C. Acknowledgement of receipt of report on Town Hall Roof Evaluation and
Implications
Engineer to the Town, Bob Gray, explained his report that he gave to the town board. He
explained that the roof needs to be replaced. Supervisor Gutzler stated that the clerk's roof leaks
am as well as other areas of the building. She suggested to keep the replacement of the roof in mind
when considering the budget. She would like to make a decision by mid January 2013. She
added she will be looking into grant money. Discussion continued.

Resolution Making Certain Determinations in Relation to and Finding it to be in the Public
Interest to Establish Extension No. 3 of the United Wappinger Water District in the Town
of Wappinger, Dutchess County, New York
WHEREAS, a written petition has been duly filed with the Town Board of the Town of
Wappinger, Dutchess County, New York, in relation to the establishment of a proposed water
district extension, to be known as Extension No. 3 to the United Wappinger Water District

and
WHEREAS, the maximum estimated cost of said improvements is $35,000; and
WHEREAS, the cost of said improvements shall be paid in the owners of property therein
and no serial bonds of said Town shall be issued therefore; and
WHEREAS, the estimated cost of hook-up fees to the typical property in said Extension is
$10,000 (Aurora), $2,000 (STS Tire) and $3,200 (Lauria), none being typical, and $0 to a one or
two family home therein, there being none; and
WHEREAS, the estimated cost of said Extension to the typical property therein in the first
year in which operation, maintenance, debt service and other charges and expenses are to be made is
$1,443.09 (Aurora), $745.13 (STS Tire) and $659.40 (Lauria), none being typical, and $0 to a one �+

WHEREAS, said capital project for said Extension and the establishment thereof has been

WHEREAS, an Order was duly adopted by said Town Board on September 10, 2012,
reciting a description of the boundaries of said proposed Extension No. 3 to the United
Wappinger Water District the improvements proposed, the $35,000 maximum amount proposed
to be expended for said improvements, the proposed method of payment to be employed, the fact
that said, map, plan and report were on file in the Town Clerk's office for public inspection and
specifying the 9th day of October, 2012, at 7:30 o'clock P.M., local time, at the Town Hall, in
Wappingers Falls, New York, in said Town, as the time when and the place where said Town
Board would meet for the purpose of holding a public hearing to consider the establishment of
Extension No. 3 to the United Wappinger Water District and said map, plan and report filed in
relation thereto and to hear all persons interested in the subject thereof concerning the same; and
WHEREAS, notice of the aforesaid public hearing was duly published and posted in the

Resolution of the Town Board Regarding State Environmental Quality Review (SEQR)
Determination of Non -Significance for the Extension of United Wappinger Water District
Water Main to NYC DEP and Chelsea
WHEREAS, the Town Board of the Town of Wappinger has entered into an Agreement
in Principle with the New York City Department of Environmental Protection to prepare design
plans and specifications and a Map, Plan and Report for the United Wappinger Water District
water main extension to the NYCDEP Shaft 6 parcel on River Road; and
WHEREAS, the extension of the water district and construction of the water main are
subject to compliance with the provisions of the State Environmental Quality Review Act and
the regulations promulgated thereunder at 6 NYCRR, Part 617 (SEQR); and
WHEREAS, the Town Board has caused to be prepared Part 1 of a Full Environmental
Assessment Form (Full EAF);
WHEREAS, by Resolution 2012-184, the Town Board authorized the circulation of
notices of its intent to serve as lead agency for the proposed action; and
WHEREAS, by Resolution 2102-245, the Town Board declared itself to be Lead Agency
for coordinated review of the action pursuant to 6 NYCRR 617.6; and determined that Extension
No. 2 of the United Wappinger Water District to the NYC DEP Parcel and to the Chelsea Hamlet
is a Type 1 action under the SEQRA regulations found at 6 NYCRR Part 617;
WHEREAS, the Town Board has reviewed Part 1 of a Full EAF; and caused to be

prepared and reviewed Parts 2 and 3 of a Full EAF;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby determines that the Action does not involve a Federal
agency.
3. The Town Board hereby finds and determines that:
a) it has considered the Action, reviewed all parts of the Full EAF, reviewed
the criteria set forth in 6 NYCRR section 617.7(c), thoroughly analyzed
the relevant areas of potential environmental concern, and has duly
considered all of the potential project environmental impacts and their
magnitude in connection with the proposed action;
b) United Wappinger Water District water main extension to the NYCDEP
Shaft 6 parcel on River Road and Chelsea Hamlet will not result in any
large and important environmental impacts, and, therefore, is one which
will not have a significant impact on the environment; and
c) the reasons supporting this determination are set forth on the attached
Notice of Determination of Non -Significance with respect to this project
(a copy of which said form is on file in the Office of the Town Clerk of
the Town of Wappinger).
4. The Town Board, as Lead Agency with reference to the above-described project,
hereby:
a) adopts a negative declaration pursuant to 6 NYCRR section 617.7 with
respect to the project,
b) authorizes the Supervisor of the Town of Wappinger to sign a negative
declaration determination of non -significance with respect to the project,
c) directs the Town Clerk to circulate a copy to involved agencies; and to
publish a notice in the Environmental notices bulletin (ENB); and
d) directs the Town Clerk to file a copy of said negative declaration
determination of non -significance in the records of the Town.

Resolution Making Certain Determinations in Relation to and Finding it to be in the Public
Interest to Establish Extension No. 2 to the United Wappinger Water District in the Town
of Wappinger, Dutchess County, New York
WHEREAS, New York City owns and its Department of Environmental Protection
("DEP") operates New York City's water supply system, which provides, on average, 1 billion
gallons of high quality drinking water to the residents of New York City and other municipalities;
and
WHEREAS, New York City's drinking water is supplied by three (3) primary aqueducts,
one of which is the Delaware aqueduct which passes through the Town of Wappinger after
transversing approximately 600 feet below the Hudson River; and
WHEREAS, DEP has identified two leaks in a section of the Delaware Aqueduct and has
undertaken a project to address the leaks to assure the long term sustainability of its ability to supply
water to New York City; and
WHEREAS, the aqueduct repair project is known as the "Water for the Future" Project
("WFF Project") which involves, among other things, the construction of a bypass tunnel that will
cross underneath the Hudson River and continue through portions of the Town of Wappinger,

Dutchess County, New York (the "Town"); and
WHEREAS, as a component of the WFF Project, DEP will construct anew shaft on the
eastern side of the Hudson River on New York City property located in the Hamlet of Chelsea in
said Town and otherwise referred to as the "Chelsea Shaft 6B Site" located at the Hudson River on
River Road North in the Town; and
WHEREAS, for the construction of the bypass tunnel and the new Shaft 6B, DEP will
require approximately 169,200 gallons of water per day commencing in the fall of 2013; and
WHEREAS, in the future, the Town expects that it will need to provide a source of good
quality water to the Chelsea Hamlet area geographically to the south of the proposed Extension No.
2, where many of the residents are located on small parcels that currently use individual well
sources that have become unreliable; and
WHEREAS, DEP proposes to contract with the Town for the construction of a 12 inch
water main utilizing the water facilities of the United Wappinger Water District (the "District"); and
WHEREAS, after the conclusion of the WFF Project, the water main can be used to supply
water to the residents of the Chelsea Hamlet area as well as other residents of the Town of
Wappinger along the pipeline route in future extensions to the United Wappinger Water District
which residents cannot be served simultaneously with the WFF Project due to constraints in water
supply and therefore cannot be benefitted by the extension herein described; and
WHEREAS, the Town and DEP have entered into an Agreement in Principal, outlining the
terms and conditions pursuant to which the Town of Wappinger will construct a 12 inch water main
from the point of connection with the District water system located near Route 9 and Old Hopewell
Road to the Chelsea Shaft 6B Site, each in said Town; and
WHEREAS, a written petition has been duly filed by New York City with the Town Board
of the Town of Wappinger, Dutchess County, New York, in relation to the establishment of a
proposed water district extension, to be known as Extension No. 2 to the United Wappinger Water
District (hereinafter, the "Extension"), pursuant to Article 12 of the Town Law, which petition,
together with a map, plan and report for said Extension (the "map, plan and report") have been filed
in the office of the Town Clerk and are available for public inspection; and
WHEREAS, said map, plan and report include a map showing the boundaries of the
proposed extension, a general plan to serve said Extension, and a report of the proposed method of
operation thereof, and was prepared by Morris Associates, competent engineers duly licensed by the
State of New York; and
WHEREAS, the boundaries of said Extension shall be as described in Exhibit A attached
hereto and hereby incorporated herein; and
WHEREAS, the improvements proposed for said Extension consist of the purchase and
installation of 12" water distribution mains for connection to the existing District water main located
at the junction of Route 9 and Old Hopewell Road and extending approximately 20,000 linear feet
through to Wheeler Hill Road and then southward to Carnworth Farms to the Chelsea Shaft 6B Site
located in the Hamlet of Chelsea, including original furnishings, equipment, machinery, apparatus,
appurtenances, and incidental improvements and expenses in connection therewith, all as more fully
described in the map, plan and report hereinbefore described; and
WHEREAS, the maximum estimated cost of said improvements is $9,000,000; and
WHEREAS, the cost of said improvements shall be paid in full by the owner of the
property therein and no serial bonds of said Town shall be issued therefore; and
WHEREAS, the estimated cost of hook-up fees to the typical property in said Extension
having a sole parcel being the Chelsea Shaft 6B site, is $0, and $0 to any one or two family home
therein, there being none; and
WHEREAS, the estimated cost of said Extension to the typical property therein having a
sole parcel being the Chelsea Shaft 6B site, in the first year in which operation, maintenance, debt
service and other charges and expenses are to be made is $99,150 and is $0 to any one or two family
house therein, there being none; and
WHEREAS, said capital project for said Extension and the establishment thereof has been
determined to be a Type I Action pursuant to the regulations of the New York State Department of
Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act,
+�•.� the implementation of which as proposed, the Town Board has determined will not result in any
significant environmental effects; a full Environmental Assessment Form has been prepared in
connection therewith and is available for review in the office of the Town Clerk during regular
office hours; and
WHEREAS, an Order was duly adopted by said Town Board on September 10, 2012,
reciting a description of the boundaries of said proposed Extension No. 2 to the United
Wappinger Water District, the improvements proposed, the $9,000,000 maximum amount
proposed to be expended for said improvements, the proposed method of payment to be
employed, the fact that said, map, plan and report were on file in the Town Clerk's office for
public inspection and specifying the 91h day of October, 2012, at 7:30 o'clock P.M., local time, at
the Town Hall, 20 Middlebush Road, in Wappingers Falls, New York, in said Town, as the time

manner and within the time prescribed by Section 193 of the Town Law, and proof of publication

WHEREAS, said public hearing was duly held at the time and place in said order as
aforesaid, at which all persons desiring to be heard were duly heard; and
WHEREAS, said Town Board has duly considered said petition and said map, plan and
report and the evidence given at said public hearing;
NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of

Section 1. Upon the evidence given at the aforesaid public hearing, it is hereby found

Resolution Authorizing Execution of Animal Housing Agreement with Dutchess County
SPCA
WHEREAS, the Town Dog Control Officer is empowered to seize dogs in accordance
with the provisions of Agriculture and Markets Law § 118; and
WHEREAS, pursuant to Agriculture and Markets Law §118 (3), dogs seized by the
Town Dog Control Officer are required to be properly sheltered, fed and watered during the
redemption period; and
WHEREAS, the Dutchess County Society for the Prevention of Cruelty to Animals
(hereinafter DCSPCA) maintains a kennel for boarding of dogs and other animals at its office
located at 636 Violet Avenue, Hyde Park, New York 12538; and
WHEREAS, in accordance with Agriculture and Markets Law § 115(2), the Town Board
wishes to contract with DCSPCA to provide shelter for dogs seized by the Town Dog Control
Officer; and
WHEREAS, the Town Board wishes to enter into an Animal Housing Agreement with
DCSPCA to shelter, water, feed and provide necessary veterinary services for dogs and other
animals seized by the Town; and
WHEREAS, DCSPCA has presented to the Town an Animal Housing Agreement, a
copy of which is annexed hereto; and
WHEREAS, the Town determines that it is in the best interest of the Town to enter into
said Animal Housing Agreement as above described.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town of Wappinger hereby approves the Animal Housing Agreement, in the
form annexed hereto and authorizes and directs the Supervisor to execute the
Agreement by and on behalf of the Town of Wappinger, subject to any

(hereinafter the "Applicant") filed an application for Site Plan Approval under Application

WHEREAS, on or about November 16, 2011, a deposit of a Cash Bond in the amount
of Five Thousand Dollars ($5,000.00) was deposited into an escrow account with the Town of
Wappinger to insure the completion of the installation of windows; and
WHEREAS, the Planning Board approved the windows and the Amended Site Plan was

RESOLUTION: 2012-274
Resolution Authorizing the Execution of an Intermunicipal Agreement Between the City of
New York and the Town of Wappinger for Administration and Enforcement of the
Construction Codes
WHEREAS, the Delaware Aqueduct which supplies water to the City of New York
(City) and other municipalities traverses the Town of Wappinger; and
WHEREAS, the City through the Department of Environmental Protection (DEP) has
fee title to certain real property in the Town of Wappinger and has easement interests in other
parcels; and
WHEREAS, the DEP needs to make repairs to the Delaware Aqueduct which includes
the construction of the Rondout-West Branch Tunnel Bypass Project ("RWBT Bypass Project");
and
WHEREAS, as part of the RWBT Bypass Project a new shaft, designated as "Shaft 6B"
will be constructed on real property in the Town owned by the City designated as Tax Parcel ID
135689-6056-01-288977 and a bypass tunnel ("Bypass Tunnel") connecting Shaft 6B to a new
shaft being constructed in the Town of Wappinger, NY; and
WHEREAS, certain New York City Codes jurisdictionally apply to the RWBT Bypass
Project and compliance with same is the responsibility of the City through DEP; and
WHEREAS, the City has requested that the Town's Code Enforcement Officials inspect
and certify compliance of the RWBT Bypass Project with applicable City Codes; and
WHEREAS, the City and the Town hereby agree to the terms and conditions as
contained in the Intermunicipal Agreement for Administration and Enforcement of the
Construction Codes in substantially the same form as attached hereto and the Town reserves the

right to make any changes thereto as may be required; and
WHEREAS, the Town Board hereby authorizes the Town Supervisor to execute the
Intermunicipal Agreement.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board Members individually confirm that they have each read the
Intermunicipal Agreement attached hereto, and understand the terms, conditions
and obligations therein.
3. The Town Board hereby authorizes Supervisor Barbara A. Gutzler to execute the
Intermunicipal Agreement by and on behalf of the Town of Wappinger,
• w evidencing the Town's agreement to the terms, conditions and obligations
contained therein, specifically to inspect, enforce and ensure compliance with
referenced City Codes.
4. The Town Board further authorizes the Supervisor and the Attorney to the Town
to negotiate and modify the wording of any of the terms, conditions or obligations
contained in the Intermunicipal Agreement, provided that such modifications are
substantially consistent with the terms and conditions as stated therein.

RESOLUTION: 2012-275
Resolution Authorizing a Civil Compromise and So -Ordered Stipulation of Settlement and
Execution of Same in Connection with an Action Pending Against Sean McElduff
WHEREAS, Defendant, Sean Mc Elduff, was served with various violations of the
Town of Wappinger Code including, but not limited to, placing large amount of fill material onto
Town owned property, as well as grading without a permit and non-compliance of a stop work
order; and
WHEREAS, in lieu of removing the fill, Defendant, Sean Mc Elduff, has volunteered to
make certain improvements to the Town of Wappinger Robinson Lane Recreation Field,
specifically constructing a 30 foot baseball dugout, as community service and in furtherance of a
Civil Compromise of the above mentioned charges; and
WHEREAS, the baseball dugout has been inspected and approved, and a Certificate of
Compliance has been issued by the Town of Wappinger Code Enforcement Officer, Salvatore
Morello; and
WHEREAS, the parties desire to enter into a Civil Compromise to resolve the pending
charges upon the terms and conditions as set forth in the Civil Compromise and So -Ordered
Stipulation of Settlement, a copy of which is affixed hereto; and
WHEREAS, the Town hereby authorizes the Attorney to the Town, Albert P. Roberts, to
enter into a Civil Compromise to resolve the pending charges against Sean Mc Elduff upon the
terms and conditions set forth in the above referenced Civil Compromise.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby approves the terms and conditions of the Civil
Compromise and So -Ordered Stipulation of Settlement and hereby authorizes the
Attorney to the Town to execute same in full satisfaction of all charges against
Sean Mc Elduff.
3. The Town Board also acknowledges that Code Enforcement Officer, Salvatore
Morello, has confirmed that all Building and Zoning Code violations at the
Defendant's residence have been remedied and agree to request the Justice Court

to dismiss all charges against the Defendant, with prejudice, upon the execution of

Improvement Districts and Improvement Areas within the Town of Wappinger for the Fiscal
Year 2013 and filed said rolls with the Town Clerk pursuant to Town Law § 239; and
WHEREAS, the Town Board, as required by Town Law § 239, hereby schedules and orders a
Public Hearing for the purposes of hearing and considering any objections which may be made
to the aforementioned assessment rolls for the Special Improvement Districts and Special
Improvement Areas for Fiscal Year 2013.
NOW, THEREFORE, BE IT RESOLVED, as follows:

Resolution Authorizing a Public Hearing on the Intended Use of Community Development
Block Grant Funds and the Submission of the Grant Application for Fiscal Year 2013
WHEREAS, the Dutchess County Department of Planning and Development is
soliciting applications for the 2013 Community Development Block Grant Program; and
WHEREAS, the Town of Wappinger intends to make application for a Community
Development Block Grant pursuant to the Dutchess County Department of Planning and
Development's Community Development Block Grant Program for fiscal year 2013; and
WHEREAS, the Town of Wappinger is required to hold a Public Hearing to discuss the
too Town's intended use of Community Development Block Grant Funds prior to and in furtherance
of making application for said funds.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby schedules a Public Hearing to be held at Town Hall, 20
Middlebush Road, Wappingers Falls, New York, on the 15th day of October,
2012 at 7:30 P.M. at which time all parties in interest and citizens shall have an
opportunity to offer comments and suggestions on the Town's intended use of
Community Development Block Grant Funds being applied for by the Town of
Wappinger for calendar year 2013.
3. The Town Board has determined that pursuant to 6 NYCRR 617.5(c)(21) the
proposed adoption of the aforementioned Resolution is a Type II action not
requiring environmental review pursuant to the State Environmental Quality
Review Act (SEQRA) or pursuant to Local Law No. 6 of 1992 and, accordingly,
no environmental review has been undertaken.
4. The Town Clerk is hereby directed to post and publish the Notice of Public
Hearing in the form annexed hereto which said publications are to be made in the
Poughkeepsie Journal and the Southern Dutchess News at least five (5) days prior
to the scheduled Public Hearing and post same on the Town's website.
5. The Town Board hereby further authorizes and directs Greg W. Bolner, P.E. of
Clark Patterson Lee Design Professionals to prepare and submit the Grant
Application for fiscal year 2013; Mr. Bolner shall be paid in accordance with his
hourly rate previously approved by the Town Board.

Emergency service mold and remediation of duct work.
Motion To: awarding the project to Subclean Indoor Air Inc.
Buildings and Grounds Supervisor, Steve Frazier explained that he received a call from the
Troopers stating there was a mold issue. He then removed the sheet rock. Using mold sensor kit
he found that the area tested positive. He called a company to take care of the mold and the duct
work. Supervisor Gutzler suggested that they take the advice of Steve Frazier and the Town
Engineer, Bob Gray, to have the issue taken care of. Supervisor Gutzler made a motion to award
Subclean indoor air Inc the job. Seconded by Councilman Beale all were in favor.
