1964-07-06 RGMThe regular monthly meeting of the Town Board, Town of
Wappinger was held on Thursday evening, July 6, 1964
in the Town Hall, Mill Street, Wappingers Falls, N. Y.
Present: Supervisor -Richard H. Linge, Councilmen -George
Robinson and Wilmer Iffhll, Justices of the Peace, William
Bulger and. Vincent Francese, Town Attorney=Judson Williams,
Town Engineer -Robert Lawson, Building Inspec tor -Joseph
Ludewig, Town Clerk -Helen L. Travis
The meeting was opened at 8 P. M. by Supervisor, Richard
H. Linge.
Supervisor, Linge adivsed the Board that they had received
copies of the Minutes of theJune Meeting, what was their
pleasure an same.
Attorney Williams stated that under the Resolution for the
re -zoning of property on Route 376 the reasons for doing
same were' omitted.

Motion was made by Justice of thePeace Francese and seconded
by Justice of the Peace Bulger that the minutes of theJune
meeting be accepted as read with the above correction.
Motion carried
The Town Clerk reported that she had received the reports
for the month of June from the Building Inspector and from
the Justices of thePeace.
During the month of June, 1964, while presideing in Justice
Court, Town of Wappinger, I heard the following cases and
collected the fees and fines listed below:

I am holding $7.50 in my official bank account on panding
civil aases.
I am also holding $100.00 on a pending motor
vehicle violation which was not disposed of duicing the month

Following is a report of actions handled by me during the
month of June, 1964 in my official capacity as Justice of
the Peace:
(1) 20 motor vehicle cases showing $310.00 collected in
fines.
(2) B Civil cases closed showing $10.50 collected in fees.
(3) There were noLcriminal cases closed during the month.
I am holding $100.00 in bail on a pending criminal case.
I have forwarded a total of $320.50 to the State Department
of Audit & Control Respectfully submitted -Vincent S. Francese
We issued permits for:
25 Single Family residences
3 Residence additions
4 Residence Garages
2 Residence Porches
1 28 Unit Apartment Building
1 Public Swimming Pool
36 Total Permits
Value of permits issued was for $626,600.00
Fees collected and turned over to Town Clerk $541.00
Miles traveled in Zoning and Building Insepction 392 Miles
Joseph E. Ludewig, Bldg. Insp.
A letter was read from Aldrich & Aldrich for Phillip W. Jackson &
Jean S. Jackson asking to have the Town Board, amend, change
and modify the Zoning Ordinance of the Town of Wappinger, pres-
ently in effect, so as to lawfully permit riding academies &
stables in R-20 District under the same regulations & controls

as presently exist for riding academies and stables in R-40 Districts.
Motion was made by Justice of Peace Bulger and seconded by Justice
of Peace Francese that the letter be referred to the Planning Board
Motion carried
A letter was read from Edederick R. Linehan, addressed to the Reareah4on
Commission
Board, presenting his resignation from the Recreation Commission due to
his moving to Kingston, N. Y. Attorney Williams pointed out that all
resignations must be addressed to the Town Clerk. The Clerk was
ordered to return this letter asking him to rewrite same.
Supervisor Linge stated that there was a vacancy on the Planning
Board and that the name of Martin Leskow had been presented.
Motion wigs made by Justice of Peace Francese and seconded by Justice
of the Peace Bulger that Martin Leskow be appointed a member of the
Planning Board. Motion carried
Mr. Leskow will fill the vacancy made by the resignation of Thomas
Mc Cullough and his term will expire on January 1, 1967.
A letter was read from Barger & Russ giving quotations for Eval-
uation for Oakwood Knolls Sewer District and Fleetwood Manor Sewer
District. The Board held this open until Councilman Ifill arrived
as he was the one taking care of this matter.
Supervisor Linge said he had been requested to appoint a member of
the Board to act on the Board of Trustees of the Joint Garbage
Disposal District.
Motion was made by Councilman Robinson and seconded by Justice of
the Peace Bulger that ebgincilman Ifill be appointed to the Board
of Trustees of theJoint Garbage Disposal District. Motion carried
The matter of the Wheeler Hill re -zoning was brought up.
It was suggested that the Town Board appoint two members to meet
with the area residents and Planning Board and then come up with
a proposal.
Mr. Mac Donald, Attorney for the people of the area, said the people
would like a Public Hearing as soon as possible.

Attorney Williams said he had drawn up a proposed Amendment.
Motion was made by Councilman Robinson and seconded by Justice
of the Peace Bulger that an informal Hearing be held on Thursday
evening, July 16, 1964 at 8:30 P. M. in the Town Hall, for the
purpose of hearing the people on the Wheeler Hill re -zoning.
Motion carried.
Mpdaomotion by Justice of thePeace Francese and seconded by
Justice of the Peace Bulger a public hearing was ordered held
on August 13, 1964 at the Town Hall at 9 P. M. on the following
proposed amendment to Town bf Wappinger Zoning Ordinance.
BE IT RESOLVED AND ORDAINED by the Town Board of Town
of Wappinger, Dutchess County, New York, in pursuance of the
authority conferred by Article 16 of the Town Law of the State
of New York, and also in pursuance of Article 9 of the Town Law,
to the extent applicable as follows:
Section 1. The Town of Wappinger Zoning Ordinance,
adopted January 29, 1963, as amended, is hereby further amended
by rezoning the following tract of land from RD -20, Optional
Dwelling Residential, to LB, Local Business, said tract of
land being situate on the southerly side of New Hamburg-
Hopewa1l Junction Road (County Highway No. 28) being more
particularly described as follows:
BEGINNING At the point on the southerly side of
said highway marking the boundary between lands of Rende on

the east and lands of Irving on the west, said point being
also in the boundary line between R-20 and RD -20 zoned lands,
and running from thence southerly along said boundary line
a distance of 230 feet, thence westerly through lands of Irving
and parallel with said highway a distance of 250 feet, thence
northerly still throughlands of.Irving and parallel with said
boundary line 230 feet to the southerly side of said highway,
easterly
thence/along the southerly side of said highway 250 feet to the
place of beginning.

Section 2. The zoning map of Town of Wappinger adopted by
the Town Board January 29, 1963, and being a part of the aforesaid
Town of Wappinger Zoning Ordinance is hereby amended in conformity
with the foregoing.,
Section 3. This amendment shall become effective immediately
upon adoption, posting and publication as prescribed by Town Law.

Peace Bulger that the following be appointed Election Inspectors
for one year starting July 15, 1964.

Attorney Williams reported he had looked into the Ordinance for Open-
ing of Town Streets, and had drawn up one, but he did not think
it was complete and thought more work should be done on same. Just-
ice of the Peace Bulger suggested he contact the Association of
Towns asking them if they had any suggetsthions for same. Attorney
Williams stated he would do this.
A large delegation of members of the Cedar Hill -Pine Ridge Civic
Association, Inc., were present. Mr. Hugh Maurer acted as spokes-
man for the group and introduced Mr. Hugh Musto, who outlined the
two Sewer projects, stating that he understood Plan A. was to be
in their area and that this was the one that was being very
strongly considered. He also read and presented a letter to the
Town Board on same. He said the group wanted to go on record
as opposing this site, and also opposing any site that would be adjacent
to any well developed residential area. He also asked the Town
Board to state if they were all in agreement with them on this
matter. The Board stated that they all were in absolute agree-
ment with them.
Supervisor Linge then asked the group if the committee needed
help in finding a site if some members of the group would work dzith
them. Mr. Maurer stated that they would furnish 4 or 5 people to
work with the group at any time.
Mr. Mitchell Kt4rol spoke about dumps and explained about different
places he had seen that were handled this same way.
The Town Board wished to 4o on record as not in favor of these
sites or any site that would be adjacent to a residential area
and that they wished to offer assistance in helping them find a
site.
Motion was made by Justice of the Peace Bulger and seconded by
Justice of the Peace Francese that Harold Reilley be empowered
to handy the seven casegof acquiring property on the Widmer Road.

The Town Superintendent of Highways, Robert Lawson recommended that
the H. G. Page Company being warded the bid.
Motion was made by Councilman Robinson and seconded by Justice of
the Peace Bulger that H. G. Page Company be awarded the boetract.
Motion carried
Attorney Williams presented pppers asking for permission to form
the Dutchess Water Corporation.
Motion was made by Councilman lfill and seconded by Councilman Robinson
that Supervisor Linge be given permission to sign the papers giving

Motion was made by Councilman Ifill and seconded by Councilman
Robinson that Barger & Russ be instructed to go ahead with Quotations
for Evaluation of the Oakwood Knolls Sewer District providing said
survey includes current Market Value prices. Motion carried

Peace Bulger that the meeting adjourn.
