1963-12-05 RGMThe regular meeting of the Town Board, Town of Wappinger was held
on Thursday evening, December 5, 1963 in the Town Hall, Mill St.

Present: -Supervisor -Richard H. Linge, Councilmen -Malcolm Hait &
George Robinson, Justices of the Peace-Sdn ntCIF' '.acncese, • Towne.
Attorney -Judson Williams, Superintendent of Highways, Kenneth
Croshier, Building Inspector -Joseph Ludewig, Town Clerk -Helen
L. Travis, Town Engineer --Charles Maneri
The meeting was opened at 8:10 P. M. by Supervisor, Richard H.
Linge.
Supervisor Linge advised the Board that each member had received
copies ;of minttes and amendments to same, and what was their
pleasure on same.
Councilman Hait asked is one correction could be made, minufies
should state that 5 serious accidents had taken place instead of
5 fatalities had occurred on the corner on Route 9D.
Motion was made by Justice of Peace Francese and seconded by Coun-
cilman Robinson that the minutes and amendments with correction be
accepted. Motion carried
The bills for the months of November were read. Motion was made
by Councilman,Robinson and seconded by Justice of Peace Francese
that the bills be paid. Motion carried.

Supervisor Linge stated that all Board members had received copies
of correspondence as follows:
1. --Copy of primer on the effect of Equalization Rates
2, --Copy of Planning Board Minutes
3. --Copy of Recreation minutes
4. --Copy of Supt. of Highways letter
5. --Copy of letter received by Mr. Ludewig
6.--Fishkill Auto Parts Letter
Motion was made by Councilman Haat and seconded by eouncilman Rob-
inson that all correspondence be accepted and placed on file.
Motion carried
Mrs. Alfred Arkell of the Recreation Committe, showed maps and gave
a report of proposal of Recration committee for improving the Becker
property. She also reported that the ice skating pond at the Reese
Recreation area would be open to skaters as soon as it was frozen,
and that the ski area and toboggan slides would also be ready for
use this year.

Attorney Williams, presented road for acceptance at Bash Apartments.
He stated that the deed was in order.
Town Engineer Maneri and Superintendent of Highways, Kenneth Croshier
questioned the flow of water under the road. The Board decided to
defer this matter until a later date so that they could determine
about about the flow of the water. Mr. Williams and Mr. Maneri and
Mr. Croshier are to investigate same.
The following roads were presented to the Town.
The following resolution was made by Councilman Hait and seconded
by Councilman Robinson and unanimously adopted.
RESOLVED, that Wildwood Drive, Gary Place, Dennis
Road, Wendy Road, Russ Place, Brian Place, Dana Place and
Beth Place as sown on a cerain map entitled "Map of
Wildwood Forrest", dated October 1963, and Wildwood Drive
as sown on a certain map entitled "Plat of Wildwood
Manor", dated December 15, 1962, which said Wildwood
Drive on said latter map is designated thereon as par-
cel "a", be and same hereby are accepted as pulTic High-
ways of the Town of Wappinger, such acceptance to be
contingent upon and to become effective only when the
following conditions are complied with:
1. A good and sufficient full convenant and warranty
deed conveying such road or roads and any drainange or other
easements deemed necessary by the Town Superintendent of High-
ways be a metes and bounds description, 9s delivered to the
Town, and
2. A performance bond issued by a surety company

authorized to do business in New York State in the amount of
$56,000.00 in form acceptable to the Town Attorney shall have
been posted with the Town guaranteeing.
(a) that said road or roads shall be completed
in accordance with applicable Town specifications
within two years from the date of the adoption
of this resolution, but not sooner than eighteen
months from said date, unless the Town Board
shall consent to such sooner completion based on
a finding that the area served by said road or
roads has been substantially developed, and
(b) that pending said completion of said road or
roads the developer shall at his own cost and
expense maintain said road or roads in a reason-
ably suatable condition for use by the general
public including snow removal therefrom.
(c) that for a period of one year following a
finding by the Town Board that said roads have
been completed and notwithstanding such finding
as aforesaid, the developer will at his own
cost and expense, make any repairs that may be
necessary and shall rectify any condition aris-
ing out of or attributable to any failure to so
complete said roads to said Town's applicable
specifications.

A discussioh arose about name of Streets and Roads being so much
alike. Supervisor Linge asked Mr. Lafko and Mr. Alexander if they
would contact the Post Office and Check the names of their roads.
They stated they would do so.
Attorney Williams presented a deed to 6 acres of property from Lafko
& Alexander to the Town for Recreational purposes, with a right of
way. This was offered at the request of the Planning Board.
Mr. Weinbert, Chairman of the Recreation Committee stillted that
he and some of his committee had examined this area and that they
could not see any reason why the Town should not accept this, but
that no work would be done on same at the present time.
Mr. Fred Koehler spoke as an officer of the Quiet Acres Civic Assoc- u
iation, which represents 80 to 90 % of the group. He said he had
not had time to discuss this matter alloitthad come as a complete
surprise and that they were not against a recreational areae.
Attorney Reed spoke on this matter, stating that refusal of this
would hold them up on getting their mortgage.
Hugh J. Maurer spoke in reference to above matter.
Mrs. Young spoke in reference to above matter.
Mr. Gus Tullo spoke in reference to above matter.
Mr. Arthur Bisom spoke in reference to avoe matter.

Justice of the Peace Francese spoke stating he could see no reason for
ho&ding up the acceptance of same, being that the Planning Board had
recommended same.

Councilman Hait stated he could not see any objection to this.
After this discussion Mr. Lafko was informed that this would in
no way interfere with his acceptance by the Planning Board.
It was decided to set up a meeting with the Recreation Committee
and the Quiet Acres Civtc Association to discuss this matter and
to have it brought up at a later date.
Upon the recommendation of the Town Engineer and the Town Highway
Superintendent and upon motion by Councilman Robinson and seconded
by Councilman Hait, the following Resolution was unanimously
adopted.
RESOLVED, that the Town Board hereby finds
that Daisy Lane, Daisy Court, and an unnamed
strip dor construction of future street's dedica-
ted to the Town by resolution of this Board on
Octmber 4, 1962, have been completed in accord-
ance with the provisions of said October 4, 1962
resolution and futher
RESOLVED, that for a period of one year
from this date Vista Properties Corporation,
Fred. J. Lafko and David Alexander have offered
to guaratee that said roads have been so com-
pleted and have agreed to make any repairs to
said streets at their cost and expense which may
be necessary by reason of any failure to con-
struct said roads to said Town"s specifications
and futher
RESOLVED, that this resolution shall be-
come effective when, as and if the Town shall

receive an amendment of Lumbermens Mutual Casu-
alty Compan"s Cond No. 2 S 356 160 guarantee-
ing that Vista Properties Corporation, Fred J.
Lafko and David Alexander will perform the obli-
gations specified above for the one year period
beginning this date.
Justice of the Peace, Vincent Francese reported that the Town's
Commercial and Industrial Development Committee Mad held several
meetings and were now in the processsof compiling data to be in-
cluded in a brochure to be distributed to proppective developers.
He also asked that a letter be written to the State Department
of Public Works to determine what improvements the State plans to
make on route 376 and how soon it might be completed.
A letter was read from the State Superintendent of Public Works
in answer to request from the Town Board in reference to the con-
struction of st4aightening and improving route 9 in the Village
and outside of the Village in the Town.
A request was received from the Anal Development Corp. asking that
a parcel of land on Hopewell Road in Hughsenville be rezoned from
R-20 to R. D. This was referred to the Planning Board for consid-
eration.
A request was received from Rocco Raneeri and Vito Vintimiglia
for the change of property on Rt. 9D from R-40 to Local business.
This was feferred to the Planning Board for their consideration.
A letter was read from County Highway Superintendent, stating signs
had been ordered for Middlebush Road and that they would probably
be received in about 6 weeks.

Attorney Williams announced that a Public Hearing would be held on
December 16, 1963 at 7:30 P. M. in the Raymond J. Marshall garage
on Route 9. The hearing is being held as the result of a petition
to the Village of Wappingers Fa&ls to permit the annexation of
several acres of property south of the village on Route 9 to the
village.
Motion was made by Councilman Hait and seconded by Councilman Rob-
inson that the meeting adjourn.
Motion carred.
