1965-07-08 RGM252 The regular monthly meeting of the Town Board, Town of Wappinger, was held in the Town Hall, Mill Street, Wappingers Falls, N. Y., Thursday evening, July 8, 1965. Present: -Councilmen -George Robinson and Louis De+h1e, Justice of the Peace - William Bulger and Vincent Francese, Attorney for the Town --Harold Reilly, Engineer for the Town --Vincent Kelly, Building Inspector -Joseph E. Ludewig, Highway Superintendent -Robert Lawson, Town Clerk -Helen L. Travis. The meeting was opened at 8 P. M. by Deputy Supervisor, George Robinson. Deputy Supervisor, 6eohgedRobinson advised the Board that they had received copies of the minutes of the Regular meeting of June 3rd, 1965 and the Public Hearing of May 27thrp 1965, what was their pleasure on same. Town Clerk stated that tbere was a correction in the minutes of the Public Hearing of May 27th, 1965 as follows: on Page 243 under the resolution BE IT RESOLVED AND ORDAINED, by the Town Board of the Town of Wappinger, Dutchess County, New York in pursuance of the Authority conferred by Article 16 of the Town Law of the State of New York and also in pursuance of Artile 9 of the Town Law to the extent applicalbe as follows: - "17 Riding Academies*, Stables*, Veterinarians Offices*, Animal Hospitals*, and dog kennels*, only when located on 10 or more acres of land. Motion was made by Councilman Robinson and seconded by Justice of the Peace Bulger that the minutes of the Public Hearing of May 27, 1965 be accepted as read with the above correction. Motion carried The minutes of the regular meeting of June 3, 1965 were held over to the next meeting , due to the fact that there was only two members of the -rite Board present who had been at a June meeting. She bills for the months of June 1965 were read as follows: -General Fund $6,224.07 --Highway Fund -$20,719.35. Motion was made by Justice of the Peace Bulger and seconded by Councilman Diehl that the bills for the month of June be paid subject to audit. Motion carried The following reports were read: Building Permits issueed for: 29 Single Family Residences 8 Residence Additions 6 Swimming Pools 2 Other3 53 Total Permits Issued for June Value of Construction $1,379,240.00 Fees collected & turned over to Town Clerk 1,044.00 Miles Traveled on Zoning & Building Inspection by guilding Inspector Miles Traveled on Building Inspection by Deputy Buidlding Inspector 279 307 Outing the Month of June, Certificates of Occupancy were issued for 19 Single Family Dwellings and 56 Aparment Units. Joseph E. Ludewig, Bld. Insp. During the month of June 1965, the activities listed below were handledin Justice Court: (1) 52 motor vehicle caseshandled showing $900.00 collected in fines. (2) 8 civil cases handled showing $18.00 collected in fees and filing costs. (3) 4 criminal cases were handled during the moftyh. Issued 1 warrant for arrest. A total of $918.00 was forwarded to the State Department of Audit and Control. At the close of the month, I was holding $50.00 in two pending motor vehicle cases. VincentiSi Francese J. of P. The following is a report of activities handled by me during the month of June, 1965. A letter was read from Duchess County Board of Supervisors suggesting that a copy of each Town seal be placed on the Walls of the Supervisors room in the new Building of the Court House . Motion was made by Councilman Diehl and seconded by Justice of the Peace Bulger that our seal be placed on the walls of the Supervisors office. Motion carried A memo was submitted from the Planning Board recommending changes in names of roads in the Town of Wappinger. Motion was made by Justice of the Peace Bulger and seconded by Councilman Dlr e4h1 that an Informal Public Hearing be held on the changes of name of Streets and 254 roads on July 29th, 1965 at 7:30 P. M. in the Town Hall, Mill Street, Wappingers Falls, N. Y. Motion carried The following resolution was made by Councilman Diehl - WHEREAS, hi JiatI�nas be teeived by Ihn Board from Mid - Point Park, Inc. requesting that the proposed streets and partially completed proposed streets known as Joel Place, Sabra Lane, Martin Drive, Maurice Drive, Doret Drive, Gabriela Road, and located in a residential real estate subdivision in the Town of Wappinger, Dutchess County, New York, known as "Mid -Point Park, Inc." be accepted as and for public streets in the Town of Wappinger, and WHEREAS, the said Mid -Point Park, Inc., has tendered to this Board a deed conveying and dedicating said proposed street to the Town of Wappinger as and for public streets, it is. hereby RESOLVED, that this Board does hereby accept the proposed streets known as Joel Place, Sabra Lane, Martin Drive, Maurice Drive, Dorett Drive, Gabriela Road, and the deed dedicating the same, and it is further RESOLVED, that the said streets shall hereafter be public streets in the Town of Wappinger, knowilas Joel Place, Sabra Lane, Martin Drive, Maurice Drive, Dorett Drive, Gabriela Road subject to the following conditions FIRST: That Mid Point Park, Inc., furnish to the Town Board of the Town of Wappinger a performance bond in the amount of $117,000.00 approved by the said Town Board, and by the Town Attorney and by the Superintendent of Highways of the Town of Wappinger as to amount, form, sufficiency of surety and manner of execution, insuring satisfactory completion of the aforesaid streets in said subdivision in accordance with the current minimum standard requirements for establishing roads in the said Town of Wappinger and in accordance with current spedifications provided by the Superintendent of High- ways of the Town of Wappinger and further insuring installation and completion of the storm water drainange system for said subdivision, the plan for which has been heretofore approved by the Town Superintendent of Highways and the Town Engineer, said work, and improvements being subject to the final approval of the Town Superintendent of Highways and the Town Engineer of the Town of Wappinger, and further insuring compliance with the conditions set forth in the resolution of the Planning Board of the Town of Wappinger dated May 17, 1965. SECOND: That the Town of Wappinger assumes no responsibility for maintenance and repair, including the removal of snow, of and from said streets until the performance of the conditions mentioned in the aforementioned bond has been completed. THIN That a full covenant and warranty deed of dedication and the grant of storm sewer drainange easements be delivered to the Town of Wappinger and to the approval by the Town Attorney as to the adequacy, substance and form 255 of such instruments and that such instruments are aceepted subject to an examination of title to the premises or rights conveyed thereby by the Town Attorney. FOURTH That an attorney's certificate of title insuring title e in said road shall be delivered and accepted by the Town Board. Seconded by: -Jus tice of the Peace Francese. The following vote was taken:- Justice of the Peace-Francese--Aye, Councilman Robinson --Aye, Councilman Diehl --Aye, Justice of the Peace -William Bulger - Aye. Motion carrifd The following resolution was made by Councilman Diehl :- WHEREAS, an application has been received by this Board from the Bell - Air Construction Company, Inc. requesting that the proposed streets and par- tially completed proposed streets known as Bell -Air Lane and Orange Court, and located in a residential real estate dubidvision in the Town of Wappinger, Dutchesss County, New York, known as, "Map of Spook Hollow" be accepted as and for public streets in the Town of Wappingeh+as and for public streets, it is hereby RESOLVED, that this Board does hereby accept the proposed streets known as Bell -Air Lane and Orange Court, subject to the following conditions: FIRST: That Bell -Air Construction Company, Inc. furnish to the Town Board of the Town of Wappinger a performance bond in the smountof $21,000.00 approved by the said Town Board, and by the Town Attorney and by the Superintendent of Highways of the Town of Wappinger as to amount, form sufficiency of surety and manner of execution, insuring satisfactory completion of the aforesaid streets in said subdivision in accordance with the current minimum standard requirements for establishing roads in the said Town of Wappinger and in accordance with current specifications provided by t§e Superintendent of Highways of the Town of Wappinger and further insuring installation and com- pletion of the storm water drainange system for said subdivision, the plan for which has been heretofore approved by the Town Superintendent of Highways and the Town Engineer, said work and improvements being suject to the final ap- proval of the Town Superintendent of Highways and the Town Engineer of the Town of Wappinger, and further insuring compliance with the conditions set forth in the resolution of the Planning Board of the Town of Wappinger app- roving the said map. Seconded by --Justice of the Peace --Bulger The following vote was taken -Justice of the Peace-Francese--Aye, Councilman Robinson --Aye, Councilman Diehl --Aye, Justice of the Peace Bulger --Aye Motion carried The following resolution was made by Justice of the Peggie Bulger and seconded by Councilman Diehl: - WHEREAS the Constitution and statutes of the State of New York authorize and encourage governing bodies of counties, cities, towns and villages to cooperate for purposes of pursuing common objectives and solving mutual problems in the interest of their general welfare and WHEREAS the town of Beekman, East Fishkill, Fishkill, La Grange and Wappinger and the village of Fishkill share a community of interests in the health, safety and welfare of the people residing in the geo- graphical area which they comprise and WHEREAS the said towns and villages are desirous of promoting the efficient and economical provision4 of local government services within their respective jurisdictions and WHEREAS Article 12-C of the General Municipal Law of the State of New York specifically authorizes cooperation among municipal corporations and the creaglon by agreement of joint municipal survey committees to make surveys and studies NOW THEREFORE BE IT RESOLVED that under the authority of Aricle 12-C of the General Municipal Law the Town of Beekman, East Fishkill, Fishkill, La Grange and Wappinger and the village of Fishkill do hereby agree to create a joint municipal survey committee to be knfeyf as the Fishkill Drainange Basin Joint Municipal Survey Committee and be it further RESOLVED that membership of said committee shall comprise Six (6) members, one each, to be appointed by each town board of the towns of Beekman, East Fishkill, Fishkill, La Grange and Wappinger and one to be appointed by the board of trustees of the village of Fishkill, and be it further RESOLVED that the members of said committee shall serve without 257 compebsation and that their terms shall be concurrent with the duration of this agreement or for such other terms as the participating towns and village shall separately determine in the case of their respective members, and that any vacancies in the membership of said committee arising from any cause, shall be filled in the manner of original appointment, and be it further RESOLVED that the said committee shall survey in general and conduct studies for the furtherance of the common purpose of the participating towns and village. The authority of the committee to act in the name of the participating municipalities shall be for a Comprehensive Sewage Works Studies pursuant to Sec. 1263-a of the Public Health Law. RESOLVED that the committee shall organize, upon the appointment of all of its members, the election of a chairman from its own membership, shall meet at its discrition at such times and places as the members shall agree to and shall report to the respective governing boards of the participation municipal governments, regularly or periodica at the discrationo6litts membersin a manner consistent with the objectives an purposes stated herein and be it further RESOLVED that this agreement shall extend for a period of Two(2) years from the final date of approval by the participating towns and village and shall be sysect to such renewal, modifications or ex,nsions, upon which the governing board of the respective participants shall, by resolution, mutually agree. This resolution shall take effect, and the governing boards of the participating municipal governments shall proceed with the selection of members of the joint municipal survey committee herein proposed, upon due and valid adoption of this resolution by all named participants. The voe on said Resolution is as follows: Councilman George Robinson ---Aye , Louis Diehl Aye Justice of the Peace William Bulger Aye Justice of the Peace Vincent Francese Aye 258 Motion was made by Councilman Diehl and seconded by Justice of the Peace Francese that Justice of the Peace Bulger be appointed on the Fishkill Drain- age Basin Joint Municipal Survey Committee to respresent the Town of Wappinger. Motion carried A resolution was presented from Gallo Bros. Holding Corporation asking for acceptance of streets in Fleetwood Manor. Motion was made by Justice of the Peace Francese and seconded by Councilman Diehl that this resolution be tabled for a later date. Motion carried Motion wes made by Councilman Diehl and seconded by Justice of the Peace Bulger that Attorney Rielly be instructed to call in the Bond on Fleetwood Manor. The following vote was taken -Councilman Robinson --Aye, Councilman Diehl --Aye, Justice of the Peace--Bulger--Aye, Justice of the Peace-- Francese--Aye. Motion was made by Justice of the Peace Francese and seconded by Justice of the Peace Bulger that authority be given Engineer Kelly to employ Richard Barger to prepare plans and specifications for construction of Storm Sewer in Edgehill subdivision and to receive bids for said work on Tuesday, July 27th, at 10:00 A. M. Motion carried A letter was read from Barbara Bain Neighborhood Chairman of the Girl Scouts thanking the Board for the use of the room for registration. Attorney Rielly reported that the roads in Oakwood Knolls have not been completed and that he had called the bond on same. Engineer Kelly reported that he had checked figures on Ditch at Wildwood. To close the ditch it would cost $47,000.00. To install 6 foot §ence it would cost $8,000.00, 3 1/2 foot fence would cost $5,400.00. He also reported that during the storm the ditch overflowed, but the contractor claimed this was due to straw and debris from repairs clogging the ditch. Tax collector Helen L. Travis, reported on tax collection as follows: Total taxes collected and turned in $591,729.62 Unpaid taxes 46,509,70 These books were turned in to Dutchess County Treasurer on June 10th, 1965 and were reported 0. K. on same day. Motion was made by Councilman Diehl and seconded by Justice of the Peace Bulger that it be recommedned to Planning Board that they hold up accept- ance of Wildwood Secti9n 2 until we find out just what is what about drainage into Section 8 1. Motion carried Engineer Keljy stated that his estimate for work on the ditch at Oakwood would be $10,400.00. Engineer Kelly stated that he would like permission to call a Public meeting 259 of the contractors and property owner review new road specifications. Motion was made by Justice of Peace Bulger and seconded by Justice of Peace Francese that Engineer Kelly be given the authority to call a meeting of Developers and Engineers working in the Town to goover new road specifications. Motion -carried Motion was made by Justice of Peace Bulger and seconded by Councilman Diehl that Engineer Kelly be authorized to call a meeting of leaders of the Civic Groups of the Town, following the meeting at the Junior High School on August 6, 1965. Engineer Kelly to set the date of the meeting. Motion carried Louis Eck presented roads for acceptance by Town. The Board asked Mr. Worona and Mr. Eck to meet with the Board and talk over same. The Board ordered this tabled until the next meeting. Motion was made by Councilman Diehl and seconded by Justice of the Peace Bulger that all new roads presented for acceptance must be accompanied by a written certificate of adequacy signed by the Highway Superintendent and Town Engineer stating a professional enfibeering evaluation has been made by "Test borings" or "Test Samplings" and by such these roads meet all spec- ifications to the best of their knowledge. These tests can be made by Vincent Kelly. The report shall become a part of the minutes at which time the roads are accepted. The following vote was taken, Councilman Robinson --Aye, Council- man Dieh--Aye, Justice of the Peace--Bulger--Aye, Justice of the Peace-Francese-- Aye. Motion carried. Councilman Diehl brought up the question of Discontinuous of waivers on Curbs & Gutters. Mr. Vandewininkel, Chairman of the Planning Board stated that they were testing this out on one of the developements to see hoe it would work. A petition was received from residents of All Angels Hill Road asking that the speed limit be reduced from 50 M. P. H. to 35 M. P. H. Motion ries made by Councilman Diehl and seconded by Justice of Peace that the Town clerk send necessary pppers to County Superintendent of Highways for his signature and then on to the Traffic Commission. Motion carried Motion was made by Councilman Diehl and seconded b0 Justice of Peace Francese that the Town Clerk write the Sheriffs Office and the Fishkill State Police Barracks asking then to check the speeding and reckless driving on All Angels Hill Road. Motion carried Motion was made by Councilman Diehl and seconded by Justice of Peace Francese that Attorney Rielly write a strong letter to the Dutchess County Board of Health requesting that the matter of Oakwood Sewer District be cleaned up immediately. A copy of this letter to be sent to Mr. John Haberer, Assistant Director of Public Health, Albany, N. Y. Motion carried 260 Joseph E. Ludewig, Building Inspector presented the name ofMiss Susan Pike, for secretary of his office at a salar4 of $3400. per year. Motion was made by Justice of Peace Bulger and seconded by Justice of Peace Francese that Miss Susan eike be appointed Secre6ary to the Building Inspector at a salary of $3400.00 per year. Town Clerk to send in order to Company, Letter was read from Michael E. Bash asking for releasing of maintenance Bond. This was ordered held over until we could check up *bat wai overed uncier this bond. Don Margolos, spoke from Wildwood Ass. He spoke about ditch saying it was a Health Hazard and dangerous for children. He also stated the ditch was overflowingi Mr. Rochelson spoke about the ditch at Wildwood. Luke Reed asked if ditch met specifications. Mr. Bing spoke about drainage prblem of roads. Engineer Kelly stated that he was checking the drainage problem. Mr. Fannelli reported he lived on corner of Wildwood Drive and Dana Place and that water overflowed into his place. Mr. Rifkin spoke about ditch. The Town Clerk was instructed to write a letter to the Recreation Com mission asking them to consider a Fourth of July Celebration next year in the Town. The Town Clerk was instructed to write a letter to Dutchess County asking them to clean up the dumping eefuse at the Airport property. Motion was made by Justice of the Peace Bulger and seconded by Councilman Diehl that the meeting adjourn.
