Yes. Motion to open the public hearing. Second the motion. All present voted aye. Swore in the applicant. The house is 4.8 feet closer to the road. We are just looking to put a nice decorative porch on it and that's all. What's there now? Just the foundation and its being framed. So it looks like the house itself is ok, correct? Yes. Any other questions on the board? (No.) Is there anyone in the audience that would like to ask a question or make a comment? Swore in the resident. Bob Scott, 25 Beechwood Circle. Why wasn't the house set further back? It was simply an oversight on the stakes. ,Town of Wappinger Zoning Board of Appeals """ Mr. Fanue1e: Mr. Cain: Mr. Scherpf: Mr. Cain: Mr. Scherpf: Mr. Cain: Mr. Warren: Mr. Cain: Mr. Fanue1e: '--' Mr. Cain: Mr. Fanue1e: Mr. Scott: Mr. Fanue1e: Mr. Scott: Mr. Fanue1e: Mr. Fanuele: Mr. Prager: Mr. DellaCorte: Vote: Mr. Warren: Mr. Prager: Vote: '--' Page 3 Minutes of February 8, 2005 Swore in the resident. Jim Cain, 16 Beechwood Circle. How much property is this on? About 1 Yz acres. What was this before the subdivision? I think about 3 acres. One is now I believe 1.45 and the other is 1.65 acres. This was part of a larger subdivision and this is a circle where school buses come in. Why can't you move this back now? I did take a picture of how close this will be. So your concern is about the school buses? Yes. How far back are the other homes set back? Much further back. The zoning code says it needs to be 35 feet back. So we are dealing with 32 feet. Why do you have a 50 foot rule to be back from the road? In this case it is 35 feet. Why do you have that stipulation? To give a little front yard. Any other questions? Hearing none. Motion to close the public hearing. So moved. Second the motion. All present voted aye. Motion to set a site visit for February 12,2005. Second the motion. All present voted aye.
