PLEASE TAKE NOTICE that there has been reintroduced before the Town
Board of the Town of Newburgh in the County of Orange and State of New York on January 30,
2013, a Local Law now designated as Introductory Local Law No. 1 of the Year 2013 and
entitled "A Local Law Amending the Application and Public Hearing Notification Provisions of
Chapter 83 Entitled "Clearing and Grading", Chapter 125 Entitled "Noise and Illumination
Control", Chapter 163 Entitled "Subdivision of Land", Chapter 168 Entitled
"Telecommunications Facilities, Wireless" and Chapter 185 entitled `Zoning' of the Code of the
Town of Newburgh."
The purpose of the Local Law is to require that uniform and adequate public notice be
given for public hearings conducted by the Planning Board and Zoning Board of Appeals. The
Local Law amends each of the referenced Code Chapters to require the mailing of notice of
public hearing to the owners of all abutting property and to all other owners within at least 500
feet. It also requires the posting and maintaining of a copy of the notice of public hearing on or
near the front property line(s) within view of the nearest adjacent street right(s) of way. The
Local Law requires the Planning Board to forward a letter to all property owners within 500 feet
of the land involved in a subdivision or site plan application within ten business days of the
applicants first appearance, notifying them of the application's receipt and additional notice in
the event the applicant later proposes changes to its application if the changes meet certain
thresholds or there is a modification in the proposed use. The Local Law requires the Zoning
Board of Appeals and Planning Board to forward notice to neighboring property owners by first
class mail mailed by the secretary of the Board or an officer or employee of the Town rather than
by certified mailing by the applicant. The Local Law also specifies that notices of site plan public
hearings must include the tax lot designation and street address and the size of the lot(s), the
number of buildings and size of each building's footprint, number of stories and height of each
building or structure, and a detailed description of the proposed use, or where the use
classification is generic and the applicant cannot commit to a particular use, a description of the
possible permitted uses to which the site might be put.
PLEASE TAKE FURTHER NOTICE that pursuant to Section Twenty of the Municipal
Home Rule Law, a public hearing will be held on the aforesaid proposed Local Law before the
Town Board of the Town of Newburgh at the Town Hall at 1496 Route 300 in the Town of
Newburgh, New York at 7:00 o'clock p.m. on April 1, 2013 at which time all interested parties
will be heard.
