1972-12-12The regular meeting of the Zoning Board of Appeals of the
Town of Wappinger was called to order on Tuesday, December 12, 1972
at 8:05 p.m., at the Town Hall, Mill Street, -Wappingers Falls,
400 New York.

PUBLIC HEARINGS:
Appeal ¢# 176, at the request of Edwin A. Corl, and the Hobby
Hut, Inc., and the Stitch Shop, Inc., seeking a variance of Article IV,
Sections 423 and 424 of the Town of Wappinger Zoning Ordinance, to
permit a free-standing sign on their business premises located at the
southeasterly corner of the intersection of Hopewell Road and Route 9D,
in Hughsonville, locatidn of said free-standing sign being at a setback
of 11 feet from Hopewell Road, Town of Wappinger.
The Chairman read the legal notice.
The Chairman then asked the secretary if affadavits of
publication had been received and if all abutting property owners
were notified.
The secretary noted that affadavits had not been received but
noted further that all abutting property owners had been notified.
Mr. Bob Fox of the Hobby Hut was present for the Appeal in
behalf of the appellants.
The Board and Mr. Fox discussed the location of his store
within the building, Mr. Fox noted he was in the back near the
parking lot.
The Board then generally discussed the site plan.
Miss Pike noted that 16 parking spaces had been provided.
Mr. Fox then noted that he leased three rooms and had been in the
building since July 1, 1972. Mr. Fox then noted that the sign was behind
4,00 the guard rails in the parking lot and that each sign was one square
foot by one square foot and they were white with black lettering.
Mr. Kalaka then asked how long the sign had been up.

Mr. Fox replied that the sign had been there for about two
440 months and noted that Miss pike had told him to leave the sign
up as this would give the Board an opportunity to see it.
Mr. Kalaka then asked if there were other occupants besides
the Hobby Hut and the Stitch Shop.
Mr. Fox replied that the Easter Road Co-op also occupied a
portion of the jDtijbd"g.
Mr. Kalaka then asked if any further additions to the sign
were anticipated.
Mr. Fox noted that the Easter Road Co-op had their own sign and
that they had expressed no interest in the sign the Hobby Hut and
Stitch Shop were using.
The Board then generally discussed the size and construction
of the sign.
Mr. Cortellino then asked if the residence area was being used.
Mr. Fox replied no, noting that it is an art gallery and
part of the Easter Road Co-op.
Mr. Kalaka then asked if the business were intern*Iktddaajid3_ff
there was one principal involved.
Mr. Fox replied that they were all individu&I businesses.
The Board then asked if there was anyone else present who wished
to be hhard.
No one else present wished to be heard.
The hearing was closed at 8:17 p.m.
Appeal # 177, at the request of Charles Mc Kay, seeking a
variance for a building permit to construct a single-family dwelling
on his property located on All Angels Hill Road, and containing 2.09
acres of land, on which there exists four legally non -conforming mobile
homes in an R-20 zoning district which requires a lot area of 20,000
sq. ft. per dwelling.
Mr. Charles McKay and Mr. Harold Rlly, his attorney, were
40 present for the Appeal.

Mr. Reilly noted that they had been before the Board in the
Spring and were back for reconsideration of their Appeal.
Mrs. Waddle then arrived at 8:20 p.m.
Mr. Reilly then noted that the property was in excess of two
acres and the trailers occupy less than h of the property and further
noted the house would occupy one acre and would be on the back of the
property as the trailers are on the front.
Mr. Reilly noted that ordinarily there would be no problem but
the presence of the four trailers necessitates a request for a
variance.
Mr. Kalaka then noted that in the Appeal it was noted that
Mrs. Mc Kay relies on the income of the trailers for support.
Mr. Kalaka then asked if any of the other trailers were occupied
by members of the Mc Kay family.
Mr. Mc Kay replied that just hdomself and his mother reside in one
trailer and the others were occupied by people who are not members of
his family.
460 Mr. Kalaka then asked if the income provided from the trailers
would be enough to make Mrs. Mc Kay self-supporting.
Mr. Reilly noted that Mrs. Mc Kay was about to retire.
Mr. Mc Kay noted that when he got married his mother would
be moving back into the trailer.
Mr. Kalaka then asked in the event that the Appeal.is granted
would Mr. Mc Kay's mother be the only individual who would receive
benefit from income from the trailers.
Mr. Mc Kay replied yes.
Mr. Kalaka then asked how many rooms there would be.
Mr. Mc Kay replied that there would be three bedrooms.
Mrs. Waddle then asked if Mr. Mc Kay worked in the Wappingers'
area.
Mr. Mc Kay replied that bbe veziuedldobeS'hbken, bWzl"dmsand Quinn.
The Board and Mr. Mc Kay then discussed water and sewage
facilities on the property.

Mr. Mc Kay noted that there were three septic tanks and one
well for the trailers. He further noted that", -'he would be drilling
a new well for the house and would be putting„ian additional septic
system in.
Mr. Kalaka then asked what plans Mr. Mc Kay had for the start
Of construction.
Mr. Mc Kay noted that he hoped to start building in the
Spring.
It was then noted that the trailer have been on the property
since before zoning.
Miss Pike noted that about 100,000 sq. ft. were required
and that Mr. Mc Kay had about 91,000 sq. ft. and was only short
by 8,900 sq. ft.
Mr. Kalaka then asked if Mrs. Mc Kay moved into the house
would the trailer be leased to someone else.
Mrs. Mc Kay replied yes but noted when herson married she
would move ;'back into the trailer.
Mr. Kalaka then noted that there was a -letter from Edna and
Coert Van Voorhis which stated that they had not objection to the
variance being granted and had found the Mc Kay's splen4id neighbors,
it was also noted that the letter was not dated.
Mr. Reilly noted that he could get a letter from John Helmsorig,
also a neighbor of the Mc Kay's if the Board wished.
The Board then asked if there was anyone else present who
wished to speak for or against the Appeal.
No one else present wished to be heard.
The hearing was closed at 8:35 p.m.
It was noted that in regard to Appeal # 176, a recommendation
had not yet been received from the Dutchess County Department of
Planning and the Board could take no action on this Appeal.
The Board then went into exaMt-we session at 8:37 p.m.
The meeting was reconvened at 9:28 p.m.

Regarding Appeal # 176, action was tabled pending the receipt

the recommendation of the Dutchess County Department of Planning.
Regarding Appeal # 177, a motion was made by Mrs. Waddle,
seconded by Mr. Cooke, to grant a variance to Charles Mc Kay,
on the basis that the variance would not change the character
of the district because the use is permitted.
Motion Unanimously Carried
Miss Pike then noted that she had received a letter from
Patrick Hennebery of Valley Performance Specialities inquiring
about a request for an interpretation that the type of business
he planned would come under the definition of "Industrial and
Manufacturing", as permitted uses in the airport industry district.
The Board noted that they could take no action on this request
until such time as Appeal forms were submitted to the Board.
Miss Pike noted that she would inform Mr. Hennebery of this.
A motion was then made by Mrs. Waddle, seconded by
Mr. Cortellino, to approve the minutes of November 14, 1972.
