It should be understood that groups using the Buildings' Facilities for evening meetings must select dates when
Town Meetings are normally scheduled (i.e., Justice Court, Planning Board, etc.) Special requests will be
considered upon their own merit, and arrangements can be made for access to, and closing, the building at the close
of your meeting.
You and your Organization hereby agree to adhere to the rules set forth on the attached page by signature of an
authorized member of your Organization or group.
The Town of Wappinger reserves the right to suspend temporarily this agreement should the Town have need of the
facility for its own purposes. Advance notice will be given as soon as possible on such occasions.
The Town Clerk should be informed promptly of any schedule change or cancellation of your group activities.
Arrangements for access to specific area to be used should be made with the Town Clerk at the time this form is
submitted.
No application shall be considered approved until it has been submitted to the Town Clerk for review and
Clearance.

Terms of the agreement must be strictly adhered to by the contracting group as any disregard or abuse of the rules
for use of the facilities will result in termination of use by the offending group, and they will not be granted
reinstatement.
I have read and understand the rules and regulations for the use of the Facilities in the Town of Wappinger Town
Hall, and will comply with these requirements.

Chapter Liability
SCARE chapters and branches often use space at locations a«•ned by tl~~. Chambzr of
Commerce, Iibraries, churches, ban]tis anal other orgaruzatians. C)ccasianalty l~{nd:lorcls or
ov~rners of these properties ti~-i1l ask for a certificate of insurance from the chapter. Their
want to kna~v if they are protected should a claim arise ii'on~ an injured party.
SCf.7RE chapters da not have national liability insurance. Ta satisfy the landlc>rd,
chapters have a couple of options. Chapters can purchase liability insurance therrisclves.
This is a legitimate chapter expense and cau be reimbursed against the chtapter budg~a. L.f
chapters are residing daily in a location requiring liability insurance, this may be
necessary.
If the request comes from a landlord. ar host for a location used occasionally, chapters
should ask to be added to the Iandiard or hosts insurance policy. This should be a
nominal cost to the chapter because fh.e space and tune of usz would both be limited.
SCCIRE chapters can not agree to bald the landlord harmless.

This article addresses, and hopefully resolves; any possible concern of SCOR:F members, inrludin th~:, of;icers
of the SCO1tE Association and its subsidiary chapters_ as to wiaether they have personal liability Ilrotectian
against tart claims by people dealing with SCORE. These claims might arise from counseling, workshops; an
alleged defect in the SCORE premises, ar from any other alleged actaan or inactior: Irv 2 Sc:.C)RE Volunteer.
Rc:cogttizing the valuable contribution that SCORE members make to the small business u~mmt!nity. i::onnrc ss,
under the Small Business Act, granted SCORE volunteers the same protectiar. fiom tort clairns gie en to federal
employees. The Act states the basic legislation auti-,orizing the val:u^.teer St:.ORE program and that SCORE
volunteers are deemed to be federal employees far purposes of the Federal'I'ort Claims Act (FTC.;.
Under the FICA, the federal gaverrrment permits itself to be sued when people claim they were dataged h~• the
negligent or wrongful acts of federal employees. With three general exceptions, SCORE meniaers .viii not be
subject to ciVril claims or lawsuits arising from SCORE activities, and will not be held liable for pay ini?
monetary damages, even if they camrnitted the alleged tort. The federal eavemmer;t will defend t'ilr sC.r.~r.~.

Three C;etteraE Exceptions
The member is found to have comnutted the tort while acting outside the scope of SCORE aeti~~ities. For
example, if the tort is committed with such malice or intent to injure, or the actior< was taken with such cross
negligence as m be considered willful, the member may be found not to be working far SCORE. The C3.S.
gavemrnent believes that in these instances, federal employees (and SCORE members} should be persanall~/
responsible far the resulting damages.
The member is found to have committed a constitutional tart. A constitutional tort is a v;rong committed. in
violation of one or more of the fundamental rights found in the U.S. Constitution. It is ver}~ unlikely that any
constitutional torts would be committed by SCARE members in the course of their SCORE work.
The member acted contrary to a specific statute that allows a ~ derai employee (or SCORE me::,ber) to be
personally liable for the tort, nattivithstanding the FTCA. I know of no such specific statutes at this time that are
applicable to SCORE members.
As of this date, I knave of no tort clai-n against a SCORE member arising from the perfor maace of SCORL
work. However, if there is an incident that might create the basis far a claim against ar inval~ring a SC;C)ftr.
member, or notice of a claim is given ar threatened the chapter chair, the district director and CEO of SC::ORE
should promptly be natitied. If the claim is directly against the director, native should be given to the CEC). In
addition, the SCORE member against whom the tort claim is made should promptly refer it to tl:e closest SBA
district counsel; or directly to the SBA. associate general counsel far litigation at 409 3rd Street, S.W., Seventh
Floor, Washington, DC 20416.
There maybe other bases far liability by members, such as an unavoidable breach of a cantr~ct entered into b~ a
member in the course of SCORE work ar for property loss, such as damage to a member's vehicle rvhilc
traveling to or from SCORE work. 4'~'hile these situations are nai covered by the FTCsA, they are covered b~ the
Small Business Act, which authorizes the reimbursement to volunteers "far all necessary out-af-pocket expenses
incidental to *.heir provision of sen-ices under tlvs Act ...and, while They are carrying out such. activities a•~xa_y
