A public hearing was held by the Town Board, Town of Wappinger
,on Thursday evening, December 16, 1963.
Present: -Richard H. Linge, Supervisor, Councilmen -Malcolm fiait
and Geo*ge Robinson, Justice of the Peace -William Bulger, Town
Attorney -Judson Williams, Town Clerk -Helen L. Travis, Attornies-
Russell Aldrich & Murrill Effron, representatives of the New
Hackensack Fire District and afid the Hughsonville Fire Dis-
trict and about 25 people of the District.
The Hearing was opened by Supervisor Richard H. Linge at 7:30
P. M.
Supervisor Linge reported that petition had been served on him
in the matter of Application of Raymond J. Marshall, Maurice M.
Burke, John Montfot and Vincent Brancato and others, for the
annexation to the Village of Wappingers Falls, Dutchess County,
N. Y. of territory adjoining said Village, situate in Town of
Wappinger, Dutchess County, N. Y.
Russell Aldrich, Attorney, presented affidavit signed by Richard
H. Linge, Supervisor stating he had received petition and set the
date of hearing for December 16, 1963 at7:80 P. M. o'clock at the
Garage buildingp of Raymond J. Marshall.
An affidavit of Personal Service of Russell E. Aldrich, stating he
had served duplicate duplica6e and original of amended petition and
supporting papers upon Richard H. Linge, Supervisor of the Town of
Wappinger on December 3, 1963.
A copy of Supplementary petition was presented from Arnold Cecchini
and Vicki Cecchini(also known as Arnold E. Cecchini & Gussie A.

Cecchini.
Russell Aldrich, Attorney, discussed the petitions and stated in
what form objections had to be made.
He also stated that this would ;in no way hurt the New Hackensack
Fire District or th4 Hughsonville Fire District.
Kermit Becker asked about how much of the new Highway would be
included in this. Maurice Burke answered stating that just a
small portion would be involved.
Kermit H. Becker presented the following statement. I am chairman
of the Board of Fire Commissioners of the New Hackensack Fire Dis-
trict. I would like to make a statement on behalf of the Board
and also as a taxpayer of the Town.
1.^The Board of Fire Commissioners of the New Hackensack
Fire District, objects to this proposed annexation on the
grounds that it will remove taxable real property from the
Fire District tax rolls and place an addifiional burden on
the remaining residents of the Fire District.
2. The New Hackensack Fire District presently has bonded
indebtedness in the amount of $33,000 plus interest. Under
the terms of the annexation laws the Village Government and
th the Village Taxpayers can become a party to the retirement
of this bonded indebtedness. These facts should be given
serious consideration by the Town Board and Village Board
before action is taken which may create increased burdens
to the taxpayers of the Fire District and the Village.
Murrill Effron then submitted the following statements.
Atlas Water Works Company states that on May 3, 1962 the Water

Resources Commission of the State of New York granted to
ATLAS WATER WORKS COMPANY the right to operate a water system
in the following area:
The area lying northeast of the village of
Wappingers Falls and bounded on the northwest
by the present water supply area of the company
and by Wappinger Creek, on the northeast by Nicholas
Road and A11 Angels Road, on the southeast by Myers
Corners Road and on the southwest by Dorothy Heights
Road and United States Highway Route 9.
The lands proposed to be annex8d and which are the subject of
this public hearing are within this franchise area.
We wish to note on the record of this public hearing the right
of ATLAS WATER WORKS COMPANY to operate a water system in the
area which is the suject of this annexation proceeding.
The L & A. FILTRATION CORPORATION states that on November 27,1963
the Town Board of the Town of Wappinger granted to L. & A. Sewerage
Disposal Corporation a franchise to operate a sewerage disposal
system in the following area:
The area in said Town of Wappinger boun ded on the
North by New Hackensack Road, on the East by All Angels
Road, on the South by Myers Corners Road , on the west
by by U. S. Route 9, excluding therefrom all lands lying
within the Village of Wappingers Falls and all lands
lying within the Ritter "Oakwood Knolls" Development
on the North side of Myers CornerS Road.
The lands proposed to be annexed and which are the suject of this

public hearing are within this franchise area.
On December 3, 1962 L. & A. SEWERAGE DISPOSAL CORPORATION was
duly incorporated under the Transportation Corporation Law
of the State of New York. The name of this Corpor tion was
changed to L &nA FILTRATION CORPORATION pursuant to a Cer-
tificate issued on January 31, 1963 by the Secretary of State
of the State of New York.
We wish to note on the record of this public hearing the fran-
chise rights of L & A Filtration Corporation to operate a sew-
erage disposal system ib the area which is the suject of this
annexation proceeding.
Supervisor Linge asked if there was any futther objections.
There being no further objections the following motion was
made.
Motion was made by Councilman Hait and seconded by Justice
of Peace Bulger that the Town Board does hereby consent that
the territory hereinafter described, (a copy of which is hereby
attached) kmaximmximdxamm be annexed to the Village of Wappingers
Falls, Dutchess County.
