Public Comment
The first resident to speak was Bill Dangler. He stated that he was opposed to the outsourcing of
the recycle center. He has noticed some dumping around the town and thinks it may get worse if
it is outsourced. The next resident to speak was Jo Dangler. She questioned who is responsible
for the cleanup of the road side dumping. The Highway Superintendent state that it depends on
the road. The town is responsible for the town roads and Dutchess County is responsible for
County roads. Councilman Beale explained the situation with the property by Adams Fair Acre
Farms and how the Town really doesn't have anything they can do about how that property
looks. Councilman Bettina stated that years ago there was a court decision that over rides the
Towns control. Discussion continued. The next resident to speak was Claudia Bruno. She stated
that she was opposed to the outsourcing of the recycle center. The next resident to speak was
June Wyant. She was opposed to closing/outsource of the recycle center. She stated that she
believes that if a company comes in and can make money at it so can the town. The last resident
to speak was Gary Lindstrom. He stated that one way to save money at the recycle center is to
outsource some of the man hours. He suggested hiring someone at a lower wage then what the
Highway employees are making.

Supervisor Gutzler stated that the Sports Museum is requesting to use the Chapel at Carnwath.

There is a letter of request in the correspondence log. Councilman Kuzmicz made a motion to
allow the use of the Chapel seconded by Councilwoman Czarniecki. All were in favor.

B. Energy Cost
George Ban, Senior Account Manager of Hudson Energy spoke to the board about energy and
the potential for saving money on energy. Hudson Energy is a supplier for energy that purposed
a reduced rate for energy and gas. He distributed the information to the board. He then fielded
questions from the board.

Public Comment
Anthony Costanzo asked for an explanation on how the Assessment Rolls will affect the property
taxes and how it will improve the quality of living. Christian Harkins, Tax Assessor, explained
the Rolls and charges to the residents. Al Roberts, Attorney to the Town, stated that the
resolution establishes how a particular property is going to pay its share of the bond indebt ness.
He added that it has been on the bills and if he had any objection to the bill he is to let the board
know at this time. Discussion continued.

RESOLUTION: 2012-286
Resolution Adopting Final Benefit Assessment Rolls for Special Improvement Districts and
Special Improvement Areas for Fiscal Year 2013
WHEREAS, the Town Assessor prepared proposed Benefit Assessment Rolls for all
now Special Improvement Districts and Special Improvement Areas in the Town of Wappinger for
Fiscal Year 2013 and said proposed Benefit Assessment Rolls were filed with the Town Clerk as
required by Town Law § 239; and
WHEREAS, in accordance with Town Law § 239, the Town Board duly noticed and
held a Public Hearing on October 22, 2012, to hear and consider any objections to the Benefit
Assessment Rolls for all Special Improvement Districts and Special Improvement Areas within
the Town for use in Fiscal Year 2013; and
WHEREAS, all interested persons were given the opportunity at the Public Hearing to
challenge or contest such benefit assessment determinations; and
WHEREAS, the Town Board has reviewed the proposed benefit assessment rolls for all
Special Improvement Districts and Special Improvement Areas within the Town for use in Fiscal
Year 2013 and has determined that they were prepared in proper order.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby adopts the Benefit Assessment Rolls as prepared by the
Assessor subject to any corrections made by this Board, as the final benefit
assessment rolls for all Special Improvement Districts and Special Improvement
Areas in the Town of Wappinger for Fiscal Year 2013.

RESOLUTION: 2012-287
Resolution Setting Public Hearing on Proposed Budgets, O&M Charges, Water/Sewer
Rates and Rents for Special Improvement Districts and Special Improvement Areas for
Fiscal Year 2013 and to Hear Any Objections Thereto
WHEREAS, the Town Board annually establishes budgets for the financing of all
Special Improvement Districts and Special Improvement Areas within the Town of Wappinger
for the ensuing year, and as part of the budget process the Town Board establishes Operation and
Maintenance Charges (O&M Charges), Rates and/or Rents, to be charged against those
properties within said Special Improvement Districts or Special Improvement Areas; and
WHEREAS, the Town Board has completed the proposed budgets and has established now
proposed quarterly O&M Charges, Rates and Rents to be charged against those properties within
said for the Special Improvement Districts and Special Improvements Areas for Fiscal Year
2013; and
WHEREAS, the Town Board, as required by Town Law, hereby schedules and orders a
Public Hearing for the purposes of hearing and considering any objections which may be made
to the aforementioned proposed budgets, and the proposed quarterly O&M Charges, Rates and
Rents for the Special Improvement Districts and Special Improvement Areas for Fiscal Year
2013.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby confirms that it has completed the proposed budgets for
Fiscal Year 2013 and has set proposed quarterly O&M Charges, Rates and Rents
to be levied against the properties within the Special Improvement Districts and

3. The Town Board hereby schedules a Public Hearing to be held at a regular
meeting of the Town Board on November 5, 2012 at 7:30 p.m. at Town Hall, 20

proposed quarterly O&M Charges, Rates and Rents to be levied against the

RESOLUTION: 2012-288
Resolution Directing a Public Hearing on Preliminary Budget
WHEREAS, the Town Supervisor, as Budget Officer, pursuant to Section 106 of the
Town Law has presented the Tentative Budget to the Town Board for review, examination and
possible revision; and
WHEREAS, the Tentative Budget for calendar year 2013 has been submitted to the
Town Board in accordance with Town Law § 106; and
WHEREAS, New York State Town Law § 108 requires that the Town Board must hold
a public hearing on the Preliminary Budget on or before the Thursday immediately following the
general election in November; and
WHEREAS, Town Law § 109 requires the adoption of a Final Budget on or before
November 20, 2012; and
WHEREAS, the Town Board has reviewed the Tentative Budget and has made changes
thereto deemed reasonable and appropriate and intends to adopt a Preliminary Budget as required
by Town Law;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger shall meet at Town Hall, 20
Middlebush Road, Wappingers Falls, New York on the 5th day of November,
2012 at 7:30 p.m. and then and there shall hold a Public Hearing upon the
Preliminary Budget.
3. The Town Board of the Town of Wappinger hereby determines that the salary of
elected officials listed in the attached Notice of Public Hearing are the salaries
included in the Preliminary Budget and to be published as required by New York
State Town Law § 108.
4. The Town Clerk of the Town of Wappinger shall give Notice of such Public
Hearing in the format attached hereto by publishing Notice thereof in the
Southern Dutchess News, the official newspaper of the Town of Wappinger, and
also in the Poughkeepsie Journal, at least five (5) days prior to the scheduled
Public Hearing and the Town Clerk shall cause a copy of said Notice to be posted
on the sign board of the Town no later than five (5) days before the scheduled
Public Hearing.

RESOLUTION: 2012-289
October 22, 2012
Order Calling Public Hearing in the Matter of Increase and Improvement of Facilities of
United Wappinger Sewer District, in the Town of Wappinger, Dutchess County New York
WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York,
has caused to be prepared a map, plan and report, including an estimate of cost, pursuant to
Section 202-b of the Town Law, relating to the increase and improvement of the facilities of the
United Wappinger Sewer District, in the Town of Wappinger, Dutchess County, New York,
being to pay the District's share of the cost of improvements to the Wappingers Creek Pump
Station located at the corner of Market Street and Franklindale Avenue in the Village of
Wappingers Falls, a facility of Tri -Municipal Sewer Commission, including original furnishings
equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in
connection therewith, at a maximum estimated cost of $385,000; and
WHEREAS, said capital project has been determined to be a Type II Action pursuant to
the regulations of the New York State Department of Environmental Conservation promulgated
pursuant to the State Environmental Quality Review Act, the implementation of which as
proposed, it has been determined will not result in any significant environmental effects; and
WHEREAS, it is now desired to call a public hearing on the question of the increase and
improvement of the facilities of said United Wappinger Sewer District, in the matter described
above, and to hear all persons interested in the subject thereof, concerning the same, in
accordance with the provisions of Section 202-b of the Town Law;
NOW, THEREFORE, IT IS HEREBYORDERED, by the Town Board of the Town
of Wappinger, Dutchess County, New York, as follows:
Section 1. A public hearing will be held at the Town Hall, in Wappingers Falls, New
York, in said Town, on November 5 2012, at 7:40 o'clock P.M., Prevailing Time, on the
question of the increase and improvement of the facilities of United Wappinger Sewer District,
in the Town of Wappinger, Dutchess County, New York, in the manner described in the

WHEREAS, on August 13, 2012 by Resolution 2012-219, the Town Board accepted the
Map, Plan and Report entitled "United Wappinger Water District (UWWD) Filtration System
Improvements and Meadowwood/Route 9 Water Main Loops, Town of Wappinger, Dutchess
County, New York" dated August 2012 prepared by Morris Associates PLLC for necessary
improvements to the UWWD, specifically including:
An interconnection with the Meadowood Wells to the UWWD, to construct a water main
loop that will connect to the recently constructed water main service in the Adams Fairacre

WHEREAS, the proposed action, consisting of filtration system improvements and the
water main loops, is subject to compliance with the provisions of the State Environmental
Quality Review Act and the regulations promulgated thereunder at 6 NYCRR, Part 617 (SEQR);
and
WHEREAS, the Proposed Action is a Type I action under the Wappinger Environmental
Quality Review (WEQR) law and a Determination of Significance has not yet been made with
respect to the Proposed Action; and
WHEREAS, in accordance with SEQR, the Town Board is the most appropriate agency
to serve as Lead Agency in the review of the "proposed action;
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Part 1 of the Full Environmental Assessment Form identifies the involved
agencies.
3. Part 1 of the Full Environmental Assessment Form shall be circulated to the

Resolution Awarding Contract for Little League Challenger Field Project Funded by
Community Development Block Grant
WHEREAS, the Town of Wappinger was granted a Community Development Block
Grant (CDBG) for the construction and installation of handicapped accessible improvements at
the Challenger fields at the Robinson Lane Sports Complex; and
WHEREAS, the base bid solicitation for the improvements provided from the
installation of an asphalt parking area, walkways, spectator areas and dugouts; alternate 1
provided for the installation of fifteen foot high ball stopper; alternate 2 provided for fine grading
and seeding of the field; alternate 3 provided for the installation of a clay transition path; and
alternate 4 provided for the installation of an additional spectator area; and
WHEREAS, by letter dated October 11, 2012, Greg W. Bolner, P.E. of Clark Patterson
Lee Design Professionals, reports that $80,000 of Community Development Block Grant funds
are available for construction of the project; and
WHEREAS, advertisements for bids for the construction and installation of handicapped

responsible bidder for the Base Contract with Alternate 1 in the amount of $78,275.00; and
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger determines that the contract for the
project described above should be awarded for the base project plus alternate
number 1.
3. The Town of Wappinger hereby awards the contract for the construction and
installation of handicapped accessible improvements at the Challenger fields at
the Robinson Lane Sports Complex to Sun Up Enterprises, Inc. in the amount of
$78,275.00 and directs the use of the Community Development Block Grant
funds to be applied towards the costs of the construction.
4. The Town Board hereby authorizes the Supervisor to execute the contract
documents as prepared by Clark Patterson Lee, and to issue the Notice of Award
and Notice to Proceed to Sun Up Enterprises, Inc. after the Attorney to the Town
has confirmed that Sun Up Enterprises, Inc. has signed the contract documents
and has supplied the necessary Performance Bond, Payment Bond and insurance
certificates as required by the bid specifications.

A. Councilwoman Czarniecki
Councilwoman moved to reinstate the Animal Control Officer, budget lines3510.100A and
3510.400 lines accordingly. She stated that she believes that it is required by law to have an
Animal Control Officer. She and the residents in her neighborhood have had to call on him.
Councilman Kuzmicz added that he believed that if the Town issues licenses they have to have a
Dog Control Officer. Councilman Bettina stated that there are Coyotes in Fleetwood and feels
the Town is in need of an Animal Control officer. He added he will provide the board with
pictures of the animal growling at the next meeting. He would like to have him look at them.

XII. New Business
A. Councilman Beale
Councilman Beale stated that he would like to continue to work together and explore option for
the Building and Grounds Department since it will be discussed at the next meeting.
Christine Fulton, Town Clerk questioned the Board as to whether or not her office should
continue to sell Recycle Center Permits through the end of the year. Councilwoman Czarniecki
stated that the sale of the permits should be continued. Councilman Bettina stated that he agreed,
although the resident should be made to understand that it will expire the end of December 2012
and there is a possibility of outsourcing the center. He feels that the RFP should include that the
vender will honor the permits. Councilman Beale stated that the sale of the permits should
continued and once the RFP's come back then the Board can give direction to the Clerk. Town
Clerk, Christine Fulton, stated that the clerk's office is informing the residents that the permits
are only good until the end of December 2012.Councilman Kuzmicz added that the permits are
budgeted for the rest of the year, to continue selling the permits and inform the resident that once
there is a decision made the residents will be informed.
B. Councilwoman Czarniecki
Councilwoman Czarniecki requested the Highway Superintendent, Graham Foster and the
Mo. Engineer to the Town, Bob Gray to go Carroll Dr and Scott Dr and look at possibly placing a
stop sign there. Councilman Beale questioned if the Town Patrol could be focused over there.
Supervisor Gutzler stated that the patrol needs to be split because there is an issue in the
Wildwood neighborhood. Councilman Kuzmicz added that if they are going to look at those
issues please look at Gold Rd and also Martz Field. Councilman Beale stated that a stop sign
cannot be used as a speed device and if there isn't police present, the stop sign will be of no
good. Discussion continued
C. Councilman Bettina
Councilman Bettina state that on Osborne Hill there have been break-ins. He asked for patrol in

RESOLUTION: 2012-294
Resolution Introducing "Local Law No. _ of the Year 2012, to Override the Tax Levy
Limit for Fiscal Year 2013 Established in General Municipal Law § 3-C"
WHEREAS, General Municipal Law § 3-c establishes limits on the amount of real property
taxes that may be levied by or on behalf of any local government thereby placing a "tax levy limit"
on municipalities; and Now
WHEREAS, a tax levy increase in excess of the General Municipal Law § 3-c limits may
be required for the Town of Wappinger because projected revenues for Fiscal Year 2013 are
projected to decrease substantially, in particular Dutchess County has announced that the sharing of
sales tax revenue will be reduced and that the Town of Wappinger will receive approximately
$200,000 less than it did in Fiscal Year 2012; in addition mortgage tax revenues are anticipated to
decline in 2013; and
WHEREAS, the Town Board has determined that the expenses in the Fiscal Year 2013
Budget are projected to increase while the revenues are projected to decrease which will require a
tax levy increase that is greater than that allowed by General Municipal Law § 3-c; and
WHEREAS, by adoption of this local law, the Town Board hereby intends to override the
limit on the amount of real property taxes that may be levied by the Town of Wappinger and
authorize the Town Board to adopt a budget for fiscal year 2012 in excess of the "tax levy limit" as
defined by General Municipal Law § 3-c; and
WHEREAS, the adoption of this local law is authorized pursuant to subdivision 5 of
General Municipal Law § 3-c, which expressly authorizes the Town Board to override the tax levy
limit by the adoption of a local law approved by vote of sixty percent (60%) of the Town Board;
and
WHEREAS, the local law to exceed the tax levy limit must be introduced and adopted
before the Fiscal Year 2013 Budget is finalized and approved if the Town Board is required to
exceed the tax levy limit; and
WHEREAS, this is a Type II action pursuant to 6 NYCRR § 617.5 (c) (20) and is otherwise
exempt from environmental review pursuant to the New York State Environmental Quality Review
Act ("SEQRA").
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board hereby introduces for adoption Local Law No. of the Year
2012 in the form annexed hereto.
3. The Town Board hereby determines that the aforementioned Local Law is a Type II
action as defined in 6 NYCRR § 617.5(c)(20) and, accordingly, the Town Board
hereby expressly determines that this action is not an action that requires review
pursuant to the provisions of the New York State Environmental Quality Review
Act ("SEQRA").
4. The Town Board hereby schedules a Public Hearing on the Proposed Adoption of
Local Law No. of the Year 2012 to be held at Town Hall, 20 Middlebush
Road, Wappingers Falls, New York on the 5th day of November 2012, at 7:30
p.m., and the Town Clerk is directed to post the Notice of the Public Hearing in
the form annexed hereto and to publish same in the Southern Dutchess News and
the Poughkeepsie Journal as required by law.
