Supervisor Ruggiero noted for the record that Councilman Bettina had sent notification
that he would not be able to attend this Meeting as he has a family member undergoing
emergency testing in the hospital.
II. Presentation of Certificates
Presentation of Awards
Supervisor Ruggiero presented awards to members of the Town of Wappinger Little
League Softball 13-14 year old All-Star Team. The team won the District 17 Championship this
past summer. The awards were presented to: Rachel Albertelli, Gina Cantarella, Marlene
Cuevas, Jessica Dorien, Casey Herzog (not present), Alex Pagan, Victoria Pippa and Allison
WMW Sim.

Councilman Paoloni Statement
Councilman Paoloni thanked the Town Clerk, Chris Masterson, for his hard work on
compiling the verbatim Minutes of January 27th, 2007.
V. Discussion
Recreation Field Usage - Refunds
Supervisor Ruggiero opened the discussion at 7:48 PM. The Town Comptroller has
submitted a memo to the Town Board regarding recreation field usage. Over the summer, an
outside organization reserved ball fields at Robinson Lane and paid the reservation fee. Three
days prior to the event, the organization decided to cancel the event due to lack of participation.
They are now asking for a refund of their deposit. Nonnally, the Town's fees are non-
refundable. The Comptroller is asking for direction and clarification of what the policy is.
Councilwoman McCarthy asked if there is anything in writing when people book a field.
Supervisor Ruggiero asked Ralph Holt, Recreation Chairman, if there was a "no refund" clause
on the application. Mr. Holt was not sure.
Councilman Beale asked how often businesses reserve the ball fields. Mr. Holt replied
that they are reserved all summer long. Supervisor Ruggiero asked if they pay up front. Mr.
Holt replied that they do not. There is no consistent policy on how recreation handles these
requests. Councilwoman McCarthy commented that it would be a good idea to draft a "non-
refundability" clause. She doesn't have a problem with this particular instance because there
were no other requests for the fields and there is no clause in place. Councilman Beale added
that there needs to be standards. Before refusing a refund, the standardized procedures should be
in place.
Councilman Paoloni noted that this was why he made a motion on October 9th asking for
a field utilization study. He went out to see the soccer fields after the rain store from the night
before and the fields were in great condition. He also went out to Robinson Lane to find that 6
out of 15 fields were not being used. He has no problem with refunding the deposit in the
absence of a contract and in the absence of data that the fields are in high demand. In addition to
the contract that Mr. Holt has been asked to draft, he would like to see the field utilization study.
He also recommended putting a full-time employee in the budget to manage the Town's fields.
Councilman Beale asked if Mr. Reich planned on reserving the fields at a later time.
Supervisor Ruggiero answered that he has not expressed that intention. Also, it would be better
to refund it now so that it doesn't cart' over into the new fiscal year.
Supervisor Ruggiero again asked Mr. Holt to develop the policy and submit it to the
Board. Councilman Paoloni asked when he would be receiving the field utilization study.
Supervisor Ruggiero replied that it was submitted and the Councilman should have received it.
Councilman Beale made a motion to reimburse Victor T. Reich, the General Manager of
Extra Innings-Wappinger, for his rental fee deposit of $500.00. The motion was seconded by
Councilwoman McCarthy and passed unanimously. The discussion was then closed at 7:57 PM.

VI. Resolutions
RESOLUTION: 2007-225
Resolution Introducing Local Law No. _ 2007, Authorizing a Real Property Tax
Exemption for Cold War Veterans Pursuant to RPTL §458-13
WHEREAS, the New York State Legislature, pursuant to the Laws of 2007, Chapter
655, has created a new section of the Real Property Tax Law by adding section 458-b entitled
"Exemption for Cold War Veterans"; and
WHEREAS, the Town Board has detennined that Cold War Veterans, as defined in
*own RPTL § 458-b, have made a significant contribution to their country, our community, and to the
Town of Wappinger and that it is appropriate to grant the additional real property tax relief as
authorized by RPTL § 458-b to such Cold War Veterans; and
WHEREAS, the Town Board has determined that it is in the best interest of the Town
and of the citizens of the Town of Wappinger to amend Chapter 221 "Taxation" of the Town
Code by creating a new Article therein in order to implement the broadest possible tax
exemptions for Cold War Veterans as authorized by § 458-b of the Real Property Tax Law; and
WHEREAS, this is a Type II action pursuant to 6 NYCRR 617.5 (c) (20) or Local Law
No. 6 of 1992 of the Town of Wappinger and the adoption of this Local Law is otherwise exempt
from environmental review.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby introduces for adoption Local Law No._ of 2007 in the
form annexed hereto.
3. The Town Board hereby determines that the enactment of the aforementioned
Local Law is a Type 1I action as defined in 6 NYCRR 617.5 (c) (20), or Local Law No. 6 of
1992 of the Town of Wappinger, and, accordingly, the Town Board hereby expressly
determines that the adoption of this Local Law is not an action that requires review pursuant to
the provisions of New York State Environmental Quality Review Act (SEQRA) or pursuant to
Local Law No. 6 of 1992 or pursuant to 6 NYCRR Parts (617).
4. The Town Board hereby schedules a Public Hearing on the Proposed Adoption of
"no Local Law No. of 2007 to be held at Town Hall, 20 Middlebush Road, Wappingers Falls,
New York on the 13t1i day of November, 2007, at 7:30 p.m., and the Town Clerk is directed to
post the Notice of the Public Hearing in the form annexed hereto and to publish same in the
Southern Dutchess News and Poughkeepsie Journal as required by law.

RESOLUTION: 2007-226
Resolution Naming the Roads in Maloney Heights Subdivision
.... WHEREAS, there are two roads located in the Maloney Heights Subdivision in the
Town of Wappinger without names; and
WHEREAS, it is important to name this road in order to assist emergency personnel
with location; and
WHEREAS, Amy Bombardieri of M. Gillespie and Associates has proposed to name the
main road into the subdivision "Rana Lane" and the private drive for three lots "Jimmy Lane";
and
WHEREAS, the Town Board has decided to name the main road into the subdivision
"Rana Lane" and the private drive for three lots "Jimmy Lane" pending approval from Dutchess
County 911; and

WHEREAS, Jim Tompkins, Program Assistant for Dutchess County Emergency
Response, has determined that there are no conflicts with the names "Rana Lane" and "Jimmy

WHEREAS, Mark Liebermann, Fire Inspector for the Town of Wappinger Fire
Prevention Bureau, finds no conflicts within the Town with the names "Rana Lane" and "Jimmy
Lane"
NOW, THEREFORE, BE IT RESOLVED, the Town Board authorizes fonnally
naming the main road into the Maloney Heights Subdivision "Rana Lane" and the private road to
three lots "Jimmy Lane."

Resolution Designating Depository for the Town of Wappinger
WHEREAS, Putnam County Savings Bank, Orange County Trust, Bank of America,
Citizen's Bank, TD Bank North, Mahopac Bank, JP Morgan Chase and M&T Bank, each being a
banking institution maintaining banking rooms and offices in Dutchess County, New York, had
been designated as depositories of the monies of this Town during the reorganization meeting on
January 1", 2007.
BE IT RESOLVED, that HSBC Bank, being a banking institution maintaining banking
rooms and offices in Dutchess County, New York, be and hereby is designated as a depository of
the monies of this Town; and
BE IT FURTHER RESOLVED, that the Town Clerk be and he hereby is directed to
give notice to said banking institution.

RESOLUTION: 2007-228
Resolution Accepting a Performance Agreement Secured by Letter of Credit, Deed and
Conservation Easement in Connection with BRH Realty Subdivision
WHEREAS, Phantom Hollow Equities, Inc. has made application to the Town of
Wappinger Planning Board to approve a subdivision of lands more particularly described in a
Subdivision Plat entitled "Subdivision for BRH Realty" prepared by Richard G. Barger last
revised July 10th, 2007; and
WHEREAS, the Town of Wappinger Planning Board granted Final Subdivision Plat
Approval, by Resolution dated September 5tl', 2007 subject to and conditioned upon completion
of the conditions set forth in the aforementioned Resolution, and subject to certain improvements
being made and constructed as set forth in the aforesaid Subdivision Map and related Contract
drawings, all in accordance with the Town of Wappinger Subdivision Regulations, Zoning Code,

Highway Specifications, and Rules and Regulations of the Town, and further subject to the
requirements set forth in the letter of Paggi, Martin & Del Bene, LLP, Engineer to the Town,
dated September 101h, 2007 together with the Schedule of Bond Values; and
WHEREAS, Town Law §277 requires a developer of a proposed subdivision to
guarantee the construction, installation, and dedication of the improvements required by the
Resolution of Subdivision Approval, prior to issuance of any building permits; and
WHEREAS, to secure the obligation to guarantee the construction, installation and
dedication of the required public improvements and obligations set forth in the above referenced
Resolution of Subdivision Approval, Richard G. Barger, President of Phantom Hollow Equities,
Inc., has executed a Perfonnance Agreement dated October 10`', 2007 Secured by a Letter of
Credit issued by M&T Bank No. SB -910912-2000 in favor of the Town of Wappinger as
r.. security for the perfonnance of the obligations set forth in the Perfonnance Agreement; and
WHEREAS, Richard G. Barger, BRH Realty and/or Phantom Hollow Realty Corp.
hereby agrees to make, construct and complete the improvements and agrees to perform all of the
obligations set forth in the Subdivision Regulations, Highway Specifications, and Zoning Law of
the Town of Wappinger, including road maintenance and snow removal in accordance with the
standards maintained by the Town of Wappinger Highway Department and at the direction of the
Town of Wappinger Highway Superintendent, in accordance with the Resolution of Final
Subdivision Plat Approval adopted by the Planning Board on September 5th, 2007, and the letter
of Paggi, Martin & Del Bene, P.C., the Engineer of the Town, dated September 10`', 2007, and
further in accordance with the local laws, ordinances, rules and regulations of the Town of
Wappinger within two (2) years from the date hereof; and
WHEREAS, upon construction and completion of the required improvements and
obligations set forth above and upon request of the Town, the undersigned will dedicate same to
the Town of Wappinger, free and clear of any liens or obligations as set forth in the local laws,
ordinances, rules and regulations of the Town of Wappinger; and
WHEREAS, Richard G. Barger has agreed to secure the obligations as set forth herein
by executing a Perfonnance Agreement Secured by the aforementioned Letter of Credit in the
sum of Ninety Four Thousand, Eight Hundred Dollars ($94,800.00) in favor of the Town of
Wappinger; and
WHEREAS, the Performance Agreement executed by Richard G. Barger further binds
his hiers, executors, administrators, successors or assigns for the faithful perfonnance of his
obligations hereunder; and
am. WHEREAS, Richard G. Barger by execution of the Perfonnance Agreement
acknowledges that if any default remains in the performance of the obligations created under the
ten -ns and conditions of the Performance Agreement, the lots within the Subdivision will no
longer be eligible for Building Pen -nits until such default is cured.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby determines that the Performance Agreement as
personally guaranteed by Richard G. Barger and secured by Standby Letter of Credit issued by
M&T Bank in the sum of Ninety Four Thousand, Eight Hundred Dollars ($94,800.00), securing
the obligations to guarantee the construction, installation and dedication of the required public
improvements is acceptable and sufficient to guarantee the work required by the Performance
Agreement.
3. The Town Board hereby accepts the Performance Agreement Secured by a
Standby Letter of Credit issued by M&T Bank No. SB -910912-2000 in the total sum of Ninety
Four Thousand, Eight Hundred Dollars ($94,800.00) in favor of the Town of Wappinger,
executed by Phantom Hollow Equities, Inc., and personally guaranteed by Richard G. Barger as
security for the faithful perfonnance of the obligations secured by and set forth in the
Perfonnance Agreement.
4. The Town Board hereby accepts title to the extensions for Ada Drive and Eck
Road and authorizes the Supervisor and Attorney to the Town to take any necessary steps to have
,n, the deed recorded in the Dutchess County Clerk's Office simultaneously with the filing of the
Subdivision Map.
5. The Town Board further authorizes the recording of the Conservation Easement
simultaneously with the filing of the Subdivision Map and authorizes the Supervisor to sign
same.

VII. New Business
1. Councilman Beale New Business
Councilman Beale had a conversation with the Town Engineer regarding residents that
were asking for municipal water on Pleasant Lane. He will discuss that matter with the Town
Engineer at a later time.
2. Councilwoman McCarthy New Business
Councilwoman McCarthy asked for a follow-up on her question about street lights on
Schnabl Court. Supervisor Ruggiero asked the Town Board's legislative aide if he has heard
back from Central Hudson. The legislative aide, Dan Passes, replied that he has been calling but
hasn't heard back.
3. Councilman Beale New Business
Councilman Beale mentioned an issue regarding a street light on Steinhaus Lane. A
family that lives there has informed Councilman Beale that the Town had planned on putting a
street light at the cul-de-sac. Supervisor Ruggiero discussed the process of getting a street light
put on a street. Discussion followed.

1. Recreation/Senior Center/Comptroller/Assessor
RESOLUTION: 2007-229
Resolution Approving Preliminary Budget for Fiscal Year 2008 and Directing a Public
Hearing Thereon
WHEREAS, the Town Supervisor, as Budget Officer, pursuant to Section 106 of the Town Law
has presented the Tentative Budget to the Town Board for review, examination and possible revision; and
WHEREAS, the Town Board has reviewed salve and has made changes thereto deemed
reasonable and appropriate.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. Pursuant to and in accordance with the provisions of Section 106 of the Town Law, and
other applicable provisions of law, the annexed detailed statement of estimated expenditures and revenues
is hereby approved and adopted as the Preliminary Budget of the Town of Wappinger for the fiscal year
beginning January 1", 2008.
3. The Preliminary Budget adopted herein shall forthwith be tiled in the Office of the Town
Clerk in the Town of Wappinger where it shall be available for public inspection.
4. The Town Board of the Town of Wappinger shall meet at Town Hall, 20 Middlebush
Road, Wappingers Falls, New York on the 8"' day of November, 2007 at 7:30 p.m. and then and there
shall hold a Public Hearing upon such Preliminary Budget.
5. The Town Clerk of the Town of Wappinger shall give Notice of such Public Hearing in
the format attached hereto by publishing Notice thereof in the Southern Dutchess News, the official
newspaper of the Town of Wappinger, and also in the Poughkeepsie Journal, at least five (5) days prior to
the scheduled Public Hearing and the Town Clerk shall cause a copy of said Notice to be posted on the
sign board of the Town no later than five (5) days before the scheduled Public Hearing.
6. This Resolution shall take effect immediately.

Resolution Authorizing Public Hearings to Hear Objections to the Proposed Budgets for
the Financing of Certain Special Improvement Districts and Special Improvement Areas as
Well as Establishing the Quarterly Operations and Maintenance Charges and/or Rents for
Calendar Year 2008
WHEREAS, the Town Board annually establishes the budgets for the financing of all
Special Improvement Districts and Improvement Areas and the charges to be levied against those
properties within said Special Improvement Districts or Special Improvement Areas for each
calendar year ensuing; and
WHEREAS, the Town Board annually establishes Operation and Maintenance Charges

Improvement Areas for calendar year 2008, and, also for hearing and considering any objections
to the Quarterly Operation and Maintenance Charges and/or Rents to be levied against those
