Hi Serge,
After reviewing your documents and discussing this with the town attorney, I believe the best course of action will be to
apply for a variance since we really need to count on dry land for setbacks. This will keep this on track moving
forward. You will also need to amend your site plan for the planning board.
In order to appear before the Zoning Board, you will need to apply through an area variance application found either on
our website or you may pick one up here in the office. Once submitted, Sue Rose will put you on the next ZBA agenda.
As soon as you submit an amended site plan application we can get you back on the planning board agenda as well.

Hi Barbara,
At Monday evening's Planning Board meeting, the issue of the "permanence" of our NYS underwater license and
whether we meet the required setback was raised.
To my non-legal mind, the following seem relevant:
1. There's a 50-foot setback requirement for new construction. Chelsea Yacht Club's (CYe's) land, strictly speaking,
extends only 27 feet from proposed permanent awning.
2. New York State owns the underwater land under navigable waterways.
3. We have a 10-year renewable license from NYS to use the land in front of the club extending out several
hundred feet from shore. License is valid thru 2020, and the expectation is that we'll continue to renew
routinely, as we've done in the past.
4. As a shorefront property owner, evc has permanent "riparian rights", which grant us access to navigable water
for boating, fishing, etc. To that end, we have docks, etc. A corollary of this is that no one can deny us this
access (state or private).
5. No one has a "crystal ball", and nothing is truly permanent.
a. The only thing anyone can do is act on what's the situation today.
b. If something changes (in our case after 2020), the situation existant at the time of change typically is
"grandfathered". You know better than I that there are plenty of examples in the property and building
code areas.
Given all the above, I don't know whether we need a variance or not, and I'm not about to second-guess. What I'd
appreciate from you are a couple simple answers:
1. Do you need any additional information from us.
2. Should I plan to attend the Zoning Board meeting on April 15th?

Chelsea Yacht Club - Proposed Metal Roof & Structure
General Description: Replace the current 16' x 34' canvas awning and metal pipe frame, a
"temporary" structure, located on the Southwest comer of the Chelsea Yacht Club clubhouse
facing the Hudson River, with a permanent wood frame structure topped with metal roofing to
match the rest of the clubhouse. A photopage showing the canvas awning is attached.
Code and construction considerations: Frame structure and supports designed to meet local
building codes, which are generally based on the American Wood Council's Wood
Frame Construction Manual. A robust structure takes into consideration snow and wind
loads and soil bearing capability. Design factors and materials estimate spreadsheet is
attached. A note about the setback of the new roof: there is a minimwn of 27 feet of
land between the roof and the river. CYC does have rights extending into the river,
specifically, a New York State license for the land underlying our mooring area that
extends from the shore in front of the clubhouse out several hundred feet; a copy of the
license and a site map are attached. Thus, we easily meet the 50-foot setback
requirement.
Detailed aspects of construction:
1. A 2x12 header is bolted to the existing house just below second-story windows. Some
reinforcement of house framing may be required. To the header, 2x8x16 rafters on 12"
centers are attached with Simpson hangers.
2. At the other end of the rafters, a double 2x12x34 header is made up, and rafters rest atop
the header; 6 ~' headroom under header. Hurricane clips also connect rafters to header.
The header is supported by five 6x6 columns, which are in turn supported by 10"
diameter reinforced concrete colwnns with flared bottoms which extend down to the 42"
frostline. Simpson plates connect the parts top & bottom.
3. Atop rafters, 5/4x6 purlins span the rafters, with 12" c-c spacing. Atop these, pre-cut and
pre-painted metal roofing to match the house's is attached with proprietary screws.
Matching flashing is used at the house wall. The North & South end roofing sheets are
bent to overhang the end wall sections.
4. End wall sections are framed with 2x4's, covered with W' plywood sheathing and faced
with cedar shakes stained to match the house.

Pursuant to Article 6, Section 75 of the Pub.lic Lands Law, permission is hereby given by the People of the
State of New York, acting by and through the Commissioner of the Office of General Services, located at
Governor Nelson A. Rockefeller Empire State Plaza, Corning Tower, Albany, New York 12242, (hereinafter
referred to as "Licensor") to:

Front Street, P.O. Box 180
Chelsea, NY 12512

(hereinafter referred to as "Licensee"); to use and occupy certain State-owned submerged land generally
described in Attachment LUW01489-1 attached hereto for the purpose of:
Operation and maintenance of an existing mooring facility of 140 moorings for a term of ten years
commencing on November 30,2010 and expiring on November 29,2020.
THIS LICENSE is given and accepted subject to the following terms and conditions:
Licensee shall pay to Licensor the sum of $12,359.88, (or discounted to present value of $11,123.89,
If paid in full at time of license issuance) for the use and occupation of lands described herein as set
forth in the sche;dule of payments, which is attached hereto as Attachment LUW01489-2.
1. Payments are due on the anniversary date of the License. In the event Licensee does not remit the
annual payment within 60 days of said anniversary date, then the entire balance of payments for the
remaining term of the license will become due and payable ( annual paym~nt x remaining years of
license). If paymentof the balance for. the remaining term is not received within 90 days of the
anniversary date, the Licensee will be considered in default and the license terminated. Upon receipt
of the notice of termination from the Owner, all formerly licensed structures located upon State
owned land under water must be removed.
3. The License hereby given is issued only with respect to the structures and/or improvements
described in the application and shown on the map or plan which accompanies the application. If the
structures and/or improvements shall not have been maintained and used for a period of two years
as determined by inspection by the Licensor and if such lack of maintenance and use is not cured or
time to cure extended within sixty (60) days of receipt of written notice from licensor, then in such
event the License shall terminate.
4. At the termination of the License hereby given, the Licensee agrees at the expense of the Licensee
and at no expense to the Licensor, to remove at once the said structures and/or improvements from
the land of the Licensor hereby affected and to leave said land in as nearly the same condition as it
was prior to the use and occupation and/or construction hereby authorized. .
5. If the licensee shall have kept and performed all the terms of this License, Licensee may, pursuant to
applicable statute and regulation, apply to licensor for a renewal of this license upon the same or
similar terms, provided that at leastsixty (60) days before the expiration of the term, Licensee notifies
Licensor in writing of its intention to renew this License.

6. The Licensee shall be liable for and pay all damages that may arise or occur to the Licensor and shall
save the Licensor harmless. from all claims for damages in consequence of the construction,
maintenance, use, occupation and/or removal of the said structures and/or improvements or by
reason of any work done or authorized by or under this License and, at the expense of the Licensee,
will defend all suits brought on account thereof.
7 This License gives no authority for the mooring or docking of boats in such a manner that they will
extend in front of adjacent upland owned by others than the Licensee, and is further subject to the
riparian rights, if any, of the adjacent upland owners.
8 The Licensee hereby agrees that no lateral approach rights in front of either adjacent upland owner
are given or granted by this license.
9 The License hereby given is intended to affect only the rights of the Licensor in the aforedescribed
parcel of land.
10. The Licensee will not assign this License.
11 Licensee shall be responsible for payment of all federal, state, city, county, school taxes or other local
taxes including all real property taxes, assessments, levies, fees, water and sewer rents and other
governmental charges whether general or special, ordinary or extraordinary, all sales and use taxes
and all charges for water, gas, light, heat, telephone, electric, and other utilities used on the Licensed
premises.
12 (a) Licensee shall promptly comply with every law, statute, rule, ordinance, regulation and/or
notice of any municipal, county, state, federal or other authority having jurisdiction pertaining
to or affecting the licensed premises.
(b) Licensee, at its sole cost and" expense shall at all times keep or cause.all improvements on
State-owned submerged land to be in good condition and repair. Licensee shall not allow
debris or refuse to accumulate on the premises.
13 Except as provided in paragraph 2 above, if Licensee shall fail to comply with any of the terms of this
License, Licensor shall have the right, at its option at any time thereafter, to terminate this License,
re-enter and take possession of the premises after giving thirty (30) days advance notice in writing to
the Licensee The Licensor may vacate such termination notice should the Licensee cure any
deficiencies within the thirty (30) days notice of termination period. Such right of termination shall be
in addition to a yother legal or equitable rights or remedies, which the Licensor may have.
