Public Comment
Supervisor Gutzler opened the floor for public comments. The first resident to speak was Mary
Schmalz. She reminded that in 2011 the community day fire works had a poor turn out. Last year
when community day was in July, although the turn out for community day was low people did
come back for the fire work. She suggested to have the fire works separate from community day.
She feels that if the fireworks are coordinated with the July concert serious it would be better
since people think of fourth of July and fireworks.

VIII. Discussions
A. Cornell Cooperative Extension Presentation
Carolyn Klocker, Senior Water Resource Educator, from Cornell Cooperative Extension
Dutchess County distributed material to the board in regard to the Hudson Estuary Watershed
Resiliency Project. She stated that the Hudson Estuary Watershed Resiliency Project is a
combination of research, demonstration, and educational outreach projects to address the
challenges of flooding, stream and watershed management, and climate change. The focus is on
flood resiliency and climate change and is intended to assist communities in reducing flood risks
and start planning for future increase participation. She explained that they are in the first stage
of the project, which is informing the communities of the project. She invited the board to attend
the training sessions and presentations that are offered. She then requested input from the board
as to the communities educational needs. Councilman Beale's concerns are the debris that comes
down to the lower creek that can cause a hazard to people in the creek. Councilwoman
Czarniecki stated that the Town will be having a roads and parks clean up. In order to get people
aware she would like to work together. Councilman Kuzmicz concerns were the flooding on
Patty Place and Joan Lane. He requested help in that area. Discussion continued.

WHEREAS, there is now pending in the Dutchess County Supreme Court a tax
certiorari proceeding commenced in 2012 by NES Rentals, regarding property located at 20 All
Angels Hill Road, bearing Grid # 6259-04-503105-0000 seeking a reduction in the 2012 tax
assessment for the respective tax roll; and
WHEREAS, the Town Assessor and Special Counsel have recommended a settlement of
these tax review proceedings;
NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of
Wappinger hereby approves a settlement on behalf of the Town of Wappinger of the tax review
proceeding for the year 2012, as it pertains to Grid # 6259-04-503105-0000:

RESOLUTION: 2013-119
Resolution Authorizing Temporary Borrowing from the United Wappinger Sewer
Operational Account
WHEREAS, by Resolution 2012-332 dated December 10, 2012, the Town Board
authorized the issuance of $385,000.00 in Serial Bonds to be issued by the Town to pay for the
increase and improvement of the facilities of the United Wappinger Sewer District (UWSD) in
connection with certain improvements required at the Wappinger Creek Pump Station which
serves the Tri -Municipal Sewer Plant; and
WHEREAS, the Accountant to the Town has advised the Town Board that there are fund
balances within the United Wappinger Sewer Operational account which could be temporarily
loaned to pay for the first round of improvements to the Wappinger Pump Station.
NOW, THEREFORE, BE IT RESOLVED, as follows:

1. The recitations incorporated above set forth are incorporated in this Resolution as
if fully set forth and adopted herein.
2. The Town Board, rather than go through the expenses of issuing bonds to fund the
payment of initial costs of the first round of improvements to the Wappinger
Pump Station, the Town Board hereby authorizes the Supervisor to temporarily
borrow up to $385,000.00 from the United Wappinger Sewer Operational account
to pay a portion of Wappinger's share of the improvements to the Wappinger
Pump Station.
3. The Town Board directs that any funds temporarily borrowed from the United
Wappinger Sewer Operational account shall be reimbursed to said United
Wappinger Sewer Operational account prior to December 31, 2013 together with
interest at the rate of .3% per annum pro -rated to date of payment.

for the 2013 season for various parks in the Town of Wappinger; and
WHEREAS, advertisements for bids for Port -a -Johns were duly published and the
following bids were received:

office located at 88 Grove Street, Cairo, New York 12413, in the amount of $5,271.00 for the
2013 season, a copy of which is affixed hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:

Minutes
April 8, 2013
Councilman Kuzmicz wanted to remind the community of the Little League opening day this
Saturday.
B. Councilman Beale
Councilman Beale stated that the Library district passed. He then stated that the water line
running through his district is in the ground and will be a big asset to the town. He commended
Schultz Construction on their work and professionalism. Then next item he discussed was the
timber Harvesting off of Fowlerhouse Road on a 60 acre parcel. He stated that they are
consistent with the town code and have filed in the Town Clerks office. Supervisor Gutzler stated
that she had talked to the director of Midhudson Forest project and had suggested to him to
notify the residents even though it is not required. Which she believes he has done. The last item
he discussed was the Odyssey Diner. He stated that it will have to go back to the planning board
because there is a second floor that was not on the plans.
