1983-02-08The regular meeting of the Zoning Board of Appeals of the
Town of Wappinger was held on Tuesday, February 8th, 1983
beginning at 8:00 p.m., at the Town Hall, Mill Street, Wappingers
Falls, New York.

Mrs. Waddle called the meeting to order and then asked the
secretary if all the abutting property owners been notified.
The secretary replied that the abutting property owners
and the appellants had been notified according to the records
available in the Assessors office.
Mrs. Waddle then asked for the roll call.
The roll was called with Mr. Urciuoli being absent.
Mrs. Waddle then noted that she would explain how the
Zoning Board will operate this evening, we will hear each case
in turn, after all parties have had a chance to speak, the Board
will deliberate up here, we ask that we have no audience participation
at that time and we may or may not render a decision this evening.
PUBLIC HEARING:
Appeal # 654, at the request of Joseph Meditz, seeking a
variance of Article IV, Section 404.31 and 412 of the Town of
Wappinger Zoning Ordinance, to allow for an addition to a legally
non -conforming dwelling and to allow for the issuance of a building
permit on a lot which does not have 25 foot of road frontage, on
property located on Old Post Road (Old Fowlerhouse Road), being
parcel # 6157-04-649374, in the Town of Wappinger.
Mrs. Waddle read the legal notice.

Mrs. Waddle then asked if there was anyone present to speak
for this appeal.
Mr. Joseph Meditz of Old Post Road, mailing address is
Old Fowelerhouse Road, Wappingers Falls.
Mrs. Waddle then asked him if he would like to tell the
Board why he needs the addition.
Mr. Meditz replied that his family is growing and he needs
the additional living space to meet the personal living needs of
his family.
Mrs. Waddle asked him how many there were in his family.
Mr. Meditz replied at present his wife and two children
and his wife was expecting.
Mrs. Waddle noted there would be three children and two
adults and asked how many bedrooms he had now.
Mr. Meditz replied that at present he has one master bedroom
and two small rooms, one was a converted porch to make room for a
bedroom for one of his children.
Mrs. Waddle noted that she also sees that they have a sewing
room.
Mr. Meditz replied that was his plan if he gets the addition,
drawn that in tentatively, right now that is a bedroom, it is
his daughter's bedroom, the sewing room, if he gets the addition
then that would be turned into a sewing room.
Mrs. Waddle then asked him to show her what is the proposed
addition here, is this the proposed addition these two bedrooms.
Mr. Meditz replied these two bedrooms and he was going to move
the kitchen, and pointed to the plan noting that this was the
existing house from here back.
Mrs. Waddle commented and this is what you want to add on.
Mr. Meditz replied yes, this is what he wanted to add on.

Mrs. Waddle replied okay, now she sees what he means, had a
little trouble with the drawing, so you want to make the kitchen
larger and add two bedrooms.
Mr. Meditz replied that he was going to move the kitchen
over, the kitchen is presently here where he has it marked dining
room, move the kitchen over into here and then change that into
a dining room because he really has no dining room at the present.
Mrs. Waddle then asked if anyone had any questions.
Mr. Caballero then asked what was the required sideyard,
the footage.
Mr. Gunderud replied that he believed that it was twenty feet,
his only problem is the fact that the road frontage is only
twenty feet, this is like a flag lot, he has a thin twenty
foot strip down and he needs twenty-five feet by State law.

The Board commented that you were talking about five

Mr. Caballero commented that this would then stay with the
line of the house as it is now.
Mr. Gunderud replied yes, there is no change there.
Mrs. Waddle added that there was no problem with his
meeting the setback requirements, has a problem with the road
frontage.
Mrs. Waddle then asked if there was anyone who wished
to be heard for or against this variance.
No one present wished to be heard.
Mrs. Waddle then noted that she did have a letter
from the County which recommends that the decision be based
upon local study.

Mr. Cortellino then made a motion to move that the
variance be granted. The motion was seconded by Mr. Landolfi.
Vote:
Mrs. Waddle -- aye
Mr. Cortellino - aye
Mr. Urciuoli - absent
Mr. Caballero - aye
Mr. Landolfi - aye
Mrs. Waddle noted that the variance was granted and then
declared the hearing on appeal # 654 closed.
The hearing was closed at 8:07 p.m.
NEW BUSINESS:
Appeal # 655, at the request of Stephen Ossenkop, seeking
a Special Use Permit pursuant to Article IV, Section 421, paragraph
7 of the Town of Wappinger Zoning Ordinance, to establish a campground
for seasonal residence only, on property located on Robinson Lane,
consisting of 140 acres, in the Town of Wappinger.
Mrs. Waddle noted that all she needed was a motion to
send this to the Planning Board.
The secretary replied that it was sent to the Planning
Board but the Planning Board meeting was cancelled due to the
storm.
Mrs. Waddle commented that we really couldn't do anything
with this as it is still in the Planning Board's hands.
The secretary noted that the Planning Board was awaiting
comments from the County Planning Board and Mr. Lapar, which
haven't come in yet.
Mrs. Waddle commented that she assumed that would be continued
at our next meeting.
The secretary noted that the Planning Board should have this
on their March 7th agenda.
Mrs. Waddle asked if there was any further business.

A motion was then made by Mr. Cortellino, seconded by
Mr. Landolfi, to adjourn.
The motion was carried by those members present.
The meeting was adjourned at 8:08 p.m.
