1965-06-03 RGM246 The regular monthly meeting of the Town Board, Town of Wappinger was held on Thursday evening, June 3, 1965, in the Town Hall, Mill Street, Wappingers Falls, N.Y. Present: Supervisor, Richard H. Linge; Councilman. George Robinson; Justice of the Peace, Vincent Francese; Attorney for the Town, Harold H. Reilly; Engineer for the Town, Vincent Kelley; Superintendent of Highway, Robert Lawson; Building Inspector, Joseph E. Ludewig; Town Clerk, Helen L. Travis. The meeting was opened at 8 P.M. by Supervisor Richard H. Linge. Supervisor Linge reported that Justice of the Peace Bulger was out of Town, and that Councilman Diehl was ill. Supervisor Linge aditrised the; Board that they had received copies of the minutes of the Public Hearing of April 29, 1965, Special Meeting of April 29, 1965, Public Hearing of April 29, 1965, and Regular meeting of May 6, 1965. What was their pleasure on same. Motion was made by Councilman Robinson, and seconded by Justice of the Peace Francese, that the Minutes be accepted as read. The following bills were presented: Highway $5,447.41 General Fund $6,295.51 Motion Carried Motion was made by Councilman Robinson, seconded by Justice of the Peace Francese that the above bills be paid, subject to audit. Motion Carried The following reports were presented: During the month of May, 1965, while presiding in Justice Court, Town of Wappinger I heard the following cases and collected the fees and fines listed below: Type Number Fines & fees collected Motor Vehicle 28 $243.00 Civil 10 25.00 Criminal 2 I am holding $260.00 in bail on pending motor vehicle cases which were not disposed of during the month. Bulger During the month of May, 1965, the activities listed below were handled in Justice Court: (1) 31 motor vehicle cases handled showing $465.00 collected in fines. (2) 18 civil cases handled showing $43.50 collected in fees and filing costs. L 247 (3) One criminal case was handled during the month. A total of %508.50 was forwarded to the State Department of Audit and Control. At the close of the month, I was holding $120.00 in pending motor vehicle cases. Respectfully submitted, Vincent S. Ludewig A letter was received from Carl Silber in reference to Rockingham Farms, Inc. Mr. Silber appeared personally, and presented Deed to roads. The following Resolution was proposed by Justice of the Peace Francese: WHEREAS, an application has been received by this Board from Rockingham Farms, Inc. requesting that the proposed streets and partially constructed proposed streets know as Scenery Hill Drive, Crestwood Road, Douglas Drive, Delmar Drive, Green Acres Road, Corn Belt Road, Lake Shore Drive, Cloverdale Road, Bellview Drive, and located in a residential real estate subdivision, in the Town of Wappinger, Dutchess County, New York, known as "Rockingham Farms, Inc." be accepted as and for public streets in the Town of Wappinger, and WHEREAS, Rockingham Farms, Inc. has tendered to this Board a deed conveying and dedicating said proposed streets to the Town of Wappinger as and for public streets, it is hereby RESOLVED, that this Board does hereby accept the proposed streets know as Scenery Hill Drive, Crestwood Road, Douglas Drive, Delmar Drive, Green Acres Road, Corn Belt Road, Lake Shore Dagve, Cloverdale Road, Bellview Drive and the deed dedicating the same, and it is further RESOLVED, that the said streets shall hereafter be public streets in the Town of Wappinger known as Scenery Hill Drive, Crestwood Road, Douglas Drive, Delmar Drive, Green Acres Road, Corn Belt Road, Lake Shore Drive, Cloverdale Road, Bellview Drive, subject to the following conditions: FIRST: That Rockingham Farms, Inc. furnish to the Town Board of the Town of Wappinger a performance bond in the amount of $262,000.00 approved by the said Town Board, and by the Town Attorney and by the Superintendent of Highways of the Town of Wappinger as to amount, for, sufficiency of surety and manner of execution, 248 insuring satisfactory completion of the aforesaid streets in said subdivision in accordance with the current minimum standard requirements for establishing roads in the said Town of Wappinger and in accordance with current specifications provided by the Superintendent of Highways of the Town of Wappinger and further insuring installation and completion of the storm water drainage system for said subdivision, the plan for which has been heretofore approved by the Town Super- intendent of Highways and the Town Engineer, said work, and improvements being subject to the final approval of the Town Superintendent of Highways and the Town Engineer of the Town of Wappinger, and further insuring compliance with the conditons set forth in the resolution of the Planning Board of the Town of Wappinger dated dated May 20, 1965 SECOND: .That the Town of Wappinger assumes no responsibility for maintenance and repair,including the removal of snow, of and from said streets until the performance of the conditions mentioned in the aforementioned bond has been com- pleted. THIRD: That a full covenant and warranty deed of dedication and the grant of storm sewer drainage easements be delivered to the Town of Wappinger and to the approval by the Town Attorney as to the adequacy, substance and form of such instruments are accepted subject to an examination of title to the premises or rights conveyed thereby by the Town Attorney. FOURTH: That an attorney's certificate of title insuring title in said road shall be delivered and accepted by the Town Board. FIFTH: That siad road or roads shall be completed in accordance with applicable Town specifications within two years from the date of the adoption of this resolutiory but not sooner than eighteen months from said date, unless the Town Board shall consent to such sooner completion based on a finding that the area served by said road or roads has been substantially developed. Seconded by Councilman Robinson. The following vote was taken: Supervisor Linge, Aye. Councilman Robinson, Aye. Justice of the Peace Francese, Aye. Resolution Carried A letter was read from Verner Christensen and Bertha Recchia, asking for per- mission to attend the Advanced Course in Appraising for Tax Assessors, at Cornell University, from July 19 to July 24, 1965. Motion was made by Justice of the Peace Francese, and seconded by Councilman • Robinson, that permission be granted to all members of the Board of Assesssors desiring to attend the Seminar be able to do so. Motion Carried 249 A letter was read from the New York State Traffic Commission, in reference to Speed Limit on Losee Road, stating they would make a thorough check of this. A letter was read from Murray Edelstein, submitting his resignation from the Recreation Commission, effective May 29, 1965. Motion was made by Justice of the Peace Francese, and seconded by Councilman Robinson, that the Town Clerk write a letter to Mr. Edelstein, expressing our regrets for his resignation. Motion Carried A letter was read from the Rdcreation Commission, regarding the following appoint- ment for the 8 week Summer Playground Program: Mrs. John Biasotti Director $650.00 For Season Mr. Paul Stitch Assistant Director $550.00 For Season Miss Dauna J. Gunn Councilor in training...$200.00 For Season Miss Karen Savory Councilor in training $200.00 For Season Motion was made by Councilman Robinson, seconded by Justice of the Peace Francese that the above appointments be made. Motion Carried A letter was read from the Planning Board in reference to Accepting Dugan Lane as a Town Road. The Board discussed this and Attorney Relley stated they are proposing a Quit Claim Deed for the property and then he will propose a Resolution to be brought before the Board. A letter was read from James Coppola, in reference to re -zoning of land. Attorney Reilley stated he had written this man before, and that he would write him again. A letter was read from Luke Reed, President of the Democratic Club, in reference to Widmer Bridge. Engineer Kelley presented the matter of Green Tree Apartments, connecting sewer with L & A Sewerage System. The following Resolution was proposed by Justice of the Peace Francese: WHEREAS, on the 8th day of November, 1962 the Town Board of the Town of Wappinger gave its approval to the formation of a sewerage disposal corporation to be formed in the Town of Wappinger under the name of the L & A Sewerage Disposal Corporation, and WHEREAS, the area to be serviced by this corporation was to be bounded on the North by the NewHackensack Road, on the East by All Angels Road, on the South by Myers Corners Road and on the West by U.S. Route 9, and WHEREAS, the said corporation was formed and has been servicing the area herein described, and WHEREAS, it has come to the attention of the Town Board by a letter from the Dutchess County Department of Health, addressed to the Town Engineer, that the sewerage disposal facilities of the Greentree Apartments are not functioning properly and as a result a public health nuisance has been created, and WHEREAS, it is the recommendation of the Department of Health that this nuisance be eliminated by the connection of the sewer facilities with the L & A Sewerage Disposal Corporation, and WHEREAS, the Greentree Apartments lie outside of the area of which the Town Board has previously consented to the operation of the L & A Sewerage Disposal Corp- oration, at' is hereby RESOLVE), that this Board does hereby consent to the connection of the Greentree Apartments sewer facilities with that of L & A Sewerage Disposal Corporation, subject to the right of the said apartments to connect to a sewerage district in the event that one should be formed in the area in which the Greentree Apartments are now located. Seconded by Councilman Robinson. The following vote was taken: Supervisor Linge, Aye. Councilman Robinson, Aye. Justice of the Peace Francese, Aye. Resolution Carried Engineer Kelley presented the matter of Calling the Bond on the Oakwood Knolls property. It was stated that a lien for $11,852.00 from the K & A Excavating Contractors, Inc., had been placed on the road on Wednesday afternoon. The Board ordered a letter written to the owners of Fleetwood Development, stating that if roads were not completed to specifications before July 1, 1965, that they would call the Bond. Attorney Reilley to write the letter. Engineer Kelley received a letter from the Local Health. Department, stating that application for Sewerage Survey would not be accepted. There is to be a meeting at Dutchess Community College on Friday evening at 7:30 P.M. Mr. Kelley will attend, and asked any others on the Board interested to attend. The new road specifications were presented, which implement the Town Road Spec- ifications of March 1965. Motion was made by Councilman Robinson, and seconded by Justice of the Peace Francese, that the new road specifications be accepted. Motion Carried Attorney Relley reported that he had talked with Mr. Alexander, in reference to roads in Wildwood, and he assured him they were going to start work on Monday, and be finished by July 4, 1965. A letter was read from Joseph E. Landolfi, Or., Chairmen of the Wildwood Forest L Civic Association, enclosing letter they had written to Mr. Lafko, in reference to roads in Wildwood Drive, Mr. Landolfi spoke, stating Mr. Contelleno had some facts on the matter. Walter Boileau spoke, stating children had drunk water from the ditch, and been taken ill. Wanted to know if they would not consider filling in the ditch, be- cause it was a Health Hazzard. Mr. O'Neill, of Marshall and Sterling Office spoke. Spoke on Resolution and about road Bond. Stating they have until December,to finish, but that they had promised to start work on Monday and be finished by July 4, 1965. Mr. Contelleno stated they were not asking for completion right away, but were asking for maintenance of roads. Mrs 413erle spoke, stating that it was very dangerous for the children of Oakwood Knolls and Wildwood for children playing in the ditches. She asked if these could not be closed up. Supervisor Linge reguested the ditch hazzard be looked into. He stated that if this is done, it will be a Town expense. The following Resolution was made by Councilman Robinson, and seconded by Justice of the Peace Francese: WHEREAS, Bridge No. WP -10 on Widmer Road in the Town of Wappinger is narrow, and WHEREAS, the Town Superintendent of Highways of the Town of Wappinger has requested the County Superintendent of Highways to do_the.neceSsary work of widening, now Therefore be it RESOLVED, that the County Superintendent of Highways be authorized to proceed with the widening of said bridge in accordance with Article 9, Section 233 of the Highway Law and bill the Town of Wappinger for the necessary labor and equipment to do the same, the amount not to exceed twelve hundred dollars ($1200.00). The following vote was taken: Supervisor Richard H. Linge, Aye. Councilman George Robinson, Aye. Justice of the Peace Vincent S. Francese, Aye. Motion Carried Justice of the Peace Francese reported that the re -districting of Election Districts was about 70% completed.
