1962-03-14157 The regular monthly meeting of the Town Board, Town of Wappinger was held in the Town Hall, on Thursday evening, March 14, 1962. Present: -Supervisor -Richard H. Linge, Councilmen -Malcolm I. Hait and George Robinson, Justices of the Peace -Joseph F. Kelly and Edward B. Beatty, Superintendent of Highways- @harles` E. Mewkill, Sr., Town Attorney -Judson 0, Williams, Town Clerk -Helen L. Travis. The meeting was opened at 8:00 o'clock by Supervisor, Richard H. Linge. The minutes of the last meeting were read. Motion was made by Judge Kelly and seconded by Councilman Robinson that the minutes `be accepted as read. Motion carried. The bills for the month of February were read. Mention was made by Judge. Beatty and seconded.. by Councilman Hait that the bills be accepted. Motion carried. The Board ordered the letter placed on file. A letter was received from the Wappinger. Democratic Club re- questing permission to usIthe Town Hall for their regular monthly meeting whenever p0 they are unable to obtain other facilities. Motinn was made by Judge Kelly and seconded by Councilman Hait that they be allowed to use the Town Hall when they need same. Motion carried A letter wasread from Walter J. Altonen enclosing a letter from Constable John Yaccarine, in which he asks the Board to Accept his resignation due to ill health. Motion was made by Councilman Hait and seconded by Judge Kelly that the resigination be accepted with regret and that the Town Clerk write a letter to Mr. Yaccarine 159 inregard to this. - - . Motion c-arried A request was received from the New Hackensack Fire District for the vii--prEN Town to plow in front of the Firehouse only. Attorney Williams was ordered to prepare the contract. A letter was received from the Wappingers Central School asking that the town consider plowing at the Kethham High School, our present Highway School and the James. S. Evans Elenent.ary School during the winter. A motion was made by Councilman Hai -t and seconded by Judge Beatty that Councilman Robinson and Superintendent of High- ways Mewkill be appointed to look into this matter and see just what is needed and what they want and report same back to Town Board. Motion carried. The Supervisor stated that the 196.1 assessment roll of the Town, which was used in levying 1962 state, county and town taxes, in- cluded an assessment standing in the name of Theodore Becker on a parcel of land situate on Robinson Lane in the Town, The Sup- ervisor pointed out that the parcel in question was assessed for 6,0000. And_ that the total 1962 taxes, thereon, including District taxes, amounted to 132.12. The Supervisor indicated that, as the law required., this reflected the status of the property on June 1, 1961. The Supervisor pointed out that in September 1961, the Town had purchased most of the land included withinthe above parcel and that the deed to the Town for the land so acquired by the Town was recorded in the Dutchess County Clerk's Office on September 28, 1961, in Liber 1066 of Deeds at page 82. The Supervisor stated the Mrs. Nettie Becker, who now owns the land remaining, is unwillingto pay the full assessment of $132.12 since a substantial portion of the parcel was now owned by the Town and was owned by Town on the date that the taxes in question were levied. 160 The Supervisor reported that the Board of Assessors of the Town had stated that, in their opinion, the portion of the land retained by Mrs. Becker should bear an assessment of 3,000. and the portion of the land acquired by the Town choul.d likewise bear an assessment of 3,000. Town Attorney Williams_ advised the Town Board that, pursuant to Section 995 of Real Property Tax Law, the Town was authorzed and required to discharge tax liability of the Town from general funds of the Town. On motion by Judge Beatty, seconded by Councilman Robinson, the fol- lowing resolution was unanimously adopted: RESOLVED that the Supervisor is hereby authorized and directed to pay to the Town Receiver of Taxes the sum of y 66.06, plus 2% ibenalty of $1.32 for a total of $67.38, to be applied to the full tax liability on the parcel above described in the amount of $132.12, and that the action of the Town Receiver of Taxes in tlaxxxxxxm accepting prior do February 28, 1962, the sum of $66.06 from Nettie Becker to be applied on the liability of the above decribed parcel, is hereby ratified, confirmed and approved. Superintendent of Highways Charles E. Mewkill, Sr., reported on the Rids received at the last meeting and suggested the following. Dr Harvey Miller stated that a work day would be held at the Becker property on April 21st, 1962 and would like any help that they can get. Motion was made by Judge Beatty and seconded by Councilman Rob- inson that the meeting nights for the next two months be changed to the seconded Wednesday of the month. This is being done so that Judge Kelly may attend the school for Justices being held every Thursday evening. Motion carried. Motion made by Judge Kelly and seconded by Councilman Hait that Harry Straley be appointed Dog Warden for the Town of Wappinger, Motion carried. Motion was made by Judge Kelly and seconded by Councilman Hait that the meeting adjourn. Motion carried.
