PDBLIC HBARING- APPRAL # 77, at the request of Grossmann of
Central New York, for a variance to permit the construction of a
free-standing sign larger than permitted by the Zoning Ordinance,
on their property located on the westerly side of Route 9, east
of the old Route 9.
Mr. James E. Coombs, Attorneys was.present in behalf of the
appeal. He explained that Grossman's has approximately seventy-
nine stores in various locations, and that the sign for which
the variance is requested is used at all but one of these stores.
The size of the sign requested in this variance is 203 sq. ft.'
Mr. Coombs noted that the area in which the site is located is
a comeercial area, and that Grossman' has frontage on two highways
which should entitle them to twics'as mush sign area as the
Ordinance allows. He further noted that people who are not familiar
with the area cannot easily find the Grossman site due to the fact
that there is no sign on the premises to identify the site.
The Hoard asked about the trailAar which is parked in front
of the building.
Mr. Armstrong, Store Manager, noted that this trailer is
presently being used for storage of goods.for a truckload sale
that they have coming up., Rs further noted that the trailer has
been parked on the promises since after the store was opened, or
approximately three weeks.
Mr. Nalaka noted that the Zoning ordinance allows a maximum
of only 28 sq, ft. for free-standing reigns, and that this request
is for eight times more than the maxim= allowed. He noted that no
attempt has been made to propose alternate signs which might some
closer to the Ordinance than this one.
Mr. Hirt disagreed with the statement that people cannot,
easily find the site. as felt that there is plenty of sight
distance when approaching the site from either direction on Route 9.

Dr. Robert Y. Heisler, Chairman of the Town of Wappinger
Planning Hoard, was present and pointed out that the Planning Board
is currently actively studying the ordinance with respect to signs.
iia stated that the Planning Hoard fools that some revisions are
needed, and that they hope to corse up with a cecommandation within
a month or so.
Mr. Coombs stated that in an area such as along Route%,
25 sq, ft. is not a reasonable size to restrict a buainess such
as this one to for signs,
The recommendation of the Dutchess County Department of
Planning, dated Dec. lo, 1968# was recreived# and reviewed by the
Hoard at this time.
No one else was present to be heard. The Chair declared the
hearing closed at 8s4S p.m., at which time the Board want into an
executive session.
The meeting was reconvened at 9205 P.M.
A motion was made by Mir. Dist, seconded by Mr. Jacobson, to
deny the variance requested by *rossmans of Central in Appeal # 77,
on the basis that the proposed sign unreasonably exceeds the limits
of the Town of wappinger Zoning Ordinance.
Motion Unanimously Carried.
A motion was made by Mr. Birtp seconded by Mr. Malaka, to
direct a letter to the Ton Planning Board encouraging them to
complete their sign ordinance study, and to forward their
recpasendations, findings, mW conclusions to the Town Board at
their earliest convenience. Motion Unanimously Carried.
A motion was made by Ilio. Kalaka, seceded by Mr. Jacobson,
to approve the minutes ofthe August 13,E i968, mooting, as written.
Motion unanimously Carried.
A motion was made by Mr, Kalaka, seconded by Mr. Hirt, to
approve the minutes of the August 29, and November 12, 1968,
meetings, as read. Motion Unanimously Carried.
Chairman Graham officially welcomed Mr, Kalaka to the
Zoning Board of Appeals as a near mks.
A motion was made by Mr. Jacobson# seconded by Mr. Kalaka#
to adjourn the meeting. Motion Unanimously Carried.
The meeting was adjourned at 9s2S p.m.
