Resolution Awarding Bid for United Wappinger Water District Water Main Extension to
NYC DEP Shaft 6
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on February
25, 2013.
The meeting was called to order by Barbara Gutzler, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilman Beale and seconded by
Councilman Bettina.
WHEREAS, by Resolution No. 2012-282 adopted by the Town Board on October 9,
2012, the Town Board approved the Establishment of Extension No. 2 to the United Wappinger
Water District (UWWD) in connection with the installation and construction of a 12 inch water
main from a point of connection with UWWD to the NYC DEP Shaft 6 site; and
WHEREAS, bids and specifications were prepared by Robert J. Gray of Morris
Associates, Engineer to the Town, for the work required for the installation and construction of a
12 inch water main from a point of connection with UWWD to the NYC DEP Shaft 6 site; and
WHEREAS, bids were duly solicited for the work to be done and the following bids
were received on January 22, 2013:

WHEREAS, by letter dated February 20, 2013 from Morris Associates Engineering
Consultants, PLLC, the Engineers to the Town determined that the alternate bid amount should
be selected; and
WHEREAS, by letter dated February 20, 2013 from Morris Associates Engineering
Consultants, PLLC, Engineers to the Town, have determined that the lowest responsible bidder is
W.M. Shultz Construction, Balston Spa, NY, with a base bid in the amount of $4,202,635 and an
alternate bid in the amount of $4,229,530.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town of Wappinger hereby awards the bid for the installation and
construction of a 12 inch water main from a point of connection with UWWD to
the NYC DEP Shaft 6 site to W.M. Schultz Construction, Balston Spa, NY, in the
alternate bid amount of $4,229,530.
3. In accordance with the authorized bid specifications, the Town Board hereby
authorizes the Supervisor to execute the contract documents as prepared by
Morris Associates, including the Notice of Award and Notice to Proceed and
forward a copy to W.M. Schultz Construction, after the Attorney to the Town has
confirmed that W.M. Schultz Construction, has duly executed the contract
documents, has supplied the necessary Performance Bond, Payment Bond and
provided insurance certificates all as otherwise required by the bid specifications.
The foregoing was put to a vote which resulted as follows:

This office reviewed the bid of the apparent low bidder, W.M. Shultz Construction. Following
review of the attached bid form, this office requested additional information on related project
experience, financial information, owned equipment, proposed subcontractors, and

references listed as contacts for 5 related projects.

W.M. Schultz has worked on a number of similar water distribution main projects in the past
and appears to be qualified to complete the work required for this project. The responses from
the references contacted were also favorable.
While the Alternate Bid has a slightly higher construction cost than the Base Bid, it will
require fewer easements, which will prevent any delays in starting the construction of the project
and avoid any additional costs associated with acquiring these easements. It is therefore
recommended that the Town of Wappinger award the Altemate Bid. Based on our review of
WM Shultz Construction, Inc.'s bid and supporting documentation, we recommend that the
Town of Wappinger awards the Altemate Bid To W.M. Schultz, Construction, Inc. in the contract
amount of $4,229,530.00.
