1964-10-22 PHIII 111111 1111 125 A special meeting of the Town Board, Town of Wappinger, was held on Thursday evening, October 22,-1964, in the Town Hall, Mill Street, Wappingers Falls, N. Y. Present:- Supervisor -Richard H. Linge, Councilmen -Wilmer Ifill and George Robinson, Justices of the Peace -William Bulger and Vincent Francese, Superintendent of Highways -Robert Lawson, Town Attorney -Judson Williams, Town Clerk -Helen L. Travis Meeting was called to order at 8 P. M. by Supervisor Richard H. Linge. Attorney Eugene Nicolati submitted the following petition from residents of Fleetwood Manor District asking for a Public Hearing on the PieelaineftWateofDasWatet.District, in the said Town of Wappinger, to be bounded and described as follows: All that certain lot, piece or parcel of land situate in the Town of Wappbnger, County of Dutchess, State of New York, and more accurately bounded and described as follows: BEGINNING at a point in the northwesterly line of Osborne Road, said point being the most eatterly corner of lot now or formerly of Du Bois, said point being the intersection of the northwesterly line of Osborne Hill Road with the southwesterly 1 line of Fleetwood Drive now being constructed in Fleetwood Manor subdivision; thence along the southwesterly line of Fleetwood Drive along lands now or formerly of Du Bois and now or formerly Iry of Kretch on the next the courses Nor 42o 02 10*4"West 180.00' to a point, North 43°49' 10" West 239.31' to a point and North 48042! WHEREAS, the improvements proposed consist of the construction and maintenance of a water system, to serve the said district, including distributing mains from the Water Company's pumphouse to the perimeter of the proposed public water district* and throughout the entire water district, and also includes house meters for 62 dwellings, 28 apartment units and proposed 66 additional dwellings, service mains from the street distributing mains to the curb lihes, including curb cocks, with all necessary easements and appurtenances pertaining thereto, including a key 12 to the pumphouse, and also a master meter and fire hydrants, in accordance with certain plans made a part of such petition and now on file in the office of the Town Clerk of the Town of Wappinger, and WHEREAS, the maximim amount proposed to be expended for the improvement as stated in said petition is the sum of $93,000.00 which maximum amount includes the water system, water mains, distributing pipe, master meter, house meters and hydrants to be installed; it is hereby ORDERED, that a meeting of the Town Board of the said Town of Wappinger shall be held at the Town Office, Mill Street, Wappingers FP11s, New York, on the 19th Day of November, 1964 at 7:30 o'clock P. M. on that day to consder the said petition and to hear all persons interested in the subject thereof, concerning the same and for such other action on the part of said Town Board with relation to the said petition as may be required by law or proper in the premises. WHEREAS, the improvements proposed consist of the erection, construction and maintenance of a sewerage system to serve the said district, including main and lateral sewers, pumping stations and appurtenances thereto, and also including the acquisition of rights of way therfor, in accordance with certain plans made a part of such petition and now on file in the ofIlce of the Town Clerk of the Town of Wappinger, and WHEREAS, the maximim amount proposed to be expended the improvement as stated in said petition is the sumof $123,000.00, it is hereby ORDERED, that a meeting of the Town Board of the said Townnof Wappinger shall be held at the Town Office, Mill Street, Wappingers Falls, New York, on the 19th day of November 1964, at 7:30 o'clock P. M. on that day to consider the said petition and to hear all ppesons interested in the subject thereof, concerning the same and for such other action on the part of said Town Board with relation to said petition as may bereequired by law or ' proper in the prmises. Motion was made by Councilman Ifill and seconded by Justice of the Peace Bulger that the above Petition be accepted. The Board voted as follows: Supervisor -Richard H. Linge--Aye Councilman --George Robinson --Aye Councilman --Wilmer Ifill--Aye Justice of the Peace --William Bulger Justice of the Peace --Vincent Francese--Aye Motion was made by Councilman Robinson and seconded by Justice of the Peace Bul er that Attorney Eugene Nicolato be appointed Attorney to handle the Fleetwood Sewer and Fleetwood Water District. Motion carried. Supervisor Tinge declared the meeting adjourned at 8:10 P. M. Signed Town Clerk 1.33 A public Hearing on the proposed reaening of Wheeler Hill Road was held by the Town Board, Town of Wappinger, in the Town Hall Mill Street, Wappingers Falls, on Thursday evening October 22, 1964. Present -Supervisor -Richard H. Linge, Councilmen -Wilmer Ifill and George Robinson, Justices of the Peace -William J. Bulger and Vincent Francese, Town Highway Superintendent -Robert Lawson, Town Attorney -Judson Wiliams, Building Inspector Joseph E. Ludwig, Chairman of Planning Board -A. W. Vamder- winckel, Town Clerk, Helen L. Traivs, Dept. Town Clerk Agnes Grosenbeck. Supervisor Richard H. Linge opened the Hearing at 8:15 P. M. The Notice of the Hearing was read by Town Clerk, Helen L. Travis and also showed prof that same had been published in paper and posted on Bulletin Board. Attorney Williams then outlined the District to be covered. Town Clerk, Helen L. Travis then read a letter from the Wappingers Falls Chamber of Commerce protesting the treatment given Angelo Williams the developer invudted in Tall Trees. A letter was read from Good Council Novitiate and from Mr. & Mrs. Willis Resse asking that this re -zoning be granted. Attorney Williams advised the Board that it would take a 2/3 matority of the Board to pass the re -zoning. Supervisor Linge then asked that all those who were in favor of the re -zoning apeak at this time. Attorney Rusell Aldrich stated he was in favor of the application of Dddrhil Estates for re -zoning the entire area. He stated that the Hisbb±±c low deasity of the neighborhood shoudd be preserved. John Burdis=- who drew up the Zoning Ordinance for the Village of Wappingers Falls spoke in favor of re -zoning this area. Armand Fuimarelli & James Forrester --Showed a map showing the boundar*es of the zoning area proposed. Mr. Forrester discussed the width of Wheeler pill Road. John Herring -- Asked how this would effect a person with less 134 than one acre. CHARLES CRAWFORD--Old State Rbad.--stated that the proposed zoning would cut his property in half, this making his property unsaleable. BEN SCHOFIELD, Old Troy Road --Stated that Chrinian property is not under this area. STEVE PUZIO --Asked if this cut through any property on Route 9D WILLIAM HEANEY--stated that most every areain the Town of Wappinger could be classed as an Historicl low density area. ROBERT STRANG --Showed slides of the Wheeler Hill Area. ROSE MARIE HOLLENBECK--Stated she had a low priced house but she was still in favor of the re -zoning of the area. MR. FRAZIER --Garrison, N. Y. --spoke for Mr. Cormier of the Hudson River Conserviation Society- He spoke on the Historical value of the situation. LOUIS CLAUSEN--Spoke stating the time was getting late and thought the other side should have a chance to speak. DENNIS HANNON Spoke in favor of ze-zoning. WILLIAM PEARSE Atty. Representing Rivercrest, Inc.,--apoke re- garding same. Filed statment of Ownership. JOSEPH MILANO --spoke about the program for the aged staing he had $50,000.00 invested in same. MR. CRAWFORD spoke staing he didn't think they had to cut his property in two. MR PUZIO spoke about density of property. Supervisor Linge then called for those who were against the re- zoning to speak at this time. ATTORNEY WORONA --spoke stating he represented Brookhollow, Inc and Angelo Williams & Lilyan Berger. He spoke against the adoption of the re -zoning. He spoke about the adoption of the Zoning Ordinance. and about the consultants map, and read excerpts from the Zoning Ordinance. LILYAN BERGER-spoke stating that whatever had been done had been done legally, she listed the various non-residential and no conforming uses on properties surrounding her. 135 MR. KANTER -spoke about ordinance ATTY WORONA--spoke about Bond BENNIS HANNON --Asked Mr. Berger if her property had not been put up for sale. HERMAN OSTEN Stated he thought change of zoning would be most un- fair. A motion was made by Councilman Ifill and seconded by Justice of the Peace Bulger that the Board adjourn fro 30 minutes and try to reach a decision in the matter. Mttion carried The meeting adjourned at 11 P. M. The Town Board returned at 11:30 P. M. and the meeting was re- opened. A motion was made by Councilman lIffill and seconded baa Justice of the Peace Bulger that the 1st proposal in the publication, excluding Tall Trees be rejected.
