Resolution Adopting "Local Law No. —of the Year 2013, Designating Four -Way Stop
Intersection at the Western Intersection of Scott Drive and Carroll Drive"
WHEREAS, a Resolution was duly adopted by the Town Board of the Town of
Wappinger introducing a proposed Local Law entitled "Local Law No. of the Year 2013,
Designating Four -Way Stop Intersection at the Western Intersection of Scott Drive and Carroll
Drive" for consideration of adoption by the Town Board; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News, the
official newspaper of the Town, and the Poughkeepsie Journal; and
WHEREAS, a Public Hearing was held on February 25, 2013 and all parties in
attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed
Local Law or any part thereof; and
WHEREAS, the Town Board determined that the proposed Local Law was not subject to
environmental review; and
WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds

that it is in the best interest of the Town to adopt said Local Law; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board

NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger hereby adopts the Local Law entitled
"Local Law No. 7 of the Year 2013, Designating Four -Way Stop Intersection at the
Western Intersection of Scott Drive and Carroll Drive", a copy of which is attached
hereto and made a part of this Resolution.
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting
into the Local Law book for the Town of Wappinger and to give due notice of the
adoption of said Local Law to the Secretary of State of New York.
4. Highway Superintendent, Graham Foster, is hereby further directed to place stop
signs at the appropriate locations in accordance with this Local Law and to take
any other necessary actions to implement the above mentioned four-way stop
intersection as required in accordance with the spirit and intent of this Local
Law.

RESOLUTION: 2013-90
Introducing "Local Law No._ of the Year 2013, Noise Control Law of the Town of
Wappinger"
WHEREAS, excessive sound is a public nuisance which is disruptive of the peace and
quiet, and which impairs the health, safety, welfare and quality of life of the residents of the Town
of Wappinger; and
WHEREAS, the residents of the Town have a right to, and should be ensured of, an
environment free from sound pollution so it is in the best interest of the Town to enact a noise
control law to prohibit excessive sound that may disrupt and degrade the quality of life and that may
jeopardize the health, safety and welfare of its citizens; and
WHEREAS, the Town Board has determined it is necessary to set standards for
unreasonable and prohibited noise; and
WHEREAS, the Town Board has determined that the Proposed Action is a Type I action
pursuant to Article 8 of the Environmental Conservation Law and 6 NYCRR 617.4(b)(9)
(commonly known as "SEQRA") and pursuant to Local Law No. 6 of 1992 (the Town's
Environmental Quality Review Law); and
WHEREAS, the Town Board has determined that the proposed Local Law is an action
for which there are no other Involved Agencies and the Town Board is therefore, by default,
Lead Agency for this action.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board hereby introduces for adoption Local Law No. of the Year
2013 in the form annexed hereto.
3. The Town Board hereby declares itself as Lead Agency for purposes of SEQRA
review.
4. The Town Board has caused to be prepared a Full Environmental Assessment
Form for purposes of review of the SEQRA action and the Town Board will defer
making a determination of significance until after public comment is received on
the proposed Noise Control Law.
5. The Town Clerk is direct to submit a copy of the Proposed Noise Control Law to
the Dutchess County Department of Planning pursuant to GML § 239-m.

WHEREAS, bids and specifications were prepared by Robert J. Gray of Morris
Associates, Engineer to the Town, for the work required for the installation and construction of a
12 inch water main from a point of connection with UWWD to the NYC DEP Shaft 6 site; and
WHEREAS, bids were duly solicited for the work to be done and the following bids

be selected; and

Consultants, PLLC, Engineers to the Town, have determined that the lowest responsible bidder is
W.M. Shultz Construction, Balston Spa, NY, with a base bid in the amount of $4,202,635 and an
alternate bid in the amount of $4,229,530.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town of Wappinger hereby awards the bid for the installation and
construction of a 12 inch water main from a point of connection with UWWD to
the NYC DEP Shaft 6 site to W.M. Schultz Construction, Balston Spa, NY, in the
alternate bid amount of $4,229,530.
3. In accordance with the authorized bid specifications, the Town Board hereby
authorizes the Supervisor to execute the contract documents as prepared by
Morris Associates, including the Notice of Award and Notice to Proceed and
forward a copy to W.M. Schultz Construction, after the Attorney to the Town has
confirmed that W.M. Schultz Construction, has duly executed the contract
documents, has supplied the necessary Performance Bond, Payment Bond and
provided insurance certificates all as otherwise required by the bid specifications.

RESOLUTION: 2013-92
Resolution Authorizing Execution of a License Agreement with Central Hudson Gas &
Electric Corporation in Connection with Construction of Water Main by United
Wappinger Water District
WHEREAS, the Town of Wappinger, by and on behalf of the United Wappinger Water District
(UWWD), has entered into an Inter -Governmental Agreement (IGA) with the New York City Department
of Environmental Protection (DEP) dated September 25, 2012 for the construction of a 12 inch water

main from a point of connection with the UWWD water system on Old Hopewell Road and Route 9 to
the DEP site located in the Hamlet of Chelsea, Town of Wappinger; and
WHEREAS, the Town Board has formally authorized the extension of the UWWD to the DEP
site located in the Hamlet of Chelsea, Town of Wappinger; and
WHEREAS, the Engineer to the Town, Morris Associates Engineering Consultants, PLLC
(Morris Associates), has designed the route of the pipe to the DEP site which route requires the
acquisition of several easements; and
WHEREAS, the Town Board has previously authorized the Town Supervisor, Barbara A.
Gutzler, the Engineer to the Town, Morris Associates, and the Attorney to the Town, Albert P. Roberts,
to acquire all required and necessary easements; and
WHEREAS, terms have been negotiated to enter into a License Agreement with Central
Hudson Gas & Electric Corporation (CHG&E) in order to have access to, and use of, a specific
portion of the CHG&E Easement Area for the sole purpose of constructing and installing the
Water Main; and
WHEREAS, the Attorney to the Town has prepared a form of a License Agreement which
includes the terms and conditions agreed upon by CHG&E, a copy of which form of License Agreement
is attached hereto as Exhibit "I"; and
WHEREAS, the form of License Agreement approved by CHG&E references documents which
have been recently recorded in the Dutchess County Clerk's Office however, the recorded instruments
have not yet been returned to the Town and accordingly, the recording information will have to be
inserted in the License Agreement when such information is received.
NOW, THEREFORE, BE IT RESOLVED, as follows:

RESOLUTION: 2013-93
Resolution Reappointing Christian Harkins as Joint Assessor
WHEREAS, by Resolution No. 2007-164 adopted on August 27, 2007, the Town Board
appointed Christian Harkins as Joint Assessor for the Town of Wappinger pursuant to the
Coordinated Assessment Program at a salary of $75,000.00, pursuant to the Agreement between
the Town of Wappinger and the Town of Fishkill; and
WHEREAS, the Assessor's appointment is scheduled for reappointment effective
October 1, 2013.
NOW, THE BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. Christian Harkins is hereby reappointed to the position of Joint Assessor pursuant
to Local Law No. 8 of 2006 of the Town of Wappinger, and pursuant to the
Coordinated Assessment Agreement between the Towns of Wappinger and
Fishkill, dated December 28, 2006.
3. The salary of Christian Harkins is hereby set at $95,000.00, as it may be adjusted
from time to time hereafter, together with three weeks vacation, pursuant to the
Coordinated Assessment Agreement between the Town of Wappinger and the
Town of Fishkill.
