Town of Wappinger, it is hereby RESOLVED, that this Board does hereby accept the proposed street known as Eck Drive, which was previously excepted in the deed conveying title to the roads as sown on the maps of Ardmore Hills, Nos 2604,2614 and 2722, and it is hereby RESOLVED, THAT THIS Board does aceept a new deed conveying title to all the roads as set forth on the said maps. Respectfully Submitted -Joseph X. Ludewig, Building Inspector. During the month of July, 1965, the activities listed below were handled in Justice Court: (1) 39 motor vehicle cases handled showing $670.00 collected in fines, with one defendant remanded to Dutchess County Jail ;in lieu of payment of $100.00 fine. (2) 2 civil cases handled showing $4.00 collected in fees and and filing costs. (3) No criminal cases were handled during the month. A total of $674.00 was forwarded to the State Department of Audit & Control. At the close of the month, I was holding $250.00 in four pending motor vehicle cases. Respectfully submitted -Vincent S. Bulger A letter was read from the Central Hudson Gas & Electric Corporation enclosing Plans 1 & 2, providing installation of lights at junction of roads. Supervisor instructed Town Clerk to lay this letter over until next meeting. To send each Board member a copy and have it checked by the Attorney. A latter was read from the County Superintendent of Highway, Edgar M. Petrovits, 5 ori in reference to Speed LimitawAll Angels Hill Road. Mr. Petrovits stated he would not sign same as this road was primarily built to spped traffic from Red Oaks Mills area to I. B. M. Plant. A letter was read from Edgar M. Petrovits, County Superintendent of Highways in reference to garbage being dumped at Airport saying he had turned same over to Cecil D. Sherow * Co-chairman of Airport Committee, as his deparment only does work at the Airport which is authorized by that committee. The Town Board instructed the clerk to write to Cecil D. Sherow and Jack Dexter co-chairman of the Airport Committee in reference to Garbage Dumping stating that they thought enough time had elapsed on this matter. Clerk to send letter certified. A letter was received from Lawrence M. Quinlan, Sheriff of Dutchess County in answer to our letter of July 15th stating he did assigned men to watch and check this area on All Angels Hill Road as frequently as possible and we will continue to do no. A letter was received from Fred. J. Lafko, President of Skyview Developement Corp. about the situation at Wildwood Drive. The Town Clerk reported that she had received the copy of the Audit of the Town Books and that _they were in very good condition. That notice had been posted in paper and t hat the audit was on file in the office and could be seen at any time. The following letter was received from Wildwood Forest Association: Wappinger Town Board: Gentlemen: Enclosed is a copy of a letter to Mr. F. J. Lafko thanking him for the completed portions of the roads ahead of original schedule. We would like to thank the Town Board for the contribution of its time and effors on an impartial basis to arrive at a solution amenable to the in- tarasted parties. Signed Joseph E. Landolfi Enclosed Letter Dear Mr. Lafko: The Wi0dwood Forest Civic Association would like to express its thanks to you for the fullfillment of the promises that you made at a special meeting of the Town Board of Wappinger in regard to the paving of the roads in the completed portions of Wildwood Forest. We hope that this spirit of cooperation will continue in the future so that upon completion of construction in other areas, the roads serving these areas will be paved. Joseph E. Landolfi, President Attorney Murrill Effron appeared before the Board in refer$nce to accepting roads in Fleetwood Drive. Engineer Kelly and Superintendent of Highways, Robert Lawson reported that within a day or two that these roads would meet the specifications for 1960 and that they recommended that they beaccepted, the motion stating when these minor things had been taken care of. Joseph Landsman stated he and other residents were against the acceptance of the road as they were not in condition. BobLmArchesvesque asked for a meeting between the residents and the Town Engineer, before the acceptance. Luke Redd asked do they meet the 1960 -1962 specifications.He also suggested that he thought the Town Board should talk to the people before they accepted the road. He asked if there was any defsault in the bond is the new speicifdeations would apply. Joseph Tullo suggested he thought we should wait until after the meeting withe the people before accepting the roads. The Town Engineer agreed to meet with the people from Fleetwood Drive on Saturday August 7, 1965. Mr. Joseph Landolfi spoke on problems on Sky View Developement. 1 --Solving of Ditch.:Problem. Justice of the Peace Bulger suggested that gratitg could be used over ditch. Mr. Kelly is to lok into this. Mr. Landolfi stated that the people thought there would be no other solution but to fill in the ditch. They stated dich does not meet specifications, because it is about twice as wide as specifications. Mr. Bisom aked who is to pay the $47,000.00 for Edghill. If we pay this won't other be after the same thing. Mr. Landolfi stated that if grates were installed he was afraid that this would cause troubles with cleaning bl4e ditch. Engineer Kelly is to talk to developers to see what can be done about the ditch. Mr. Bisom spoke about sppeding on Myers Corners Road, asked if we would send an- other application for reducing speek stating about opening of I. B. M. Plant and that they now had over 300 employees making a lot more cars on same. The Board instructed the Clerk to write a letter to the County Superintendent of Highways asking what the Plans were for Myers Corners Road and what was going to be done this year. It was recommended that the Town consider the speeding on Wildwood Drive, as this road is supposed to be extended and the speeding is already started and 2'3 will be much greater when extended. Mrs.Schmaltz spoke about Edgehill Road sppeding stating no report had core in as yet. Justice of the Peace Bulger suggested that that the officers of the Civic Assoc- ation write direct to State officers about speeding. Mr. Fred. Weiss, Henry Drive asked if he could have a copy of letter about sppeding on Henry drive sent to him. Milton - D. Silver spoke about the meeting of Planning Board held on Monday evening staling that it was very poorly conducted, that they would not answer any questions. He suggested that Mr. Vander winckel be reprimanded for his conducting of this meeting. Mr. Bisom wanted it made known the Planning Board members do not recieve any money for the work that they do. Supervisor Linge on behalf of the Town Board thanked Mr. Vanderwinckel chairman of the Planning Board and all of the member and the Board an also members of the Zoning Board of Appeals and the Receeation Commission and all people who are giving their services to help the Town. Engineer Kelly presented a title to Ougans Lane to the Town Board for Mrs. Rao. The following resolution was proposed by Justice of the Peace Bulger and seconded by Justice of Peace Francese and carried. WHEREAS, the owners of the real property situated on the street and highway, known and designated as Duggees Lane, in the Town of Wappinger, Dutchess County, New York, have tendered to this Board a deed of dedication to this road, and WHEREAS, Duggans Lane Ws for many years been continuously used by the public, as and for a public street and highway, and WHEREAS, This Board is of the opinion that the interests of the residents of the Town of Wappinger and of the public in general will be best served by the acceptance of this offer of dedication Now therefore, RESOLVED, that Duggans Lane, as described in the deed of dedication offered to this Board, be accepted as and for a public Street and Highway in the Town of Wappinger, Subject to -obtaining the interest conveyed to the Town of Wappinger, presently held by the Estate of Michael Mirras, Further Resolved; that the Superintendent of Highways of the Town of Wappinger is hereby authorized to maintain the road Duggans Lane, as described in the deed of dedication. Engineer Kelly reported that he had been ih touch with the Village and that Adams St, in which the Town owns 200 feet is to be paved. He would have a more thorough report for the Board later. Engineer Kelly reported on the Edgehill Sewer bids. The Board agreed that these whould be laid over until a later date. Engineer Kelly says he has the applications of two operators at Oakwood. The Board agreed to meet with these people for an interview. Knud Clausen asked the Town Engineer to look at the Bridge on Widmer Road stating something is wrong. Engineer stated the County Highway Superintendent knew about same and that they would be there in the morning. The following resolution was made by Justice of the Peace Francese and seconded by Justice of the Peace Bulger and unanimously carried. WHEREAS, an application has beeivreceived by the Board from Orchard Homes, inc. requesting thet that portion of the proposed street and partially completed poo - posed street, as is more particularly described in a deed of dedication to be offered by Orchard Homes, Inc., known as Ardmore Drive, in a residential real estate subdivision in the Town of Wappinger, Dutchess County, New York, known as "Orchard Homes section A," be accepted as and for a public street in the Town of Wappinger, and WHEREAS, the said Orchard Homes, Inc., Its to submit to this Board a deed con- veying and dedicating said portion of the proposed street to the Town of Wappinger as and for a public street, and WHEREAS, the Town Engineer and Town Superintendent of Highways, have reported that the said road as described in the said deed of dedication, the applicable minimum standard requrements for establishing roads in the Town of Wappinger, it is hereby RESOLVED, that this Board does hereby aceept thlA pootion of the proposed street known as Ardmore Drive, as described in the said deed of conveyance, subject to the following conditions: FIRST: That a full covenant and waranty deed of dedication and the grant of storm sewer drainange easements be delivered to the Town of Wappinger and to the approval of the Town Engineer as to adequacy of description and to the approval by the Town Attorney as to adequacy, substance and form of such instruments and that such instruments are accepted subject to an examination of title to the premiies or rights conveyed thereby by the Town Attorney. SECOND: That an Attorney's certificate of title insuring title in said road shall be delivered and accepted by the Town Board.
