The regular• monthly meeting of the Town Board, Town of Wappinger
was held in the Town Hall, on Thursday evening, September 6, 1962
Present: -Supervisor -Richard H. Linge, Justices of the Peace -Joseph
F. Kelly and Edward B. Beatty, Councilman -Malcolm I Hait &.George
Robinson, Town Attorney -Judson Williams, Town Superintendent of
Highways -Charles E. Mewkill, Sr., Town Engineer -Charles Maneri,
Building Inspector -Kenneth Thornton, Town Clerk -Helen L. Travis.
The meeting was opened at 8 P. M. by Supervisor, Richard H1 Linge.
The minutes of the last meeting were.. read. Motion was made by
Justice of Peace Kelly and seconded by Justice of Peace Beatty
that the minutes be accepted as read. Motion carried.
The bills for the month of August were read.
Motion was made
by Justice of Peace Beatty and seconded by Councilman Robinson
that the bills be paid. Motion carried

Justice of the Peace, Edward B. Beatty presented the following
resolution and moved its adoption, seconded by Councilman Malcolm
Hait,
WHEREAS, Justice of the Peace Joseph F. Kelly has requested his
salary as Justice of the Peace be reduced to an anual rate of
$1200. payable in mothly installments effective October 1, 1962,
NOW, THILREFORE, be it
RESOLVED that effective October 1, 1962, the salary of the
Justice of the Peace Joseph F. Kelly be and, the same is hereby
established at the annual rate of $1200. payable in monthly in-
stallments. Resolution carried.
The question of the dedication to the Town of approximately two
acres of land, by Osborn Hills, Inc., to be used for recreation
was brought up. A motion was made by Justice of Peace, Edward
B. Beatty and seconded by Councilman Hait that this be referred
to the Town Engineer, Superintendent of Highways and Recreation
Commission to be inspected and gone over thoroughly by them.
Motion carried.
Councilman Hait said he had been approached asking what could

be done about the speed limit on the Hopewell Road. The Board was
in favor of reducing the speeed. Town Clerk was requested to write
letter to State Traffic Commission asking; if this coud be done.
Councilman Hait also asked what it would cost and if additional
lighting could be placed on this road, between route 9 and 9D.
Town Clerk to contact Central Hudson Gas & Electric Corp. asking
about this matter.
Councilman Hait then asked what would have to be done to make a
Street one way. This was referred to Attorney Williams, who will
report on same at the next meeting.
Building Inspector Kenneth. M. Thornton repoarted that 32 permist
had been issued during month of July, amounting to 631,00.00
Fees ti 536.75.
Town Attorney Williams reported that the Town had been named de-
fendent in a Court Action by the New York Telephone Company and
stated it was the proceedure of the Town to name an attorney other
than the Town Attorney to take care of this case.
The name of James J. Lyons was suggested to handle this.
Motion was made by Justice of Peace, Joseph F. Kelly and seconded by
Justice of Peace, Edward B. Beatty that Attorney James J. Lyons
be hired to handle the case. Motion carried.
Mr. Murrill Effron appeared before Board for I. C. B. M. Inc.,
asking that roads, Lake Oniad Drive, Fox Hill Road and Bungilow
Lane be officially accepted by the Town and Bond on same be
returned.
The following resolution was made by Councilman Hait and seconded
by Councilman Robinson and carrried.
RESOLVED: that the Town hereby finally accepts Lake Oniad Drive,
Fox Hill Road and Bungalow Lane as public roads and that Lumbermens

Mutual Casualty Company Bond No. o5355573 previously furnished by
I. C. B. M. Homes, Inc. guaranteeing completion of these roads is
hereby discharged.
I. C. B. M. Homes presented the remaining portion of Central
Avenue and an of Ervin Drive for acceptance as Town Roads.
Upon motion of Councilman Robinson, seconded by Councilman Hait
the following resolution was unamimously adopted.
RESOLVED:, that the Town tentatively accepts as public
roads, the remaining portion of Central Avenue and all of Ervin
Drive all as described in a deed tendered to the Town for I.
C. B. M. Homes, Inc., dated, July 31, 1962, provided however that
the Town be furnished with a surety bond in favor of the Town, in
the amount of 424,500.00, guaranteeing completion of said Portion
of Central Avenue and Ervin Drive to the Town road specifications
and that pending said completion I. C. B. M. Homes, Inc., assumes
responsibility for maintenance, including snow removal.
Upon motion by Justice of Peace Beatty and seconded by Counilman
Hait the following resolution was uhanimously adopted.
fiESOLVED, that the Town hereby accepts the dedication by
ICBM Homes, Inc., by deed dated July 31, 1962, of a 50 foot strip
of land extnending northerly from the proposed extension of
Central Avenue to lands now or formerly of Schnabl; said land to
remail -1 undeveloped as a highway pending future developement of the
said Schnabl land, and further
RESOLVED:, that the Town hereby expresses its intention
to hereafter refuse dedication of lands reserved for continuation
of future streets unless the developer finishes the said reserved
lands to Town road specifications.

Motion was made by Justice of Peace Kelly and seconded by Justice
of Peace Beatty that the piece of land deeded to the Town by
fpr road purposed
I. C. B. M. Homes, Inc., under date of April 30, 1962, be re-
fused and the land returned to the owner. Motion carried
Mid. A. W. Vanderwinkel appeared before the Board asking about
purchasing the land at Lake Oniad.
Mrs.
Halstead still objects
to this, and said she had gotten in touch with her lawyer about
the deed to this property and promised to bring the information

in at the next meeting. Mr. HA.1sLoad agreed to wait on this
matter.
Mr. Fred.- Lafko presented Daisy Lane, "Daisy Court and that strip
of land unnamed for construction of a future road to the Town
for acceptance as Town Roads.
Upon motion of Councilman Halt, seconded by Councilman Robinson
the following resolution was unanimously adeopted.
RESOLVED, that the Town tentatively accepts as public roads,
Daisy Lane, Daisy Court and that strip of land unnamed for con-
struction of a future street, all to be more fully described in
a full deed to be furnished to the Town for said roads,
in form satisfactory to Town Attorney, from Vista Developement
and upon final approval of Developement by the Town Planning
Board, provided however that the Town be furnished with a surety
bond in favor of the Town in the amount of $14,000.00 contingent
upon the completion by Vista Developement Corp., prior to July
1, 1963 of said roads hereby tentatively accepted to the spec-
ifications d$ the Town of. Wappinger, said surety bond being in
a form satisfactory to the Town Attorney, and pending final
acceptance of the said roads that Vista Developement Corp., as-
sumes responsibility for maintenance including snow removal.

Mr. Eugene Schuele presented roads in Edge Hill Manor, Inc., for
acceptance as Town Roads.
Upon motion of Councilman Robinson, seconded by Councilman Hait
the following resolution was uhanimously adopted.
RESOLVED, that the Town tentatively accepts as a public
road that portion of Edgehill Drive extending Easterly from
the junction of Beatty Road and continuing in an Easterly,
Southerly, and Westerly direction to another junction with
Beatty Road and a road extendgin Northerly from Edgehill Drive
to a jiction with Brothers Road, all as more fully described
in a deed Tendered to the Town from Edge Hill Manor, Inc., dated
August 31, 1962, and also a strip of land for the continuation
of a future street extending easterly from Edgehill Drive pro-
vided, however, that the Town be furnished with a surety bond
in favor of the Town in the amount of $13,500.00 contingent upon
the completion of Edge Hill Manor, Inc., prior to July 1st, 1963
of the said roads hereby tentatively acepted to the specifications
of the minimum standard requirements for establishing new Town
roads in the Town of Wappinger, and provided that a full covenant
deed in form satisufactory to the Town Attorney be furnished fori',,

the latter strip of land, said surety bond being in a form sat-
isfactory to the Town Attorney, and pending final acceptance
of the said roads that Edge Hill Manor, Inc., assumes respon-
sibility for maintenance including snow removal.
Mr. Ritter appeared before Boad asking about Sewerage and Water
District or Oakwood Knolls. He said he plans to cone before
the Board at a later date asking for their approval and asked
the Board for their opinion on these matters and whether they
would give their approval. The Board stated they did not see
any reason why they wouldn't if they were all up to standards.
Motion was m ade by Justice of Peace Kelly and seconded by Councilman
Hait that the meeting adjourn.
