This will keep this on track moving forward. You will also need to amend your site plan for the planning board. In order to appear before the Zoning Board, you will need to apply through an area variance application found either on our website or you may pick one up here in the office. Once submitted, Sue Rose will put you on the next ZBA agenda. As soon as you submit an amended site plan application we can get you back on the planning board agenda as well. To my non-legal mind, the following seem relevant: 1. There's a 50-foot setback requirement for new construction. Chelsea Yacht Club's (CYe's) land, strictly speaking, extends only 27 feet from proposed permanent awning. 2. New York State owns the underwater land under navigable waterways. 3. We have a 10-year renewable license from NYS to use the land in front of the club extending out several hundred feet from shore. License is valid thru 2020, and the expectation is that we'll continue to renew routinely, as we've done in the past. 4. As a shorefront property owner, evc has permanent "riparian rights", which grant us access to navigable water for boating, fishing, etc. To that end, we have docks, etc. A corollary of this is that no one can deny us this access (state or private). 5. No one has a "crystal ball", and nothing is truly permanent. a. The only thing anyone can do is act on what's the situation today. b. If something changes (in our case after 2020), the situation existant at the time of change typically is "grandfathered". You know better than I that there are plenty of examples in the property and building code areas. Given all the above, I don't know whether we need a variance or not, and I'm not about to second-guess. What I'd appreciate from you are a couple simple answers: 1. " , " . , W , , " " , , STREET Chelsea Yacht Club - Proposed Metal Roof & Structure General Description: Replace the current 16' x 34' canvas awning and metal pipe frame, a "temporary" structure, located on the Southwest comer of the Chelsea Yacht Club clubhouse facing the Hudson River, with a permanent wood frame structure topped with metal roofing to match the rest of the clubhouse. A photopage showing the canvas awning is attached. Code and construction considerations: Frame structure and supports designed to meet local building codes, which are generally based on the American Wood Council's Wood Frame Construction Manual. A robust structure takes into consideration snow and wind loads and soil bearing capability. Design factors and materials estimate spreadsheet is attached. A note about the setback of the new roof: there is a minimwn of 27 feet of land between the roof and the river. CYC does have rights extending into the river, specifically, a New York State license for the land underlying our mooring area that extends from the shore in front of the clubhouse out several hundred feet; a copy of the license and a site map are attached. Thus, we easily meet the 50-foot setback requirement. Detailed aspects of construction: 1. A 2x12 header is bolted to the existing house just below second-story windows. Some reinforcement of house framing may be required. To the header, 2x8x16 rafters on 12" centers are attached with Simpson hangers. 2. At the other end of the rafters, a double 2x12x34 header is made up, and rafters rest atop the header; 6 ~' headroom under header. Hurricane clips also connect rafters to header. The header is supported by five 6x6 columns, which are in turn supported by 10" diameter reinforced concrete colwnns with flared bottoms which extend down to the 42" frostline. Simpson plates connect the parts top & bottom. 3. Atop rafters, 5/4x6 purlins span the rafters, with 12" c-c spacing. Atop these, pre-cut and pre-painted metal roofing to match the house's is attached with proprietary screws. Matching flashing is used at the house wall. The North & South end roofing sheets are bent to overhang the end wall sections. 4. End wall sections are framed with 2x4's, covered with W' plywood sheathing and faced with cedar shakes stained to match the house.
