of the Supreme Court, Third Judicial Department,
has rendered a decision which is of importance to
every town in the State. Miss Eliza B. Mack, of
the town of Sbawangunk, while returning from a
party on the night of February 4, 1943, drove off the
side of a brides on which it is declared there were
no guaxd rally. She sustained injuries, and on
suing the town of Shawangunk received a verdict of,
$5,000. This verdict the trial court refused to set
aside, and' an appeal was taken to the Appellate �
77ivision, which unanimously, reversed the judgment
of

along a highway which is practically straight goes
off "a bridge which is 13 feet wide and only 9 feet
between abutnipnts the Commissioner of Highway
