1964-03-04 PHA public Heariwas held on Wednesday evening, March 4, 1964
in the Town Hall Mill Street, Wappingers Falls, N. Y.
The Hearing was called to order by Supervisor, Richard H. Linge
at 7:30 P. M.
Supervisor Richard H. Linge read the notice as posted in the
paper.
Supervisor Linge then presented each item separately.
L --Amend Item 17 of Permitted Principal Uses in Resi-
dential Districts as contained in Section 421 to read as follows:
"17. Riding Academies*, veterinarian's offices*,
and animal hospitals*, stables* and dog
kennels*, only in R-40 Districts and only
when located on 10 or more acres of land."
An error was made in the publication of this, by ommission
of asterlks, this must be republished and another hearing held
on same.
2. --Amend Item 1 of Permitted Principal Uses in AI Air-
port Industrial Zones as contained in Section 423 to add "motels"
as a permitted use.
There was no one present who spoke against this item.
3. --Amend Section 437 to read as follows:
"437" Expiration of Special Permits.
A special permit hertofore or hereafter
issued shall be deemed to authorize only the
particular use or uses specified in the permit
and shall have no expiration date, except that
such permit shall automatically expire if said
use or uses shall cease for more than twelve
(12) consecutive months for any reason."
There was no one present who spoke upon this item.
4. ---Amend Section 531 by inserting in the first sentence
of said Section 531 immediately prior to the phrase "shall
be guilty of a misdemeanor" the following:
"or who fails to comply with any condition or
safeguard attached to a special permit issued under

Section 435.02 hereof,"

5. --Amend the Zoning Map to redone from R-20, One Family
Residential District, to RD -20, Optional Dwelling Residential
District the following described lands:
Lands owned by Lena Rende boutbed on the north
by Hopewell Junction Road (County Highway 28), on
the east by Indian Ridge DevelopAient, on the south
by lands now or formerly owned by Card and on the
west by lands now or formerly owned by Irving, having
approximately 373 feet frontage on said Hopewell
Junction Road, a depth of approximately 1716 feet
and containing approximately 6.629 acres of land.
George Lieberman -Hopewell Road- He was opposed to this-stateijhe
would like to have it stay as it was.
William Speedling--Hopewell Road -Opposed to this. Said the traffic
was plenty congested on this road now.
Mr. Rende spoke in favor of same.
6. --Amend the zoning map to rezone from R-40, One Family
Residential District, to GB, General Business, the following tract
of land:

Land fronting on New York Route 9D boudded
and described as follows:
Beginning at a point approximately 200 feet
south of the northerly juction of said Route 9D
and Old State Road, said point of beginning being
the point of intersection of the present boundary
line between R-40 and R-20 zoned lands with the westerly
line of said Route 9D, thence westerly along said boundary
line to a point which is 300 feet distant from the said
ivesfdaly line of said Route 9D measured at right angles
thertto, thence southerly along a line parallel with the
said westerly line of said Route 9D and 300 feet
distant therefrom to the present boundary line
between RD -40 and R-40 zoned lands in the vininity

of the southerly junction of Old State Road and
said Route 9D, thence easterly and southerly along
the said boundary line between RD -40 and R-40 zoned
lands and along the present boundary line between
R-20 and R-40 zoned lands crossing said Route 9D
to a point northerly of Stoneykill Road and distant
300 feet from the easterly side of said Route 9D
measured at right angles thereto, thence northerly
along a line parallel with the easterly side of
said Route 9D and distant 300 feet therefrom to
the present boundary line between R-40 and R-20
zoned lands first described above, thence westerly
along said last mentioned boundary line to the
westerly side of said Route 9D and the point of
beginning.
7. --Amend the Zoning Map to rezone from R-40, One Family
Residential District to R-20, One Family Residential District
the following tract of land:
All of the land now zoned R-40 lying west of
New York Route 9D and southerly, westerly or northerly
of Old State Road except for the lands included in
proposed amendment number 6 above.
8. Amend the Zoning Map to rezone from R-40, One Family
Residential Distrcit to LB, Local Business District, the
following tract of land:
Lands now owned by Rocco Ranieri, Jr. and Vito
Vintimiglia bounded on the west by New York Route 9D*
on the south by lands now or formerly owned by
Popular, on the east by lands now or formerly owned
by Central Hudson Gas and Electic Rorporation and
on the north by lands now or formerly owned by Popular,
having approximately 4.00 feet frontage on said Route
9D, a depth of approximately 725 feet and containing
approximately 6.68 acres of land. A portion of said
lands are included in the lands described in proposed amendment
6 above.
Raymond Aldrich, Atty spoke stating he was reppesenting those in-
terested in item #8, but if they made it all local business he
would not kick at all. He introduced Joseph Dinkin, Real Estate
Consultant and Appraiser who spoke in favor of these items and
gave figures showing why they should be adopted. He stat4d that
the state count on traffic showed 4,340 care passing one spot
in 12 hours. on Route 9D.
A petitchon was presented by 15 residents of the area approving
the rezoning of Route 9D from Old State Road to Stoneykill Road
from One Family Residential to G. B. General Business.
Letters had been received from Sid Shapiro, Martin Brundage,
Francis Greco, Charles Crawford, Rocco Raneri, Vito Vintimiglia
and Carmine Rende in favor of these items.
Mr. Axel Blom spoke stating he was opposed to having it rezoned
General Business but not to local business.
Ernest Peline spoke on same.
Mrs. Brundage spoke stating she was for re -zoning and asked why
these people objected to the change as they were on the Old State
Road and not on Route 9D,
Mr. Peline asked why they could not compromise and rezone one side
of the road only.
De. Engelman -Spoke about protecting property values in the area.
and stated that the residents objected to having it re -zoned but
did not object to the businessess already there.
Mr. Arthur Booth spoke stating he was in favor of this being a
buiiness area.
Axel Blom spoke stating he was for business on the West side of
the Road but not to LB on the East side of the Road.
Charles Crawford spoke stating there was 11 businessess operating
or non-operating along this area and wanted to know why it should
be classed as residential, he also spoke about the large flow of
traffic.
Nick Constantino spoke stating he was opposed to the re -zoning.

Miss BeatricFIrving spoke stating she was in favor of Route 9D.
being commchrcial and she said that with the flow of traffic Route
9D is certainly commercial.
The Hearing closed at 9:30 P. M.
