She said that people are already smoking on Town Hall property before they see the signs saying that there is no smoking on the property, because the signs are posted on the building. Residents are smoking as they walk up to the building. Supervisor Gutzler stated that when the law passes there will be signs placed on the property. Resident Joe Torres asked the Town Board how violations of this law would be enforced. Supervisor Gutzler responded that it would be referred to the Zoning Office or local law enforcement agency that is on the premises. The violator would be issued a summons for either littering or violating the ordinance. Mr. Torres asked what repercussions there would be for Town employees who violated the ordinance and would the violation be entered into their personnel file. Supervisor Gutzler said she had not thought of going into people's personnel records and that it was in fact the employees that had requested the local law. Councilman Beale stated that when a similar ordinance had been passed for town parks, it wasn't meant to be a punitive approach. It was to get people to think before they smoke in town parks and that he thinks it is good to extend the ordinance to town facilities. Mr. Torres stated that in the past there had been people smoking cigars out at Robinson Lane and that the smoke spread through the fields. He pointed out that there needed to be enforcement of the ordinances or what point is Town of Wappinger Page 2 Printed 6/18/2013 Town Board Meeting Minutes June 10, 2013 there of having them on the books. Attorney to the Town, Al Roberts stated that it is already in the code, that they be enforced by code enforcement officers and any police agency. Smoking is prohibited in all of the town parks. Supervisor Gutzler stated this was not an agenda item and asked Mr. Torres to sit down. Councilwoman Czarnecki also pointed out that the rules for the public portion were that it is for agenda items only. Councilman Beale stated that the Board would love to hear his concern, but there is a process. He stated that Mr. Torres needed to put it in writing, send it to the Town Board, and they would take a look at it. Discussions A. Daniels; new project in Town Mr. Daniels introduced himself as the owner of the Half -Time beer store on Route 9. He said that he came up with the idea to resurrect the Matthew Vassar Brewing Company which operated a brewing company in the 1800s. The company also funded Vassar College and Hospital. He has been looking for a space to use, when he heard the Fun Central would not be reopening this year Mr. Daniels felt it would be a good spot to turn into a brew pub. Mr. Daniels dispersed information to the Board. He stated that the drawing he passed out to the Town Board was of the original brewery as well as other plans. He said that they are going to install a 20 barrel brew system. There would also be a full kitchen. The inside of the current arcade would be turned into the bar and restaurant. The outdoor spaces would be redesigned. Councilman Bettina stated that Mr. Daniels was proposing an outdoor beer garden. Councilman Beale expressed that he was very excited about the proposal. He said that when he heard that Fun Central was closing, he was worried about what would be replacing it. Councilman Beale also said that he is excited that the brewery is going for a market that will appeal to a broader demographic than Fun Central. Supervisor Gutzler said that when she met with Mr. Daniels, there was a lot of enthusiasm about the project and she believes the restaurant will fit nicely. Councilman Beale said that the brewery will attract people looking for a specific type of product, just as Alto Music and Adams Fairacre Farms do. Councilman Bettina said that the brewery ties in with what New York State wants to do with Agritourism. Councilman Beale thanked the Supervisor for bringing this matter to the Town Board before it went to the Planning Board. Mr. Daniels stated that he hoped to create a Town of Wappinger Page 3 Printed 6/18/2013 Town Board Meeting landmark in the Town. IX. RESOLUTION: 2013-156 Resolution Abandoning Excess Right of Way of Old Post Road to Abutting Property Owners WHEREAS, Eduardo Lauria and Lucia Lauria (hereinafter "Lauria") own a parcel located on the east side of Old Post Road, hereinafter known as the "Lauria Parcel"; and WHEREAS, the Lauria Parcel abuts portions of Old Post Road which have not been used for public highway purposes for many years; and WHEREAS, Lauria has requested that the unneeded portions of Old Post Road abutting their parcel be abandoned to them; and WHEREAS, on May 13, 2013, the Dutchess County Legislature authorized an abandonment of portions of Old Post Road described in Schedule "I", attached hereto, to Lauria. A copy of the Dutchess County Legislature's Resolution is attached hereto as Schedule "2"; and WHEREAS, Lauria has requested the County and the Town of Wappinger to convey by quitclaim whatever interest each municipality has in the portion of Old Post Road that is adjacent to the Lauria Parcel as depicted in the attached Schedule "I"; and WHEREAS, the Acting Commissioner of Public Works of Dutchess County recommended to the Dutchess County Legislature that such portions of Old Post Road be abandoned to Lauria; and WHEREAS, the Town of Wappinger Highway Superintendent has recommended that Town of Wappinger Page 4 Printed 6/18/2013 Town Board Meeting Minutes June 10, 2013 the unneeded portions of Old Post Road as described in Schedule "1" be abandoned to Lauria. RESOLUTION: 2013-157 Resolution Rejecting Bids for Roberts Road Sewer Improvements WHEREAS, by Resolution 2012-253 adopted on September 24, 2012, the Town Board authorized the issuance of $256,000 Bonds to pay the cost of the increase and improvement of the facilities of the United Wappinger Sewer District including the design, construction and installation of a gravity sewer line and appurtenances to replace the Roberts Road Sewer Pump Station; and WHEREAS, on March 25, 2013, the Town Board authorized, by motion, the commencement of the construction and replacement of the Roberts Road Pump Station with a gravity sewer line, in accordance with plans and specifications prepared Morris Associates Engineering Consultants, PLLC, Engineers to the Town; and WHEREAS, the project was duly let out to bid; and WHEREAS, bids were received and the apparent low bidder was Precise Landscaping and Lawn Maintenance, Inc. of Wallkill, New York; and WHEREAS, in order to replace the Roberts Road Pump Station, the Town was required to obtain various easements to permit the construction and installation of the gravity sewer line; and WHEREAS, the Town has been unable to acquire the required easements and will not be able to do so for many months; and WHEREAS, the Town may have to redesign the route of the gravity sewer line; and WHEREAS, the Town Board hereby determines that it is both prudent and in the best interest of the Town of Wappinger, particularly the residents of the United Wappinger Sewer District, to reject all bids received in connection with the construction and installation of the gravity sewer line to replace the Roberts Road Sewer Pump Station. NOW, THEREFORE, BE IT RESOLVED: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein: 2. The Town Board hereby rejects all bids received in connection with the construction and installation of the gravity sewer line to replace the Roberts Road Sewer Pump Station. 3. The Town Clerk is hereby directed to return all bid bonds in accordance with law. 4. Upon acquisition of all necessary easements and right-of-way for the construction and installation of the gravity sewer line, and upon receipt of any redesigned route of the gravity sewer line, if any, the Town Board shall authorize the resubmission and solicitation of bids for the construction and installation of the gravity sewer line replacing the Roberts Road Sewer Pump Station. X. Items for Special Consideration A. Councilman Beale Councilman Beale stated that he had been talking to County Officials regarding the conditions of Creek Road. The people he spoke with took the position that the Town of Wappinger should take the road over. However, the road has structural issues, so Councilman Beale said that was not an option. Highway Superintendent, Graham Foster, said that he has also refused that proposal in the past. Councilman Beale explained that he spoke to Ron Hicks. Mr. Hicks said Dutchess County is willing to put $50,000 worth of work into the road which should repair the road for about a year and a half. After that, he was unsure of what would happen. Councilman Beale said he was concerned that someone could hit a pothole, blow a tire, and hit a pedestrian. Dutchess County suggested that the road be turned into a trail. However, Councilman Beale pointed out that that road is used by commuters to get to the train station. B. Councilman Bettina Councilman Bettina said that he spoke to residents who had damage to their cars from driving on Route 9D. Councilman Bettina said that since the road is a state road, a memo should be sent to the DOT asking when the road is going to be fixed. Highway Superintendent stated that the 9D paving is a huge project that is going to take time. Councilman Bettina said that that does not take away the anger of the residents who have had damage to their cars. Councilman Bettina proposed that based on the past practices of the Town Board, the number of meetings held during the summer be reduced to one per month. Councilman Bettina said that July 8`h and August 26t were good dates to hold meetings. Supervisor Gutzler reminded the Board, that last year when the Board reconvened in August, there was a large amount of business that had to be handled. Supervisor Gutzler said that so much space between meetings would result in bills having to be pulled and paid by the Supervisor instead of them going before the Town Board. Supervisor Gutzler suggested dates of July 8th and August 12th. Councilman Beale said that the advantage of having six weeks between meetings was having more flexibility for planning vacations and that he had no problem authorizing the Supervisor to pay the bills. He also stated that in the case of urgent business, a special meeting could be held. Councilman Kuzmicz said that he was alright with whenever the meetings were scheduled, so long as they were still held at 7:30. Councilwoman Czarniecki stated that she would go along with whatever the majority of the Board decided. Councilman Bettina moved that meetings be held July 8th and August 26t . Councilman Beale seconded the motion and the motion was unanimously carried. Supervisor Gutzler Supervisor Gutzler said that she received a letter from Mark Price requesting $200 from the Friends of Carnwath fund to help restore gardens on the Carnwath property. Supervisor Gutzler moved the authorizing of a stipend of $200 from the Friends of Carnwath account for the purpose of the Friends of Camwath doing planting. Councilman Bettina seconded the motion and the motion was unanimously carried.
