Resolution Declaring Type II Action Regarding Granger Place Drainage Improvements
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on June 24,
2013.
The meeting was called to order by Barbara Gutzler, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilwoman Czarniecki and seconded by
Councilman Beale
WHEREAS, the Town Board authorized consultation between the Town's Highway
Superintendent and Town Engineer about an existing drainageway under Granger Place at a
point midway between Alpert and Scott Drives in the Town of Wappinger, Dutchess County,
New York to examine stormwater drainage problems at that location; and
WHEREAS, the proposed action, involves the replacement of twin existing 48" culvert
pipes with metal arch pipes as the existing pipes have deteriorated thus creating drainage
problems in this neighborhood area that must be remedied; and
WHEREAS, the Proposed Action is a Type II action under the provisions of the State
Environmental Quality Review Act and the regulations promulgated thereunder at 6 NYCRR,
Part 617 (SEQR) subsection 617.5 (a) and (c) since it is a replacement in kind; and is not subject
to SEQR review; and
WHEREAS, in accordance with SEQR 617.6 (a)(1)(i), the Town Board determines that
this is a Type II Action and thus the Board has no further responsibilities under SEQR;
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Part 1 of the Short Environmental Assessment Form describes the Proposed
Action.
3. No further action is required under SEAR.
