1964-10-08 RGM111 The regular Town Board meeting of the Town of Wappinger was held on Thursday evening, October 8, 1964 at the Town Hall, Mill Street, Wappingers Falls, N. Y. Present:=Supervisor-Richard H. Linge, Councilmen -Wilmer M. Ifill and George S. Robinson, Justices of the Peace, William J. Bulger and Vincnet S. Francese, Town Attorney -Judson Williams, Town Superin- tendent of Highways -Robert Lawson, Building Inspector -Joseph Lude- wig, Town Clerk -Helen L. Travis. The meeting was opened at 8 P. M. by Supervisor Richard H. Linge. Supervisor Linge advised the Board that they had received copies of the minttees of the last meeting and what was their pleasure on same. Motion was made by Councilman Robinson and seconded by Councilman Ifill that the minutes be accepted as written. Motion carried Supervisor Linge advised the Board that they had received copies of the Warrant Sheets of the bills for the month of September, what was their pleasure on same. General Fund --$896.60 Highway Department --$4,148.23 Motion was made by Justice of the Peace Francese and seconded by Councilman Robinson that the bills be paid. Motion carried The Town Clerk reported she kkaereceived reports from Building Inspector Joseph E. Ludewig and Bustices of the Peace, Francese and Bulger. Building Inspector's Report for the month of September 1964 Building permits issued for: 27 Single Family Residence 7 Residence Additions 5 Residence Garages 1 20 Unit Apratment Building 1. Swimming Pool 41 Total permits for September 1964 Value of Construction $619,700.00 Fees collected and turned over to Town Clerk 578.00 Miles Traveld on Zoning and Building Inspection 351 Miles Joseph E. Ludewig, Building Inspector Following is a repoot of actions handled by me during the month of September, 1964 in my official capacity as Justice of the Peace: (1) 25 motor vehicle cases showing $355.00 collected in fines (2) 9 civil cases closed showing $19.00 collected in fees. 1 criminal case closed during the month with no monies collected. I have forwarded a total of $374.00 to the State Department of Audit and Control. I am holding $16.00 in my official bank account for civil cases which were not closed during the month. Vincent S. Francese, Justice of the Peace. During the month of September,1964, while presiding in Justice Court, Town of Wappinger, I heard the following cases and collected the fees and fines listed below: TYRE NUMBER FINES & FEES COLL. Motor vehicle 32 400.00 Civil 6 12.50 Criminal 3 I am holding $125.00 in my official bank account on pending motor vehicle cases and $125.00 on pending criminal actions. A letter was read from Dr. Harry L. Bisnoff, pertaining to re -coning of his property. Mr. Worona appeared asking if this could be held over to the next meeting as Mr. Bisnoff could not be present. The recom- mendation of the Planning Board was read. A letter was read from Aldrich & Aldrich enclosing a petition of Daniel & Helene Hannigan for zoning change. Motion was made by Justice of the Peace Frances and seconded by Councilman Ifill that the petition be handed to the Planning Board for their recommendation. Motion carried A letter was received from the Recration Commission recommending the name of Mr. Richard C. Garren as a member of the Commission to complete the unexpired term of Frederick Linehan. Motion was made by Councilman Robinson, seconded by Justice of the Peace Bulger, that Richard C. Garren by appointed a member of the Recration iia Co i.Ss on to complete the unexpired term of Frederick Linehan. Russell Aldrich, Atty. Knolls Sewe5age Hearing Motion carried, appeared before the Board asking that the Oakwood be postponed until the next meeting, November 12, 1964. He presented a letter from Ilten Chazi stating that approval had not been given by Board of Health, but stating it would be received 1 in 2 or 3 wweks. Motion was made by Councilman Robinsop,seconded by Justiceoof the Peace Francese that the Hearing on Oakwood Knolls Sewerage be postponed until November 12, 1964 meeting of the Town Board. Motion carried Town Clerk stated that the next Town meeting would be to close to election day to have warrant sheet made out and asked that meeting be postponed a week. Motion was made by Councilman Robinson and seconded by Justice of the Peace Bulger that the regular monthly meeting of the Town Board be held on November 12, 1964. Motion carried ,Motion was made byaCouncilman Ifill and seconded by Justice of Peace Bulger that the Town Clerk notif9 the Bonding Company, carring Osborn Hills, Inc., Bond covering Kretch Circle in Fleetwood Deveddpement that this road must be taken care of or that the Board will call upon the Company to do so. Motion carried Justice of the Peace Bulger stated that it had been brought to his attention that since the last survey, now three years old, certain areas have grown so large that the small business within them can no longer serve the public in an efficient manner. In accordance with good planning practices as set forth in our Town developement plan A these changes should be made in groups rather thin individually. RESOLVED that the Planning Board make a resurvey of non-sfonforming local business uses to permit legal operation and expansion in such areas where, groth of business demands increased facilities_ Motion carried 114' Justice of Peace Bulger presented a proposed Fire Ordinance for the Town of Wappinger. He turned this over to the Town Attorney asking if he would read same over and comment on same at the next meeting. Mr. William Egan spoke about the Land Fill project in Robinson Lane. He asked what the Land Fill Committee thought about the project in Robinson Lane and what the Town Board thought about same. Mr. Ifill said he personally had inspected the land and would defiinitely vote against same. The Board also stated they would definitely be against it. A bond was presented by Mr. Thomann asking for acceptance of roads in Edghill Manor. Motion was made by Councilman Ifill and seconded by Justice of the Peace Bulger that the acceptance of this bond for new roads be held over until the next meeting, giving the Board time to look into same. Attorney Worona asked the Board to accept the Bond at this time. Town Attorney Williams said that the bond guaranteed the conditions required by tlje planning board, and guaranteed the conditions under which the Town Board had accepted roads in the past. But he said the Town Board might want to adopt more conditions at this time, and if they accepted the bond they could not do this. Attortney Williams announced that at 10:30 the night before the Town Board meeting a restraining order from State Supreme Court Justice Leonard J. Supple had been served on him, Mr. Berger, Brookhollow Builders, their attorney and the entire Planning Board, restraining them against any action to secure the filing of the Tall Trees plot plan. Atty. Williams added that the rest4aining order did not ex- plicitly restrain the Town Board from approving the bond. Worona then presented the Board with a certified copy of an order from Justice Supple granted on October 8, 1964 at 4:30 vacating 115 L the restraining order. Atty. Worona asked that the Board act on the matter tonight. Atty. Williams stated that the Planning Board would have to be def- ended in these actions and suggested that Attorney Robert Winne be appointed to respresent the Board in the matter of Wheeler Hill re- zoning. Motion was made by Councilman Ifill and seconded by Councilman Robinson that Attorney Robert Winne be appointed to represent theiBoard in the action pea&awning to Wheeler Hill re -zoning. Motion carried • Attorney Russell Aldrich asked the Board to delay this action until after the Public Hearing. Councilman Ifill said that he had been ready to make a decision but that due to all the legal action he wanted time to study the situation further. Supervisor Linge stated -a decision would not be made until after the Public hearing. Town Clerk announced that the Public Hearing on the re -zoning of 110 Wheeler Hill would be held on Thursday, Oct. 22nd, 1964 at 8 P. M. in the Town Hall ;Mill St. Louis Eck presented a strip of road for acceptance. Supervisor Linge stated that this would be gone over and checked by the Town Engineer. Justice of the Peace Bulger suggested that the Town consult with the Town of Poughkeepsie about the possibility of a joint water district. Motion was made by Justice of Peace Bulger and seconded by Councilman Ifill that Supervisor Linge contact the Town of Poughkeepsie win ref- kw erence to the possibility of a jothnt water district. Motion carried. LGrover Roth -Spoke about conditions of roads. Arthur Bisom spoke about speeding on Myers Corners Road. Motion was made by Councilman Robinson and seconded by Justice of the Peace Bulger that the Town purchase a new voting machine from the Rockwell Mfg. Company. Motion carried Hugo Musto asked the Town to put pressure on the County to Cut off the turns on Myers Corners Road instead of just paving it It was suggested that the Town Clerk write again tb the County High- way Engineer about Myers Corners Road asking if they could give us a schedule of when they planned on doing this road. Supervisor Linge stated that due to a slight change to be made in the Budit that a Special meeting would be called on Friday evening, October 9th, 1964 at 6:30 P. M. for the purpose of accepting the Preliminary Budget. Motion was made by Councilman 11ill and seconded by Justice of the - Peace Bulger that the meeting adjourn.
